MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Engineering Manager
Gerardo Perez, Senior Construction Manager, CNC Engineering DATE: August 25, 2022
SUBJECT: Consideration of Change Order Nos. 3, 4, 5, 6, 7, 8, and Notice of Completion for Contract No. CITY-1434, Resurfacing of Don Julian Road from 6th Avenue to 7th Avenue, and Unruh Avenue from Nelson Avenue to Cul-De Sac, and Sidewalk on Turnbull Canyon Road, and Intersection Widening and Traffic Signal Installation at Don Julian Road and 6th Avenue, with Gentry Brothers, Inc.

Background:

On September 12, 2019, the City Council awarded Contract No. CITY-1434, Resurfacing of Don Julian Road from 6th Avenue to 7th Avenue, and Unruh Avenue from Nelson Avenue to Cul-De-Sac, and Sidewalk on Turnbull Canyon Road, and Intersection Widening and Traffic Signal Install Resurfacing in the amount of $806,400.20, to Gentry Brothers. This project consists of resurfacing Don Julian from 6th Avenue to 7th Avenue, resurfacing Unruh Avenue from Nelson Avenue to cul-de-sac, reconstructing curb and gutter and driveways, adjusting utilities to grade, installing Connector Pipe Screen (CPS), striping, modifying a traffic signal, modifying curb returns, and installing signage.

Discussion:

On December 10, 2020, the City Council approved Change Orders Nos. 1 and 2 in the total amount of $89,912.49 for the following:
• Change Order No. 1 - Costs in the amount of $82,912.49 were approved to incorporate changes under Plan Revision No. 1 per LACDPW comments (revisions to the traffic signal plans) and Plan Revision No. 2 per SCE requirements (installation of new conduit and handholes).
• Change Order No. 2 - Costs in the amount of $7,000.00 were approved to install temporary streetlights as part of the removal of the SCE streetlights.

This project was awarded on September 12, 2019, and a Notice to Proceed was issued on November 19, 2019. However, we did not have an LA County permit to perform work within the County's jurisdiction. Also, the coordination with SCE to relocate the two streetlights and provide power to the new pedestal was incomplete. The County also would not approve the removal of the two streetlights until the new safety lights were operational. Logistically it created a coordination problem with SCE and the installation of the traffic signals. There were also COVID related delays and revisions to the traffic signal plans. Change Orders Nos. 3 and 5 were a direct result these changes and logistical issues with SCE and LA County including the inability to obtain power from SCE in a timely manner.

As of August 1, 2022, the Engineering Manager reviewed the following change orders for completeness and accuracy as to the materials and labor included:
• Change Order No. 3 - Because of the issues stated above, the Contractor incurred delay costs to renew both the railroad and workers compensation insurance. In addition, labor, materials and equipment costs escalated since the project was awarded. Contractor submitted total delay costs in the amount of $19,900.00.
• Change Order No. 4 - Prior to installing all traffic striping per plan, the Contractor was directed to submit a cost proposal to use thermoplastic striping in lieu of regular traffic paint. The additional cost is $3,560.00. • Change Order No. 5 - SCE decided to perform all removal and installation of the new streetlights and provide power to the meter pedestal all at one time. The Contractor incurred costs to remobilize, maintain traffic control and demobilize.

Costs were also incurred by the traffic signal subcontractor to remobilize. In addition to these costs, the new catch basin that was installed was damaged by truck traffic leaving the site. The top deck of the catch basin was repaired and reinforced. Total cost for this work is $20,000.00
• Change Order No. 6 - A portion of this project is within LA County jurisdiction and therefore the City and the contractor are required to obtain a permits for the road work and traffic signal installation. Per the contract any permit fees will be reimbursed to the Contractor. The permit fees total $6,046.15. • Change Order No. 7 - The Contractor was required to replace traffic signal loop detectors at Nelson Ave. and Unruh that were damaged during the cold milling operation. Replacement of the loop detectors was not shown on the contract plans. The cost for replacement is $5,400.00.
• Change Order No. 8 Final field measurements have been completed and underruns are as follows:

CITY COUNCIL
ITEM NO. 6.3

OF INDUS

CITY OF INDUSTRY

MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Engineering Manager
Chris Lum, Construction Manager, CNC Engineering
DATE: August 25, 2022
SUBJECT: Consideration of Change Order No. 2, Closeout Change Order 3, and Notice of Completion for Contract No. CITY-1482, 2021-2022 Annual Slurry Seal, with Doug Martin Contracting, Inc.

Background:

On April 14, 2022, the City Council awarded Contract No. CITY-1482, 2021-2022 Annual Slurry Seal, in the amount of $314,892.20. The project consisted of all labor, materials, and equipment to slurry seal 11 City streets, and seal coat a City parking lot. Work includes preparation of surface by crack sealing, and installation of pavement striping and pavement markers. The streets to be slurry sealed are Pellissier Place, Red Hat Lane, Mayor Dave Way, Proctor Avenue, Curl Court, Almahurst Street, Walnut Hall Road, Keystone Street, Ferrero Parkway, Harrison Avenue, and Reyes Drive, and the seal coat will be applied to the Post Office/Youth Activities League parking lot.

Discussion:

As of June 20, 2022, the City Manager approved Change Order No. 1 in an amount totaling $7,720.00:
• Change Order No. 1 - Costs in the amount of $7,720.00 were approved to furnish and apply an herbicide to all cracks and edge of gutters within the project limits.

As of July 6, 2022, the Engineering Manager has reviewed Change Order No. 2 for completeness and accuracy as to the materials and labor, as set forth below:
• Change Order No. 2 - Plan Revision 1 was issued to slurry seal and install pavement striping in the City's right-of-way on Nelson Avenue from Hacienda Boulevard to Glendora Avenue. The centerline of Nelson Avenue delineates the City of Industry and the City of La Puente's jurisdictions with the North half being La Puente's, and the South half Industry's. After work had started on Plan Revision 1, the City of La Puente requested to see if its half of Nelson Avenue could be included in the extra work. Staff was directed to incorporate the City of La Puente's portion of the street in the work and will coordinate with them to seek reimbursement. Work consisted of remobilization, roadway preparation, crack sealing, slurry seal, and installation of pavement markings on Nelson Avenue between Hacienda Boulevard and Glendora Avenue. The total cost for this Change Order is $43,167.13.

Final field quantities have been measured and verified. • Change Order No. 3 - Final quantities have been completed and overruns are as follows:

Overruns -
Bid Item No. 2 - Slurry Seal Surfacing, Type II, $274.35/TONS × 11.06/TONS = $3,034.11.00
The Total Amount of Overruns and costs for Closeout Change Order No. 3= $3,034.11
Table 1 - Summary of Extra Costs
Contract Amount $314,892.20
Change Order No. 1 $7,720.00
Change Order No. 2 $43,167.13
Closeout Change Order No. 3 $3,034.11
Revised Project Cost $368,813.44

MEMORANDUM
TO: Honorable Mayor and Members of the City of Industry City Council FROM: Joshua Nelson, City Manager
STAFF: Eduardo Manriquez, Contract Planning Technician E Mike Poland, Contract Planning Manager
DATE: Thursday, August 25, 2022
SUBJECT: Consideration of a Resolution approving Development Plan Application No. 20-08, for the construction of a new 7,326 square foot building identified as Building "D", an addition of 1,200 square feet and facade improvements to an existing building identifiec as Building "B", and an addition of 1,117 square feet and facade improvements to an existing building identified as Building "C"; and approval of a Resolution approving Conditional Use Permit No. 20-03 to allow for the operation of a training school (Operating Engineers Training Trust) for the property located at 2190 Pellissier Place, Assessor's Parcel Number 8125-018-018, City Of Industry, California, adopting a Notice of Exemption regarding same, and making findings in support thereof Proposal:

Luis Ibanez of Ware Malcomb, on behalf of Operating Engineers Training Trust - Local 12, submitted applications for the consideration of Development Plan No. 20-08, for structural additions to two existing buildings and the addition of a new building, and Conditional Use Permit No. 20-03 for the operation of a training school as described above, collectively, the "Project".

Location and Surroundings:

The Project site is located at 2190 Pellissier Place, further described as Assessor's Parcel Number 8125-018-018. The Project site is an 8.31-acre (362,197 square feet) irregular shaped lot that is bound by Interstate 605 and Pellissier Place to the north, the Union Pacific Railroad to the south, and industrial uses to the east and west. All the adjacent properties are being utilized with industrial uses.

Adjacent uses include The Argas Distribution Center, The Los Angeles Regional Food Bank, Crossroads Business Park, and McKinney Trailer Rentals to name a few. There are residential uses located approximately 300 feet to the west, however, they are separated from the project site by the 255,600 square foot rectangularly shaped Argas Distribution Center building. See aerial photo below and Exhibit A - Location Map.

Background
The site has been operating as a training facility for the Operating Engineers Training Trust since 1954. The facility trains students on how to maintain, repair and operate heavy equipment. Also, students are trained on how to perform inspections and testing during the construction phase of development. The Applicant has been operating the training facility without a Conditional Use Permit because they were unaware that a Conditional Use Permit for the training facility was necessary until they discussed with Staff the need for a Development Plan for new Building D, and additions to Buildings B and C.

According to the Los Angeles County Assessor's Office, Buildings B and C were originally built in 1958 and 1963, respectively. On December 12, 2002, the City Council approved Development Plan No. 02-23 for the construction of the 22,826 square foot concrete tilt up building that is now known as Building A. Building A is utilized for administration and classrooms. No modifications or additional square footage is being proposed for Building A. Proposed Building D will be 7,326 square feet.

Planning Entitlements:

Section 17.04.120 of the Municipal Code ("Code") requires that when separate applications for the same project involve final decisions by the Planning Commission and City Council, all applications must first be submitted to the Planning Commission for review and recommendation, and then to the City Council for a final decision. This Project involves the following two applications:

1. Development Plan Application - Long Form:

In reviewing this Development Plan Application - Long Form, the City Council will evaluate whether the Project complies with the requirements set forth in Chapter 17.36 of the City's Municipal Code.

2. Conditional Use Permit:

In reviewing this Conditional Use Permit Application, the City Council will evaluate whether the proposed operation of a training school complies with the requirements set forth in Section 17.48.050 of the City's Municipal Code.

On July 12, 2022, the Planning Commission conducted a duly noticed public hearing on the Project and adopted Resolution No. PC 2022-15, recommending that the City Council approve Development Plan Application No. 20-08 and Conditional Use Permit No. 20-03.

Staff Analysis:

DEVELOPMENT PLAN NO. 20-08
As previously noted, the Project site currently consists of three buildings that are labeled as A, B, and C. Refer to Exhibit B to view the proposed site plan.

Building B is a 17,355 square foot structure that is utilized for equipment maintenance (shop area, offices, and classrooms). The Application is proposing a 1,200 square foot addition to the building that will be utilized for a workshop and parts area. Modifications to the facade and new paint colors are also proposed for Building B.

Building C is a 16,253 square foot structure that is utilized as a welding shop (shop area and classrooms). The Application is proposing a 1,117 square foot addition to the building that will be utilized for a new first and second level entrance. Modifications to the facade and new paint colors are also proposed for Building C.

Building D is a proposed 7,326 square foot structure that will be utilized for warehousing, painting, and truck storage. Refer to Exhibit C to view the floor plan for Building D. The paint schemes for Buildings B, C and D will be consistent.

On December 12, 2002, the City Council approved Development Plan No. 02-23 for the construction of the 22,826 square foot concrete tilt up building that is now known as Building A. Building A is utilized for administration and classrooms. No modifications or additional square footage is being proposed for Building A.

Table 1 below lists the existing and proposed square footage of each building.

General Plan
The Project site has an Employment General Plan Land Use Designation. Allowable uses in the Employment Land Use Designation include a variety of business and employment uses including industrial manufacturing, assembly, printing, machining, milling, welding, research and development, distribution, warehousing, storage, and supporting office uses. Also, any of the uses permitted in the Commercial land use designation when zoned appropriately.

This proposed training facility is consistent with General Plan because in that it complies with General Plan Goal LU2-2 that states the City should "[a]ttract the establishment and continuation of businesses that bring new jobs and improve sales tax revenue, particularly those that increase the City's share of growing sectors of the regional and global economy. Encourage businesses that contribute to a professional environment and enhance the overall value of the City of Industry as a place to conduct business." The proposed trade school would allow the Applicant to conduct day-to-day operations and training for Operating Engineers in how to maintain, repair and operate heavy equipment. Also, students are trained on how to perform inspections and testing during the construction phase of development. These standards help develop an apprentice's career to obtain more highly skilled employment opportunities. Also, the proposed use is consistent with General Plan Goal LU3-2 that states the City should "support the surrounding population through the sponsorship and/or provision of education- and community-building programs". The proposed use utilizes industrial buildings to provide quality vocational instruction. This instruction will produce highly skilled workers into the San Gabriel Valley Area. The project will provide a highly amenable community environment and thriving regional industrial center by allowing a vocational training center that supports residents' education and employment and promotes industrial technology and training opportunities.

The proposed building additions and the new building are consistent with the Employment land use designation set forth in the City's General Plan. Permissible land uses in the Employment land use designation include such uses as manufacturing, warehouses, and storage. Additionally, the Project is consistent with General Plan Policy LU5 that states the City should provide "Ihligh quality and well- maintained properties, buildings, and infrastructure that enhance property values and encourage additional public and private investment." The Project would provide additions to existing buildings and a new building that are of high architectural design, along with new infrastructure that will enhance the property value. Also, the new development is consistent with Policy LU2-6, which states the City should "[s]upport the use of energy-saving designs and equipment in all new development and rehabilitation or reconstruction projects" because the new building will be solar ready, thereby supporting the use of an energy saving design.

Zoning
The zoning designation of the project is Industrial. Development within the Industrial zone is subject to the development standards set forth in the City of Industry Municipal Code, Chapter 17.16 and Table 2 - Title 17 Zoning Standards

Parking and Access
Pursuant to Section 17.36.060.K.1. of the Municipal Code, the parking requirement for the Project site is 50 spaces plus 1 space per 750 square feet of floor area over 25,000 square feet. This equates to a minimum of 105 parking spaces being required. The Applicant is proposing a total of 265 parking spaces. This includes 133 existing parking stalls and 132 new parking stalls. The project also meets the City's access requirements by providing two separate driveways used for both entrance and exit of vehicles greater than 26-feet; one driveway is 29.5 feet, and the other is 36 feet.

The property has two main entrances off Pellissier Place that have driveway widths of 29.5 feet and 36 feet that lead directly into the project site. The interior drive aisles are all 26 feet wide throughout the project site. The 26-foot-wide drive aisles have over 390 feet of length to drive around the project site's parking lot and the driveways have a length of over 130 feet in separation between each other thereby avoiding any potential traffic impacts such as congestion, stacking, or spillage onto City streets. The location, configuration, size and design of buildings and structures do not create any pedestrian or vehicular traffic hazards.

Architecture
The proposed elevations for Building D are like other industrial buildings in the area and will have architectural panels with alternating colors. The overall architecture is simple and modern, and the color scheme is appropriate to the design. As shown in the building elevations the architecture provides a variety of design treatments. Proposed Building D is designed in variations of gray and blue tones. The proposed concrete tilt up building's walls will have a variety of panel around the buildings and will provide varying projections at the building's entrance thereby creating a three- dimensional illusion. Refer to Exhibit D to view the Building Elevations and Material Board for Building D.

As mentioned above, existing Buildings B and C will have new paint schemes that will be consistent with the proposed paint scheme for new Building D. Metal awning will also be incorporated throughout Buildings B, C and D.

Although the Applicant is not proposing any changes to Building A, staff has incorporated a Condition of Approval that will require that Applicant to paint Building A to match the proposed color scheme of Buildings B, C and D, therefore, making it visually harmonious with the entire campus.

Setbacks
Pursuant to Municipal Code Section 17.32.040, building lines are required to be a minimum of 30 feet from the curb line of any street (Pellissier Placed) or highway, whether the street is improved or not.

Building A is the nearest building to Pellissier Place and is setback 30 feet. Therefore, all the buildings are in compliance with City's required setback distance from the frontage street.

Landscaping
The Project site will be provided with 43,500 square-feet of existing and proposed landscaping, on the perimeter of the Project site and within the parking areas. Section 17.36.060. Q. of the Municipal Code requires that a minimum of 12 percent of the site be devoted to landscaping. Based on this requirement a minimum of 43,438 square-feet of landscaping is required for the 8.31-acre (361,984 square feet) Project site. The Applicant is exceeding this requirement by proposing a total of 43,500 square feet of landscaping.

CONDITIONAL USE PERMIT NO. 20-05
Pursuant to Section 17.16.025.4 of the City's Municipal Code a Conditional Use Permit is required for the training facility.

The Operating Engineers Training Trust is a non-profit entity created by the International Union of Operating Engineers - Local 12, and its signatory contractors, to provide training for journeypersons, apprentices, and accepted applicants. Currently there are six training facilities located throughout Southern California that offer a variety of training opportunities to better the skills of the students. All training classes are conducted indoors in classrooms. Training site hours are 7:00am to 3:30pm Tuesday through Saturday. The facility is closed on Mondays. The facility will host 150-250 students and 15 employees on most Saturdays. Training on how to drive and operate heavy equipment is provided at other Operating Engineers Training Trust sites located outside the City.

Operating Engineers are highly trained, skilled professionals who:
• Operate heavy construction equipment on high-rise buildings, roads and freeways, residential developments, dams, waterways, airports, and underground tunnels; or • Do specialized work operating cranes, concrete pumps, pile drivers, or drilling equipment; • Perform inspections and testing during the construction phase on such things as reinforced concrete, soils, structural masonry, prestressed concrete, structural steel, and welding; or
• Repair and maintain heavy duty construction equipment, working in shops or on job sites where equipment has broken down; or
• Work in plants that produce sand, gravel, asphalt, and concrete; or • Work on or near the water with dredging equipment.

As mentioned above, all the adjacent properties are being utilized with industrial uses.

Based on the nature, condition, and development of adjacent uses, buildings and structures have been considered and the proposed training facility use will not adversely affect or be materially detrimental to these adjacent uses, buildings or structures as the proposed training facility is within an industrially developed site. Further, the training facility is conditioned to ensure that the project does not negatively impact adjoining land uses.

Environmental Analysis:

In accordance with the provisions of the California Environmental Quality Act ("CEQA") Guidelines, this Project is Categorically Exempt from environmental proceedings pursuant to Article 19, Section 15301 (Class 1 Existing Facilities) (e)(2) of the CEQA Guidelines for the following reasons: (1) Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use.

The Project consists of licensing to allow for a training school along with additions to two existing buildings totaling 2,317 square feet and a new 7,326 square foot building. The Project proposes to add a total of 9,643 square feet and will not exceed the allowed 10,000 square feet.

The Project site is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan and the area in which the project is located is not in an environmentally sensitive area as the site is already developed. All roads and utilities are existing and maintained by the City and the respective utility entities and have served the industrial uses for many years and are suitable for the minor additional square feet. The site does not contain any endangered habitat because it is a developed lot that has three existing industrial buildings and was disturbed when the original buildings were built and there were no environmental concerns found at the time of original construction. Refer to Exhibit E to view the Notice of Exemption.

Public Hearing:

The required Public Hearing Notice (Exhibit F) was posted on the site, Fire Station 118, City Hall, Council Chambers, distributed to surrounding property owners within 300 feet of the site, the City's webpage and published in the San Gabriel Valley Tribune on August 12, 2022, pursuant to Government Code Section 65091.

Fiscal Impact:

Development of the Project will generate revenues to the City in the form of building permit fees to defray planning and inspections costs.

Recommendation:

Because the Project complies with the development standards of the City's Code, does not pose a significant impact on the environment, and satisfies the required findings outlined in Resolution No.

CC 2022-35 (Exhibit G) and Resolution No. CC 2022-36 (Exhibit H), Staff recommends that the City Council:
1) Adopt Resolution No. CC 2022-35 approving Development Plan 20-08, Standard Requirements and Conditions of Approval, and Notice of Exemption regarding same. 2) Adopt Resolution No. CC 2022-36 approving Conditional Use Permit No. 20-05,, Standard Requirements and Conditions of Approval, and Notice of Exemption regarding same.

and a new 7,326 square foot building. The project proposes to add a total of 9,643 square feet to an existing development, which is below the 10,000 square foot threshold set forth by 15301(e) (2) of the CEQA Guidelines. Further, the project site is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan, and the project site is not in an environmentally sensitive area as the site is already developed with building and site improvements; and WHEREAS, on August 12, 2022, Notice of the City Council's August 25, 2022, public hearing on the Application was published in the San Gabriel Valley Tribune, in compliance with the City's Code and Government Code Section 65091, and was posted at the property, City Hall, the City's Council Chambers, Fire Station 118, and on the City's website; and

NOW THEREFORE, the City Council of the City of Industry hereby finds, determines, and resolves as follows:

SECTION 1: The City Council finds that all of the facts set forth in the Recitals above are true and correct and are incorporated herein by reference.

SECTION 2: All necessary public hearings and opportunities for public testimony and comment have been conducted in compliance with State law and the City's Code.

SECTION 3: An Environmental Assessment form was submitted by the Applicant pursuant to the City's requirements. Based upon the information received and Staff's review and assessment, the proposed project is exempt from the California Environmental Quality Act (CEQA) per Section 15301 (Class 1 Existing Facilities) of the CEQA Guidelines for the following reasons: The project consists of licensing to allow for a training school along with additions to two existing buildings totaling 2,317 square feet and a new 7,326 square foot building. The project proposes to add a total of 9,643 square feet to an existing development, which is below the 10,000 square foot threshold set forth by 15301(e)(2) of the CEQA Guidelines. Further, the project site is in an area where all public services and facilities are available to allow for maximum development permissible Resolution No. CC 2022-35
DP No. 20-08

in the General Plan, and the project site is not in an environmentally sensitive area as the site is already developed with building and site improvements.

SECTION 4: Based upon substantial evidence presented to the City Council during the August 25, 2022 public hearing, including public testimony, and written and oral staff reports, and which includes without limitation, CEQA, the CEQA Guidelines, City's Municipal Code, the City Council finds as follows:

A. The site is suitable for development in accordance with the development plan because the project is in conformance with the City's General Plan, Zoning Code and all applicable development standards outlined within Section

17.36.060 of the Zoning Code. This includes setbacks, building height, parking, and landscape standards. Further, pursuant to the provisions of the General Plan, industrial uses are permitted in the Employment land use designation, and the project does not conflict with the established goals and objectives of the Land Use Element of the General Plan. The Project consists of the construction of a new industrial building and additions to two existing buildings thereby increasing the total building square footage for the site to 66,077 square feet. The proposed building and building additions are in accord with the objectives of the Zoning Code in that the Zoning Code designates the project site as Industrial. The proposed development is consistent with the land use intent of the Industrial Zone. The adjacent sites are also within the Industrial Zone and consist of industrial/storage buildings or vacant land. The overall design of the new building is similar or similar in scale and intensity of the existing buildings and the neighboring area.

B. The total development is arranged to avoid traffic congestion, ensure the public health, safety, and general welfare, or prevent adverse effects upon neighboring properties because it has been designed to minimize any potential impacts by complying with the City's Code. The City's Code requires all driveway and drive-aisles to be a minimum of twenty-six feet in width. Furthermore, conditions of approval are incorporated to prevent the project from having any adverse effects upon the public health, safety, and general welfare of neighboring properties. Conditions include a requirement to comply with the Los Angeles County Noise Ordinance regarding hours permitted for construction, compliance with the standards set for in the California Building Code, standards and requirements from the City's Public Works/Engineering Department, Los Angeles County Regional Water Quality Control Board, and South Coast Air Quality Management District.

Resolution No. CC 2022-35
DP No. 20-08

Page 5 of 7 ends

C. The development is in general accord with all elements of the City's Zoning Code because the project complies with all development standards regarding building setbacks, building height, parking, access, screening, and design. The project meets the minimum setback requirements of 30-feet from the front of the curb line of all streets, complies with the maximum building height of 150- feet. Building B is 29.5 feet high; Building C is 27.2 feet high, and Building D is 22 feet high. The project complies with the City's minimum parking requirement.

In accordance with Section 17.36.060.K.1. of the City's Municipal Code, fifty parking spaces plus one space per 750 square feet of floor area over 25,000 square feet, for a total of 105 require parking spaces. The Applicant is proposing a total of 265 parking spaces. This includes 133 existing parking stalls and 132 new parking stalls. The project also meets the City's access requirements by providing two separate driveways used for both entrance and exit of vehicles greater than 26-feet; one driveway is 29.5 feet and the other is 36 feet, with all drive aisles being 26-feet within the property, the property will be adequately screened because the project site has existing landscaping fronting Pellissier Place and decorative wrought iron fencing along the rear of the parking lot, and will be designed to be similar to the existing building architecture, construction, and styling.

D. The development is consistent with the provisions of the general plan or any applicable redevelopment plan because the proposed building additions and the new building are consistent with the Employment land use designation set forth in the City's General Plan. Permissible land uses in the Employment land use designation include such uses as manufacturing, warehouses, and storage. Additionally, the Project is consistent with General Plan Policy LU5 that states the City should provide "Ihligh quality and well-maintained properties, buildings, and infrastructure that enhance property values and encourage additional public and private investment." The Project would provide additions to existing buildings and a new building that are of high architectural design, along with new infrastructure that will enhance the property value. Also, the new development is consistent with Policy LU2-6, which states the City should "Islupport the use of energy-saving designs and equipment in all new development and rehabilitation or reconstruction projects" because the new building will be solar ready, thereby supporting the use of an energy saving design.

SECTION 5: Based on the foregoing, the City Council hereby approves the Notice of Exemption, and directs Staff to file same as required by law, and approves Development Plan Application No. 20-08 subject to the Conditions of Approval, attached hereto as Attachment 1, and incorporated herein by reference.

SECTION 6: The provisions of this Resolution are severable and if any provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, Resolution No. CC 2022-35

sentences, sections, words or parts thereof of the Resolution or their applicability to other persons or circumstances.

SECTION 7: That the City Clerk shall certify to the adoption of this Resolution and the same shall be in full force and effect.

WHEREAS, the subject site has a General Plan Employment land use designation and an Industrial Zoning designation. In accordance with Section 17.36.020 of the City's Municipal Code ("Code"), a Development Plan Application is required for the construction of the new building and the proposed additions to Buildings "B" and "C." Pursuant to Section 17.16.025.4 of the City's Code, a Conditional Use Permit is required for the training school; and
WHEREAS, Section 17.04.120 of the Code requires that when separate applications for the same project involve final decisions by the Planning Commission and City Council, all applications shall first be submitted to the Planning Commission for review and recommendation, and then to the City Council for a final decision. In the City, Development Plans are decided by the City Council, and Conditional Use Permits are decided by the Planning Commission. Due to the occurrence of two applications, the Planning Commission served as the recommending body to the City Council; and WHEREAS, On July 12, 2022, the Planning Commission of the City of Industry conducted a duly noticed public hearing on the Application, and considered all testimony written and oral, including the information contained in the Notice of Exemption, and adopted PC Resolution No. 2022-15, recommending that the City Council approve the Application and the Notice of Exemption; and
WHEREAS, an Environmental Assessment form was submitted by the Applicant, and based on Staff's review and assessment, the proposed project is exempt from the California Environmental Quality Act (CEQA) per Section 15301 (Class 1 Existing Facilities) of the CEQA Guidelines because the project consists of licensing to allow for a training school along with additions to two existing buildings totaling 2,317 square feet and a new 7,326 square foot building. The project proposes to add a total of 9,643 square feet to an existing development, which is below the 10,000 square foot threshold set forth by 15301(e)(2) of the CEQA Guidelines. Further, the project site is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan, and the project site is not in an environmentally sensitive area as the site is already developed with building and site improvements; and WHEREAS, on August 12, 2022, Notice of the City Council's August 25, 2022, public hearing on the Application was published in the San Gabriel Valley Tribune, in compliance with the City's Code and Government Code Section 65091, and was posted at the property, City Hall, the City's Council Chambers, Fire Station 118, and on the City's website; and
Resolution No. CC 2022-3
UP No. 20-0

Page 3 of 7 ends

WHEREAS, on August 12, 2022, Notice of the City Council's August 25, 2022, public hearing on the Applications was mailed to each property owner within three hundred feet of the project site; and
WHEREAS, on August 25, 2022, the City Council of the City of Industry conducted a duly noticed public hearing on the Applications, and considered all testimony written and oral; and
WHEREAS, all legal prerequisites prior to adoption of this Resolution have occurred.

Approval of the CUP only involves a negligible expansion of the existing training facility. The project proposes to add a total of 9,643 square feet to an existing development, which is below the 10,000 square foot threshold set forth by 15301(e) (e)(2) of the CEQA Guidelines. Further, the project site is in an area where all public services and facilities are available to allow for maximum development permissible in the General Plan, and the project site is not in an environmentally sensitive area as the site is already developed with building and site improvements.

SECTION 4: Based upon substantial evidence presented to the City Council during the August 25, 2022 public hearing, including public testimony, and written and oral staff reports, and which includes without limitation, CEQA, the CEQA Guidelines, City's Municipal Code, the City Council finds as follows:

A. The proposed use is consistent with the goals and objectives of the general plan and any applicable redevelopment plan because the project site has an Employment General Plan Land Use Designation. Allowable uses in the Employment Land Use Designation include a variety of business and employment uses including training facilities, industrial manufacturing, assembly, printing, machining, milling, welding, research and development, distribution, warehousing, storage, and supporting office uses. Also, any of the Resolution No. CC 2022-36
CUP No. 20-03

Page 4 of 7 ends

uses permitted in the Commercial land use designation when zoned appropriately.

Additionally, the proposed training facility is consistent with General Plan because in it complies with General Plan Goal LU2-2 that states the City should "[a]ttract the establishment and continuation of businesses that bring new jobs and improve sales tax revenue, particularly those that increase the City's share of growing sectors of the regional and global economy.

B. The site is adequate in size, shape, topography and location for the proposed use and there will be adequate utilities to accommodate the proposed use. The Property is a flat 8.31 acres (361,984 square feet) parcel suitable for an industrial training facility, and exceeds the minimum lot size requirement of 50,000 square feet. The shape of the Property is irregular, and exceeds the lot frontage minimum requirement of fifty feet by having a frontage 787.5 feet. No adverse impacts will be created to the surrounding neighborhood as the operation will abide by the conditions of approval which will require the use to adhere to State, County, and City development standards. Also, the Project will be served by existing utilities on the property. The Project will pay fair share costs of additional sewer impacts and replace existing sewer laterals as needed.

C. There will be adequate street access, traffic circulation and parking capacity for the proposed use. The Property is served by two driveway entrances that are adequate in width and improved as necessary to carry the kind and quantity of traffic a training school would generate. All driveway and drive aisle widths exceed the minimum 26 feet required by the City's Code. The existing driveways are for both ingress and egress and connect throughout the site with the existing drive aisles throughout the parking lot, creating proper circulation for the vehicles and pedestrian traffic. No new driveway entrances or Resolution No. CC 2022-36
CUP No. 20-03

Page 5 of 7 ends

modifications to existing entrances are proposed as part of this project.

On June 25, 2020, the City Council adopted Resolution No. CC 2020-20, adopting the Vehicle Miles Travel ("VMT") metric to evaluate transportation impacts. Using the VMT method, the project's potential VT impact were evaluated, and it was determined that the project is screened out from the preparation of a complete VT analysis because it was below the Baseline VMT metrics (Low VMT area. In addition, the project is surrounded by similar land use types; therefore, no further traffic analysis is required.

D. The proposed use is compatible with the surrounding properties and uses; in making this finding, consideration shall be given to the potential for changes in the uses of surrounding properties. An industrial training facility to teach individuals how to maintain, repair and operate heavy equipment and how to perform inspections and testing during the construction phase of development is a compatible use with the surrounding properties and uses because the area is composed of only industrial uses. The proposed use will complement the adjacent uses as it will provide and attract students who can join the industrial workforce in and around the City and the San Gabriel Valley. The uses of the surrounding properties may change, but the character will remain industrial in nature which is consistent with the General Plan and Zoning designations of the site.

E. The proposed use will not be detrimental to the public health, safety, or general welfare. The proposed project, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. The surrounding neighborhood consists completely of industrial uses. The proposed project is similar in size and scale to the other industrial uses in the surrounding area.

The new construction and operation of the school is expected to meet all Code standards regarding noise. The project has been reviewed and conditioned by requisite City Staff and conditioned to minimize potential impacts. Also, Conditions of Approval provide the City the authority to revoke the subject Conditional Use Permit if it is discovered that the operators of the proposed use are violating state regulations or any condition(s) of this approval.

SECTION 5: Based on the foregoing, the City Council hereby approves the Notice of Exemption, and directs Staff to file same as required by law, and approves Conditional Use Permit No. 20-03, subject to the Conditions of Approval, attached hereto as Attachment 1, and incorporated herein by reference.

SECTION 6: The provisions of this Resolution are severable and if any provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the Resolution or their applicability to other persons or circumstances.

SECTION 7: That the City Council Secretary shall certify to the adoption of this Resolution and the same shall be in full force and effect.
