ITEM NO. 6.6
CITY OF INDUSTRY
MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Elise Calvo, City Treasurer
Yamini Pathak, Finance Director
DATE: July 13, 2023
SUBJECT: Consideration of Resolution No. CC 2023-43 - A Resolution of the City Council of the City of Industry, California, Rescinding Resolution No. CC 2023-23, and Amending the Current Salary Range Schedules for Fiscal Year 2023-24 as Adopted on May 25, 2023, Due to New Assistant City Treasurer Position
BACKGROUND
On May 25, 2023, the City Council approved and adopted the City's Operating Budget for FY 2023-24 ("FY 24"), along with FY 24 Salary Schedule. The Salary Schedule adopted for the Fiscal Year started July 1, 2023 did not include Assistant City Treasurer Position.
DISCUSSION
On February 23, 2006, the City Council adopted Resolution 2135, creating the Office of Assistant City Treasurer pursuant to Article VII Section 700 of the City Charter. However, the position was not included in the FY 24 Salary Schedule, as adopted. Staff has reviewed the needs of the Treasury Department and has determined that it is in the best interest of the City to appoint an Assistant City Treasurer. The FY 24 adopted budget for Treasury Department includes an Accounting Technician III position, which will be replaced by the newly proposed position. A budget adjustment is required, as the new Assistant City Treasurer position is at a higher rate than the previously budgeted Accounting Technician Ill position.
FISCAL IMPACT
The fiscal impact to the FY 24 budget is $46,000. An appropriation is requested from the General Fund to the Treasury Department to cover the additional salary and benefits for the position being proposed.
RECOMMENDATION
Staff recommends the City Council adopt Resolution CC 2023-43, amending the City of Industry's FY 2023-24 Salary Schedule, as adopted.

CITY OF INDUSTRY
MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Yamini Pathak
DATE: July 13, 2023
SUBJECT: Consideration of Fiscal Year 2023-2024 Budget Adjustment to Engineering Department Due to Position Change
BACKGROUND
On May 25, 2023, the City Council approved and adopted the City's Operating Budget for FY 2023-24 ("FY 24"'), along with FY 24 Salary Schedule. The Salary Schedule adopted for the Fiscal Year started July 1, 2023 includes a new City Engineer/Director of Public Works position and an existing Administrative Technician I position.
DISCUSSION
Since the adoption of the budget for FY 24, staff has reconsidered the staffing needs for the Engineering Department and is seeking to replace the Administrative Technician I position with the Management Analyst II position. Additionally, staff had budgeted a part-time Administrative Technician I position, while the new Management Analyst I position will be full-time. Both positions are included in the Salary Schedule, thus a new Salary Schedule is not needed at this time. A budget adjustment is required, however, as the new position is at a higher rate than the original position approved in the FY 24 budget.
FISCAL IMPACT
The fiscal impact to the FY 24 budget is $130,000. An appropriation is requested from the General Fund to the Engineering Department to cover the additional salary and benefits for the position being proposed.
RECOMMENDATION
Staff recommends the City Council approve Fiscal Year 2023-2024 Budget Adjustment to Engineering Department Due to Position Change.

CITY OF INDUSTRY
STATEMENT OF INVESTMENT POLICY
Effective July 13, 2023
(Supersedes All Previous Investment Policies)
1.0 Introduction. The purpose of this document is to identify various policies and procedures that enhance opportunities for a prudent and systematic investment policy and to organize and formalize investment-related activities.
Related activities which comprise good cash management include accurate cash projections, the expeditious collection of revenue, the control of disbursements, cost-effective banking relations, and arranging for a short-term borrowing program which coordinates working capital requirements and investment opportunities.
2.0 Policy. It is the policy of the City of Industry to invest public funds not required for immediate day-to-day operations in safe, liquid and medium-term investments. These investments shall yield an acceptable return while conforming to all California statutes and the City's Investment Policy.
3.0 Scope. It is intended that this policy cover the investment activities of all contingency reserves and inactive cash under the direct authority of the City and its component units including but not limited to, the City of Industry, the Successor Agency to the Industry Urban-Development Agency, the Civic-Recreational- Industrial Authority, the Industry Public Utilities Commission, the Industry Public Facilities Authority and the Industry Property and Housing Management Authority.
3.1 Pooled Investments. Investments for the City and its component units will be made on a pooled basis including, but not limited to, the City of Industry, the Successor Agency to the Industry Urban-Development Agency, the Civic- Recreational-Industrial Authority, the Industry Public Utilities Commission, the Industry Public Facilities Authority and the Industry Property and Housing Management Authority. The City's identifies the fund types involved as follows:
• General Fund
• Special Revenue Funds
• Debt Service Funds
• Capital Project Funds
• Enterprise Funds
• Trust Funds
• Miscellaneous Special Funds
• Any new funds created by the applicable governing board, unless specifically exempted
2 CITY OF INDUSTRY
STATEMENT OF INVESTMENT POLICY
3.2 Investments held separately. Investment of bond proceeds will be held separately when required by the bond indentures. Bond proceeds will be invested in accordance with the requirements stated in the bond indentures. This policy does not apply to deferred compensation plans.
4.0 Objectives. Section 53600.5 of the California Government Code outlines the primary objectives of a trustee investing public money. The primary objectives, in order of priority, of the City's investment activities shall be:
4.1. Safety. Safety of principal is the foremost objective of the investment program. Investments of the City shall be undertaken in a manner that seeks to ensure preservation of capital in the overall portfolio.
4.2 Liquidity. The City's investment portfolio will remain sufficiently liquid to enable the City to meet all operating requirements which might be reasonably anticipated.
4.3 Return on investment. Investment return becomes a consideration only after the basic requirements of safety and liquidity have been met. The City Treasurer shall attempt to realize a yield on investments consistent with California statutes and the City's Investment Policy.
The City Treasurer should strive to maintain the level of investment of all contingency reserves and inactive funds as close to one hundred percent (100%) as possible. While the objectives of safety and liquidity must first be met, it is recognized that portfolio assets represent a potential source of significant revenues. It is to the benefit of the City that these assets be managed to realize a yield on investments consistent with California statutes and the City's Investment Policy.
A buy and hold strategy will generally be followed; that is, investments once made will usually be held until maturity. A buy and hold strategy will result in unrealized gains or losses as market interest rates fall or rise from the coupon rate of the investment. Unrealized gains or losses, however, will diminish as the maturity dates of the investments are approached or as market interest rates move closer to the coupon rate of the investment. A buy and hold strategy requires that the portfolio be kept sufficiently liquid to preclude the undesired sale of investments prior to maturity. Occasionally, the City Treasurer may find it advantageous to sell an investment prior to maturity, but this should only be on an exception basis and 'only when it is in the best interest of the City.
3 CITY OF INDUSTRY

The Treasurer shall review the portfolios quarterly to identify any securities that are no longer in compliance. The Treasurer shall report any major and critical incidences of noncompliance to the City Manager and City Council and provide recommendations to address the noncompliant securities.

RECITALS
WHEREAS, California Government Code Section 65300 requires every city and county within the State to adopt a General Plan for the physical development of the jurisdiction. General Plans serve as the "blueprint" for how the city will grow and develop, and must include eight state-mandated elements: land use, circulation, conservation, noise, open space, safety, housing, and environmental justice (when required); and WHEREAS, pursuant to State law (Government Code Sections 65580 - 65589.11), local governments must adopt plans and regulatory systems that provide opportunities for, and do not unduly constrain, housing development to adequately plan to meet the housing needs of the community. This requirement is met by adopting and regularly updating their Housing Elements, and submitting to the State of California Department of Housing and Community Development ("HCD") for review and, upon demonstrating compliance with all statutory requirements, certification. Currently, all salitornia cities and counties are entering the sixth cycle planning period, addressın lousina needs and constraints tor the elaht-vear span trom 2021-2029: ani WHEREAS, the City has prepared a Housing Element and submitted the document to HCD for formal review and, on February 17, 2023, HCD issued correspondence to the City stating that "(t)he revised draft element meets the statutory requirements described in HCD's September 9, 2022 review. The housing element will comply with State Housing Element Law (Article 10.6 of the Gov. Code) when rezoning is completed (see below) and it is adopted, submitted to and approved by HCD, in accordance with Government Code section 65585" ", The revised Housing Element and the proposed zoning code amendments are collectively the "Project"; and WHEREAS, Program 3 of the 2021-2029 Housing Element commits the City to establishing a Housing Overlay Zone, and Program 1 commits the City to rezoning the property located at 20249 East Walnut Drive South, City of Industry, California ("Property"), from Industrial (M) to Industrial with a Housing Overlay Zone (M/HOZ); and WHEREAS, the establishment of a Housing Overlay Zone ("HOZ") is in conformity with the goals and policies of the City's General Plan because Program 2 of the 2021- 2029 Housing Element provides that the City will define and permit, by right specific housing types required by State law. In addition, Program 3 of the Housing Element commits the City to establishing a HOZ that permits single family and multifamily residential uses by right, with a minimum density of 20 units per acre, and minimum of 16 units per site. Zoning Ordinance Amendment No. 23-01 codifies each of the aforesaid revisions and establishes the HOZ. The proposed Zoning Ordinance Amendment actually implements specific programs contained within the General Plan and is, therefore, consistent. The establishment of the HOZ is consistent with the City's Zoning Code because it creates a new zone within the Zoning Code. The City is permitted to divide the City into zones to classify land uses, may establish zones to promote the public safety health and welfare, and to carry out the purposes of the planning law of the state.
As set forth above, it is necessary to establish the HOZ in order for the City's 2021-2029 Housing Element to comply with state law; and
WHEREAS, According to the City's records, the existing zoning for the Property is Industrial (M) zoning. In order for the City's 2021-2029 Housing Element Update to be certified by HCD, it is necessary for the City to add the HOZ to the Property, which constitutes a changed condition warranting additional zoning for the Property. The addition of the HOZ to the Property allows the Property to be developed with residential uses, consistent with the provisions of the City's 2021-2029 Housing Element Update.
The City will be deprived of a property right if the zone request is not granted because HCD is requiring the City to rezone the Property with the HOZ in order to certify the City's 2021-2029 Housing Element Update. The change of zone will not adversely affect the adjoining properties as to value because the proposal will make the zoning designation of the Property more compatible with surrounding properties. The change of zone will not adversely affect the adjoining properties as to precedent, because the City desires to create consistent uniform zoning in geographical areas. The proposed addition of the HOZ to the Property will not be detrimental to the area, as there are residential uses located to the east and south of the Property. The addition of the HOZ to the Property will be in the interest of furtherance of the public health, safety, and general welfare because the Property will be developed in accordance with the provisions of the City's Code. Further, the Project may actually enhance the general welfare of the community because it will create additional development opportunities in the City; and WHEREAS, the City, as lead agency, caused to be prepared for the Project pursuant to the provisions of the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq. "CEQA") and the CEQA Guidelines (Title 14, Cal. Code of Regs., §§ 15000 et seq. the "CEQA Guidelines") an Addendum ("Addendum") to the 2014 Initial Study/Negative Declaration (SCH No. 2014011026) for the 2013-2021 Housing Element ("2014 IS/ND"); and
WHEREAS, the Addendum was prepared in accordance with CEQA and Sections 15162 and 15164 of the CEQA Guidelines; and
WHEREAS, California Government Code Section 65354 requires city or county planning commissions make a written recommendation on the adoption or amendment of a general plan; and
WHEREAS, on June 9, 2023, the Planning Commission of the City of Industry conducted a duly noticed public hearing to consider the Addendum to the 2014 IS/ND, and considered all testimony written and oral, and adopted Resolution No. PC 2023-02, recommending the City Council adopt the Addendum; and
WHEREAS, on June 9, 2023, the Planning Commission of the City of Industry conducted a duly noticed public hearing on the Project, and considered all testimony written and oral, and adopted Resolution Nos. PC 2023-03 and 2023-04, recommending the City Council approve the Project; and
WHEREAS, on June 12, 2023, notice of the City Council's June 22, 2023, public hearing on the Project, including the Addendum to the 2014 IS/ND was published in the San Gabriel Valley Tribune, in compliance with the City's Municipal Code and Government Code Section 65091, and was posted on the property located at 20249 East Walnut Drive South, City of Industry, California, City Hall, the City's Council Chambers, Fire Station 118, and on the City's website; and
WHEREAS, notice of the City Council's June 22, 2023, public hearing on the Project, including the Addendum to the 2014 IS/ND, was also mailed to each property owner within 300 feet of 20249 East Walnut Drive South, City of Industry, California; and WHEREAS, on June 22, 2023, the City Council of the City of Industry conducted a duly noticed public hearing on the Project, and considered all testimony written and oral, and adopted Resolution Nos. CC 2023-37 and 2023-38, approving the Addendum to the 2014 IS/ND and the General Plan amendment; and
WHEREAS, on June 22, 2023, the City Council of the City of Industry conducted a duly noticed public hearing on the Project, and considered all testimony written and oral; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF INDUSTRY, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that based upon substantial evidence presented to the City Council during the June 22, 2023 public hearing, including public testimony and oral staff reports, that all of the facts set forth in the Recitals, are true and correct, and are incorporated herein by reference.
Section 2. Zoning Code Text Amendment Findings.
Based upon substantial evidence presented to the City Council during the June 22, 2023 public hearing, including public testimony and written and oral staff reports, and which includes without limitation, CEQA, the CEQA Guidelines, the Addendum and the City's Code, and any documents provided by the public to the City Council at the June 22, 2023 public hearing, and in accordance with Section 17.28.040 of the City's Municipal Code, the City Council finds as follows:
a. The establishment of a Housing Overlay Zone ("HOZ") is in conformity with the goals and policies of the City's General Plan because Program 2 of the 2021-2029 Housing Element provides that the City will define and permit, by right, accessory dwelling units, employee housing, licensed residential care facilities serving seven or more clients, low-barrier navigation centers, supportive housing, manufactured housing, mobile homes, multi-family dwellings, single-family dwellings, single- room occupancy housing, and transitional housing and permanent supportive housing. In addition, Program 3 of the Housing Element commits the City to establishing a HOZ that permits single family and multifamily residential uses by right, with a minimum density of 20 units per acre, and minimum of 16 units per site. The purpose of the proposed Zoning Ordinance Amendment No. 23-01 is to codify each of the aforesaid revisions and establish the HOZ. The proposed Zoning Ordinance Amendment actually implements specific programs contained within the General Plan and is, therefore, consistent.
b. The establishment of the HOZ is consistent with the City's Zoning Code because it creates a new zone within the Zoning Code. Pursuant to Section 17.04.010 of the City's Code, the City is permitted to divide the City into zones to classify land uses. Further, in accordance with Section 17.04.030 of the City's Code, the City Council may establish zones to promote the public safety health and welfare, and to carry out the purposes of the planning law of the state. As set forth above, it is necessary to establish the HOZ in order for the City's 2021-2029 Housing Element to comply with state law.
Section 3. Change of Zone Findings.
Based upon substantial evidence presented to the City Council during the DATE public hearing, including public testimony and written and oral staff reports, and which includes without limitation, CEQA, the CEQA Guidelines, the IS/MND, MMRP and the City's Code, and any documents provided by the public to the City Council at the DATE public hearing, the City Council finds as follows:
a. According to the City's records, the Property is currently zoned Industrial (M). As shown on the property map, the property located at 20249 East Walnut Drive South, City of Industry, California is zoned Industrial. In order for the City's 2021- 2029 Housing Element Update to be certified by HCD, it is necessary for the City to add the HOZ to the Property. The rezoning requirement by HCD constitutes a changed condition warranting additional zoning for the Property. b. The addition of the HOZ to the Property allows the Property to be developed with residential uses, consistent with the provisions of the City's 2021-2029 Housing Element Update.
c. The City will be deprived of a property right if the zone request is not granted because HCD is requiring the City to rezone the Property with the HOZ in order to certify the City's 2021-2029 Housing Element Update. d. The proposed addition of the HOZ to the Property will not be detrimental to the area, as there are residential uses located to the east and south of the Property.
e. The addition of the HOZ to the Property will be in the interest of furtherance of the public health, safety, and general welfare because the Property will be developed in accordance with the provisions of the City's Code. Further, the Project may actually enhance the general welfare of the community because it will create additional development opportunities in the City.

ITEM NO. 6.11
CITY OF INDUSTRY
MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Engineering Manager; Upendra Joshi, Sr. Project Manager, CNC Engineering
DATE: July 13, 2023
SUBJECT: Consideration of Amendment No. 2 to the Memorandum of Agreement with the San Gabriel Valley Council of Governments, to award funding from the San Gabriel Valley Slower, Safer Streets Program
BACKGROUND
On December 2, 2021, the Los Angeles County Metropolitan Transportation Authority Board ("LACMTA Board") approved the Open Streets Cycle 4 Grant Program providing Los Angeles County Proposition C Funds ("Grant Funds") for events that temporarily close the street to automotive traffic and open them to pedestrians, cyclists, and demonstrations intending to make the streets safer for both pedestrians and motorists. The LACMTA Board approved the San Gabriel Valley Council of Governments ("SGVCOG") to serve as the pass-through agency of the Proposition C Funds with its member cities, and SGVCOG was successful in securing $500,000.00 in Grant Funds during Cycle 4 from the LACMTA Board for the SGV Slower, Safer Streets Program.
SGVCOG member cities were invited to apply to SGVCOG for Grant Funds of up to $50,000.00 for eligible projects under the SGV Slower, Safer Streets Program. The City applied for $40,000.00 in Grant Funds to support hosting a Slow Street Demonstration at the intersection of Nelson Avenue and Willow Avenue in the City ("Demonstration").
On July 28, 2022, the City approved a Memorandum of Agreement ("MOA") with the San Gabriel Valley Council of Governments to award funding from the SGV Slower Safer Streets Program. On February 6, 2023 the City approved Amendment No. 1 to award funding from the San Gabriel Valley Slower, Safer Streets Program.
Staff worked with SGVCOG on preparation of an Implementation Plan for the project. The plan outlined the steps involved in carrying out the Demonstration from initial design, developing a schedule, to installing and project closeout. The Implementation Plan was reviewed and approved by SGVCOG on December 8, 2022.
DISCUSSION
After review of the City's application, the SGVCOG determined that the Demonstration is eligible for an award in an amount not-to-exceed $40,000.00 in Grant Funds for those reimbursable expenses described in Exhibit A. The Demonstration entails installing a Rectangular Rapid Flashing Beacon ("RRFB") for the existing crosswalk at Nelson Avenue and Willow Avenue, an unsignalized intersection. Currently, there are only static advance signs. The RRFB will be pedestrian actuated and solar powered. This Demonstration will enhance the safety of both the vehicular and pedestrian traffic. The City will fund the Demonstration up front and thereafter be reimbursed 80 percent by SGVCOG, up to $40,000.00, due to the condition of the Grant Funds, that the City is required to provide a minimum 20 percent contribution of the project costs.
The Term of the Agreement is from August 17, 2022 to September 30, 2023. This Second Amendment extends the Term through October 31, 2023.
FISCAL IMPACT
The fiscal impact associated with Amendment No. 2 is $17,360.00.
RECOMMENDATION
Staff recommends approval of Amendment No. 2 to the Memorandum of Agreement.

Implementation Plan
for
City of Industry (City) Slow Street Demonstration Project Demonstration Location: The Demonstration will be located at the intersection of Nelson Avenue and Willow Avenue in the City. The Demonstration is located on the border of the City and the City of La Puente, with Nelson Avenue acting as the dividing line between the two cities. There is an Adult Learning Center on the north side of the Nelson Avenue (City of La Puente) and commercial/industrial businesses on the south side of Nelson Avenue (City of Industry).
Event Description: The City will purchase and demonstrate the use of a solar powered Rectangular Rapid Flashing Beacon (RRFB) at an existing un-signalized intersection of Nelson Avenue and Willow Avenue. The demonstration will increase crosswalk visibility, slow down oncoming vehicular traffic, improve safety and encourage active forms of transit.
Implementation Plan: The following is a breakdown of the sequence of tasks, including budget and schedule, needed to implement the demonstration.
Planning and Engineering Tasks:
1. Identify Location for Demonstration: This task has already been completed.
2. Field Review to identify any constraints: This will involve a site visit to the location document the existing conditions, including any that impact the layout or location of the RRFB. The field review will include photo documentation of the existing conditions.
3. Research available devices: Research will be performed to determine which traffic equipment manufacturers provide RRFB's. In addition, research will need to be done to determine the proper solar panel size, configuration and support equipment to provide power to the RRFB
4. Identify additional safety measures to incorporate: In addition to the installation of he RRFB device, the existing conditions of the location as well as the pedestrian and vehicular movements will be evaluated to determine if additional safety measurement need to be incorporated to supplement the RRFB. 1 Engineering Tasks:
5. Preparation of Base Map: A topographic map will be prepared to properly locate all existing surface features that may impact the location of the RRFB, sight distance for approaching vehicles and visibility to the crosswalk.
6. Prepare conceptual layout of devices, signage and any additional safety measures: Once the base map has been completed and the specific RRFB and solar panel devices have been selected, a conceptual layout plan will be prepared.
7. Coordinate with and obtain approval of conceptual layout from the City of La Puente: Since the project location straddles the boundary between the Cities of Industry and La Puente, the City of Industry will meet with the City of La Puente to discuss the proposed safety measure and the need to perform work within La Puente's jurisdiction.
8. Prepare final plans and Bid Documents: Upon agreement between the cities of Industry and La Puente on the conceptual layout, final plans and Bid Documents will be prepared for submission to contractors for bidding purposes.
Bidding Tasks:
9. Using plans and bid documents, obtain contractor to purchase and setup devices: The City of Industry will solicit 3 bids from contractors qualified to perform the work necessary to provide a functional RRFB system. The bids will be evaluated and a contractor will be selected to enter into contract with to setup the RRFB for the demonstration.
Temporary Installation Tasks:
10. Contract Administration: Once the contract has been executed between the selected contractor and the City, the city's construction manager will authorize the contractor to begin the work.
11. Installation: The city will provide inspection of the work as it is progressing, including documenting the progress.
Close Out Tasks:
12. Final Inspection: Upon completion of the installation, the City of Industry will perform a final inspection to determine the system is functioning as intended and no additional safety measures need to be implemented.
13. Temporary Installation Sign Off: Once the city is satisfied with the system, a Notice of Completion will be issued to the contractor.
14. Evaluation: The City will provide an opportunity for the surrounding community to provide feedback on the demonstration project for a period of 30 days. If the demonstration proves to be a success, the City may consider installing RRFB permanently.
2 15. Final Invoicing: After the Notice of Completion is issued, all outstanding and final invoices will be processed and payment made to the contractor.
16. Project Closeout: Upon final payment to the contractor and any final billings for staff and/or consultants, the City will closeout the project.

CITY COUNCIL
ITEM NO. 6.13
CITY OF INDUSTRY
ARGELES
MEMORANDUM
TO: Honorable Mayor Moss and Members of the City Council FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Engineering Manager
DATE: July 13, 2023
SUBJECT: Consideration of a Reimbursement Agreement with Rowland Water District for water line relocation services on the Colima Road Improvement project, in the amount of $2,673,580.00 (MP 00-29)
BACKGROUND
Colima Road widening included widening the north side of Colima Road by two feet to achieve wider travel lanes to accommodate trucks that utilize Colima Road. The street widening required the relocation of existing streetlights and other infrastructure. The streetlights were relocated on top of the Rowland Water District's ("District") existing water line, creating a conflict. The most cost effective solution to resolve the conflict was to abandon the District's water line and construct a new waterline 13 feet from the streetlight foundations, and reconnect all existing laterals and fire services.
DISCUSSION
The District requires a reimbursement agreement to perform the water line relocation services which includes abandoning the District's existing waterline and constricting a new waterline 13 feet from the streetlight foundations, and reconnecting all existing laterals and fire services. The District provided an estimate of $2,673,580.00 for the work but will invoice the City for the actual work performed.
FISCAL IMPACT
The fiscal impact to the City is estimated at $2,673,580.00. In the fiscal budget 2023-2024 is $10,050,000.00 was approved for this project (Account No. 120-702-5205) (MP 00-29) no appropriations are required.
RECOMMENDATION
It is recommended that the City Council approve the Reimbursement Agreement with Rowland Water District.

REIMBURSEMENT AGREEMENT
FOR RELOCATION OF WATER LINE FOR COLIMA ROAD WIDENING
This Reimbursement Agreement ("Agreement") is made and entered into this 13th day of July, 2023 ("Effective Date") by and between the City of Industry, a California municipal corporation ('City"), and the Rowland Water District, a California public water agency ("District"), Industry and the District are hereinafter collectively referred to as "Parties", and individually as "Party".
RECITALS
WHEREAS, Colima Road is on the Highway Element of the City's General Plan, and is also on the Highway Plan for the County of Los Angeles ("County"); and WHEREAS, on or about July 13th ' 2023, the City and the County entered into a Cooperative Agreement to improve the roadway pavement of certain segments of Colima Road ("Project"); and
WHEREAS, as part of the design process for the Project, the City revised the original designs to widen the north side of Colima Road by two feet to achieve wider travel lanes to accommodate trucks that utilize Colima Road to enter and exit the City; and WHEREAS, the street widening required the relocation of the then existing streetlights and other infrastructure. The location where the streetlights were relocated was on top of the District's existing water line, thereby creating a conflict; and WHEREAS, the most cost effective solution to resolve the conflict was to abandon the District's water line and construct a new waterline 13 feet from the streetlight foundations, and reconnect all existing laterals and fire services ("Relocation Project"); and WHEREAS, given that it was the City's decision to widen Colima Road for the benefit of the public, the City desires to reimburse the District for the Relocation Project, in the amount of $2,673,580.00; and
WHEREAS, the City desires to solely reimburse District for the Relocation Project, and is not responsible or liable for the construction, any defects thereto, and/or any future maintenance of the water line.
