MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Director of Public Works
James Cramsie, Sr. Director of Engineering
DATE: April 23, 2026
SUBJECT: Consideration of a Partnership Agreement between the County of Los Angeles, Los Angeles County Flood Control District, City of Baldwin Park, City of Industry, City of La Puente, and City of West Covina, for the Bassett High School Multi-Benefit Stormwater Capture Project (JN-7446) Background:

Since 2013, the City has been a member of the Upper San Gabriel River (“USGR”) Watershed Management Group (“WMG”). Members of the group include the Los Angeles County Department of Public Works (“County”), Los Angeles County Flood Control District (“Flood”) and the cities of Baldwin Park, Glendora, West Covina, La Puente, South El Monte, and Covina. The WMG has worked to develop and implement a Coordinated Integrated Monitoring Program (“CIMP”) and a Watershed Management Program (“WMP”) in response to requirements of the Los Angeles County Regional Water Quality Control Board (“LARWQCB”) Municipal Separate Storm Sewer System (“MS4”) Permit.

As part of the WMP, a stormwater project was identified at Bassett High School that would provide an opportunity for regional collaboration. The County took the lead in the management and design of the project, which would collect stormwater runoff from surrounding tributary areas in underground chamber, treat the water, and then release it back into the storm drain.

Discussion:

During the design process, the County determined the amount of drainage area each adjacent jurisdiction would contribute to the project and based on the percentage breakdown, applied that percentage to the cost of construction. This Partnership Agreement reflects that breakdown in the construction costs. The construction costs are partially being funded through the Safe, Clean Water Program, otherwise known as Measure W, through the Regional Program.

Page 34 of 155 ends

Fiscal Impact:

The fiscal impact to the City is estimated to be $1,376,700.00 and will be funded through the SCWP Municipal Program (Measure W funds) (MP 25-08). $2,000,000 is budgeted for in the adopted Capital Improvement Project budget (Account No. 103-300-5205).

Recommendation:

Staff recommends the City Council approve the Partnership Agreement.

Contract No. CITY-1545 – Specifications A-5
CITY’s Rights of Enforcement. In the event any policy of insurance required under this Agreement does not comply with these requirements or is canceled and not replaced, the CITY has the right but not the duty to obtain the insurance it deems necessary and any premium paid by the CITY will be promptly reimbursed by Contractor or the CITY will withhold amounts sufficient to pay premium from Contractor payments. In the alternative, the CITY may cancel this Agreement.

Waiver of Subrogation. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against CITY, its elected or appointed officers, agents, officials, employees and volunteers or shall specifically allow Contractor or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. Contractor hereby waives its own right of recovery against CITY, and shall require similar written express waivers and insurance clauses from each of its subconsultants.

Enforcement of Contract Provisions (non estoppel). Contractor acknowledges and agrees that any actual or alleged failure on the part of the CITY to inform Contractor of non-compliance with any requirement imposes no additional obligations on the CITY nor does it waive any rights hereunder.

Requirements Not Limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Contractor maintains higher limits than the minimums shown above, the CITY requires and shall be entitled to coverage for the higher limits maintained by the Contractor. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the CITY.

Notice of Cancellation. Contractor agrees to oblige its insurance agent or broker and insurers to provide to CITY with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.

Additional Insured Status. General liability policies shall provide or be endorsed to provide that CITY and its officers, officials, employees, agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess/umbrella liability policies.

The policy(ies) shall not contain any cross-liability exclusions.

Pass Through Clause. Contractor agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Contractor, provide the same minimum insurance coverage and endorsements required of Contractor. Contractor agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Contractor agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to CITY for review.

CITY’s Right to Revise Requirements. The CITY reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the Contractor a ninety (90)-day advance written notice of such change. If such change results in substantial additional cost to the Contractor, the CITY and Contractor may renegotiate Contractor’s compensation.

Self-insured Retentions. Any self-insured retentions must be declared to and approved by CITY. CITY reserves the right to require that self-insured retentions be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to comply with these specifications unless approved by the CITY.

Timely Notice of Claims. Contractor shall give CITY prompt and timely notice of claims made or suits instituted that arise out of or result from Contractor’s performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.

Additional Insurance. Contractor shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the work.

MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Director of Public Works
James Cramsie, Sr. Director of Engineering
DATE: April 23, 2026
SUBJECT: Consideration of Award of Contract No. CITY-1527, Temple Avenue Reconstruction from Baldwin Park Boulevard to Railroad Crossing to Sequel Contractors, Inc. in an amount not to exceed $1,279,263.00, and adopt Notice of Exemption regarding same
Background:

On December 11, 2025, the City Council authorized solicitation of public bids for the CITY-1527 project, for an estimated cost of $1,890,000.00. This project was bid to procure a contractor to reconstruct existing roadway pavement from Baldwin Park Boulevard to the Railroad Crossing.

As part of the project, a new PCC sidewalk and street lights system will be constructed on the southside of Temple Avenue. The existing sidewalk and driveways on the northside will be reconstructed, along with the existing curb ramps within the intersection of Temple Avenue and Baldwin Park Boulevard.

On February 19, 2026, the bid was posted in the City’s PlanetBids™ vendor portal and an email notification was sent to 738 vendors. The bid was viewed by 77 prospective bidders. The appropriate trade journals were notified on February 19, 2026. The bid was advertised on February 23, 2026 and March 2, 2026 in the San Gabriel Valley Tribune. Questions pertaining to the bid were received up until March 16, 2026 at 5:00 p.m. in the City’s PlanetBids™ vendor portal.

Discussion:

The bid process closed on March 26, 2026. Twelve (12) bids were received. The review of bids has found that Sequel Contractors, Inc. has submitted the lowest responsive bid and has the relevant experience, qualifications, and licensing necessary to complete this project. Below is a

Staff has determined that this project is subject to review under the California Environmental Quality Act (“CEQA”), however, it falls within the Categorical Exemption, Section 15301 Class 1, minor alteration of existing public facilities. As set forth above, the project involves the maintenance of existing streets by applying slurry seal for pavement preservation, and pursuant to Section 15301 of the CEQA Regulations, the repair, maintenance, or minor alteration of existing City streets is exempt, as long as there is no expansion (or only negligible expansion) of the use. Here, Staff is proposing the removal of existing asphalt concrete pavement and aggregate base and replacing with new AC pavement on crushed aggregate base on one layer of geogrid between subgrade and aggregate base. Work includes the construction of PCC sidewalk and street light system on southside of roadway and reconstruction of sidewalk on northside, PCC driveway and curb ramps to current ADA standards, adjusting existing utilities to finish grade, pavement markings, striping and red curb throughout. Based on the foregoing, Staff is recommending that the City Council adopt a Notice of Exemption for the project.

Fiscal Impact:

The fiscal impact is $1,279,263.00. In the adopted Fiscal Year 2025-2026 Capital Improvement Project budget $1,940,000 is approved for this project (Account No. 120-702-5205) (MP 20-12).

Recommendation:

1. Staff recommends that the City Council consider the results of the Temple Avenue Reconstruction from Baldwin Park Boulevard to Railroad Crossing bid, and award the bid to Sequel Contractors, Inc. and

2. Authorize the City Manager to approve change orders up to ten percent of the contract amount; and

MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Director of Public Works
James Cramsie, Sr. Director of Engineering
DATE: April 23, 2026
SUBJECT: Consideration of a Reimbursement Agreement with Union Pacific Railroad Company, for preliminary engineering services for the East-West Bike Path on Valley Boulevard project, along the UPRR R/W., in the amount of $25,000.00 (CITY-1537)
Background:

Staff is currently preparing the construction documents for the construction of a Class I Bike Path along Old Valley and Valley Boulevards, from the intersection of Common Avenue to Azusa Way. The project consists of construction of a PCC Bike Path, security fencing, drainage improvements and grading. Work includes construction activities within the Union Pacific Railroad (“UPRR”) right-of-way.

Discussion:

UPRR requires a Reimbursement Agreement to perform preliminary engineering services that include reviewing construction documents for improvements within the railroad right-of-way.

UPRR has provided an estimate of $25,000 for the work, but will invoice the City for the actual work performed.

Fiscal Impact:

The fiscal impact to the City is estimated to be $25,000.00. However, the final cost of plan checking by UPRR may vary. In the Fiscal Year 2025/2026 Capital Improvement Budget, $300,000.00 is approved for this project (Account No. 120-702-5130) (MP 24-07) and no appropriations are required.

Recommendation:

AGREEMENT
NOW THEREFORE, the parties hereto agree as follows:

1. Railroad, and/or its representatives, at Agency's sole cost and expense, agrees to perform (or shall cause a third-party consultant to perform on Railroad's behalf) the preliminary engineering services work described on Exhibit B attached hereto (PE Work). Agency acknowledges and agrees that: (a) Railroad's review of any Project designs, plans and/or specifications, as part of the PE Work, is limited exclusively to potential impacts on existing and future Railroad facilities and operations; (b) Railroad makes no representations or warranties as to the validity, accuracy, legal compliance, or completeness of the PE Work; and (c) Agency's reliance on the PE Work is at Agency's own risk.

2. 3. Agency acknowledges and agrees that Railroad may withhold its approval for the Project for any reason in its sole discretion, including without limitation, impacts to Railroad's safety, facilities, or operations. If Railroad approves the Project, Railroad will continue to work with Agency to develop final plans and specifications and prepare material and force cost estimates for any Project related work performed by Railroad. Approval of any design submittal shall not be construed as consent to the acquisition (or conveyance) of any property interest, nor shall it be interpreted as a representation that any such acquisition (or conveyance) would be compatible with or non-interfering with Union Pacific’s current and future railroad operations.

4. If the Project is approved by Railroad, Railroad shall prepare and forward to Agency a Construction and Maintenance Agreement (C&M Agreement) which shall provide the terms and conditions for the construction and ongoing maintenance of the Project. Unless otherwise expressly set forth in the C&M Agreement, the construction and maintenance of the Project shall be at no cost to Railroad. No construction work on the Project affecting Railroad's property or operations shall commence until the C&M Agreement is finalized and executed by Agency and Railroad.

5. Neither party shall assign this Agreement without the prior written consent of the other party, which consent shall not be unreasonably withheld, conditioned, or delayed.

6. No amendment or variation of the terms of this Agreement shall be valid unless made in writing and signed by the parties.

7. This Agreement sets forth the entire agreement between the parties regarding the Project and PE Work. To the extent that any terms or provisions of this Agreement regarding the PE Work are inconsistent with the terms or provisions set forth in any existing agreement related to the Project, such terms and provisions shall be deemed superseded by this Agreement to the extent of such inconsistency.

MEMORANDUM
TO: Honorable Mayor and Members of the City Council
FROM: Joshua Nelson, City Manager
STAFF: Mathew Hudson, Director of Public Works
Upendra Joshi, Senior Project Manager
DATE: April 23, 2026
SUBJECT: Consideration of an Agreement for Replacement of Overhead with Underground Distribution Facilities, with Southern California Edison Company, for Temple Avenue from Railroad Avenue to Perez Place, in the amount of $580,138.33 (MP 09-15)
Background:

The California Department of Transportation (“Caltrans”), in cooperation with Los Angeles County Metropolitan Transportation Authority (“LA Metro”), San Gabriel Valley Council of Governments (“SGVCOG”), Los Angeles County Department of Public Works (“LACDPW”), and the City, propose to improve the mobility of vehicles and relieve congestion, capacity constraints, and other related deficiencies at the Interstate 605 (“I-605”) Valley Boulevard interchange, including high accident rate locations, inadequate truck turn paths, nonstandard lane and shoulder widths along loop ramps, and noncompliant Americans with Disabilities Act (“ADA”) facilities. These improvements are being funded by LA Metro. LA Metro hired NCM Engineering Corp (“NCM”) to design and manage this project.

Discussion:

As NCM was hired by LA Metro for the design of the interchange project, City also contracted with NCM on August 26, 2021, for additional City improvements along Temple Avenue. These improvements include widening the street from Valley Boulevard to Perez Place, construction of raised medians on a portion of Temple Avenue, and eliminating the left turn movements from Railroad Street to Temple Avenue. This will aim to eliminate bottlenecks at the railroad crossing and benefit the City by reducing the traffic congestion at this location and enhancing safety along the railroad crossing.

As part of the project, the City decided to underground the existing overhead SCE line on east

Page 148 of 155 ends

side of Temple Avenue. The existing large power pole will be removed, and the electrical line will be underground making the sidewalk ADA compliant. SCE will replace an existing overhead with underground distribution and the work includes furnishing and installing vaults, transformers and associated equipment, conduits, ducts, wires, pavement trenching, backfilling and repaving as required in the amount not to exceed $580,138.33.

Fiscal Impact:

The fiscal impact to the City is estimated to be $580,138.33. In the adopted Fiscal Year 2025/2026 Capital Improvement Budget, $400,000.00 is approved for this work (Account No. 120-702-5205) (MP 09-15) and is sufficient for the initial costs. Additional funds will be allocated as needed.

Recommendation:

It is recommended that the City Council approve the Cooperative Agreement with Southern California Edison Company.
