SECTION 10 – WATER POLLUTION CONTROL
PART 1 - GENERAL
Scope of Work
This section includes specifications for water pollution control.
The Contractor is required to prepare a Storm Water Pollution Prevention Plan (SWPPP) and implement the plan once approved by the Engineer.
The intent of these requirements is to enforce federal, state and local laws, ordinances, codes and regulations that pertain to storm water pollution attributable to construction projects. Storm drains discharge directly to creeks without treatment. Therefore, discharge of pollutants (i.e. any substance, material or waste other than uncontaminated storm water) into the storm drain system is strictly prohibited.
For the purpose of eliminating storm water pollution, the Contractor shall implement effective control measures over the entire project. There are several publications which provide guidance on selecting and implementing effective control measures known as Best Management Practices (BMPs). BMPs include, but are not limited to, schedules of activities, prohibition of practices, general good housekeeping practices, operational practices, pollution prevention practices, maintenance procedures and other management procedures designed to prevent the discharge of pollutants directly or indirectly to the storm drain system. BMPs also include the construction of some facilities which may be required to prevent, control and abate storm water pollution. The reference publications are as follows:
1. California Storm Water Best Management Practices Handbook - Industrial/Commercial
2. California Storm Water Best Management Practices Handbook - Construction Activity The Contractor must comply with the State of California’s General Permit for Stormwater Discharges associated with construction activities (order no. 2009-0009-DWQ).

Material Storage
Storage and exposure of raw materials, by-products, finished products, and containers shall be controlled as described below:
1. All construction materials shall be stored at least ten (10) feet away from inlets, catch basins, and curb returns. The Contractor shall not allow any material to enter the storm
2026 NEIGHBORHOOD STREET REHABILITATION PROGRAM TS-32
drain system. At the end of each working day, the Contractor shall collect and dispose of all scrap, debris, and waste material.
2. During wet weather or when rain is forecast, the Contractor shall store materials that can contaminate rainwater or be transported by storm water or other runoff to the storm drain system inside a building or cover them with a tarp or other waterproof material secured with weighted tires or sandbags to prevent contact with rain.
The Contractor is reminded that storage and disposal of all hazardous materials such as paints, thinners, solvents, and fuels; and all hazardous wastes such as waste oil must meet all federal, state and local standards and requirements.
PART 3 - EXECUTION
De-Watering Operations
All groundwater removed from the trench or excavations must be removed and disposed of offsite in accordance with local and state requirements and through methods and procedures described in the California Storm Water Best Management Practice Handbook - Construction Activity (latest edition). A sampling and analysis program for non-visible storm water pollutants must be implemented if required. Sampling & analysis guidance can be found in the Fact Sheet of the National Pollutant Discharge Elimination System (NPDES) General Permit for Discharge of Storm Water associated with construction activities Order No. 99-08-DWQ (8/27/04) from the following link:
http://www.waterboards.ca.gov/water_issues/programs/stormwater/docs/finalconstpermit.pdf If there is suspicion of soil amendments (such as lime, fly ash, etc.) are being used and they will be exposed to storm water, a sampling and analysis program must be implemented.
Pavement Saw-Cutting Operations
The Contractor shall prevent any saw-cutting debris from entering the storm drain system. The Contractor, preferably, shall use dry cutting techniques and sweep up residue. If wet methods are used, the Contractor shall vacuum slurry as cutting proceeds or collect all wastewater by constructing a sandbag sediment barrier. The bermed area shall be of adequate size to collect all wastewater and solids. The Contractor shall allow collected water to evaporate if the wastewater volume is minimal and if maintaining the ponding area does not interfere with public use of the street area or create a safety hazard. If approved by the Engineer, the Contractor may direct or pump saw-cutting wastewater to a dirt area and allow to infiltrate. The dirt area shall be adequate to contain all the wastewater. After wastewater has infiltrated, all remaining saw-cutting residue must be removed and disposed of properly. Remaining silt and debris from the ponding or bermed area shall be removed or vacuumed and disposed of properly.
If a suitable dirt area is not available or discharge to the sanitary sewer is not feasible, with the approval of the Engineer, County Flood Control Department & Water Conservation District (WCD), the Contractor shall filter the saw-cutting wastewater through filtering materials and methods meeting ABAG Standards for Erosion and Sedimentation Control Measures (latest edition) before discharging to the storm drain.
2026 NEIGHBORHOOD STREET REHABILITATION PROGRAM TS-33
Pavement Operations
The Contractor shall prevent the discharge of pollutants from paving operations by using measures to prevent run-on and run-off pollution, disposing of wastes properly, and by implementing the procedures in the Best Management Practices Handbook. In addition, the Contractor shall observe the following guidelines:
Paving during wet weather:
1. No paving while it is raining.
2. No paving of the top lift of asphalt concrete (AC) on any day that experiences 1/4” of rain in a twenty-four (24) hour period.
3. No paving of bottom lift if previous seventy-two (72) hour period experienced more than 1/2” rain, unless directed by the Engineer or his designee.
Store materials as required under this section.
1. Cover inlets and manholes when applying asphalt, seal coat, tack coat, slurry seal, fog seal, etc.
2. Place drip pans or absorbent materials under paving equipment when not in use. During wet weather, store contaminated paving equipment indoors, or cover with tarp or other waterproof covering.

4. Keep ample supplies of drip pans or absorbent materials on-site.
5. If paving involves Portland cement concrete, refer to section F below.
All of the above is at the discretion of the Engineer or his designee.
Concrete Operations
Do not wash out concrete trucks into storm drains, open ditches, streets, streams, etc. The Contractor shall prevent the discharge of pollutants from concrete operations by using measures to prevent run-on and run-off pollution, properly disposing of wastes, and by implementing the following BMPs:
1. Store all materials in waterproof containers or under cover away from drain inlets or drainage areas.
2. Avoid mixing excess amounts of Portland cement materials. Dispose of any excess materials properly.
3. Whenever possible, perform washout of concrete trucks off-site where discharge is controlled and not permitted to discharge to the storm drain system. For on-site washout:
4. Locate washout area at least fifty (50) feet from storm drains, open ditches or other water bodies, preferably in a dirt area. Confine run-off from this area by constructing a temporary pit or bermed area large enough for the liquid and solid waste.
5. Wash out concrete wastes into the temporary pit where the concrete can set, be broken up and then disposed of properly. If the volume of water is greater than what will allow
2026 NEIGHBORHOOD STREET REHABILITATION PROGRAM TS-34
concrete to set, allow the wash water to infiltrate and/or evaporate, if possible. Remove or vacuum the remaining silt and debris from the ponding or bermed area and dispose of it properly.
6. Dispose of wastewater from washing of exposed aggregate to dirt area. The dirt area shall be adequate to contain all the wastewater and once the wastewater has infiltrated, any remaining residue must be removed.
7. Collect and return sweepings from exposed aggregate concrete to a stockpile or dispose of the waste in trash container.
Grading and Excavation Operations
The erosion and sedimentation control materials and methods shall be in accordance with ABAG Standards for Erosion and Sediment Control Measures and/or the procedures and methods described in the California Storm Water Best Management Practice Handbook - Construction Activity (latest edition) and the City’s grading ordinance.

In accordant with Section 39-2.01C, “Construction”, of the Caltrans Standard Specifications.
Surface Preparation
Prepare subgrade to receive HMA under the sections for the material involved. Subgrade must be free of loose and extraneous material.
Before placing HMA, remove loose paving particles, dirt, and other extraneous material by any means.
The full-width of a surface to which a tack coat is to be applied shall be cleaned with a selfpropelled, truck-mounted sweeper equipped with both power brooms and a vacuum system to remove loose dirt, sand, dust and other objectionable material. The surface to which the tack coat is to be applied shall be dry prior to application.
Tack Coat
Prior to applying tack coat, submit calculations for the minimum spray rate required to achieve the minimum residual rate.
Apply a tack coat:
1. To existing pavement including planed surfaces
2. Between HMA layers
3. To vertical surfaces of:
a. Curbs
b. Gutters
c. Construction joints
The surfaces of structures and trees adjacent to the areas being treated shall be protected to prevent their being splashed or damaged.
Equipment for the application of tack coat must comply with section 37-1.03B of the Caltrans Standard Specifications.
For gore points and other areas not accessible to a truck distributor bar apply by hand spraying.
Close areas receiving tack coat to traffic. Do not allow the tracking of tack coat onto pavement surfaces beyond the job site.
If use an asphalt binder for tack coat, the asphalt binder temperature must be from 285 to 350 degrees F when applied.
A certificate of compliance for each truckload of emulsion or asphalt binder shall be provided to the Engineer before the application of tack coat starts. The Engineer may obtain and retain samples for testing.

2026 NEIGHBORHOOD STREET REHABILITATION PROGRAM TS-72
Deliver HMA to the site in a thoroughly mixed condition and spread by a self-propelled asphalt paving machine.
HMA shall not be placed when the air temperature is below 50°F unless using an approved WMA technology.
HMA with WMA water injection technology shall be spread at a mix temperature of not less than 260°F, or not less than 250°F if a WMA additive technology is used.
No placement will be allowed when the roadway is moist, damp or when it is raining. For the purpose of this provision, "raining" means any weather condition that causes the roadway to become moist or damp. In the case of sudden precipitation, all paving work must stop immediately, all HMA on site not yet placed and all HMA in transit from the plant will be rejected and no payment will be allowed.
Deposit HMA in a windrow and load it in the paver if:
1. Paver is equipped with a hopper that automatically feeds the screed
2. Loading equipment can pick up the windrowed material and deposit it in the paver hopper without damaging base material
3. Activities for depositing, pickup, loading, and paving are continuous Do not use petroleum products such as kerosene or diesel fuel to release HMA from trucks, spreaders, or compactors.
Where the pavement thickness shown is 0.30 foot or greater, place HMA in multiple lifts not less than 0.15 foot each. If placing HMA in multiple lifts:
1. Aggregate gradation must comply with the requirements shown in the following table:
Aggregate Gradation Requirements
HMA lift thickness Gradation
0.15 to less than 0.20 foot 1/2 inch
0.20 foot to less than 0.25 foot 3/4 inch
0.25 foot or greater 3/4 inch
2. Apply a tack coat before placing a subsequent lift
3. The Engineer evaluates each HMA lift individually for compliance If the ambient air temperature is below 60 degrees F, cover the loads in trucks with tarpaulins. If the time for HMA discharge to truck at the HMA plant until transfer to paver's hopper is 90 minutes or greater and if the ambient air temperature is below 70 degrees F, cover the loads in trucks with tarpaulins, unless the time from discharging to the truck until transfer to the paver's hopper or the pavement surface is less than 30 minutes. The tarpaulins must completely cover the exposed load until transfer of the mixture to the paver's hopper or the pavement surface.

Longitudinal Joints
Longitudinal joints in the top layer must match lane lines. Alternate the longitudinal joint offsets in the lower layers at least 0.5 foot from each side of the lane line. Other longitudinal joint placement patterns are allowed if authorized.
A vertical longitudinal joint of more than 0.15 foot is not allowed at any time between adjacent lanes open to traffic.
For an HMA thickness of 0.15 foot or less, the distance between the ends of the adjacent surfaced lanes at the end of each day's work must not be greater than can be completed in the following day of normal paving.
For an HMA thickness greater than 0.15 foot, must place HMA on adjacent traveled way lanes or shoulder such that at the end of each work shift the distance between the ends of HMA layers on adjacent lanes is from 5 to 10 feet. Place additional HMA along the transverse edge at each lane's end and along the exposed longitudinal edges between adjacent lanes. Hand rake and compact the additional HMA to form temporary conforms. Place kraft paper or other authorized release agent under the conform tapers to facilitate the taper removal when paving activities resume.
If placing HMA against the edge of existing pavement, saw cut or grind the pavement straight and vertical along the joint and remove extraneous material.
Compaction
Start rolling at the lower edge and progress toward the highest part except when compacting layers which exceed 4 inches in compacted thickness. For layers which exceed 4 inches in compacted thickness, start rolling in the middle of the mat, and advance gradually to both edges. Roll supported edges (edges along concrete curbs and gutters, or headers) before unsupported edges. If approved, delay rolling of an unsupported edge if the required density is achieved on the remainder of the mat after the completion of finish rolling.
Complete finish rolling activities before the pavement surface temperature is:
1. Below 150 degrees F for HMA with unmodified binder
2. Below 140 degrees F for HMA with modified binder
Rolling must leave the completed surface compacted and smooth without tearing, cracking, or shoving.
2026 NEIGHBORHOOD STREET REHABILITATION PROGRAM TS-74
If a vibratory roller is used as a finish roller, turn the vibrator off.
HMA, after the completion of rolling, shall be compacted to not less than 92 percent and not more than 97 percent of the maximum theoretical density (MTD) as determined in accordance with AASHTO T 209.
Do not open new HMA pavement to traffic until its mid depth temperature is below 160 degrees F.
If the surface to be paved is both in sunlight and shade, pavement surface temperatures are taken in the shade.
Smoothness
The HMA pavement top layer must not vary from the lower edge of a 12-foot-long straightedge:
1. More than 0.01 foot when the straight edge is laid parallel with the centerline
2. More than 0.02 foot when the straightedge is laid perpendicular to the centerline and extends from edge to edge of a traffic lane
3. More than 0.02 foot when the straightedge is laid within 24 feet of a pavement conform Quality Control
HMA Density
1. The Contractor shall demonstrate that their equipment and operation can achieve the required density on a test strip not less than 200 feet long and 12 feet wide in accordance with California Test 375. The Contractor is responsible for the quality control process necessary to achieve the required density.
2. The test strip construction may be on the same day as production testing or the first day of paving. If on the first day of paving, the Engineer will issue a notice to proceed for paving after the completion of the test strip. Contractors are fully responsible for achieving the required in-place density both prior to, and after, determination of the theoretical maximum density.
In-Place Density
1. The Engineer determines the percent of theoretical maximum density by determining the in-place density by nuclear gauge and dividing by the theoretical maximum density.
2. The Engineer will determine the field density by a nuclear gauge calibrated from cores taken from the test strip in accordance with California Test 375. Nuclear gauge asphalt testing devices will be re-correlated whenever there is a change in lift thickness of 1/2 inch or greater, underlying material, materials source, or mix design.

No Bidder shall be allowed to make, file or be interested in more than one bid for the same work unless alternate bids are specifically called for. A person, firm or corporation that has submitted a sub-proposal to a Bidder, or that has quoted prices of materials to a Bidder, is not thereby disqualified from submitting a sub-proposal or quoting prices to other bidders. No person, firm, corporation, or other entity may submit a sub-proposal to a Bidder, or quote prices of materials to a Bidder, when also submitting a prime Bid on the same Project.
ARTICLE 22. SUBSTITUTION OF SECURITY
The Contract Documents call for monthly progress payments based upon the percentage of the Work completed. The City will retain a percentage of each progress payment as provided by the Contract Documents. At the request and expense of the successful Bidder, the City will substitute securities for the amount so retained in accordance with Public Contract Code Section 22300.
ARTICLE 23. PREVAILING WAGES
The City has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the Contract. These rates are available at the Administrative Services Department of the City or may be obtained online at http://www.dir.ca.gov. Bidders are advised that a copy of these rates must be posted by the successful Bidder at the job site(s).
ARTICLE 24. DEBARMENT OF CONTRACTORS AND SUBCONTRACTORS In accordance with the provisions of the Labor Code, contractors or subcontractors may not perform work on a public works project with a subcontractor who is ineligible to perform work on a public project pursuant to Labor Code Sections 1777.1 or 1777.7. Any contract on a public works project entered into between a contractor and a debarred subcontractor is void as a matter of law. A debarred subcontractor may not receive any public money for performing work as a

subcontractor on a public works contract. Any public money that is paid to a debarred subcontractor by the Contractor for the Project shall be returned to the City. The Contractor shall be responsible for the payment of wages to workers of a debarred subcontractor who has been allowed to work on the Project.
ARTICLE 25. INSURANCE REQUIREMENTS
Prior to commencing work, the successful bidder shall purchase and maintain insurance as set forth in the General Conditions.
ARTICLE 26. PERFORMANCE BOND AND PAYMENT BOND REQUIREMENTS The successful bidder will be required to furnish a Labor and Material Payment Bond and a Faithful Performance Bond each in an amount equal to one hundred percent (100%) of the contract price. Each bond shall be secured from a surety company that meets all State of California bonding requirements, as defined in California Code of Civil Procedure Section 995.120 and is admitted by the State of California. Each bond shall be accompanied, upon the request of City, with all documents required by California Code of Civil Procedure Section 995.660 to the extent required by law. All bonding and insurance requirements shall be completed and submitted to City within ten (10) working days from the date the City provides the successful bidder with the Notice of Award.
ARTICLE 27. SALES AND OTHER APPLICABLE TAXES, PERMITS, LICENSES AND FEES Contractor and its subcontractors performing work under this Contract will be required to pay California sales tax and other applicable taxes, and to pay for permits, licenses and fees required by the agencies with authority in the jurisdiction in which the Work will be located, unless otherwise expressly provided by the Contract Documents.
ARTICLE 28. PERMIT AND INSPECTION FEE ALLOWANCE
Notwithstanding anything contained herein, the Bid Form contains an allowance for the Contractor’s cost of acquiring traffic control permits and for construction inspection fees that may be charged to the Contractor by the Agency of Jurisdiction. The allowance is included within the Bid Form to eliminate the need by bidders to research or estimate the costs of traffic control permits and construction inspection fees prior to submitting a bid. The allowance is specifically intended to account for the costs of traffic control permits and construction inspection fees charged by the local Agency of Jurisdiction only. No other costs payable by Contractor to the Agency of Jurisdiction are included within the allowance.
ARTICLE 29. FILING OF BID PROTESTS
Bidders may file a “protest” of a Bid with the City Clerk. In order for a Bidder’s protest to be considered valid, the protest must:
A. Be filed in writing within five (5) calendar days after the bid opening date; B. Clearly identify the specific irregularity or accusation; C. Clearly identify the specific City staff determination or recommendation being protested;
38044.03101\31188026.2
-15- 00 21 13 – INSTRUCTIONS TO BIDDERS
D. Specify in detail the grounds for protest and the facts supporting the protest; and E. Include all relevant, supporting documentation with the protest at time of filing.
If the protest does not comply with each of these requirements, the City may reject the protest without further review.
If the protest is timely and complies with the above requirements, the City Clerk], or other designated City staff member, shall review the protest, any response from the challenged Bidder(s), and all other relevant information. The City Clerk will provide a written decision to the protestor.
The procedure and time limits set forth in this Article are mandatory and are the sole and exclusive remedy in the event of a Bid protest. Failure to comply with these procedures shall constitute a failure to exhaust administrative remedies and a waiver of any right to further pursue the Bid protest, including filing a Government Code Claim or legal proceedings.
ARTICLE 30. BASIS OF AWARD; BALANCED BID
The City shall award the Contract to the lowest responsible Bidder submitting a responsive Bid.
The lowest Bid will be determined on the basis of the Base Bid Price.
The City may reject any Bid which, in its opinion when compared to other Bids received or to the City’s internal estimates, does not accurately reflect the cost to perform the Work. The City may reject as non-responsive any Bid which unevenly weights or allocates costs, including but not limited to overhead and profit to one or more particular bid items.
ARTICLE 31. AWARD PROCESS
Once all Bids are opened and reviewed to determine the lowest responsive and responsible Bidder, the City may award the contract. The apparent successful Bidder should begin to prepare the following documents: (1) the Performance Bond; (2) the Payment Bond; and (3) the required insurance certificates and endorsements. Once the City notifies the Bidder of the award, the Bidder will have ten (10) working days from the date of this notification to execute the Contract and supply the City with all of the required documents and certifications. Regardless of whether the Bidder supplies the required documents and certifications in a timely manner, the Contract time will begin to run twenty (20) working days from the date of the notification. Once the City receives all of the properly drafted and executed documents and certifications from the Bidder, the City shall issue a Notice to Proceed to that Bidder.
ARTICLE 32. EXECUTION OF CONTRACT
As required herein the Bidder to whom an award is made shall execute the Contract in the amount determined by the Contract Documents. The City may require appropriate evidence that the persons executing the Contract are duly empowered to do so. The Contract and bond forms to be executed by the successful Bidder are included within these Specifications and shall not be detached.

KNOW ALL PERSONS BY THESE PRESENTS:
THAT WHEREAS, the City of Clayton, (hereinafter referred to as “City”) has awarded to _________________________, (hereinafter referred to as the “Contractor”) an agreement for Contract No._________, (hereinafter referred to as the “Project”).
WHEREAS, the work to be performed by the Contractor is more particularly set forth in the Contract Documents for the Project dated ________________, (hereinafter referred to as “Contract Documents”), the terms and conditions of which are expressly incorporated herein by reference; and
WHEREAS, the Contractor is required by said Contract Documents to perform the terms thereof and to furnish a bond for the faithful performance of said Contract Documents.
NOW, THEREFORE, we, ______________________, the undersigned Contractor and ________________________________________________ as Surety, a corporation organized and duly authorized to transact business under the laws of the State of California, are held and firmly bound unto the City in the sum of ___________________________ DOLLARS, ($____________), said sum being not less than one hundred percent (100%) of the total amount of the Contract, for which amount well and truly to be made, we bind ourselves, our heirs, executors and administrators, successors and assigns, jointly and severally, firmly by these presents.
THE CONDITION OF THIS OBLIGATION IS SUCH, that, if the Contractor, his or its heirs, executors, administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep and perform the covenants, conditions and agreements in the Contract Documents and any alteration thereof made as therein provided, on its part, to be kept and performed at the time and in the manner therein specified, and in all respects according to their intent and meaning; and shall faithfully fulfill all obligations including the one (1) year guarantee of all materials and workmanship; and shall indemnify and save harmless the City, its officials, officers, employees, and authorized volunteers, as stipulated in said Contract Documents, then this obligation shall become null and void; otherwise it shall be and remain in full force and effect.

As a condition precedent to the satisfactory completion of the Contract Documents, unless otherwise provided for in the Contract Documents, the above obligation shall hold good for a period of one (1) year after the acceptance of the work by City, during which time if Contractor shall fail to make full, complete, and satisfactory repair and replacements and totally protect the City from loss or damage resulting from or caused by defective materials or faulty workmanship.
The obligations of Surety hereunder shall continue so long as any obligation of Contractor remains. Nothing herein shall limit the City’s rights or the Contractor or Surety’s obligations under the Contract, law or equity, including, but not limited to, California Code of Civil Procedure Section 337.15.

ARTICLE 13. VERIFICATION OF EMPLOYMENT ELIGIBILITY
By executing this Contract, Contractor verifies that it fully complies with all requirements and restrictions of state and federal law respecting the employment of undocumented aliens, including, but not limited to, the Immigration Reform and Control Act of 1986, as may be amended from time to time, and shall require all subcontractors, sub-subcontractors and consultants to comply with the same. Each person executing this Contract on behalf of Contractor verifies that he or she is a duly authorized officer of Contractor and that any of the following shall be grounds for the City to terminate the Contract for cause: (1) failure of the Contractor or its subcontractors, sub-subcontractors or consultants to meet any of the requirements provided for in this Article; (2) any misrepresentation or material omission concerning compliance with such requirements; or (3) failure to immediately remove from the Work any person found not to be in compliance with such requirements.

However, the City has adopted uniform standards for certain materials, processes, and articles.
D. The Contractor shall submit substitution requests, together with substantiating data, for substitution of any “or equal” material, process, or article no later than thirty-five (35) calendar days after award of Contract. Provisions regarding submission of substitution requests shall not in any way authorize an extension of time for the performance of this Contract. If a substitution request is rejected by the City, the Contractor shall provide the material, method or service specified herein. The City shall not be responsible for any costs incurred by the Contractor associated with substitution requests. The burden of proof as to the equality of any material, process,

-64- 00 72 13 – GENERAL CONDITIONS
or article shall rest with the Contractor. The Engineer has the complete and sole discretion to determine if a material, process, or article is substantially equal to or better than that specified and to approve or reject all substitution requests.
E. Substantiating data as described above shall include, at a minimum, the following information:
1. A signed affidavit from the Contractor stating that the material, process, or article proposed as a substitution is substantially equal to or better than that specified in every way except as may be listed on the affidavit.
2. Illustrations, specifications, catalog cut sheets, and any other relevant data required to prove that the material, process, or article is substantially equal to or better than that specified.
3. A statement of the cost implications of the substitution being requested, indicating whether and why the proposed substitution will reduce or increase the amount of the contract.
4. Information detailing the durability and lifecycle costs of the proposed substitution.
F. Failure to submit all the required substantiating data detailed above in a timely manner so that the substitution request can be adequately reviewed may result in rejection of the substitution request. The Engineer is not obligated to review multiple submittals related the same substitution request resulting from the Contractor’s failure to initially submit a complete package.
G. Time limitations within this Article shall be strictly complied with and in no case will an extension of time for completion of the contract be granted because of Contractor’s failure to provide substitution requests at the time and in the manner described herein.
H. The Contractor shall bear the costs of all City work associated with the review of substitution requests.
I. If substitution requests approved by the Engineer require that Contractor furnish materials, methods or services more expensive than that specified, the increased costs shall be borne by Contractor.
ARTICLE 15. SHOP DRAWINGS
A. Contractor shall check and verify all field measurements and shall submit with such promptness as to provide adequate time for review and cause no delay in its own Work or in that of any other contractor, subcontractor, or worker on the Project, six (6) copies of all shop drawings, calculations, schedules, and materials list, and all other provisions required by the Contract Documents. Contractor shall sign all submittals affirming that submittals have been reviewed and approved by Contractor prior to submission to Engineer. Each signed submittal shall affirm that the submittal meets all the requirements of the Contract Documents except as specifically and clearly noted and listed on the transmittal letter of the submittal.
