David,
I hope you had a great Thanksgiving Holiday. I was just combing through my emails and realized I have not got back with you. We can make your restroom match your surrounding architecture.
Rough budgetary pricing for our PS-022 and PS-021 would be $170-200k+ and $150-180k+. Pricing includes design, state approved drawings, local permitting, restroom built in our warehouse, shipped to your location, crane installation on site, field crew install on site (3-5 days), and turnkey ready to operate once we leave.
Ill go ahead and include a copy of our scope of work as well as our pad prep plan for you to review.
What are your thoughts?

Subject: RE: Price Estimate for PS-021 - City of Cloverdale Steve,
Thanks for the follow up response. The name of the park is Cloverdale City Park. The PS-021 and O22 models align with our space for the restrooms. The proposed location for public restroom is north of and behind the main stage and arbor. Currently there are two landscape area with concrete slab between them that supports a drinking fountain. Attached is a photograph of the westerly landscape area. The easterly side is nearly identical.
At this time, we are attempting to obtain a cost estimate (range) to purchase a restroom as an alternative to the Portand Loo. Members of our Council support a design that works with the existing wooden arbors and design of the Plaza and provides two bathrooms. The arbors are constructed of yellow cedar. The stage is concrete. I have attached a picture depicting the stage from the street.
If you can share a price range it would be really helpful. We are estimating $150,00 - 225,000 for the 186
prefabricated restroom but not sure if that is accurate.
Thanks,
David

Thanks for responding back. What is the name of the Park you are looking to install at? Our current backlog is about late spring to early summer, but there might be some flexibility. Were you looking to build a restroom on the sidewalk? That is where we normally see the Portland Loo’s as they are more minimalistic in design.
With Public Restroom Company we have ideally the most amount of flexibility in design esthetics as well as complementary interior options. Here are just a couple buildings we have made for our PS022 customers. https://publicrestroomcompany.com/buildings/ps-022-playground-series/ Are you looking to explore PS-022 options, or something else? The City of Cloverdale is evaluating restroom options for our parks and would like to develop some preliminary “rough” cost estimates for a prefabricated unit. Would it be possible to obtain a cost estimate for the PS-021 and PS-022? Any cost data you can share with us is greatly appreciated.

Agenda Item Title:
Review and Consider Options Regarding the Sale, Possession, and Use of Fireworks and Public Display of Fireworks in the City of Cloverdale, Including the Placement of a Ballot Measure on an Upcoming Election _______________________________________________________________________________________ Recommended Council Action(s):
Staff recommends that the City Council receive an overview of options regarding the sale, possession, and use of fireworks and public fireworks display in the City of Cloverdale, including the placement of a ballot measure on an upcoming election, and provide direction to staff. ________________________________________________________________________________________ Background:
“Safe and Sane Fireworks,” also known as “State approved fireworks,” are defined in California Health and Safety Code sections 12529 and 12562 and the relevant sections of Title 19, California Code of Regulations Subchapter 6. Section 15.14 of the Cloverdale Municipal Code enables the sale of safe and sane fireworks subject to meeting the conditions, including the times and locations set forth in the Municipal Code. These fireworks are considered “legal” fireworks most often sold by non-profit groups for fundraising purposes.
Illegal fireworks continue to be prohibited under State law and are not impacted by the City’s Code. In addition, the Municipal Code provides for the public display of fireworks. The Municipal Code defines the Public display of fireworks “as a means an entertainment feature where the public is admitted or permitted to view the display or discharge of fireworks by a licensed pyro-technician.” Over the past four years, Sonoma County has experienced an increasing number of Red Flag Warning Weather Days throughout our community that drives up the frequency of increased fire risk. Several devastating wildfires (i.e., Pocket, Tubbs, Nuns, Kincade, and Glass/Walbridge Fire) have impacted Sonoma County and the City of Cloverdale. Most recently, the Kincade Fire, which started around Geyserville, burned over 75,000 acres in Sonoma County, and forced mandatory evacuations throughout Sonoma County. The City has also been subject to PG&E power shutoffs that have affected the City’s critical infrastructure systems. According to PG&E, power outages are anticipated to continue into the foreseeable future during forecasted extreme weather (low humidity and/or high wind speeds). The continuation of power outages could impact the City and Fire District’s ability to respond to fire and other emergencies.
Furthermore, persistent drought conditions have increased the amount, and extent of dry vegetation in the surrounding landscapes that have in turn generated significant fire hazards and increased public concern.
Due in part to the recent emergency events, the Council has received requests from community members to consider a ban on the sale and use of safe and sane (legal) fireworks. Currently, Cloverdale is the only remaining city in Sonoma County that permits the sale of safe and sane fireworks. Most, if not all, cities continue to allow the public display of fireworks when part of a larger event (e.g., Independent Day Celebration) hosted and inspected by the Fire Marshall. During past deliberations on whether to ban or 196

prohibit the sale of sane fireworks, proposed restrictions have been met with resistance by community members and local non—profit organizations supported by funding derived from the sale of safe and sane fireworks.
Whether to prohibit the sale and use of “safe and sane” fireworks have been raised by both the Council and the residents over the years. The City Council directed staff to provide options related to the regulation of fireworks and also options regarding how the City could place this important topic before the voters at an upcoming election.
________________________________________________________________________________________ Summary:
The purpose of this agenda item is to discuss options regarding the sale and use of safe and sane fireworks that typically occur or are planned on the Fourth of July. This agenda item, and the attached memorandum from the City Attorney, provide the Council with information and options as to potential next steps regarding the regulation of fireworks. Staff is seeking direction from Council regarding what step or steps it wishes to take.
Option 1: Adopt an Ordinance amend the Municipal Code to prohibit the sales and use of fireworks in the City. Section 15.14 of the Cloverdale Municipal Code includes provisions for the sale of safe and sane fireworks. Amendment of the Municipal Code to prohibit the sale of and use of legal fireworks could be accomplished through adoption of an Ordinance amending the Municipal Code to prohibit or restrict the sales and use of fireworks. Upon adoption, the sales and use of legal fireworks could only be further restricted or disallowed completely.
Option 2: Prohibit the sales and use of fireworks in the City for one year under the City’s current Municipal Code. The current adopted Fireworks Ordinance embodied in the Cloverdale Municipal Code provides the authority to the City Council to prohibit the sales and discharge of safe and sane fireworks in a particular sales year due to the threat to public health, safety, and welfare. Cloverdale Municipal Code section
15.14.695(B) states in part, “the City Council may in any given fireworks sales year prohibit the sale and discharge of safe and sane fireworks upon determining that conditions exist in the City, that may include, but are not limited to, fire weather events, fuel moisture, drought, limitations on available firefighting forces and/or other condition, that the City Council finds creates an extreme danger to the public health and safety and/or life and property of the residents, businesses and visitors of the City. In its sole discretion, the city council may consult with the Cloverdale Fire Protection District prior to prohibiting the sale and discharge of safe and sane fireworks in any given fireworks sales year.” Permitted sales and use of fireworks would be reinstated in a following year, with considerations to provisions that may be necessary to address current issues or concerns.
Option 3: Place a ballot measure on an upcoming election to enable the voters of the City of Cloverdale to consider whether to prohibit the sales, possession, and use of fireworks in the City.
Option 3 a – Place a Council-sponsored measure on the ballot - Ordinance Prohibiting the Sale, Possession, and Use of Fireworks within the City of Cloverdale. The City Council may submit a proposition to 197

the voters to repeal, amend, or enact an ordinance. The election on such measures can be held during the general municipal election or at a special election, including any established statewide election. When the City Council submits a measure to the electorate, whether the proposed legislation is adopted depends upon the results of the election. The proposed Ordinance approving fireworks would be adopted if the measure were approved by at least 50% of the voters. It would become effective ten days after the results of the election are certified.
A City-sponsored ballot measure empowers voters to decide whether to enact a proposed ordinance. Staff and the City Council would be responsible for drafting a proposed fireworks ordinance, but once submitted to the voters, the City Council would not be able to re-draft it, and if voters approved the measure, the Ordinance would be adopted and go into effect.
Option 3 b – Place an advisory measure on the ballot. This option entails placing an advisory measure on the ballot to seek voter opinion on whether to adopt an ordinance prohibiting the sales and use of legal fireworks in the City. An advisory measure seeks to inform the Council where the community stands on a particular issue, but it does not have any legal or binding effect.
Option 4: No change. Permitted fireworks sales and use will continue.
Due to significant division amongst the community over whether to continue or prohibit the sales and discharge of safe and sane fireworks, the Council is requested to discuss and consider options for addressing this significant policy matter.
Staff is coordinating with the Registrar of Voters on the cost and timeline associated with placing a measure on the ballot. Additional information regarding the cost of placing a ballot measure is expected to be provided during the Council’s review of this matter. Depending on the option preferred by the City Council, the City Council may desire to review additional issues related to the preferred decision, including public Fireworks Displays/events, the City’s role in sponsoring or supporting a fireworks event (or an alternative such as a laser show) and how and if to address potential loss of fundraising revenue from local non-profits that derive revenue from the sale of safe and sane fireworks. ________________________________________________________________________________________ Options:
The following options are available:
1. Adopt an Ordinance prohibiting the sale of safe and sane (legal fireworks); or
2. Temporarily ban the sale of safe and sane fireworks due to current conditions.
3. Placing a ballot measure before the voters to decide on either an advisory measure or Ordinance prohibiting the sale of safe and sane; or
4. Keep current regulations in place; or
5. Provide alternative direction to City Staff.

RE: Options Regarding the Sale, Possession and Use of Fireworks and Public Display of Fireworks in the City of Cloverdale, Including the Placement of a Ballot Measure on an Upcoming Election
I. BACKGROUND:
Whether to prohibit the sale and use of “safe and sane” fireworks have been raised by both the Council and the residents over the years. The City Council directed staff to provide options related to how the City could place this important topic before the voters at an upcoming election.
The California Constitution provides the power of initiative to voters in California. An initiative is “the power of the electors to propose statutes and amendments to the Constitution and to adopt or reject them.”1 A referendum is “the power of the electors to approve or reject statutes or parts of statutes, except urgency statutes, statutes calling elections and statutes providing for tax levies or appropriations for usual current expenses of the state.”2 The Elections Code also authorizes the City Council, on its own motion, to submit proposed legislation to the voters or to obtain the non-binding views of the electorate through an advisory measure.
This memorandum addresses the types of ballot measures that the City may bring in connection with safe and sane fireworks and the costs associated with submitting a measure to the voters. 1 Cal. Const. art. II, § 8(a).

A. Initiatives and Referenda
California law reserves to voters the power of initiative and referendum. Initiatives enact new legislation proposed through a citizen-generated petition to the local agency. Referendums provide voters with the opportunity to approve or reject legislation already adopted by the City Council, such as City ordinances. Referendums are also generated through a citizen petition to the local agency.
B. City Ballot Measures
Proposed legislation may also be submitted to the voters by the City Council without a citizengenerated petition on the Council’s own motion. Ballot measures may broadly cover any proposed legislative acts by a city, including the consideration of a new ordinance. 3 Accordingly, the City Council may initiate a ballot measure related to safe and sane fireworks to put before voters of the City. If the City Council wishes to submit to the City’s voters the opportunity to enact a safe and sane fireworks ordinance, it may do so through a ballot measure.
Additionally, the City Council may seek the views of voters through a non-binding vote, which is referred to as an advisory measure.
1. Council-Sponsored Measures
The City Council may submit a proposition to the voters to repeal, amend, or enact an ordinance.4 The election on such measures can be held during the general municipal election or at a special election, including any established statewide election. 5 When the City Council
submits a measure to the electorate, whether the proposed legislation is adopted depends upon the results of the election.6 The proposed ordinance approving fireworks would be adopted if the measure were approved by at least 50% of the voter. 7 It would become effective ten days

A PROFESSIONAL CORPORATION OAKLAND LOS ANGELES SACRAMENTO SANTA ROSA SAN DIEGO after the results of the election are certified.8 A copy of the ordinance would be provided to any voter upon request or could be published in full in the voter information guide, or both. 9 A City-sponsored ballot measure empowers voters to decide whether to enact a proposed ordinance. Staff and the City Council would be responsible for drafting a proposed fireworks ordinance, but once submitted to the voters, the City Council would not be able to re-draft it, and if voters approved the measure, the ordinance would be adopted and go into effect.10
2. Advisory Measures
Alternatively, the City Council may submit an “advisory measure” to the electorate.11 The advisory vote can be held on the date of a regular or special election.12 In addition, the ballot must clearly indicate that it is an advisory vote.13 These types of measures only ask the electorate a question and do not legally bind the Council to the result. 14 The topics for advisory
measures include almost any relevant topic, so long as the measure is clearly labeled as “advisory.” A proposed ordinance for safe and sane fireworks may accompany the advisory measure, allowing voters to review it. For example, an advisory measure may contain the following question:
“ADVISORY VOTE ONLY
Should the City of Cloverdale Adopt an Ordinance to Amend Chapter ___ of the Cloverdale Municipal Code to Allow the Sale, Use, and Possession of Fireworks?”
Advisory measures give the City Council information about the views of voters but leave it to the City Council the choice of how to proceed based on how the vote unfolds.
3. Council-Generated Ballot Measure Requirements
The City Council may place a measure on the ballot by taking the following actions:
8 Id.
9 Id. at § 9223.
10 The text of the ordinance itself may, however, empower the City Council to make minor amendments to address administrative issues, so long as the changes do not undermine the purposes of the ordinance as enacted by voters.

1. File a resolution calling the election and containing the question that will appear on the ballot. The resolution may request Consolidation of the Election with an established election The resolution must be adopted at least 88 days before the established election date. 15 The
resolution calling the election must contain a ballot question of no more than 75 words.
Although the legal requirement is 88 days before the election, if the election is consolidated, the County usually has their own calendar and would require additional days.
2. The resolution may direct the City Attorney to prepare an impartial analysis of the measure.
3. The resolution may authorize up to two members of the City Council to file an argument in favor of the measure, and a rebuttal argument, if an argument is submitted against the measure.
16 4. The resolution would direct the City Clerk to publish a synopsis of the measure in the manner for publication and in the form provided for in the Elections Code.17 C. Election Options and Costs
1. Consolidation
The next General Municipal Election will be held on November 8, 2022, which is also a Statewide General Election. The City may request the Sonoma County Board of Supervisors to consolidate the measure with the Statewide General Election. The City would be sharing the ballot with multiple state, county, and other local agencies. The Registrar of Voters’ estimate to add a measure to this ballot is $1.50-$2.50/voter. This must be done by August 13, 2022 (may be sooner, depending on County election schedule).
Further, the City can consolidate a measure with the Statewide Gubernatorial Primary election on June 7, 2022. Costs for this would be $2-$3.50/voter. The City would need to call the election by March 12, 2022 for it to be on this ballot (may be sooner, depending on the County election schedule).
The Election Code also permits the City to submit a measure to voters at mailed ballot elections, which would be held only on May 3rd and August 2nd of this year. However, a fireworks measure would not qualify for these elections because they are limited to “a special election to fill a vacancy in the legislative body or governing body” for a city the size of Cloverdale.18

2. Special Election
A stand-alone Special Election may be held on any date as long as it is held at least 88 days after the City Council adopts a resolution calling for the election. The City has two options to conduct a stand-alone Special Election: request the County hold it or hire a consultant. The County Registrar of Voters’ cost estimate for a Special Election varies drastically based on the date it is held. For example, a Special Election held in September or December of this year would involve significant overtime costs charged to the City because of the existing General Election in November. Further, the County has no obligation to hold a Special Election for the City. If the County declines and the City still wants to hold a Special Election, then a consultant would need to be hired to conduct the election.
In addition, there are limitations on the number of times a measure can be brought through a Special Election. California Elections Code section 9218 states, “[a]ny number of proposed ordinances may be voted upon at the same election, but the same subject matter shall not be voted upon twice within any 12-month period at a Special Election under the provisions of this article.” This rule applies only to Special Elections held within 12 months of each other and not to a special election followed by a regular election on the same subject matter held within 12 months of each other.

In addition, the vote may be held during a stand-alone Special Election, or the vote can be consolidated with one of the upcoming established elections identified above. the City Council must adopt a resolution for an election on the measure at least 88 days before the election. Finally, the Council also has the option of studying the matter further and taking no action at this time.
