Approve a one-time increase in the leak adjustment from $250.00 to $876.02 for 177 Cherry Creek Ct. ________________________________________________________________________________________ Recommended Council Action(s):

By motion of the City Council of the City of Cloverdale approve a one-time increase in the leak adjustment from $250.00 to $876.02 for 177 Cherry Creek Ct.
________________________________________________________________________________________ Background:

On April 5, 2023 there was a leak on the City’s water main located within an utility easement adjacent to Cherry Creek Court. Concurrently, there was a leak in the private water line serving the residence at 177 Cherry Creek Ct. When the property owner reported the leak to the City, he was advised by City staff that there was leak on the City’s water main and that the City was scheduling its repair. It was later discovered that there were two simultaneous leaks, one on the City’s side and one on the owner’s side. ________________________________________________________________________________________ Summary:

The property owner for 177 Cherry Creek did not immediately address the leaks on his property as it appeared that was on the City’s side of the water line and that it was being corrected. The property owner received a bill for 314 units of water for a total cost of $1,752.03. He requested that the City provide relief on his water bill. Because of the confusion over the water leak, the owner asked the City to split the cost of the water over the normal usage. The owner’s average usage is 5 units of water monthly and the City’s leak adjustment policy allows for a maximum of $250. City staff calculated that a 50/50 cost allocation would require a leak adjustment of $876.02.
________________________________________________________________________________________ Options:

1. Deny the request; or

2. Provide alternative direction to City staff.
________________________________________________________________________________________ Subcommittee Recommendation:

The Finance Administration and Police Subcommittee reviewed the customer’s leak information and recommended increasing the maximum leak adjustment of $250 to $876.02 on a one time basis, with the approval of the full City Council.
________________________________________________________________________________________ Budget/Financial Impact:

A reduction in Water Enterprise revenue in the amount of $876.02 ________________________________________________________________________________________ Attachments:

Minor Construction Agreement with Fitzgerald Painting for the City of Cloverdale City Hall Exterior Painting and Cloverdale Police Department Interior Painting Projects ________________________________________________________________________________________ Recommended Council Action(s):

Adopt A Resolution Entitled, “A Resolution Of The City Council Of The City Of Cloverdale Approving A Minor Construction Agreement With Fitzgerald Decorating And Painting For Exterior Prep And Painting Of City Of Cloverdale City Hall Building Exterior And Interior Prep And Painting Of The Cloverdale Police Station Interior And Budget Amendment In The Amount Of $31,714.10.”
________________________________________________________________________________________ Background:

Cloverdale City Hall building has not been painted or have any type exterior reconditioning in over 30 years.

The stucco building exterior is cracking and the paint is significantly faded. Recently staff has uncovered cases of moisture penetrating through the exterior wall into the interior sheet rock if City Hall. Recoating and fixing cracks in the exterior of the building followed by the application of new paint will help prevent any further moisture damage to the interior of the building and improved look of the exterior facade.

The recent upgrade to LED light fixtures in the City of Cloverdale Police Department during the City of Cloverdale PG&E Turn Key Program resulted in the exposure of previously unpainted areas in the ceiling and exposed holes in the ceiling sheetrock used for the mounting of the removed light fixtures. ________________________________________________________________________________________ Summary:

Fitzgerald Decorating and Painting provided two scopes of work as follows:

Exterior Painting of Cloverdale City Hall:

Clean and prep all exterior walls of the Cloverdale City Hall building, seal all exterior cracks, and paint the building with Elastomeric paint in up to a 3-color scheme.

Cost Proposal: $22,956.00
Interior Painting of Cloverdale Police Station
Fitzgerald Decorating and Painting will fill all holes clean and prep all unpainted ceiling areas of the Cloverdale Police department. Apply paint in all unpainted areas to match existing color.

Cost proposal: $5,875.00
Staff recommends establishing a total project budget in the amount of $31.714.10 consisting of $28,831.00.00 plus a 10% contingency amount of $2,883.10. The proposed painting projects were not included in the budget and therefore a budget amendment is necessary to provide funding for the project. 14 City Council/Successor Agency Agenda Item Summary

In accordance with City of Cloverdale Municipal Code Chapter 8.16, entitled “Weed Abatement”, the City Council adopted Resolution No. 061-2023 on July 26, 2023, which declared that weed conditions at certain properties within the City of Cloverdale constituted a public nuisance and approved removal of the weeds from those properties.

The resolution set out a general description of such weeds and their locations and fixed this date, time and place for the hearing of any objections to the proposed destruction or removal of such weeds by the City.

After adoption of Resolution No. 061-2023, the City Clerk prepared and distributed a Notice to Destroy Weeds to property owners at their last known address according to the latest assessor’s roll, pursuant to Municipal Code section 8.16.050. The properties identified as being out of compliance with Municipal Code Chapter 8.16 were as follows:

At the Public Hearing, the City Council is requested to hear and consider all objections to the proposed 19 2/2
destruction and removal of such weeds. The Council, by motion, may allow or overrule any or all objections, whereupon the City Council may thereupon be deemed to have acquired jurisdiction to proceed and perform the work of weed removal, and the decision of the Council on the matter shall be deemed final and conclusive.

As of August 15, 2023, the Community Development Department has confirmed that weeds have been removed from most of the sites except for two. As such no further action is required for the properties that have removed the weeds.

Regarding the remaining parcels yet to remove the weeds (see below), as a separate action, the Council may by resolution order the abatement of such nuisance or cause the same to be abated by having the weeds destroyed by any method. The resolution also gives the authority to enter onto private property. An owner can destroy the weeds any time prior to the time of destruction and avoid having the costs assessed on the property.

Options

1. Hold the hearing, by motion overrule any and all objections, and then move for approval to adopt the Resolution by title only.

2. Hold the hearing, by motion allow any or all objections, provide direction to staff, and continue the hearing to a date certain if deemed necessary.

Budget/Financial Impact
The City of Cloverdale may incur expenses including staff costs associated with abating wees and associated nuisances on certain properties. Expenses including weed abatement and incidental administrative costs shall constitute a lien and may be assessed upon the properties subject to abatement.

________________________________________________________________________________________ Background:

The City of Cloverdale is a member of the League of California Cities (“League”). Founded in 1898, the League is an association of California city officials who work together so that they may influence policy decisions that affect cities. The League provides legislative and ballot measure advocacy, legal advocacy, education, and advocates to defend and expand local control in the Legislature, at the ballot box and in the courts and through strategic outreach to the public, policymakers and opinion leaders. The League of California Cities Annual Conference & Expo is an important event for city officials to learn and collaborate on solutions to common challenges.

Each year, the League holds a conference at which delegates from across the State come together to enhance their knowledge and skills, exchange information, and combined resources. Cal Cities 2022 Annual Conference & Expo is scheduled to be held Wednesday, September 7, 2022 through Friday, September 9, 2022 in Long Beach at the Long Beach Convention Center. ________________________________________________________________________________________ Summary:

Cal Cities (League) requires the names of each jurisdiction’s delegate and alternate by no later than Wednesday, August 31, 2022 in order to allow the League’s office to establish voting delegate/alternate records prior to the conference. Consistent with the League bylaws, the City’s voting delegate and alternate must be designated by the City Council. The voting delegate and alternate must be registered to attend the conference. At least one must be present at the Business Meeting and in possession of the voting card in order to cast a vote. The Council may also appoint up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity.

The purpose of this agenda item is to appoint Cloverdale’s voting delegate for the 2022 League Annual Business Meeting. Cloverdale may appoint one voting delegate and up to two alternate voting delegates.

The Council is not required to have a representative attend the conference. Therefore, in the event that there will be no Council representation during the Annual Conference, no action is required. ________________________________________________________________________________________ 24 City Council/Successor Agency Agenda Item Summary

1. Voting Delegate Packet
25 1400 K Street, Suite 400, Sacramento, CA 95814 • 916.658.8200 • calcities.org DATE: Wednesday, June 21, 2023
TO: Mayors, Council Members, City Clerks, and City Managers RE: DESIGNATION OF VOTING DELEGATES AND ALTERNATES
League of California Cities Annual Conference and Expo, Sept. 20-22, 2023, Sacramento SAFE Credit Union Convention Center
Every year, the League of California Cities convenes a member-driven General Assembly at the Cal Cities Annual Conference and Expo. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy.

Taking place on Sept. 22, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions.

To cast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official.

Please complete the attached voting delegate form and email it to Cal Cities office no later than Monday, August 28.

New this year, we will host a pre-conference information session for voting delegates to explain their role. Submitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide preconference communications with voting delegates.

Please view Cal Cities’ event and meeting policy in advance of the conference.

Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. When completing the attached Voting Delegate form, please attach either a copy of the council resolution that reflects the council action taken or have your city clerk or mayor sign the form affirming that the names provided are those selected by the city council.

Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone.

Council Action Advised by August 28, 2023
26 Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website.

For a city to cast a vote, one voter must be present at the General Assembly and in possession of the voting delegate card and voting tool. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the voting delegate desk. This will enable them to receive the special sticker on their name badges that will admit the voting delegate into the voting area during the General Assembly.

Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official.

Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. Admission to the voting area will be limited to the individual in possession of the voting card and with a special sticker on their name badge identifying them as a voting delegate.

The voting delegate desk, located in the conference registration area of the SAFE Credit Union Convention Center in Sacramento, will be open at the following times:

Wednesday, Sept. 20, 8:00 a.m.- 6:00 p.m. and Thursday, Sept. 21, 7:30 a.m.- 4:00 p.m. On Friday, Sept. 22, the voting delegate desk will be open at the General Assembly, starting at 7:30 a.m., but will be closed during roll calls and voting.

The voting procedures that will be used at the conference are attached to this memo.

Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.

Once again, thank you for completing the voting delegate and alternate form and returning it to Cal Cities office by Monday, Aug. 28. If you have questions, please contact Zach Seals at [email protected].

29 Sixty days before the
Annual Conference and
Expo, Cal Cities members
may submit policy
proposals on issues of
importance to cities. The
resolution must have the concurrence
of at least five additional member cities
or individual members.

How it works: Cal Cities
Resolutions and the General Assembly
General Assembly
General Resolutions
Policy Committees
Developing League of California Cities policy is a dynamic process that engages a wide range of members to ensure that we are representing California cities with one voice. These policies directly guide Cal Cities advocacy to promote local decision-making, and lobby against statewide policy that erodes local control.

The resolutions process and General Assembly is one way that city officials can directly participate in the development of Cal Cities policy. If a resolution is approved at the General Assembly, it becomes official Cal Cities policy. Here’s how Resolutions and the General Assembly works.

The petitioned resolution
is an alternate method
to introduce policy
proposals during the
annual conference. The
petition must be signed by
voting delegates from 10% of member
cities, and submitted to the Cal Cities
President at least 24 hours before the
beginning of the General Assembly.

Petitioned Resolutions
The Cal Cities President
assigns general resolutions
to policy committees where
members review, debate,
and recommend positions for
each policy proposal. Recommendations are
forwarded to the Resolutions Committee.

Who’s who
The Resolutions
Committee includes
representatives from
each Cal Cities diversity
caucus, regional
division, municipal
department, policy
committee, as well as
individuals appointed by
the Cal Cities president.

Voting delegates
are appointed by each
member city; every city
has one voting delegate.

The General Assembly
is a meeting of the
collective body of
all voting delegates —
one from every
member city.

Seven Policy
Committees meet
throughout the year to
review and recommend
positions to take on
bills and regulatory
proposals. Policy
committees include
members from each Cal
Cities diversity caucus,
regional division,
municipal department,
as well as individuals
appointed by the Cal
Cities president.

During the General Assembly, voting delegates
debate and consider general and petitioned
resolutions forwarded by the Resolutions Committee.

Potential Cal Cities bylaws amendments are also
considered at this meeting.

Cal Cities policy
development is a
member-informed
process, grounded
in the voices and
experiences of city
officials throughout
the state.

For more information visit www.calcities.org/general-assembly Prior to the Annual Conference and Expo
Resolutions Committee
The Resolutions Committee
considers all resolutions.

General Resolutions approved1
by either a policy committee
or the Resolutions Committee
are next considered by the General
Assembly. General resolutions not approved,
or referred for further study by both a policy
committee and the Resolutions Committee
do not go the General Assembly. All
Petitioned Resolutions are considered by the
General Assembly, unless disqualified.2
• Voting delegates will receive increased communications to prepare them for their role during the General Assembly.
• The General Assembly will take place earlier to allow more time for debate and discussion.
• Improvements to the General Assembly process will make it easier for voting delegates to discuss and debate resolutions.

To Whom It May Concern:

As the Mayor of Cloverdale, I am honored to write this letter of support for the La Familia Sana proposal for the Community Resilience Hub with the California Strategic Growth Council. I understand that La Familia Sana is bridging the gaps both locally and on the county level through a collaborative effort. La Familia Sana is applying for the Planning grant independently and in collaboration with Sonoma County COAD to ensure that we have a strong connection to a county network when disasters strike. I support this vision and see this as a value add to Cloverdale and across Northern Sonoma County. We know that farmworkers, families, students and seniors, every member of our community, is affected by the changing climate. Wildfires damage property and structures. Wildfire smoke creates poor air quality. Volatile water levels delay or eliminate farm work days, reducing income opportunities for farmworkers. The ongoing threats of increased heat waves, drought, wildfire and floods are daunting and add stress and reduce wellness physically and emotionally.

La Familia Sana is committed to sustainably improving the health and wellness of underserved communities through empowerment, education, direct support services and advocacy. They partner to co-create equitable and culturally cognizant solutions with community members to address long-term needs for healthcare, jobs, food, and education in our community. A vision of community Resilience Center aligns with our mission to support all residents of Cloverdale.

We understand that, through this project, Cloverdale will have opportunities to contribute our knowledge of the needs of the community we represent and support partnerships with other community leaders and science and resilience experts to craft a regional resilience plan that integrates the needs of all parties, especially the most vulnerable ones.

With regards,
