PUBLIC COMMENT FOR
SEPTEMBER 3, 2024, COUNCIL

MEETING
1 Robin DiFalco
227 Baron Ave. Clovis CA 93612

9/2/24
City of Clovis Mayor and Council Members,
Attn: Liz Salazar, Assistant Planner
City of Clovis 1033 Fifth Street, Clovis CA 93612
RE: General Plan Amendment/Rezone of Osmun/Baron property. a. Consider Approval - Res. 24-_ General Plan Amendment 2024-004, A resolution approving a CEQA exemption from further environmental review and an amendment to the General Plan to re- designate the subject property from the Medium Density Residential (4.1-7.0 dwelling units per acre) designation to the Medium High Density Residential (7.1-20 dwelling units per acre) designation. b. Consider Introduction - Ord. 24-Rezone 2024-003, An ordinance rezoning the subject property from the R-1 (Single-Family Residential Low Density) Zone District to the R-2 (Multifamily Medium High Density) Zone District, associated with approximately 1.73 acres of land located along the east side of Osmun Avenue and the west side of Baron Avenue, north of Second Street.

Dear Ms. Salazar and City Council Members,
As a homeowner in Old Town Clovis (OTC), I would like to offer my written comments as requested regarding above named proposed project, proposed amendment, and proposed rezoning. I live on Baron Ave in a home that is over a 100-year-old, and I specifically sought out a small historic home in OTC. Nowhere else in Clovis can you find old historic homes/buildings.

Old Town Clovis is uniquely situated at the base of the Serra Nevada's and Old Town is at the heart of Clovis with a hub of events, neighborhoods and businesses. It is our responsibility to preserve and guard the heart of Clovis... Old Town. As you think about Old Town as the heart of Clovis and preservation, I ask the Council to pause and consider conditionally approving this general plan amendment/rezone contingent on this project. In requesting to conditionally approve the general plan amendment and rezone for this multi-family senior housing development project with this specific project/developer we guard Old Town. My fear is this, the property gets rezoned, and this project falls thru. Then we have a property that has been rezoned and I end up with an 8-story high-rise building in my backyard. Please tie the rezoning directly to this project.

A blanket change to the general plan and rezone as before you would not preserve the authenticity of Old Town and our neighborhood as not all projects are the right fit for each area. As the prior project/developer was not the right fit. I believe the current project presented by from Clovis 135 Osmun, LP, to develop a multi-family senior housing development is a fit for the area and serves a great need in our community. Although I do wish it was single story and smaller, the project is needed in our community. This project and developer seem to be a better fit and not necessarily any other project. By approving the general plan amendment/rezone as presented then if the multi-family senior housing development did not come to fruition as planned then any other project can come in, as the general plan/rezone would have been potentially approved.

I respectfully ask you to be open to change and to consider conditional approval of the general plan amendment/rezone contingent on the multi-family senior housing development as presented by Clovis 135 Osmun, LP.

Thank you for providing an opportunity for residents to express their serious concerns over this proposed project.

Sincerely.

Comment: The dirt road connecting Winery Ave and Shaw, there used to be a sidewalk there that was removed a few years ago. When I emailed city council they said the developer would restore the sidewalk when they developed the area. Even without the sidewalk this dirt path receives a decent amount of foot traffic, and provides the neighborhood with important access to nearby businesses and stores. Due to how bad traffic can get on Shaw, walking using this path is often faster than driving. Will restoring the sidewalk be a part of this development?

Mason, Thank you for the inquiry. The site is being master planned and residential pathway through the site is planned. No details at this point but it would likely not be in the exact location of the current dirt path.

Dear Honorable Clovis City Councilmembers,
The Fresno County Tobacco-Free Coalition is a network of diverse agencies and motivated community members and we, are dedicated to reducing the use of and exposure to current and emerging tobacco industry products through health education, tobacco cessation referrals, and omotion or smoke-tree policies and environmental change. We appreciate and commend ti lovis City Council's commitment to protecting the health of Clovis youth and community t adopting a tobacco retailer licensing ordinance.

The tobacco industry has a long history of targeting communities that have been historically disenfranchised. With this tobacco retailer licensing ordinance, residents of the City of Clovis are further protected from the predatory tactics of the tobacco industry. In 2018, the United States Surgeon General declared youth vaping to be an epidemic, so it is policies such as this that help reduce youth access to these dangerous products, which means fewer young people will be impacted by vaping-related illnesses and issues.

This policy provides Clovis retailers with clearer guidelines on the sale of tobacco products in lieu of the California's Flavored Tobacco Product ban and other statewide tobacco sale regulations. It also protects businesses and livelihoods by ensuring all tobacco retailers adhere to state and local laws. By maintaining high standards for licensing, the ordinance supports the stability and success of local businesses while protecting the community's health and well-being.

Thank you and your staff for prioritizing the health of our communities, and for further cultivating healthier, and more responsible retail environments. Please contact us at [email protected] with any comments or questions.

Sincerely,

Comment: This is in regards to the Clovis Round Up the system that they have to me as a writer is not great service numerous of times the bus would pick me up and I'd be on the bus for an hour to an hour 15 minutes before drop off and I would make prior arrangements 24 hours in advance and always be late at least 30 to 45 minutes to each appointment which appointments are being Considered as no-shows so therefore I'm having to pay a $25 fine not only that I have to wait another 45 minutes for us to come back and pick me up. So therefore I'm having to pay $25 fine. Not only that I would use the app and type my Destination and once I press select request the ride it then minties later it stating A different drop off location. So l come to you today with A suggestion advice that maybe Round Up should update their system, have certain buses make just for appointments only which I believe are very important to then have, and buses that are called on demand separate. And the last five month I have not yet made it to any appointment on time or picked up in a proper manner. There's always a delay or I'm passing my house twice before I get dropped off or forgotten. I'm very grateful for the Round Up and a truly blessing and appreciate the city of Clovis for it, but do wish that this addressed thank you for your time

Comment: Request for Recognition of American Legion Baseball California State Champs at City Council Founded in 1925, American Legion Baseball has taught hundreds of thousands of young Americans the importance of sportsmanship, good health and active citizenship. The program is also a promoter of equality, making teammates out of young athletes regardless of their income levels or social standings.

American Legion Baseball has been, and continues to be, a stepping stone to manhood for millions of young men who have gone on to serve their country or community, raise families or play the sport at the highest level.

The Clovis Nighthawk's were formed in 2021 and are Sponsored by Cecil Cox Post 147 located in downtown Clovis. At this year's California American Legion Baseball Championship Tournament the Clovis Night Hawks took the State Title with an impressive 5-1 Record which included 2 shutouts, one of which was a no hitter. The annual State Championship American Legion Baseball Tournament was played between 25 to 29 July 2024 at Chapman College in Orange, CA. By any standard, this tournament was a resounding success. Eight teams competed for the title of State Champion in a double elimination tournament. The Clovis Night Hawks emerged victorious in a dramatic winner-take-all finale against the El Segundo Velocity. The Night Hawks went on to play in the Western Regional Tournament against the State Champions for Arizona, Hawaii, Nevada, New Mexico, Texas and Utah. The Night Hawks placed 3rd in this Tournament with the Texas taking the Regional Championship.

Subject: RE: [External] Public Comment for City Council Gordon,
The minimum for residential services (base rate for water, sewer, refuse, recycling, greenwaste, and street sweeping) with zero consumption is roughly $150. So the customers saying that their previous bills were lower than that would only happen for a couple of reasons:

1. They had paid extra in a previous period and thus had a credit that applied to their current bill

2. They had their deposit applied on the previous bill, which caused it to be lower. We did apply a lot of deposits in May as part of the cleanup process for the transition, so those bills likely were lower for many customers.

Unfortunately, without knowing the specific customer's situation, We can't say definitively why the balances were different. But the rates for service are the same for residential customers.

I hope this helps. Feel to reach out with any questions.

Comment: The Clovis Finance Department posted on Nextdoor.com about the updated utility billing system. That generated several comments from the residents on the reason for their bill increase. A couple of residents posted their previous bill was $100 or below and now has increased ~$50. This puzzled me because street sweeping, refuse, greenwaste, recycling pickup and sewer total about $128.

My question to the City Council is are these costs the same for all residents? Supporting Files (2 Max.):

Good evening,
Can you please share the results of your evaluation?
Yesterday, a neighbor reported that a pickup truck pulled up to his house and a stranger from the truck stole two potted plants from the porch before the truck sped away. The home's security camera recorded the incident and the footage was turned over to the police. Unfortunately, the license plate in the video was not recognizable.

Radar speed signs would have helped identify these criminals.

Thank you,

Email Message from Clovis (Gene Abella) - 06/28/2024 07:24 AM We placed a radar counter on Preuss Avenue last week, and picked it up yesterday. We will evaluate the data and provide the results and our evaluation to you and the Police Department.

Dear Gene,
Thank you for your prompt response and attention to this matter.

Radar speed signs reduce speeding incidents by 80%. I believe this is important to consider because our residents include many families with young children whose safety is the top priority.

Please keep me updated on the progress.

Thanks again,
Vita Kononov

Email Message from Clovis (Gene Abella) - 05/21/2024 2:40 PM Vita,
Thank you for your request. This is primarily an enforcement issue that should be coordinated with the Police Department. Per California Vehicle Code 22352(b)(1), the prima facie speed limit for a residence district is 25 miles per hour. With prima facie speeds, we typically do not post speed limit signs. There are situations in residence districts where speed limit signs have been posted. The Engineering Division will investigate your concern further to see if enforcement alone is inadequate. We will do so by putting up speed detectors and monitor Bloom Avenue and North Press Avenue for a period of time (typically a week). The detectors are currently being used, so it may take a few weeks to put up them up.

Note that we typically do not install and maintain Radar Speed Signs, so we may not be able to install them in your neighborhood. I will speak with City staff to verify.

Let me know through this request if you have any further questions or clarifications.

Gene G. Abella, P.E.

Civil Engineer
