7 AGENDA ITEM NO. 2.
TO: Mayor and City Council
FROM: Administration
DATE: January 13, 2025
SUBJECT: Workshop – Discussion on the potential transition of the City of Clovis to a Charter City.
Staff: Briana Parra, City Clerk
Recommendation: Provide Direction
ATTACHMENTS: None.
RECOMMENDATION
Staff recommends that the City Council provide direction on whether to proceed with drafting a charter for the City of Clovis. If the Council chooses to move forward, staff will create a detailed timeline, begin the drafting process, and schedule the requi red public hearings to comply with statutory requirements and promote community engagement.
EXECUTIVE SUMMARY
In May 2024, the City Council provided direction to staff to explore the potential for the City of Clovis to transition to a charter city. Since receiving this direction, staff has conducted research on the charter city process, focusing on the statutory requirements and key steps involved.
These steps include drafting a charter, conducting public hearings, and ensuring compliance with all legal requirements.
Staff is requesting Council direction on whether to continue as a General Law City or move forward with drafting a charter. If the Council decides to initiate the process, staff will develop a detailed timeline and schedule public hearings to promote community engagement and ensure compliance with state law. This approach will provide both the Council and the community with an opportunity to thoroughly review and evaluate the proposed charter ahead of the November 2026 election.
BACKGROUND
In May 2024, the City Council directed staff to explore the potential transition of the City of Clovis, currently a general law city, to a charter city. A charter city serves as a foundational legal 8 AGENDA ITEM NO. 3.
document that defines a city's structure, powers, and gover nance, offering some flexibility in local control over certain governance areas compared to the current general law city structure.
Staff will provide the Council with an overview of key areas impacted by this transition, including elections, prevailing wages, land use, and penalties and cost recovery. These areas may provide the city with more authority to tailor local policies and pr actices, potentially benefiting the city’s operations and flexibility.
This information will help the Council determine whether to proceed with drafting a city charter, with the goal of placing the proposal on the November 2026 Election ballot.
FISCAL IMPACT
None.
REASON FOR RECOMMENDATION
Staff is seeking direction from Council r egarding the next steps for pursuing the charter city process. The two options for consideration are:
1. Remain General Law City
Or
2. Continue research on areas of interest for charter implementation with the goal of placing a charter on the November 2026 ballot.
ACTIONS FOLLOWING APPROVAL
If the City Council decides to move forward with the charter, staff will initiate the drafting process, develop a timeline, and schedule the required public hearings. Additionally, staff will ensure compliance with statutory requirements and begin outreach efforts to inform the community in preparation for placing the charter on the November 2026 Election ballot.
CONFLICT OF INTEREST
None.
