36 AGENDA ITEM NO. 4.

TO: Mayor and City Council
FROM: General Services
DATE: August 4, 2025
SUBJECT: General Services – Approval – Res. 25-___, Authorizing the Execution of the Certifications and Assurances for the FY 2025 -26 California State Transit Assistance State of Good Repair (SGR) Program.

ATTACHMENTS: 1. Res. 25-___

RECOMMENDATION
For the City Council to approve a resolution authorizing the execution of the Certifications and Assurances for the FY 2025-26 California State of Good Repair (SGR) Program.

EXECUTIVE SUMMARY
The City of Clovis is eligible for $2 49,115 in FY 202 5-26 Senate Bill 1 State of Good Repair (SGR) grant funding for capital assistance to rehabilitate and modernize local transit systems.

Council approval and a resolution are required by the California Department of Transportation to secure the grant funding. The grant also requires the recipients to submit a list of projects to secure quarterly allocations of funds. A list of projects has been created , which includes the replacement of transit vehicles that have exceeded their useful life and are long overdue f or replacement. Allocation of these funds will be processed through the Fresno Council of Governments, utilizing the regular transit project planning process.

BACKGROUND
In 2017, Governor Jerry Brown signed Senate Bill 1 (SB1), known as the Road Repair an d Accountability Act of 2017. A portion of SB 1 will provide funds to approved transit operators in California for eligible transit maintenance, rehabilitation, and capital projects. This portion is referred to as the State of Good Repair (SGR) Program. SG R funds will be made available for capital projects that maintain the public transit system in a state of good repair.

The SGR Program is funded from a portion of the Transportation Improvement Fee on vehicle registration. These funds will be allocated to eligible agencies under the State Transit Assistance (STA) program formula. As an STA eligible agency, Clovis Transit has been deemed eligible for SGR funding and has been listed on the State Controller’s Office SGR Allocation Letter.

37 AGENDA ITEM NO. 5.

The SGR grant is for eligible projects that fall under the following categories:

1. Transit Capital projects or services to maintain or repair transit operators’ existing transit vehicle fleet or transit facilities, including the rehabilitation or modernization of the existing vehicles or facilities.

2. The design, acquisition, and construction of new vehicles or facilities that improve existing transit services.

3. Transit services that complement local efforts for the repair and improvement of local transportation infrastructure.

Examples of qualifying projects include:

1. Replacement or rehabilitation of:
a. Rolling Stock
b. Passenger stations and terminals
c. Security equipment and systems
d. Maintenance facilities and equipment
e. Ferry vessels
f. Rail

2. Preventative Maintenance

3. New maintenance facilities or maintenance equipment if needed to maintain the existing transit service.

The Clovis Transit project list is eligible because it includes replacing outdated rolling stock. The California Department of Transportation requires a resolution from the Clovis City Council approving the application for the FY 2025 -26 funding year. The City of Clovis resolution will be forwarded upon approval.

FISCAL IMPACT
Funding in the amount of $2 49,115 for FY 2025 -26 will be allocated to the C ity of Clovis in quarterly disbursements. SB 1 SGR funds can be rolled over for a maximum of four (4) years to accumulate the dollar amount needed to complete the approved projects. FY 2025-26 will provide funds needed to purchase vehicles.

REASON FOR RECOMMENDATION
The funds are available for transit agencies only and are intended to provide capital assistance to rehabilitate and modernize local systems. Clovis Transit is an eligible recipient of funds and expects benefits for its fleet, transit staff, and other city staff.

38 AGENDA ITEM NO. 5.

ACTIONS FOLLOWING APPROVAL
A copy of the resolution will be submitted to the Fresno Council of Governments . Once funds are received and accumulated to the necessary level, transit staff will follow the regular procurement process to purchase the vehicles.

40 AGENDA ITEM NO. 5.

TO: Mayor and City Council
FROM: General Services
DATE: August 4, 2025
SUBJECT: General Services - Approval to Waive the City’s Usual Purchasing Requirements and Authorize the City Manager to Approve the Purchase of Five (5) FrontRunner Minibuses and Five (5) Class C – Ford E450 Cutaway Buses for a total cost of $2,066,921.15 Utilizing the California Association for Cooperative Transportation (CalACT) Competitive Bid Award.

ATTACHMENTS: 1. Vehicle Quote – Davey Coach Turtletop

2. Vehicle Quote – Davey Coach New England Wheels

RECOMMENDATION
For the City Council to waive the usual purchasing requirements and authorize the City Manager to approve the purchase of five (5) FrontRunner Minibuses and five (5) Class C – Ford E450 Cutaway Buses for $ 2,066,921.15 utilizing the California Association for Coordinated Transportation (CalACT) competitive bid award.

EXECUTIVE SUMMARY
Staff recommends the purchase of five (5) FrontRunner Minibuses and five (5) Class C – Ford E450 Cutaway Buses through Davey Coach. These vehicles will serve as both replacements and additions to the existing fleet for Clovis Transit’s Round Up and Stageline services. The purchase wil l enhance the delivery of transportation for passengers utilizing paratransit and fixed-route services. The cost of the five (5) FrontRunners is $1,190,702.90 and the cost of the five (5) Class C – Ford E450 is $876,218.25.

The total amount requested for approval is $ 2,066,921.15, which aligns with the amount approved for vehicle replacement by the Federal Transit Administration (FTA). Costs associated with the vehicles will be covered through a combination of FTA Sections 5307 and 5339 funds and Transportation Development Credits (TDCs). Clovis Transit’s use of the CalACT bid is within the City of Clovis Purchasing Policy, Section IV, C, 1, b, (1).

BACKGROUND
Clovis Transit will be purchasing replacement and additional vehicles to support our growing community, to meet the increasing demand for paratransit and fixed -route services, and to accommodate our upcoming fixed-route redesign.
41 AGENDA ITEM NO. 6.

In 2010, following the end of the Caltrans purchasing cooperative, CalACT created a purchasing cooperative administered by Basin Transit Authority to assist small and medium -sized transit agencies with vehicle procurements.

The CalACT purchasing cooperative awards bid positions in accordance with the Federal Transit Administration and California Department of Transpor tation regulations and has been audited by both agencies with no findings. The purchasing cooperative is also compliant with Buy America requirements. The purchase of transit vehicles requires technical expertise and a broad scope of knowledge of bus manufacturing concepts. By utilizing the cooperative and most recent agreement RFP No. 20 -01, Clovis Transit can purchase the vehicles our operation needs at a competitive cost for a 1.5% procurement fee.

Vehicle specifications and options were listed in the CalACT request for proposal and the vendor’s proposals. These specifications meet or exceed our transit operation’s desired vehicle design and capacity. The FrontRunner has a single-step curb height entrance to a true flat floor and is designed to hold up to fourteen (14) passengers or two (2) passengers using mobility devices. The Class C – Ford E450 has the capacity of twenty -one (21) passengers or fifteen (15) passengers with two (2) mobility devices.

FISCAL IMPACT
Federal Transit Administration (FTA) funds and Trans portation Development Credits (TDCs) held in the City’s Transit fund account for the purchase of t ransit vehicles. Vehicle purchases were included in the 2025/2026 fiscal year budget.

Pricing for the recommended purchase is as follows:

 Proposed five (5) FrontRunner Minibuses including options, tax, and procurement fee:
$1,190,702.90.
 Proposed five (5) Class C – Ford E450 including options, tax, and procurement fee:
$876,218.25.

Total Cost: $2,066,921.15

REASON FOR RECOMMENDATION
Two primary requirements guide the purchase of new vehicles:

 Several Clovis Transit vehicles have exceeded their useful life. The current fleet includes five (5) vehicles with an average mileage of 405,327 miles, with th e highest mileage reaching 496,483 miles.

 Due to the upcoming fixed-route redesign, Clovis Transit requires additional vehicles to accommodate the expansion from two (2) routes to eight (8) routes. The expansion of routes necessitates a substantial increase in the number of transit vehicles to support service needs.

42 AGENDA ITEM NO. 6.

ACTIONS FOLLOWING APPROVAL
Following approval, transit staff will prepare a purchase order for the City Manager’s approval , and vehicles will be ordered. Vehicles are expected to be delivered within six to eight months.

CONFLICT OF INTEREST
None.

For the City Council to accept the work performed as complete and authorize the recording of the notice of completion for this project.

EXECUTIVE SUMMARY
Staff is recommending that City Council accept the work performed by R.E. Schultz Construction, Inc., and authorize the recording of the notice of completion.

This was a maintenance project to address the deteriorated condition of the s urface material, safety issues, and resident concerns at Palmina Park by replacing the existing playground surface that was beyond repair and making the playground equipment fall zones safety compliant. The work consisted of the removal and installation of new pour-in-place surfacing, and the installation of a shade structure over the existing playground equipment.

BACKGROUND
Palmina Park was originally constructed in 2007. The park includes a playground area that utilizes rubber surfacing. The surfacing material aged significantly from the time of construction and the seams created large gaps between the concrete edge and surfacing due to poor initial installation. This project also included the installation of a new shade structure that is essential for safety and comfort for children and adults.

On November 4, 2024, City Council awarded the project contract to R.E. Schultz Construction, Inc., in the amount of $129,860.00. The project was completed in accordance with the construction documents, and the c ontractor has submitted a request for acceptance of the project.

TO: Mayor and City Council
FROM: Administration
DATE: August 4, 2025
SUBJECT: Consider Introduction – Ord. 25-___, Adding Chapter 5.37 to Title 5, of the Clovis Municipal Code, Prohibiting the Unlawful Possession of Detached Catalytic Converters.

Staff: Matthew M. Lear, Deputy City Attorney
Recommendation: Approve

ATTACHMENTS: 1. Ord. 25-___

RECOMMENDATION
For the City Council to approve the introduction of Ordinance 25-__, adding Chapter 5.37 to Title 5, of the Clovis Municipal Code, prohibiting the unlawful possession of detached catalytic converters.

EXECUTIVE SUMMARY
Adoption of this Ordinance would provide the Clovis Police Department with additional to ols to combat the growing issue of catalytic converter theft within the City. The Ordinance will create a criminal and administrative penalty for the unlawful possession of detached catalytic converters in the City of Clovis. Anyone in possession of one or more detached catalytic converters will be required to demonstrate valid proof of ownership or be subject to fines and/or jail time.

BACKGROUND
In May of this year, the County of Fresno passed ordinances to address unlawful possession of detached catalytic converters. City of Fresno previously adopted a similar ordinance back in 2023. In June of 2025 the City Council directed staff to draft an ordinance consistent with those passed by the City and County of Fresno.

The Clovis Police Department has rep orted forty-four (44) catalytic converter thefts within the City of Clovis since June 1, 2023. Of those forty-four (44) incidents, nine (9) have occurred since June 1, 2025, raising serious concerns about public safety. In response, and in collaboration with the Clovis Police Department, a draft of the proposed ordinance is attached hereto. 86 AGENDA ITEM NO. 14.

The Ordinance specifically targets the unlawful possession of detached catalytic converters in the City of Clovis. Individuals such as registered auto dismantlers and core recyclers as defined under the Vehicle Code are considered as lawfully possessing and are considered to be in lawful possession of catalytic converters. Anyone else in possession of one or more detached catalytic converters will be required to demonstrate valid proof of ownership or be subject to fines or jail time. Violations may be enforced through the issuance of administrative citations or misdemeanor criminal prosecutions through the City Attorney’s office.

FISCAL IMPACT
None.

REASON FOR RECOMMENDATION
The City Council directed that the Ordinance be drafted in alignment with similar measures adopted by the City and County of Fresno, which prohibit the unlawful possession of detached catalytic converters. This Ordinance is consistent with thos e existing ordinances and provides the Clovis Police Department with additional enforcement tools to help deter and prevent catalytic converter theft within the City of Clovis.

ACTIONS FOLLOWING APPROVAL
This Ordinance shall go into effect and be in full force from and after thirty (30) days after its final passage and adoption.

ORDINANCE 25-__

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLOVIS ADDING CHAPTER 5.37 TO TITLE 5 OF THE CLOVIS MUNICIPAL CODE,

PROHIBITING THE UNLAWFUL POSSESSION OF DETACHED CATALYTIC

CONVERTERS

WHEREAS, the theft of catalytic converters has been an increasing problem within the City in recent years; and

WHEREAS, catalytic converters contain expensive precious metals including platinum, palladium, and rhodium, which range in value from $1,000 (platinum), $2,000 (palladium) and over $14,000 (rhodium) per ounce; and

WHEREAS, the average cost of replacing a stolen catalytic converter and repairing the damage to the vehicle may cost the victim between $1,000 to $3,000, or more; and

WHEREAS, individuals in possession of stolen catalytic converters often recycle them for substantial profit while victims of these thefts suffer the consequences of paying thousands of dollars for repairs, the inconvenience of repairing their vehicles, and feeling unsafe in the community; and

WHEREAS, catalytic converter thefts are a persistent problem because individuals are incentivized to commit catalytic converter thefts for multiple reasons including, but not limited to: (1) the ease and undet ectable nature of committing the thefts in a matter of minutes using common tools such as a reciprocating saw and (2) the ability to recycle catalytic converters at scrap metal yards for high dollar returns, and (3) the challenge of prosecuting criminals for catalytic converter theft where a victim cannot be identified; and

WHEREAS, finding the victim of these crimes is extremely difficult due to the manner in which the catalytic converter thefts occur and the lack of identifying markers on catalytic converters (prior to 2024 vehicle models) to link a stolen catalytic converter to the victim; and

WHEREAS, thieves typically strip off, burn off, or otherwise remove protective sheathing which contains information that identifies the lawful owner and source of the wires or cables; and

WHEREAS, there is currently no state or federal legislation applicable within City of Clovis requiring individuals to provide proof to law enforcement showing how they obtained detached catalytic converters, thus limiting law e nforcement’s ability to protect the public by deterring catalytic converter thefts; and

WHEREAS, this ordinance is necessary to provide the Clovis Police Department and the Clovis Code Enforcement Division with a means to protect the public, deter this criminal activity and promote a more productive use of City resources. 88 AGENDA ITEM NO. 14.
