User comment: Re agenda item 14, March 16, 2026, City Council meeting: Two competing proposals aim to replace the transportation funding provided by Measure C, but only one reflects the needs of a growing and changing region. The "Better Roads, Safe Streets" (Fresno County Transportation Improvement Act) proposal takes a forward-looking and holistic approach by investing not just in road maintenance but also in safer streets, expanded public transit, and transportation options that serve seniors, students, and working families across Fresno County. By contrast, "Fix Our Roads Fresno" largely limits its focus to patching potholes and basic road repair -- important tasks, but hardly a comprehensive transportation vision for the decades ahead. A modern county requires a balanced system that improves safety, reduces congestion, and expands mobility for everyone, not just drivers. "Better Roads, Safe Streets" recognizes that reality and offers a responsible, future-oriented plan that will keep the region moving while strengthening access, safety, and economic opportunity. It is encouraging to know that supporters of "Better Roads, Safe Streets" include Mayor Vong Mouanoutoua, Council Member Lynne Ashbeck, and many other county leaders.

User comment: 1 am in favor of Better Roads, Safe Streets Transportation measure to replace Measure C.
As an updated Measure C, it is not a new tax but continues the ½-cent sales tax, 30-year term. Allocates 65% to repair & maintenance of existing neighborhood roads; 25% to public transit; 4% to access & innovation; 5% to regional connectivity; 1% to administration & oversight. I * =

DATE ADOPTED: March 31, 2023
PURPOSE
To establish guidelines for the exhibition of the flag of the United States of America, the California State flag, and the City of Clovis flag at City Hall and all City facilities and City property.
POLICY
It is the policy of the City of Clovis that all City-owned, operated, or controlled flagpoles, stands, supports, or any other means by which flags may be temporarily or permanently affixed to City facilities or City property for display in public view at City Hall and all City facilities and City property ("City flag display resources") shall be used only to display the flag of the United States of America, the flag of the State of California, and the flag of the City of Clovis, unless otherwise authorized by a majority vote of the entire membership of the City Council at a duly noticed City Council meeting.
The display of flags in public view using City flag display resources at City Hall and all City facilities and City property is intended and shall be deemed to constitute the speech and/or expression of only the City and not any other person, organization, or entity. To that end, all City flag display resources, including without limitation flagpoles, stands, supports, or any other means by which flags may be displayed for public view at City Hall and all City facilities and City property are not intended and shall not be used to serve as a forum for free speech or expression by the public or anyone else other than the City of Clovis.
The City Manager or designee is responsible for ensuring the proper execution of this Policy.
It is the policy of the City of Clovis that City flag display resources shall be used only to display authorized flags in conformance with the Federal Flag Code (4 U.S.C.§ 1 et seq.), the State of California Government Code Section 430 et seq., and this Policy.
Administration Memorandum 23-01
March 31, 2023
STANDARDS
The following standards should be followed in displaying any flags authorized by this Policy.
1. The United States flag, the California State flag, and the City of Clovis flag may be displayed on separate poles or the same pole, with the following limitations:
a. Whether on the same pole or different poles, the Unites States flag shall always be flown in the highest position, with the State flag in the next highest position, and the City flag in the third highest position.
Where the United States flag and California State flag are used, they shall be of the same size.
c. No flag shall be placed to the right of the United States flag.
2. Weather permitting, flags should be displayed daily in front of or at a location near City Hall and all other public buildings belonging to the City of Clovis, including the Police Department and Fire Department, during regular business hours.
3. Flags should not be displayed in inclement weather. However, all-weather flags may be flown on a 24-hour basis as long as they are illuminated from sunset to sunrise.
4. Indoor City flags shall be displayed at a minimum in the City Council Chambers.
5. The United States flag may be flown at half-staff on Memorial Day, Peace Officers Memorial Day (unless it is also Armed Forces Day), Patriot Day (September 11), and upon order or proclamation of the President of the United States or the Governor of the State of California.
When the United States flag is flown at half-staff, all other flags shall be flown at half-staff to ensure the United States flag maintains the position of first honor. The City Manager may also order that the City flag be flown at half-staff in honor of the death of a current or former City official or current City employee killed in the line of duty, or other occasion(s) as he or she may deem appropriate.
This Policy may only be amended or repealed by the City Manager. If this Policy is approved by the City Council of the City of Clovis, then it may only be amended or repealed by a majority vote of the entire membership of the City Council at a duly noticed City Council meeting.

Email: Official Bid Protest Received March 13, 2026
RE: [EXTERNAL]: RE: Immediate Action Required Reservoir 4 Tank Liner Project No. CIP 25-17- Official Bid Protest
Hi Sarai,
Following up on our conversation, SoCal Pacific Construction Corp. dba National Coating & Lining Company (NCL) hereby submits this formal bid protest against the bid submitted by Polytech Industrial, Inc. ("Polytech") for the City of Clovis CIP 25-15 Reservoir 4 Tank Liner Project.
Our protest is based on the following material defects:
1. Licensing Ineligibility (Non-Responsive) The project specifications require major structural modifications to the reservoir. Per the California Contractors State License Board (CSLB), Polytech's C-33 (Painting and Decorating) specialty license is insufficient to act as the Prime Contractor for this scope of work.
A C-33 license is limited to surface preparation and coatings. Because this project entails structural and mechanical modifications, the Prime Contractor must hold a Class A (General Engineering) or Class B (General Building) license to legally oversee and subcontract those trades. Under California law, a bid that does not meet the mandatory licensing requirements at the time of the bid is non-responsive and must be rejected.
2. False Statements on Bidder Qualification Questionnaire (Not Responsible) Polytech knowingly provided a false answer to Question 6 of the Bidder Qualification Questionnaire, which asks if the firm has been denied a public works award based on a finding of "non- responsibility" in the last five years. Polytech marked "No." This is a material misrepresentation. Polytech was determined to be a non-responsible bidder on at least two recent California public works projects:
• East Niles Community Services District: 2.2 MG Freeway Tank Project (January 13, 2026).
• Town of Hillsborough: Skyfarm Tank No. 2 Interior Recoating (February 26, 2026).
A "non-responsible" finding by a public agency is a serious matter of record. By failing to disclose these findings, Polytech has provided false information to the City. Under the 1 Public Contract Code, a bidder who provides false or misleading information in their bid documents is, by definition, not a "responsible" bidder.
Due to these material defects-either of which independently requires disqualification— we request that the City find Polytech Industrial, Inc. to be non-responsive and non- responsible. We further request that the City award the contract to the lowest responsive and responsible bidder, SoCal Pacific Construction Corp. dba National Coating & Lining Company.
Given that this item is on the Monday, March 16th agenda, we request immediate confirmation that this protest has been received and will be provided to the City Council for their consideration prior to any vote.

Subject: Immediate Required Reservoir 4 Tank Liner Project No. CIP 25-17 Importance: High
Eric,
We are writing to follow up on our repeated requests over the past week for the bid tabulation and the bid package submitted by the apparent low bidder for the Reservoir 4 Tank Liner Project No. CIP 25-17.
We have been informed by you, Eric Oliver, that these records will not be released until the City Council meeting on March 16, 2026. Please be advised that withholding these documents is a direct violation of the California Public Records Act (Gov. Code § 7920.000 et seq.). Under Gov. Code § 7922.525, public records must be available for inspection at all times during office hours. There is no "Council Approval" exemption for bid documents that have already been publicly opened.
By withholding these records until the moment of the award, the City is effectively circumventing the public bid process and denying us our right to due process. Without access to these documents, we are unable to verify the responsiveness of the low bid or file a timely protest as permitted by the Public Contract Code.
Given the lack of transparency and the procedural irregularities regarding the handling of these public records, we formally request that the City Council reject all bids for this project pursuant to Public Contract Code $ 20166.
The City's intentional withholding of bid information creates an environment of perceived favoritism and prevents the fair, open competition required by California law. To ensure the integrity of the process and the proper expenditure of public funds, the City should re- advertise this project under conditions that comply with the CPRA 3 We demand that a digital copy of the apparent low bidder's full proposal be provided to us by 4:00 PM today. If the City proceeds with the award on March 16 without first providing these records and allowing for a reasonable review period, we will be forced to bring this matter directly to the City Council and explore all available legal remedies to stay the award.
We look forward to your prompt response.

4 sCity's Response to SoCal Pacific Construction Corp
RE: [EXTERNAL]: RE: Immediate Action Required Reservoir 4 Tank Liner Project No. CIP 25-17- Official Bid Protest
Matt,
City staff and the City Attorney's Office have duly reviewed and considered the bid protest submitted by SoCal Pacific Construction Corp. on March 13, 2026, and determined that each of the grounds identified in the protest lack merit to change the recommended action to the City Council.
1. It has been determined that Polytech's bid is consistent with CA Business and Professions Code section 7059, and a C-33 specialty license can serve as a prime contractor on this project in accordance with section 7059. A majority of the project work falls within the C-33 classification, and a subcontractor was appropriately listed in the subcontractor listing of Polytech's bid for work to be performed outside the C-33 classification that is beyond "incidental and supplemental" to the C-33 specialty classification. As a result, "licensing ineligibility" is not a ground to disqualify Polytech as a prime contractor or reject its bid as non-responsive.
2. Polytech has provided evidence directly refuting the contentions in the protest about previous non-responsibility determinations and a false statement on the Bidder Qualification Questionnaire for this project.
Accordingly, City staff intends to recommend award of the project to Polytech at tonight's City Council meeting.
We appreciate your interest in this project.

Hi Sarai,
I'm writing to follow up on the formal protest submitted by our office on Friday, March 13, 2026.
Has the City completed its review of the points addressed? Furthermore, we would like to clarify if the City still intends to move forward with an award recommendation for Polytech Industrial, given the evidence regarding their failure to meet "responsible bidder" requirements.
I look forward to your response.
