Re: Peach Avenue Street Improvements CIP 24-27; Bid Advisory Regarding Dave Christian Construction Co., Inc.
This bid advisory is submitted by NorCal Construction Industry Compliance ("NCIC"), a joint labor-management organization formed pursuant to the Labor Management Cooperation Act of 1978 (29 U.S.C. § 175a). NCIC is committed to ensuring a level playing field for contractors and workers by promoting equitable contracting and ensuring compliance with all applicable state and federal labor laws governing the construction industry.
INTRODUCTION
NCIC monitors local construction projects to help ensure that fair and open competitive bidding practices are utilized and that taxpayers get the best value for their tax dollars. This is important because the policies underlying our State's competitive bidding laws not only foster fairness among bidders but also protect the public trust.
Fair competitive bidding acts as a "guard against favoritism, improvidence, extravagance, fraud, and corruption; to prevent the waste of public funds; and to obtain the best result for the public." "Competitive bidding laws are passed for the benefit and protection of the taxpaying public, not for the benefit and enrichment of bidders."2 Proper enforcement of these laws results in more responsible contractors bidding and performing public works jobs, reduces instances of health and safety problems, promotes the timely completion of the contracted work, and helps to ensure the final product is of the highest quality and value for the taxpayer dollar. ' M & B Const. v. Yuba County Water Agency (1999) 68 Cal.App.4th 1353, 1360; see also Domar Electric, Inc. v. City of Los Angeles (1994) 9 Cal.4th 161, 170-171.
The City of Clovis ("City") first opened bids for the Peach Avenue Street Improvements CIP 24- 27 project ("Project") on March 31, 2026. Dave Christian Construction Co., Inc. ("DCC") is the apparent lowest bidder on the Project.
In considering whether to accept DC's bid, NCIC urges the City to conduct a factual inquiry to determine whether DCC qualifies as a "responsive" and "responsible" bidder as required by law.
As explained below, NCIC believes that DC's bid is not responsive as it did not identify a surveying company on its list of subcontractors.
DISCUSSION
"A basic rule of competitive bidding is that bids must conform to specifications and that if a bid does not so conform, it may not be accepted."3 Failure to satisfy all bid specifications renders a bid non-responsive as a matter of law. Such a non-responsive bid must be rejected
1. DCC May be Non-Responsive Because it Did Not Identify a Surveying Company on its List of Subcontractors.
The Special Provisions section of the Project's Construction Specifications states the following regarding surveying requirements:
"Section 96-26 Construction Surveving
The Contractor shall be responsible for construction survey stakes and marks for the project.
The Contractor shall also be responsible for preserving construction survey stakes and marks for the duration of their usefulness, and shall be fully responsible for the cost of any replacement or loss during construction. Unless otherwise specified on the Plans or herein, all such property line and survey markers or Permanent Monuments that are destroyed or disturbed by the work shall first be tied in an approved manner and replaced at the conclusion of work.
Property line and corner survey markers and Permanent Survey Monuments that otherwise are lost or disturbed by the Contractor's operations shall be replaced at the Contractor's expense.
All property line and corner markers and Permanent Monuments are to be replaced by a Registered Civil Engineer appropriately licensed for land surveying, or a Licensed Land Surveyor."
Section 98-7.01C Re-Establishing Permanent Survey Monument Re-establishment of a permanent survey monument shall be completed and certified by a Registered Civil Engineer appropriately licensed for land surveying, or by a Licensed Land Surveyor. All re-established horizontal control monuments shall be Type I monument in accordance with the City Standard Drawing ST-32, "Horizontal Control Monument Detail". The work shall be completed in accordance with these Construction Specifications Section 96-26 "Construction Surveying," Technical Provisions Section 98-7 "Miscellaneous Street Improvements," here in, the City of Clovis Standard Specifications Section 70-2 "Survey Monuments". Prior to commencement of work, the Contractor shall submit records certified by a RCE or Land Surveyor showing tie-down 3 Konica Bus. Machines U.S.A. Inc. v. Regents of Univ. of California (1988) 206 Cal.App.3d 449, 454 2 information of all permanent survey monuments within the construction limit. Any damaged monument to be preserved and protected in place shall be re-established in accordance with these records at the Contractor's own expense." The Business and Professions Code ("BPC") §8725, states:
"Any person practicing, or offering to practice, land surveying in this state shall submit evidence that he or she is qualified to practice and shall be licensed under this chapter. It is unlawful for any person to practice, offer to practice, or represent himself or herself, as a land surveyor in this state, or to set, reset, replace, or remove any survey monument on land in which he or she has no legal interest, unless he or she has been licensed or specifically exempted from licensing under this chapter." Accordingly, DCC would be required to subcontract the surveying work to a licensed surveying company and list that company in its subcontractor list. Notably, the bid proposal submitted by the second low bidder, Juarez Brothers General Engineering, Inc. (JBGE), includes a licensed surveying company on its subcontractor list. The cost attributed to the surveying scope of work represents 1.2% of JBGE's bid.
CONCLUSION
Adequately investigating issues of non-responsiveness and non-responsibility goes to the heart of the City's fiduciary responsibility to taxpayers. In light of the potential issues described above, NCIC respectfully requests that the City thoroughly investigate whether DCC is a responsive bidder eligible to be awarded the Project.
If the City finds that DCC's bid is non-responsive or not a responsible bidder, then the City must either award the Project to the next responsive and responsible bidder or reject all bids and commence a new round of bidding for the Project.
Please respond to this bid advisory by April 13, 2026, indicating what steps the City will take to fulfill its fiduciary responsibility and ensure compliance with state competitive bidding laws. We look forward to your response.
Thank you for your time and consideration of this critical matter.
Sincerely,
Kristyn Pair

Re: Peach Avenue Street Improvements CIP 24-27; Bid Advisory Regarding Dave Christian Construction Co., Inc.
Kristyn:
We write to clarify that Dave Christian Construction Co., Inc. ("DCC") submitted a responsive bid under the City's specifications and applicable provisions of the Public Contract Code. NCIC's "bid advisory" fails to acknowledge the applicable requirements of PCC section 4104 for listing a subcontractor in a bid and the amount of bid item #16 in DCC's bid.
Subcontractor Listing Threshold—½ of 1% Rule
• Under PCC § 4104, any subcontractor performing more than ½ of 1% of the prime contractor's total bid—or, $10,000 for streets or highways, whichever is greater—must be listed in the prime contractor's bid
• For this Project, ½ of 1% of DCC's total base bid of $958,816.95 is $4,794.08. • DCC's bid item #16-"Re-establish Horizontal Control Monument"-was priced at $4,433.00, which is 0.46% of its base bid and below the required subcontractor listing threshold.
Accordingly, because the amount listed for bid item #16 is less than ½ of 1% of the total bid, DCC was not required to identify a subcontractor under the City's "Subcontractors Designation" form and PCC DCC's bid fully complies with the ½ of 1% threshold requirement under PCC § 4104, and therefore, DCC is a responsible and responsive bidder, and its bid will be recommended for award.
Please let me know if you need any further citations or documentation.

I am taking this time to write by email to you. I am a resident in Clovis, at 1711 Laverne Ave. I am a citizen, have a business license to teach my students and rehearse at my home studio on Laverne Avenue. I've had this business license for over 30 years. I received the postcard, telling of the hearing to approve a storage facility down my street at Laveme about a block away. I am teaching students during the meeting on April 13, 2026, and cannot attend. So, 1 am writing this email to you, to be induded at the hearing. near Keats Avenue. This is a cul de sac, and there are no other ways to get 1 revent parking and access for other musicians coming to my home. We have enough parking troubles without a storage facility taking the fev parking spots here. There are also homes right along the road of the possible lill-in development and access to stores. We don't need the addition of more busy traffic. There is not enough space. We certainly dont need roads dosed so we cannot get to our homes. though others are coming to your meeting, I have music students at that time here, that I cannot cancel. Please include my email at the neetina. We have enouch parkina troubles and also traffic in our area. I didn't buy a home here to have these troubles placed on us So please inctude my vole against the storage facility being considered.

User comment: To Clovis City Council members Regarding City Council meeting April 13, 2026 Agenda Item #12 Shaw Avenue Specific Plan Storage Facility My Name is Karey DeBardeleben. As a resident of Cougar Estates at NE corner of Shaw and Fowler Avenues (Keats Ave/Burgan Ave), I am writing to OPPOSE APPROVAL of the proposed two story storage facility conditional use permit for the following reasons: 1. TWO STORY FACILITY - A. There are no other two story businesses on this corner, or any other corner in this area. The closest we can come to having a multi-story business on any corner in the Shaw/Fowler area is the senior residence behind Walgreens on the SW corner. This is a residence home with limited coming and going and does not impact any traffic going into and out of that single family home development, as its entrance is north of the first entry to that development. The residents here tend to not generate much of a noise issue, either. There is no precedent for a two-story industrial or light industrial-type business building near any residential area in the Shaw/Fowler vicinity. The mini storage facilities I find in Clovis are in mixed use, light industrial and commercial areas. Not butted up against single family homes. B. Original Zoning - This area was originally zoned for single story, professional/administration type buildings for a reason. And that reason is to have little to no negative impact on the residential area north of it. Current professional offices and the bank have traditional business hours of 8 to 5, M-F, with minimal continuous traffic. This approval would create a major negative impact. There are 10 homes on the south side of Keats Avenue. Each will be impacted by not just a two-story building to view from their backyards, but single story roll up door units that will cause noise from 6 am to 10 pm. This will impact their ability to have the quiet enjoyment of their own backyards for relaxation or entertainment purposes. There will be the visual impact as well as noise from moving vans, trucks and automobiles, as well as conversations in an acoustic nightmare of concrete and metal amplifying every sound. 2. TRAFFIC IMPACT - A. Current DMV Traffic Load - It seems that we already have the effect of an unintended or overlooked traffic impact in our neighborhood since the opening of the DMV office at Shaw and Burl avenues. This has resulted in almost every person taking their driving test to be taken north on Laverne at Shaw avenue - stopping and backing up 40 - 50 feet, as part of their exam, and then moving forward north to Laverne and Keats, turning east on Keats to Burgan to turn north and continue to San Jose and head east back to Burl avenue through our residential area to end their test at the DMV. These vehicles start their tests at approximately 8:15 am and don't end until 4:45 PM when testing ends every Monday through Friday. But it doesn't end there, as EVERY driving school in the area takes their driving students on this same route SEVEN DAYS PER WEEK, up to 12 - 14 times per day, as late as 8 PM. I live at Keats and Burgan on the inside corner, and this traffic gets very heavy at times. B. Additional Traffic Anticipated - All this being said, the additional traffic from a 113,576 sq ft storage facility with outside perimeter units as well as a TWO STORY climate controlled building will be an additional burden in our residential neighborhood SEVEN DAYS PER WEEK between the hours of 6 am and 10 pm. As a resident who moves through my neighborhood streets, I can accurately anticipate that there will be increased traffic leaving the facility and heading north on Laverne to turn west on Keats Avenue in order to not get hung up at Laverne and Shaw until Shaw traffic clears to turn west on Shaw.
These vehicles avoiding the S & L intersection will drive past 10 residences to get to Fowler where they can turn either left or right. Those who choose to turn left (south) will have to wait for NB traffic to be clear. We have Jefferson Elementary school on the NW corner of Fowler and Shaw Avenues, with heavy school related traffic during 3 main times per day. This will cause issues with parents parked on Fowler picking up their kids and trying to merge into traffic when leaving the school. It is already pretty congested, with backup past San Jose Avenue on the west side of Fowler. If customers of the storage facility go north on Fowler from Keats, they will be heading towards Clovis High. Clovis High student foot bike traffic is pretty heavy during school hours, and this can also be a hazard to students, as well as motorists dropping off or picking their students and trying to merge back in to traffic. C. Alternative Route on Keats Ave. Storage customers who do head south on Laverne when leaving the facility can only turn right onto Shaw Avenue. Visibility to make that right turn is limited by the cyclone fencing around the ponding basin on the east side of Laverne and north side of Shaw. Residents in the area know this and actually watch for traffic movement on Shaw well before they approach the stop sign in order to gauge traffic. Non-residents are not going to pay that much attention, and traffic accidents may well increase at that intersection. There will also most likely be longer backups at the left turn lane at the Tire Store in front of WalMart Grocery on the SE corner, for people to make a U-Turn because they could not turn left onto Shaw. Or more backup at the left turn lane at Shaw and Fowler to make that U-Turn. D. Entering from Keats Ave. For those customers coming south on Fowler to access the facility, many will find that it will be more convenient for THEM to turn left from Fowler onto Keats and go through the neighborhood to access the storage. It will be less hassle than waiting for one signal and one left turn at Shaw to Laverne.
It can be 85 to 90% anticipated that vehicle traffic on Keats through the neighborhood will be impacted, as will the residents who walk, bike and play daily on Laverne, Keats, Bliss & Whittier. There are several children in our neighborhood, and they all play outside. Many in the streets with basketball, catch or just crossing Keats to get to their friends' homes. 3. Environmental Impact - Air Quality & Noise Impact - A.
Air Quality - It seems that something is missing in Ms. Parker's report of March 26. There is a report from SJ Valley Air Pollution Control District that recommends the City evaluate the project to minimize potential exposure of sensitive receptors and emissions. There is a reason that the neighborhood is SET BACK from Shaw Ave. as far as it is. That is to minimize both sound and air quality impact. Not only will we have increased traffic, at the very least the south perimeter of our development, that traffic will consist of large moving vans, truck and cars. Many of these will be diesel, as well as gasoline powered vehicles. They will be moving slowly, and in many cases, idling while running in to find something, or just drop a couple of things off. B. Noise - Many will come in and park outside the unit and spend between 20 minutes to an hour or so either unloading or loading items. This is not a quiet activity. If that is starting up at 6 am on a Saturday or Sunday, or even in the middle of the day outside of a residence where the occupants are shift workers and sleep during the day, this will be unsettling for them. And honestly, a 44- foot setback will not do anything to dampen the acoustics of concrete and metal buildings, and the sounds of roll up, industrial-type doors and the loud talking back and forth as people and their friends are loading a moving van at 6 am. 4. Privacy/Neighborhood Security - There seems to be cameras on the schematics but not mentioned in Ms. Parker's report. Video surveillance is important with a business like this. There has been an increase in break-ins of area storage facilities since around October of 2025. That raises two concerns. Where are those cameras pointed? And how does their placement impact everyday life in our residential neighborhood with a semi-industrial facility at one of our entrances. And how will this impact our home values? Security - with a 113,576 square foot storage facility, along with the increase in crime and homelessness in our area, how will this impact the safety and security of our residents in the neighborhood? It will be a magnet for burglaries and theft. I've read that there have been 2 thefts at Derrell's facilities, as well as others in recent months. This will put additional strain on our law enforcement, as well as concern for personal safety in the surrounding residential neighborhood. In looking into Hawkins Companies LLC businesses, their Cube Smart Storage facilities seem to be lacking in many area - see notes below. Security will be an issue, it appears, since they hire minimal employees - by their own admission. 5. Number of Units - I have looked through and read Ms. Parker's report several times, and while the square footage of this facility is noted, there is no mention of the number of units that will be available for rent. I am sure it was an oversight. However, it is imperative that this is known and stated. 6. Cube Smart - When | look up Cube Smart Storage Facilities, which Hawkins Companies LLC owns in Fresno on Clovis Ave., I see that there are issues with theft, lack of proper security, break- ins, pest infestations, damage to personal stored property, customer service and billing issues, poor maintenance and frequent rental rate increases. Is that what we have to look forward to? What do we really know about how they conduct business. We know that we have a very reputable local company that knows how to run storage facilities, and where to locate them for maximum efficiency and access with minimum impact to the residential community. 7. In closing - I would like urge the Council to vote NO on this resolution. The impact on our neighborhood would be detrimental to our overall quality of life and quiet enjoyment of our homes, as well as reduce our home values. We have lived in this neighborhood since October 2000. We left briefly for four years. But when we came back, we bought in the same neighborhood, just 2 blocks from our home on Bliss for a reason. And I can tell you that if we had come back and there were a 2 story storage facility developed there, we would have looked further north to buy, around Bullard and Fowler. This facility in this location is NOT in keeping with "The Clovis Way Of Life". At all. Thank you for your time.

If this new plan is approved and there is new development it would lead to noise level increase and I would no longer be able to remotely work from home. I would be forced to return to office and It would cause a financial burden on my family. We already have high traffic in our neighborhood due to the DMV and having construction in the neighborhood would cause more safety hazards for the children in the neighborhood. I am also concerned that this would cause a decrease in the value of our homes.

User comment: To whom it may concern, Last night I submitted photos in the "weed abatement" section of the city website. I would like to request to have these pictures available for city council members at city council meeting Monday, April 13th with regard to item #15 on the agenda. We share the adjacent property and fence line with the owner of the 2075 property. The weeds and overgrowth are a serious fire hazard not only in the front but the backyard. Also, our shared fence has deteriorated beyond repair and must be replaced due to the extensive damage (see pictures below). Need assistance with next steps regarding California Civil Code 841, adjoining landowners share equal responsibility for the reasonable cost of maintaining and replacing boundary fences. Formal estimated cost of replacing fence can be provided upon request. Thank you, Lacie Rodriguez (559)352-2730 2083 Swift Ave. Clovis For use at City Council meeting on April 13th, Agenda item #15, Property 2075 Swift Ave.
