VIA: Daniel Barros, City Manager
MEETING DATE: August 27, 2025
SUBJECT: MTC Active Transportation Capital Design Technical Assistance Grant

RECOMMENDATION
Staff recommends that the City Council adopt the following:

RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE

FUNDING AGREEMENT WITH THE METROPOLITAN TRANSPORTATION COMMISSION (MTC) FOR THE MTC ACTIVE TRANSPORTATION CAPITAL DESIGN TECHNICAL

OUNCIL ADOPTED VALUES
The City Council approved a master plan that addresses bicycle and pedestrian safety and transportation deficiencies on El Camino Real (ECR) in Colma. The master plan created a vision of how the highway could be reconstructed to accommodate all modes of transportation, a plan that endorses safety and promotes healthy modes of travel along El Camino Real. The approval of the resolution is a continuation of the vision that ECR can be
viable for all modes of travel.

BAC

KGROUND
The Active Transportation Capital Design Technical Assistance Program supports Plan Bay Area 2050’s greenhouse gas (GHG) emissions reduction target, as well as the Plan’s strategy to build a complete streets network to encourage walking, biking, and other mobility options.

In Spring 2022, the Metropolitan Transportation Commission (MTC) Active Transportation Plan updated its Complete Streets Policy (Resolution 4493). This was followed by the identification of an Active Transportation Network in the Summer of 2022, and the prioritization of a 5-Year Implementation Plan in the Summer of 2023.

AGENDA ITEM #3
Staff Report – MTC Active Transportation Capital Design Technical Assistance Grant El Camino Real Bicycle and Pedestrian Improvement Project Page 2 of 4 In October 2024, the MTC invited eligible Bay Area jurisdictions to submit project proposals to one or more of the following grant programs: Regional Mobility Hubs, Parking Management, Charging Infrastructure, and Active Transportation Capital Design Technical Assistance.

The Town of Colma submitted an application for the Active Transportation Capital Design Technical Assistance Call for Projects. As part of the 5-Year Implementation Plan, this call for projects is the second cycle of Active Transportation Technical Assistance. Total funding available is $2 million, with minimum grant award of $100,000, and maximum grant award of $300,000. The Town secured the maximum grant of $300,000.

Projects that are awarded funding must be located on the Active Transportation Network, a 3,244 mile network, located in Transit-Oriented Community (TOC) policy station areas. These Projects are required to implement Complete Streets principals, incorporating All Ages and Abilities design principals for high-comfort bicycle facilities, and Accessibility Guidelines for Pedestrian Facilities in the Public Right of Way.

Awarded projects will enter into a funding agreement with MTC, giving them the flexibility to hire their own consultant or choose from MTC’s on-call bench of consultants.

Detailed Description of the Project
The El Camino Real Bicycle and Pedestrian Improvement project aims to enhance safety, provide multimodal accessibility, improve connectivity and access to public transportation, and support economic growth by providing continuous sidewalks and dedicated bicycle lanes along approximately 1.5 miles of El Camino Real/State Route (SR) 82 between Albert M Teglia Boulevard in the Town of Colma and Hickey Boulevard in the City of South San Francisco. The project is divided into three segments: Segment A from Albert M. Teglia Boulevard to Mission Road, Segment B from Mission Road to Arlington Drive in the Town of Colma, and Segment C from Arlington Drive to Hickey Boulevard in the City of South San Francisco.

To move active transportation projects forward, MTC offered technical assistance to Bay Area agencies to projects located on the MTC Active Transportation Network to help them advance from conceptual or preliminary engineering design to final design, along with related outreach. This funding will allow the Town to finalize the project's design and prepare it for construction.

ANALYSIS
Since ECR is a state-owned roadway, all improvements must be approved by Caltrans. The proposed improvements will require various levels of documentation, studies, and reviews to receive Caltrans’s approval at each stage, from project initiation through construction. The Project Study Report-Project Development Support (PSR-PDS) phase was completed and approved by Caltrans in February 2025. The current phase, Project Approval and Environmental Document (PA&ED), is in development and is expected to be finished in December 2025. Following that, the project will move into the Design and Right of Way (ROW) certification.

Staff Report – MTC Active Transportation Capital Design Technical Assistance Grant El Camino Real Bicycle and Pedestrian Improvement Project Page 3 of 4 The key requirements for the Plans, Specifications, and Estimates (PS&E) approval process include Geometric Design, Safety and Accessibility, Utilities and ROW, Drainage and Stormwater, Traffic Control, Landscaping, and Engineer’s Estimate. To obtain Caltrans ROW approval, the project must complete several steps, including securing all necessary permits and certifying that all requirements have been met. This work involves preparing ROW plans, relocating utilities, appraising property, and making payments for real property as needed.

Projects that involve work within Caltrans' ROW will require an encroachment permit. A Caltrans Liaison Engineer is assigned to the Project to provide oversight for the current PA&ED phase and the future PS&E phase for the project.

The Metropolitan T ransportation C ommission ( MTC) has awarded a $300,000 Active Transportation Capital Design T echnical A ssistance grant to both the Town of Colma and the City o f South San Francisco. T he grants will support the PS&E f or two different segments of the El Camino Real Project: C olma's grant will cover Segment A, and South San Francisco's will c over Segment C. Both grants will also serve as the local m atch required t o receive future Measure s A and W H ighway P rogram 2 025 Funds, or any other potential funds, if they are awarded .

FISCAL IMPACT
The estimated cost of the preparation of the Plans, Specifications & Estimates (PS&E) for Segment A of the El Camino Real Bicycle and Pedestrian Improvement Project is estimated to be $4,435,000. A $300,000 grant from the Active Transportation Capital Design Technical Assistance will be used as a part of local match to secure future funding from the Measures A and W Highway Program 2025 or other potential grants.

MTC requires that the Town of Colma complete the PS&E phase of Segment A by the end of 2026.

SUSTAINABLE IMPACT
This resolution in support of the El Camino Real Bicycle and Pedestrian Improvement Project is consistent with the Town’s sustainability goals and Complete Streets and Green Streets Program goals.

ENVIRONMENTAL
The City Council’s action in adopting the resolution is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15306 in lieu of 15301 as information collection. The resolution will authorize information gathering for bike and pedestrian improvements along El Camino Real. Adoption of the resolution will not commit the Town to a course of action nor will it approve any actual physical improvements along El Camino Real. Instead, any improvements will only be considered for potential approval after CEQA review has been conducted.

Staff Report – MTC Active Transportation Capital Design Technical Assistance Grant El Camino Real Bicycle and Pedestrian Improvement Project Page 4 of 4

ALTERNATIVES
The City Council could choose not to accept the Active Transportation Capital Design Technical Assistant Grant. Doing so is not recommended, however, because the Town would lose this funding opportunity to assist with the implementation PS&E for Segment A of the El Camino Real Bicycle and Pedestrian Improvement Project.

CONCLUSION

Staff is requesting that City Council adopt a resolution approving and authorizing the City Manager to execute the agreement with the MTC for accepting the Active Transportation Capital Design Technical Assistant $300,000 Grant to support funding the preparation of the Plans, Specifications, and Estimates phase for Segment A of the El Camino Real Bicycle and Pedestrian Improvement Project.

RECOMMENDATION
Staff recommends that the City Council adopt the following:

RESOLUTION SUPPORTING THE EL CAMINO REAL BICYCLE AND PEDESTRIAN

IMPROVEMENT PROJECT AND AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR THE SAN MATEO COUNTY TRANSPORTATION AUTHORITY’S 2025 MEASURE A AND

MEASURE W HIGHWAY PROGRAM CALL FOR PROJECTS PURSUANT TO CEQA GUIDELINE 15306
COUN

CIL ADOPTED VALUES
The City Council approved a master plan that addresses bicycle and pedestrian safety and transportation deficiencies on El Camino Real (ECR) in Colma. The master plan created a vision of how the highway could be reconstructed to accommodate all modes of transportation, a plan that endorses safety and promotes healthy modes of travel along ECR. The approval of the resolution is a continuation of the vision that ECR can be viable for all modes of travel.

BACK
GROUND
In 2021, the San Mateo County Transportation Authority (SMCTA) adopted the Short Range Highway Plan (SRHP) and Capital Improvement Program (CIP) to guide investments for the Measure A Highways and Measure W Countywide Highway Congestion categories. The SRHP established the policy framework for these investments, incorporating goals from both measures. In December 2024, the TA Strategic Plan 2025-2029 further updated these policies and evaluation criteria based on stakeholder input.

To be eligible for the Call for Projects, a project must be included in the CIP, listed in either the Measure A or W Expenditure Plans, or be identified on the updated Measure A Supplemental AGENDA ITEM #4
Staff Report - Measure A and W Highway Program 2025 Call For Projects El Camino Real Bicycle and Pedestrian Improvement Project Page 2 of 4 Roadways candidate list, The Colma El Camino Real Bicycle and Pedestrian Improvement Project is on the updated Measure A Supplemental Roadways list, making it eligible for funding.

The SMCTA intends to make available up to $200 million between County Measures A and W including:
• Measure A: Key Congested Areas ($45 million), and Supplemental Roadways ($75 million). • Measure W: This will fund highway and interchange projects ($80 million).

ANALYSIS
Since ECR is a state-owned roadway, all improvements must be approved by Caltrans. The proposed improvements will require various levels of documentation, studies, and reviews to receive Caltrans’s approval at each stage, from project initiation to construction. The Project Study Report-Project Development Support (PSR-PDS) phase was completed and approved by Caltrans in February 2025. The next phase, Project Approval and Environmental Document (PA&ED), is currently in development and is expected to be finished in December 2025.

Following the PA&ED approval, the project will move into the Plan, Specifications and Estimate (PS&E) and Right of Way (ROW) stage of the project.

The key requirements for the PS&E approval include Geometric Design, Safety and Accessibility, Utilities and Right of Way, Drainage and Stormwater, Traffic Control, and Engineer’s Estimate. A Caltrans Liaison Engineer is assigned to the Project to provide oversight for both PA&ED and PS&E phases for the project. To obtain Caltrans ROW approval, the project must complete several steps, including securing all necessary permits and certifying that all requirements have been met. This work involves preparing ROW plans, relocating utilities, appraising property, and making payments for real property as needed. Projects that involve work within Caltrans' ROW will also require a CalTrans encroachment permit.

Town of Colma staff will apply for Measure A and W Highway Program 2025 funding to complete the PS&E phase for Segments A and C of the El Camino Real Project, and funding to acquire ROW where needed along the project boundaries. This application will be submitted to the SMCTA by September 12, 2025. The estimated funding needed for PS&E and ROW is $17,000,000. Our application seeks $15,300,000, and the required $1,700,000 local match (10%) will be shared between the Town of Colma and the City of South San Francisco.

A City Council resolution is required to apply for Measure A and Measure W Highway Program 2025 funding. The resolution must show support for the El Camino Real Bicycle and Pedestrian Improvement Project and authorize the submission of the application for both the PS&E and ROW phases.

Teglia Boulevard to Mission Staff Report - Measure A and W Highway Program 2025 Call For Projects El Camino Real Bicycle and Pedestrian Improvement Project Page 3 of 4 Road, Segment B from Mission Road to Arlington Drive in the Town of Colma, and Segment C from Arlington Drive to Hickey Boulevard in the City of South San Francisco. The requested Measure A and W Highway Program 2025 funds will be allocated for the preparation of the PS&E for Segments A and C, and the ROW of the entire corridor (Segments A, B, and C).

Design of Segment B is already funded by the Measure A and W Pedestrian and Bicycle Program 2022 (Cycle 6).

The Town of Colma and the City of South San Francisco are being awarded MTC Active Transportation Design Technical Assistance grants, $300,000 each. Colma will use its funding for the design of Segment A of the El Camino Real Project, and South San Francisco will use its grant for Segment C. Both grants will serve as the local match (10%) for the Measure A and W Highway Program 2025 Funds.

FISCAL IMPACT
The estimated cost of the preparation of the PS&E for the El Camino Real Bicycle and Pedestrian Improvement Project (Segments A & C) is estimated to be in the range of $8,000,000, and the estimated cost of the ROW for the entire corridor (Segments A, B & C) is estimated to be in the range of $9,000,000 as follows:

Phase Segment A
(Colma)
Segment B
(Colma)
Segment C
(SSF)
Total
PS&E $5,350,000 - $2,650,000 $8,000,000
ROW $5,680,000 $470,000 $2,850,000 $9,000,000
Total $11,030,000 $470,000 $5,500,000 $17,000,000

If the Measure A and W Highway Program 2025 is accepted and funded, the Town’s estimated funding plan for the PS&E phase and ROW phase will be as follows:

• Measure A and W Highway Program 2025 Grant: $ 15,300,000 • Colma’s Commitment ($850,000 Colma Local Match, and
$300,000 MTC Design Technical Assistance Grant): $ 1,150,000

• SSF’s Local Match Commitment $ 550,000

Estimated Project Total: $ 17,000,000

Should the SMCTA Board award Measure A and W Highway Program 2025 funds to the El Camino Real Bicycle and Pedestrian Improvement Project, the SMCTA will require that the Town of Colma commence work on the PS&E phase and ROW phase within one year of TA Board action, which is anticipated in December 2025. Action on this item will have no fiscal impact for FY 2025-26 and the 10% local match dollars in the amount of $1,150,000 can be included during the Capital Improvement Program budget discussions for FY 2026-27.

The Town of Colma is the project's sponsor and implementing agency. Should the project receive the funds, a funding agreement will be established with the City of South San Francisco (SSF) to ensure the Town of Colma is reimbursed for SSF's local match contribution.

Staff Report - Measure A and W Highway Program 2025 Call For Projects El Camino Real Bicycle and Pedestrian Improvement Project Page 4 of 4

SUSTAINABLE IMPACT
This resolution in support of the El Camino Real Bicycle and Pedestrian Improvement Project is consistent with the Town’s sustainability goals and Complete Streets and Green Streets Program goals.

ENVIRONMENTAL
The City Council’s action in adopting the resolution is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15306 as information collection.

ALTERNATIVES
The City Council could choose not to accept the Measure A and W Highway Program 2025 Call for Projects. Doing so is not recommended, however, because the Town would lose this funding opportunity to assist with the implementation of El Camino Real Bicycle and Pedestrian Improvement Project.

CONCLUSION

Staff is requesting that City Council adopt a resolution supporting the El Camino Real Bicycle and Pedestrian Improvement project and authorizing the submittal of an application for the San Mateo County Transportation Authority’s Measure A and Measure W Highway Program 2025 to fund the PS&E phase and the ROW phase of the Project.

MEETING DATE: August 27, 2025
SUBJECT: Notice of Award – Lawndale Blvd RRFB Mid-Block Crosswalk and Bike Lane Improvement Project

RECOMMENDATION
Staff recommends that the City Council adopt the following:

RESOLUTION AWARDING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A

CONSTRUCTION CONTRACT FOR THE LAWNDALE BLVD RRFB MID-BLOCK CROSSWALK AND BIKE LANE IMPROVEMENT PROJECT TO ZARA CONSTRUCTION INC. PURSUANT TO CEQA GUIDELINE 15301
C

OUNCIL ADOPTED VALUES
The Lawndale Boulevard RRFB Mid-Block Crosswalk and Bike Lane Improvement Project (“Project”) will provide elements of safety for bicyclists and pedestrians and provide equal accessibility for those who travel through the corridor. Approval of the proposed resolution is the Responsible action because the Council has considered the financial impact of the Project, while improving the accessibility and safety features of the Project.

BA

CKGROUND
The Transportation Development Act (“TDA”) Article 3 Program provides funding from Local Transportation funds and the State Transit Assistance to eligible pedestrian and bicycle projects within San Mateo County.

The Town of Colma has been awarded a $252,000 grant from the Metropolitan Transportation Commission (“MTC”) to assist with the implementation of the Project.

On May 28, 2025, the City Council allocated an additional $188,000 from the Fiscal Year 2025- 2026 Capital Improvement Budget to the Project.

AGENDA ITEM #5
Staff Report – Lawndale Blvd RRFB Mid-Block Crosswalk and Bike Lane Improvement Project – Notice of Award Page 2 of 4 On June 25, 2025, the City Council approved the bid document package and authorized staff to solicit formal bids for the Project.

On July 1, 2025, the project was publicly bid and advertised in accordance with the Town of Colma’s Public Contract Code.

ANALYSIS
A total of seven (7) bids were received on Tuesday, July 29, 2025. The bid results are summarized below:

VisionBuild
Construction, LLC
Zara
Construction Inc. CF Contracting, Inc. Bay Area
Lightworks, Inc.
$230,362.28 $279,898.00 $289,712.00 $299,452.00

Golden Bay
Construction Inc.

FBD Vanguard
Construction, Inc.

Gruendl, Inc. dba
Ray's Electric -
$299,532.95 $317,748.00 $462,961.50 -

Seven bids were submitted and reviewed. The staff analyzed each bid item thoroughly to ensure it was responsive and that the costs aligned with the Town Engineer's estimate. It was determined that VisionBuild Construction, LLC (VisionBuild) was the lowest bidder, with a bid of $230,362.28, but their bid was not responsive for the following reasons:

1) Missing Signed Addenda: VisionBuild acknowledged receiving the addenda in the Bid Form but failed to include a signed copy of each one with their bid. 2) Incorrect Bid Schedule: VisionBuild did not use the revised Bid Schedule from Addendum No. 2, which resulted in missing bid item #26 for replacing loop detectors.

This omission renders the bid non-responsive under applicable state law allowing the City Council to select the next lowest bidder submitting a responsive bid. See, Konica Business Machines U.S.A., Inc. v. Regents of University of California (1988) 206 Cal.

App.3d 449, 454 (a mistake as to price is non-waivable).

If the Town rejects the initial bid from VisionBuild Construction, the next lowest responsive bid, submitted by Zara Construction, Inc., for $279,898.00, will be considered. With a 10% contingency of $27,989.80, the total will be $307,887.80. This is below the amount ($440,000) currently budgeted for the Project, which includes design, construction management and construction. The remainder of the Project budget is project management, inspection, and design support.

The Engineer Estimate for the Project construction contract is $285,648.00. With a 10% contingency of $28,564.80, the total budget for construction is $314,212.80.

Staff Report – Lawndale Blvd RRFB Mid-Block Crosswalk and Bike Lane Improvement Project – Notice of Award Page 3 of 4 Detailed Description of the Project
The Town has allocated the TDA Article 3 funding for the design and construction of the Project. This project will enhance pedestrian and cyclist safety and mobility by installing high- visibility crosswalks, ADA-compliant curb ramps, RRFBs, curb and gutter, improved striping and pavement markings, advanced yield lines, and signage.

Based on El Camino High School's recommendation, a pullout area at the northern end of the mid-block crosswalk has been added to the scope of the Project. This new designated area will significantly enhance student safety, improve traffic flow, and allow parents to quickly and efficiently drop off or pick up their children.

FISCAL IMPACT
The approval of the construction contract carries no current fiscal impact at this point of the Project. The estimated budget of $440,000, which includes $252,000 in TDA Article 3 Funds and $188,000 in General Funds, covers design, construction management, construction costs, and Project contingency.

SUSTAINABLE IMPACT
This resolution in support of the Project is consistent with the Town’s sustainability goals and Complete Streets and Green Streets Program goals.

ENVIRONMENTAL
The City Council’s action in adopting the resolution is exempt from environmental review under the California Environmental Quality Act (“CEQA”) pursuant to Section 15301 of Article 19 of Chapter 3 of Division 6 of Title 14 of the California Code of Regulations. Subdivision (c) of that section provides a categorical exemption for Class 1 activities including the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, which includes but is not limited to pedestrian crossings in existing streets.

ALTERNATIVES
The City Council could choose to postpone the Project to a later date. Doing so is not recommended as the Town risks losing the $252,000 grant from MTC to assist with the implementation of the Project. Without these funds, the Town’s ability to significantly improve safety for residents, students, and the public would be severely compromised.

Staff Report – Second Amendment to Employment Contract with Dan Barros Page 1 of 2

STAFF REPORT
T
O: Mayor and Members of the City Council
FROM: Christopher J. Diaz, City Attorney
MEETING DATE: August 27, 2025
SUBJECT: Second Amendment to Employment Contract for City Manager

RECOMMENDATION
Staff recommends that the City Council adopt the following:

RESOLUTION APPROVING SECOND AMENDMENT TO EMPLOYMENT CONTRACT WITH

DAN BARROS TO PROVIDE FOR A SALARY ADJUSTMENT AND CELL PHONE STIPEND PURSUANT TO CEQA GUIDELINE 15378

COUNCIL ADOPTED VALUES
T
he City Council’s action in considering a salary adjustment for the City Manager is consistent with the value of fairness as the City Council recently provided raises to all Town employees and providing a similar salary adjustment for the City Manager is a fair thing to do.

BA

CKGROUND
On July 9, 2025, the City Council met in closed session to negotiate a salary adjustment for the City Manager. At the conclusion of those negotiations, the City Council approved a salary adjustment for the City Manager and directed staff to return with a contract amendment to formalize the increase in the City Manager’s salary by 7% which includes two cost of living adjustments of 2% consistent with what was provided to other Town employees, and a raise of 3%.

ANALYSIS
On July 26, 2023, the City Council adopted a resolution appointing Daniel Barros as City Manager and approving an employment agreement to be effective on August 21, 2023.

In 2024, the City Council approved salary increases for all Town employees, with some exceptions, with an initial increase in salary of 3.8%. Consistent with other Town employees, the City Council, on October 23, 2024, amended the City Manager’s contract to adjust his base salary by 3.8%, rounded to $250,000.

AGENDA ITEM #7
Staff Report – Second Amendment to Employment Contract with Dan Barros Page 2 of 2 On July 9, 2025 the City Council met in closed session to consider a salary adjustment for the City Manager and other contract changes. At the conclusion of that closed session, the City Council noted it had approved a compensation adjustment for the City Manager by 7% which includes two cost of living adjustments of 2% consistent with what was provided to other Town employees, and a raise of 3%. The City Council also noted it agreed to provide a stipend to the City Manager for use of his personal cell phone in lieu of using a Town owned cell phone. The City Council directed the City Attorney’s office to formalize these changes through a future contract amendment.

Consistent with the City Council’s recent direction , a second amendment to the City Manager’s employment contract has been prepared adjusting the salary from $250,000 per year to $267,500 per year (and adjustment of 7%) along with the requested cellphone stipend.

FISCAL IMPACT
Adjusting the City Manager’s salary will have a financial impact on the Town of $17,500 per year for the base salary, $600 per year for the cell phone stipend, and a single $500 maximum payment for a new phone. However, sufficient funds are included in the FY 2025-2026 budget to allow for this adjustment.

ENVIRONMENTAL
The City Council’s action in adjusting the City Manager’s salary is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15378 as this action is a government al fiscal activity without any commitment to any specific project which may result in a potentially significant impact on the environment.

ALTERNATIVES
The City Council could choose not to adopt the resolution adjusting the City Manager’s salary.

However, the City Council specifically provided direction to staff seeking the preparation of the second amendment adjusting the City Manager’s salary, so if the City Council is inclined to change course, an additional closed session to negotiate those changes may be warranted.

CONCLUSION
The City Council should adopt the resolution approving the second amendment to the City Manager’s employment contract to provide a salary adjustment.

Staff Report re: League of CA Cities Voting Delegate 2025 Page 1 of 2

STAFF REPORT
T
O: Mayor and Members of the City Council
FROM: Michelle Estabillo, City Clerk
VIA: Dan Barros, City Manager
MEETING DATE: August 27, 2025
SUBJECT: League of California Cities Conference Voting Delegate R

ECOMMENDATION
Staff recommends that the City Council make the following motion:

MOTION TO APPOINT A VOTING DELEGATE AND UP TO TWO ALTERNATES TO ATTEND THE LEAGUE OF CALIFORNIA CITIES 2025 ANNUAL CONFERENCE

COUNCIL ADOPTED VALUES
Participating in the Annual Business meeting furthers the Council’s adopted values of Responsibility and Vision because providing input on important local, regional and state policy issues protects the Town’s long-term financial stability and other interests.

BACKGROUND
The League of California Cities is an association of cities within the state of California, founded in 1898. Most of the state's 482 cities, including Colma, are represented in the League. The League publishes Western City, a monthly magazine, and holds an annual conference and exposition. The League advocates for cities at the state capitol on a multitude of topics.

T
he Annual Conference is the League’s largest and most comprehensive educational event.

General sessions feature premiere keynote speakers, while breakout sessions allow city staff and elected officials to explore topics that fit their specific needs and areas of interest.

During the annual conference, the League conducts its annual business meeting where the membership considers and acts on resolutions that establish League policy. Each member city’s city council is allowed to designate a city official to serve as the voting delegate to participate and cast votes at the business meeting along with up to two voting alternates in the case of the voting delegate’s absence. This year, the Annual Conference is scheduled for October 8-10, 2025 and will take place in Long Beach, California. Voting delegates and alternates must be submitted to the League no later than Wednesday, September 24, 2025. Once Council has designated a delegate and alternate by motion, the City Clerk will complete and submit the AGENDA ITEM #8
Staff Report re: League of CA Cities Voting Delegate 2025 Page 2 of 2 Voting Delegate Form as directed in the 2025 Voting Delegate Information Packet (Attachment A).

FISCAL IMPACT
There is no direct fiscal impact associated with this action. Attendance at various conferences is budgeted annually.

ALTERNATIVES
The Council could opt to not designate a voting delegate for the business meeting, however doing so would preclude the Town from having a voice in setting the League’s policy initiatives for the upcoming year.

CONCLUSION
Staff recommends the Council, by motion, appoint a Voting Delegate and up to two alternates for the League Conference.

League of California Cities Annual Conference and Expo, Oct. 8-10, 2025 Long Beach Convention Center
E
very year, the League of California Cities convenes a member-driven General Assembly at the Cal Cities Annual Conference and Expo. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy.

Ta
king place on Oct. 10, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions.

To c
ast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official.

A
ction by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone.

F
ollowing council action, please submit your city’s delegates through the online submission portal by Wed., Sept. 24. When completing the Voting Delegate submission form, you will be asked to attest that council action was taken. You will need to be signed in to your My Cal Cities account when submitting the form.

S
ubmitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide pre-conference communications with voting delegates.

C
onference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website.

Council Action Advised by September 24, 2025

ATTACHMENT A

For a city to cast a vote, one voter must be present at the General Assembly and in possession of the voting delegate card and voting tool. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the voting delegate desk. This will enable them to receive the special sticker on their name badges that will admit the voting delegate into the voting area during the General Assembly.

Please view Cal Cities’ event and meeting policy in advance of the conference.

Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official.

Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. Admission to the voting area will be limited to the individual in possession of the voting card and with a special sticker on their name badge identifying them as a voting delegate.

The voting delegate desk, located in the conference registration area of the Long Beach Convention Center in Long Beach, will be open at the following times: Wednesday, Oct. 16, 8:00 a.m.-6:00 p.m. and Thursday, Oct. 17, 7:30 a.m.-4:00 p.m. On Friday, Oct. 18, the voting delegate desk will be open at the General Assembly, starting at 7:30 a.m., but will be closed during roll calls and voting.

The voting procedures that will be used at the conference are attached to this memo.

Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.

Once again, thank you for submitting your voting delegate and alternates by Wednesday, Sept. 24. If you have questions, please contact Zach Seals at [email protected].

Staff Report re Republic Services Franchise Agreement First Amendment Page 1 of 6

STAFF REPORT
T
O: Mayor and Members of the City Council
FROM: Kathleen Gallagher, Sustainability Manager
VIA: Dan Barros, City Manager
MEETING DATE: August 27, 2025
SUBJECT: First Amendment to Franchise Agreement for Recyclables, Organic Waste and Garbage Collection and Processing Services with Allied Waste Services of North America, LLC dba Republic Services of Daly City to Revise Term

RECOMMENDATION
Staff recommend that the City Council adopt the following:

RESOLUTION APPROVING THE FIRST AMENDMENT TO THE FRANCHISE AGREEMENT

FOR RECYCLABLES, ORGANIC WASTE AND GARBAGE COLLECTION AND PROCESSING

SERVICES BETWEEN TOWN OF COLMA AND ALLIED WASTE SERVICES OF NORTH

AMERICA, LLC REVISING THE TERM OF THE AGREEMENT

COUNCIL ADOPTED VALUES
T
his recommendation is consistent with the Council’s adopted values from the Values-Based Code of Conduct for responsibility because the amendment provides continuity of essential services of recyclables, organic waste, and garbage collection services for residents and businesses and compliance with state mandates.

BACKGROUND
The Town’s current franchise agreement for collection of recyclables, organic waste, and garbage with Allied Waste Services of North America, LLC dba Republic Services of Daly City (Republic Services) began on August 31, 2016, and ends on August 31, 2026. In 2016, the Town issued a Request for Proposal (RFP) for solid waste collection services, developed a new franchise agreement, convened an ad hoc committee to review proposals, interviewed proposing companies and toured their recycling and organics processing facilities. After proposal review and interviews concluded, the ad hoc committee recommended Republic Services to the City Council, and the City Council approved the ten-year franchise agreement with Republic Services through August 31, 2026.

AGENDA ITEM #9
Staff Report re Republic Services Franchise Agreement First Amendment Page 2 of 6 The current agreement provides the Town with an option to extend the franchise agreement term twice for succeeding terms of two years each (total of four years). If the Town were to exercise both extensions for four years, the term would end August 31, 2030. However, this extension provision is not a current industry standard because of the capital investments necessary for haulers to franchise agreement requirements to provide a truck fleet, containers, organics processing, recycling processing and disposal capacity. Current industry standards for franchise agreement extensions are typically in the range of eight to ten years.

Despite the Town’s current option to extend the term for two two -year terms, the Town would benefit from a term extension that aligns with the City of Daly City’s franchise agreement with Republic Services to allow the Town the option to partner with City of Daly City on a competitive procurement process for future franchise agreement services. Daly City’s term ends June 30, 2031, and Daly City, at its discretion, may extend the term for up to three years in periods of one year or more, and with 120 days’ notice to Republic Services.

Therefore, staff recommends an amendment to the franchise agreement to amend the current two 2-year extensions to a new option for the Town to extend through August 31, 2028, then through June 30, 2031, and at the Town’s discretion, extend the term an addi tional three years through June 30, 2034, for a total of an eight-year extension. This extension provision aligns with the City of Daly City’s term and extension provisions and allows the Town the option and flexibility to potentially pursue competitive pr ocurement for future franchise agreement services in collaboration with Daly City.

Additionally, since the approval of the last franchise agreement in 2016, new state mandates, such as Senate Bill (SB) 1383 regulations require new programs to be included in the franchise agreement, and other new terms and conditions will need to be updated in the agreement. The California Department of Resources Recycling and Recovery (CalRecycle) issued the Town a low population waiver through January 1, 2027, exempting the Town from organic waste collection requirements. The Town has been working to comply with the organic waste collection requirements in the SB 1383 regulations to reduce greenhouse gas emissions and landfill waste, and to gain compliance. Therefore, staff will work with Republic Services to draft an Amended and Restated Franchise Agreement effective September 1, 2026, to incorporate new state- mandated programs and other terms to be mutually agreed upon and negotiated by the Town and Republic Services. Staff will return to City Council in the coming months to provide details and get council feedback.

ANALYSIS
Objectives of the Proposed First Amendment
The current franchise agreement includes the following provisions regarding the term extensions:

Staff Report re Republic Services Franchise Agreement First Amendment Page 3 of 6

The City of Daly City’s current franchise agreement term is through June 30, 2031, and the term may be extended at the City’s discretion for up to a total of three years in periods of no less than one (1) year (for a total maximum extension through June 30, 2034) with 120-day notice to Contractor.

The Town’s proposed Amendment meets the following objectives:
• Align the Town’s franchise agreement’s term and term extension with the City of Daly City’s franchise agreement.

Therefore, the proposed First Amendment would amend Section 2.3(B) of the Agreement as follows:

“B. The Term of this Agreement may be extended at the Town’s discretion (a) through August 31, 2028, (b) then, after that first extension, through June 30, 2031; and (c) then after that second extension, for up to three (3) additional years, through June 30, 2034, in periods of no less than one (1) year, provided that to exercise (a),(b), or (c), Town provides written notice to the Contractor 120 days prior to expiration of the then-current term. In order for the Term to be extended, Contractor must be in compliance with all terms and conditions of this Agreement, including the diversion requirements set forth in Section 3.14. Nothing in this Agreement shall be interpreted as requiring the Town to renew or extend this Agreement.”

Staff met with Republic Services’ General Manager Kathryn Tekulve to discuss the amendment for the extension and next steps regarding the franchise agreement, and Republic is supportive of this extension and provided the Town with a letter of support for the amendment.

Amended and Restated Franchise Agreement to Include State -mandated Programs Since the approval of the last agreement, several new state mandates, including SB 1383, SB 1383 regulations, and Assembly Bill (AB) 341, have been imposed on jurisdictions which require new programs to be included in the Town’s new agreement. SB 1383 is the more significant mandate and requires diversion of organics from landfill with new collection programs,

Staff Report re Republic Services Franchise Agreement First Amendment Page 4 of 6 procurement policies, monitoring, and enforcement and reporting to the state. The Town received a low population waiver for portions of SB 1383 compliance in 2022, and this waiver expires in January 2027, therefore the new agreement will be amended to include the required SB 1383 regulatory provisions.

SB 1383 requirements are summarized below:

1. Mandatory Organics Collection Services. Jurisdictions must provide organic waste collection services to all residents and businesses, containers must be labeled and comply with the following color requirements for containers: grey/black for trash, green for organics, blue for recyclables.

2. Mandatory Contamination Monitoring. Hauler must provide on-site monitoring of containers to reduce cross contamination e.g., food waste in recycling containers is contamination.

3. Mandatory Education/Outreach. Jurisdictions must provide education/outreach to all businesses and residents regarding mandatory participation in the organics collection service and contamination requirements.

4. Edible Food Recovery. Jurisdictions required to establish an edible food recovery program for larger food generators i.e., Tier 1 and 2 Commercial Edible Food Generators to distribute edible food to food banks. Thanks to our partnership with the County of San Mateo Office of Sustainability we participate in a regional food recovery program at no cost to the Town.

5. Capacity Planning. Jurisdictions must secure access to organics processing and food recovery capacity for the programs identified in the SB 1383 regulations. Republic Services includes the assurance that the Town’s diverted organic material is delivered to a fully permitted organic waste processing facility and there is sufficient capacity.

6. Recovered Organic Waste Product Procurement: Jurisdictions must procure an annual quantity of recovered organic waste products based on population and which can be fulfilled by procuring compost, mulch, renewable energy (transportation fuel, heat, and electricity) from anaerobic digestion and electricity from biomass conversation.

7. Inspection and Enforcement: Jurisdictions/haulers are to monitor compliance and conduct enforcement through annual inspections of commercial and residential truck routes; compliance reviews on all commercial businesses with 2 cubic yards or more of solid waste.

Republic Services’ Compliance with Current Agreement
Staff completed analysis of Republic Services’ current franchise agreement performance by analyzing Colma’s current residential and commercial monthly rates charged in comparison to neighboring jurisdictions, reviewed the diversion requirements detailed in the agreement, commercial outreach, public education, considered Republic Services’ longstanding partnership with the Town and analyzed other terms and conditions.

Staff’s findings are as follows:

Diversion Requirements: Per the current franchise agreement, Republic Services must be in compliance with the terms and conditions of the agreement, including the diversion requirements set forth in Section 3.14. Under Section 3.14, Republic Services must meet and Staff Report re Republic Services Franchise Agreement First Amendment Page 5 of 6 maintain specific diversion requirements throughout the term. Republic Services provides an annual report that documents their compliance with diversion requirements; Republic’s 2024 report shows that Republic met the required diversion rate of 40% as of December 31, 2024.

Rate Comparison: Staff completed a review of the Town’s rates in comparison to neighboring jurisdictions with similar programs and find that rates charged by Republic Services to Colma’s residents and businesses rates are consistent and in line with neighboring jurisdictions’ rates.

Analysis of Alternatives Regarding the Franchise Agreement Staff discussed the benefits of extending the term with Republic through an Amended and Restated franchise agreement or completing another competitive procurement similar to the process completed in 2016. Typically, negotiating, amending and extending a franchise agreement with an incumbent hauler is appropriate when the hauler is providing quality reliable service at reasonable rates, the diversion requirements are being met, and there are no significant contractual problems. Conversely, a jurisdiction is more likely to complete a competitive procurement when the jurisdiction isn’t satisfied with the hauler’s services, and contractual problems exist, diversion requirements are not being met, and rates charged for services are not in line with neighboring jurisdictions with similar services.

Benefits to negotiating an amended franchise agreement with incumbent hauler Republic Services include not having to devote significant staff resources to RFP development and RFP management. Additionally, working with the known incumbent (Republic) can avoid challenges and risks of working with a new hauler which does not have the resources, customer service- oriented programs and staff to provide quality programs for residents and businesses. When comparing these alternatives, the justification to negotiate an amended agreement with Republic is appropriate because Republic Services’ rates are in line with neighboring jurisdictions with similar services, Republic is meeting diversion requirements, there is a good long standing partnership with Republic, and there are no contractual problems.

Sustainability Impact
This recommendation is consistent with the Town’s sustainability goals because recycling, organics and diversion from landfill resulting from the franchise agreement reduce greenhouse gas emissions and assist the Town with meeting Climate Action Plan greenhouse gas emissions reduction targets.

FISCAL IMPACT
The recommendation will not impact the Town's budget.

ENVIRONMENTAL
This amendment is exempt from CEQA under CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility the approval will have a significant effect on the environment.

Re: Town of Colma
Support for Sole Source Negotiations
Mr. Daniel Barros:

I am writing on behalf of Allied Waste Services of North America, LLC d/b/a Republic Services of Daly City (“Republic”). As you know, Republic and the Town of Colma (“Colma”) entered into a Franchise Agreement for Recyclables, Organic Waste and Garbage Collection and Processing Services (the “Agreement”). The Agreement currently expires on August 31, 2026, with the option to extend by written agreement of the parties twice for succeeding terms of two (2) years each.

Republic supports Colma’s request to enter into sole source negotiations for an amended and restated franchise agreement that will extend the term options and include additional terms and conditions, subject to the parties’ mutual agreement. If the parties are unable to mutually agree on an amended and restated agreement, the two (2) year extension option in the current agreement may be exercised.

Republic values the relationship with the Town of Colma and looks forward to the opportunity to continue servicing the community.

Sincerely,
Kathryn Tekulve
General Manager
