Staff Report re AXON Contract for Drones Page 1 of 4

STAFF REPORT

TO: Mayor and Members of the City Council
FROM: John Munsey, Chief of Police
VIA: Dan Barros, City Manager
MEETING DATE: September 10, 2025
SUBJECT: AXON Sole Source Contract Approval For the Acquisition of Drones

RECOMMENDATION
Staff recommends that the City Council adopt the following resolution:

RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A SOLE SOURCE CONTRACT WITH AXON ENTERPRISE, INC., TO PURCHASE AND

MAINTAIN BODY WORN CAMERAS, IN CAR CAMERAS, TASERS, DRONES (UNMANNED AERIAL SYSTEMS), AND ELECTRONIC EVIDENCE STORAGE; AND ALLOWING THE

PURCHASE AND USE OF DRONES

COUNCIL ADOPTED VALUES
The resolution approving the sole source contract is the responsible thing to do by providing the community with the most transparent product available. The resolution is consistent with the vision of the Town of Colma to provide the community with the most advanced technology available.

BACKGROUND
In August of 2021 the Town of Colma entered into contract with AXON to provide Body Worn Cameras, In Car Cameras, Tasers, and Electronic Evidence Storage, using evidence.com. That contract is set to expire in 2026. The Town of Colma would now like to upgrade our contract with AXON to include Drone (Unmanned Aerial Systems) technology for the police department by adding two base stations and four drones capable of DFR (Drone as First Responder). To accomplish this, staff recommends entering into a ten -year contract with AXON for Body Worn Cameras, In Car Cameras, Tasers, Electronic Evidence Storage , and Drones (Unmanned Aerial Systems).

Unmanned Aerial Systems are considered a Military Equipment Use item (AB 481 and Colma Ordinance No. 811), and as such require Council approval for acquisition and use in a law enforcement capacity.

Staff Report re AXON Contract for Drones Page 2 of 4

Staff seeks to sole source the contract with AXON in accordance with Colma Municipal Code

1.06.210 as follows:

1.06.210 Sole Source Procurement
When requirements are so critical or call for such specialized expertise that only one source is capable of satisfying those requirements, the Awarding Authority is empowered to waive the Purchasing and Contracting Colma Municipal Code competitive procurement procedures. Sole source means that only one vendor possesses the unique and singularly available capability to meet the requirement of the solicitation, such as technical qualifications, matching to currently owned equipment or supplies or the ability to deliver at a particular time. Purchasing from a sole source shall be permitted after written justification from the requesting department explaining why a sole source has been specified, and a factual finding by the person or body authorizing the purchase that it is in the best interest of the Town of Colma to purchase without competitive purchasing.

AXON currently works with our Records Management System (RIMS) to integrate video with our CAD System. Using the Officer/Unit ID the interface will correlate CAD events by:
• Automating basic incident information entry for every recording • Improving data accuracy with complete, correct information • Increasing officer efficiency after each recorded call The SMCO District Attorney’s Office has purchased an evidence.com account which is the software that holds all evidence recorded by the AXON suit of cameras. Officers can upload third party digital evidence into this system, such as evidence photographs or video surveillance. AXON has created a one-stop shop for the management of digital evidence. By purchasing into this system, we will be streamlining the handling of digital evidence. From the capturing of the initial data to the submittal of the case file to the District Attorney’s office all data will be housed on the same evidence servers. These servers are specifically designed by AXON to comply with chain of custody evidence laws and discovery requests by defense council.

We can also share our evidence with neighboring jurisdictions who have evidence.com during mutual aid events.

AXON technology has the ability to integrate multiple automated camera activations through a variety of platforms, including the drawing of either an officer’s firearm or Taser. It can further be automated to activate by various vehicle applications, including the activating of lights, sirens, opening of doors or certain speeds. In addition to these activations the cameras also have the ability to activate other officer’s cameras within a predesignated radius. For example, if an officer is ambushed and does not have the time to manually activate their camera when the responding cover officer arrives the first officer’s camera will be activated.

AXON also has an integration feature with our FLOCK license plate reader system. Officers have the ability to upload directly from FLOCK into evidence.com to store valuable FLOCK evidence. Also, the AXON in car camera, FLEET 3, has FLOCK integration to be utilized as another mobile license plate reader.

AXON is a specific law enforcement technology company. Their products are designed with the officers in mind. Unlike other companies who are repurposing civilian products for law enforcement use, AXON’s products are designed to be easily activated and used by officers in the field. After the evidence is captured, AXON has created a digital workflow that is extremely 25977.00300\44151335.1

Staff Report re AXON Contract for Drones Page 3 of 4

user friendly and efficient, which will allow the officers to process their evidence quickly and get back on the street.

The AXON vehicle camera system comes with a device called an AXON Hub. This device provides a secure cellular data connection for the cameras. This hub also connects the in-car computers to the secured network allowing our car computers to access not only the secured AXON data but our mobile dispatching software as well. The AXON Hub links all the data together into a secured suit of data transfer.

AXON’s suit of products creates an environment for our officers to capture the evidence expected by our community without being bogged down with busy work processing the evidence. AXON’s digital workflow is user friendly and designed to get officers back on the street quickly. AXON has created a far superior product when compared to other companies.

Detailed Description of the Proposal
Staff is recommending that the Town of Colma enter into a ten-year contract with AXON to provide Body Worn Cameras, In Car Cameras, Tasers Drone (Unmanned Aerial Systems) Technology, as well as Electronic Evidence Storage.

Drones have proven to be a critical tool for de -escalation, subject apprehension, rescues, scene reconstruction, and overall scene awareness, providing for officer and community safety. Our drone expansion will create a Drone as a First Responder (DFR) pro gram. We will receive (4) Skydio X10 drones, capable of autonomous flight by a remote pilot. Two (2) of the X10’s will be positioned in enclosed docking stations at the police department . The remaining two (2) X10’s will be deployed in the field with patrol officers, allowing for redundancy or specific needs.

Reasons For the Recommended Action/Findings
Staff is recommending that the Town of Colma enter into a ten -year contract for the below reasons.

Cost Predictability & Inflation Protection
• Lock in pricing for 10 years.
• Easier long-term budget planning — no surprises in year 6+. • Protection from inflation, especially in hardware/software and cloud storage. • Spread cost over time instead of facing price hikes or renegotiation mid-cycle.

Long-Term Technology Commitment
• Shows the department’s full buy-in to the AXON ecosystem. • Allows the department to standardize workflows and training over a decade.

Operational Efficiency
• Fewer quote refreshes and contract renewals to manage. • Reduces administrative overhead for procurement and legal teams. • Ensures no lapse in service, hardware, or digital evidence continuity.

Future-Proofing
25977.00300\44151335.1

Staff Report re AXON Contract for Drones Page 4 of 4

• Guaranteed access to hardware refreshes (typically at year 5). • Access to AXON's next-gen technology without renegotiating. • Often includes continued software updates, new features, and expanded integrations.

Sustainability Impact
By entering into a ten-year contract with AXON, the Town of Colma will ensure the police department and the Town of Colma have the highest level of Body Worn Cameras, In -Car Cameras, Tasers, Drones, and Electronic Evidence Storage Technology for the next ten years.

FISCAL IMPACT
Nov 2025 $207,320.10
Nov 2026 $213,322.08
Nov 2027 $221,855.01
Nov 2028 $230,729.18
Nov 2029 $239,958.41
Nov 2030 $249,556.73
Nov 2031 $259,538.98
Nov 2032 $269,920.58
Nov 2033 $280,717.37
Nov 2034 $291,946.00
$2,464,864.44
These costs include an approximate monthly savings of $21,533.04 as well as $ 44k in credits from our previous contract.

ALTERNATIVES
The Council could choose not to go with the new contract with AXON and stay with the current contract which will end in 2026.

CONCLUSION
Staff is recommending that the Town of Colma adopt a resolution to enter into a ten-year contract with AXON for Body Worn Cameras, In Car Cameras, Tasers, Electronic Evidence Storage , and Drones (Unmanned Aerial Systems).

RESOLUTION NO. 2025-XX

OF THE CITY COUNCIL OF THE TOWN OF COLMA

RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A SOLE SOURCE CONTRACT WITH AXON ENTERPRISE, INC., TO PURCHASE AND

MAINTAIN BODY WORN CAMERAS, IN CAR CAMERAS, TASERS, DRONES (UNMANNED AERIAL SYSTEMS), AND ELECTRONIC EVIDENCE STORAGE; AND ALLOWING THE

PURCHASE AND USE OF DRONES
The City Council of the Town of Colma does resolve as follows:

1. Background
a) The utilization of Body Warn Cameras, In Car Cameras, Tasers, Drones, and Electronic Evidence Storage has become industry standard in law enforcement's ability to promote public safety, while providing the utmost transparency. b) Since 2021, the Town’s Police Department has used AXON’s law enforcement suite of services, including Body Cameras, In Car Cameras, Tasers, and Electronic Evidence Storage, using evidence.com, under a sole source contract approved by the City Council under Resolution No. 2021-28. That contract is set to expire in 2026. c) The Town’s Police Department seeks to continue using the AXON suite of services and seeks also to upgrade its contract with AXON to include Drone (Unmanned Aerial Systems) technology by adding two base stations and four drones capable of DFR (Drone as First Responder).
d) The contract upgrade includes optional features for disaster response and free trial items by AXON. The optional features require that the Town release AXON from liability arising from the optional programs. The Town can terminate the optional programs at any time. e) To accomplish this contract upgrade, staff recommends entering into a ten-year contract with AXON for Body Worn Cameras, In Car Cameras, Tasers, Electronic Evidence Storage, and Drones (Unmanned Aerial Systems).
f) Unmanned Aerial Systems are considered a Military Equipment Use item (AB 481 and Colma Ordinance No. 811), and as such require Council approval for acquisition and use in a law enforcement capacity.

25977.00300\44151677.1

25977.00300\44151677.1

2. Findings
a) Sole Source. The City Council finds that the contract with Axon for the purchase of Body Warn Cameras, In Car Cameras, Tasers, Drones, and Electronic Evidence Storage, including evidence.com, is exempt from competitive bidding under Colma Municipal Code section 1.06.210 because it is a sole source contract. Axon possesses the uniquely and singularly available capability to deliver the technical features integral to law enforcement use of the equipment, such as automated camera activations, secure cellular data and network connections, chain of custody controls, and digital workflow efficiency. The Axon cameras integrate with the Town's Records Management System (RIMS) and CAD System as well as with the Town's license plate reader system. The San Mateo County District Attorney's Office utilizes an evidence.com account which is the software that holds all evidence recorded by the Axon suite of cameras. b) Drones. The City Council finds that the acquisition of Drones from AXON for use in a law enforcement capacity is in the Town’s best interest and is approved per Assembly Bill 481 (California Government Code Sections 7070, et seq.), and Colma Ordinance No. 811 (Uncodified Ordinance Adopting a Military Equipment Use Policy). Drones have proven to be a critical tool for de-escalation, subject apprehension, rescues, scene reconstruction, and overall scene awareness, providing for officer and community safety. The Police Department’s drone expansion will create a Drone as a First Responder (DFR) program.

The Department will receive (4) Skydio X10 drones, capable of autonomous flight by a remote pilot. Two (2) of the X10’s will be positioned in enclosed docking stations at the Police Department. The remaining two (2) X10’s will be deployed in the field with patrol officers, allowing for redundancy or specific needs.
c) Optional Features. The City Council finds that the AXON optional features for disaster response and free trial items, including the requirement that Colma release AXON from liability arising from the optional programs, will also serve the Town’s best interests. The programs are free of charge, will assist the Town should there be an emergency requiring immediate response, and will enable the Police Department to continue to test and upgrade AXON equipment and features. The Town can terminate the optional programs at any time.

3. Order
a) The contract between the Town of Colma and Axon, a copy of which is on file with the City Clerk, including the acquisition of Drones for use in a law enforcement capacity, is approved by the City Council of the Town of Colma.
b) The City Manager is hereby authorized to execute said contract on behalf of the Town of Colma, with such minor technical amendments as may be deemed appropriate by the City Manager and the City Attorney.

Axon Customer Experience Improvement Program Appendix

1. Axon Customer Experience Improvement Program (ACEIP). The ACEIP is designed to accelerate Axon’s development of technology, such as building and supporting automated features, to ultimately increase safety within communities and drive efficiency in public safety. To this end, subject to the limitations on Axon as described below, Axon, where allowed by law, may make limited use of Customer Content from all of its customers to provide, develop, improve, and support current and future Axon products (collectively, "ACEIP Purposes"). However, at all times, Axon will comply with its obligations pursuant to the Axon Cloud Services Terms of Use Appendix to maintain a comprehensive data security program (including compliance with the CJIS Security Policy for Criminal Justice Information), privacy program, and data governance policy, including high industry standards of de-identifying Personal Data, to enforce its security and privacy obligations for the ACEIP. ACEIP has 2 tiers of participation, Tier 1 and Tier 2. By default, Customer will be a participant in ACEIP Tier 1. If Customer does not want to participate in ACEIP Tier 1, Customer can revoke its consent at any time. If Customer wants to participate in Tier 2, as detailed below, Customer can check the ACEIP Tier 2 box below. If Customer does not want to participate in ACEIP Tier 2, Customer should leave box unchecked. At any time, Customer may revoke its consent to ACEIP Tier 1, Tier 2, or both Tiers.

2. ACEIP Tier 1.

2.1. When Axon uses Customer Content for the ACEIP Purposes, Axon will extract from Customer Content and may store separately copies of certain segments or elements of the Customer Content (collectively, "ACEIP Content"). When extracting ACEIP Content, Axon will use commercially reasonable efforts to aggregate, transform or de-identify Customer Content so that the extracted ACEIP Content is no longer reasonably capable of being associated with, or could reasonably be linked directly or indirectly to a particular individual ("Privacy Preserving Technique(s)"). For illustrative purposes, some examples are described in footnote 11.

For clarity, ACEIP Content will still be linked indirectly, with an attribution, to the Customer from which it was extracted. This attribution will be stored separately from the data itself, but is necessary for and will be solely used to enable Axon to identify and delete all ACEIP Content upon Customer request. Once de-identified, ACEIP Content may then be further modified, analyzed, and used to create derivative works. At any time, Customer may revoke the consent granted herein to Axon to access and use Customer Content for ACEIP Purposes. Within 30 days of receiving the Customer’s request, Axon will no longer access or use Customer Content for ACEIP Purposes and will delete any and all ACEIP Content. Axon will also delete any derivative works which may reasonably be capable of being associated with, or could reasonably be linked directly or indirectly to Customer. In addition, if Axon uses Customer Content for the ACEIP Purposes, upon request, Axon will make available to Customer a list of the specific type of Customer Content being used to generate ACEIP Content, the purpose of such use, and the retention, privacy preserving extraction technique, and relevant data protection practices applicable to the Customer Content or ACEIP Content ("Use Case"). From time to time, Axon may develop and deploy new Use Cases. At least 30 days prior to authorizing the deployment of any new Use Case, Axon will provide Customer notice (by updating the list of Use Case at https://www.axon.com/aceip and providing Customer with a mechanism to obtain notice of that update or another commercially reasonable method to Customer designated contact) ("New Use Case").

2.2. Expiration of ACEIP Tier 1. Customer consent granted herein will expire upon termination of the Agreement.

In accordance with section 1.1.1, within 30 days of receiving the Customer’s request, Axon will no longer access or use Customer Content for ACEIP Purposes and will delete ACEIP Content. Axon will also delete any derivative works which may reasonably be capable of being associated with, or could reasonably be linked

1 For example; (a) when extracting specific text to improve automated transcription capabilities, text that could be used to directly identify a particular individual would not be extracted, and extracted text would be disassociated from identifying metadata of any speakers, and the extracted text would be split into individual words and aggregated with other data sources (including publicly available data) to remove any reasonable ability to link any specific text directly or indirectly back to a particular individual; (b) when extracting license plate data to improve Automated License Plate Recognition (ALPR) capabilities, individual license plate characters would be extracted and disassociated from each other so a complete plate could not be reconstituted, and all association to other elements of the source video, such as the vehicle, location, time, and the surrounding environment would also be removed; (c) when extracting audio of potential acoustic events (such as glass breaking or gun shots), very short segments (<1 second) of audio that only contains the likely acoustic events would be extracted and all human utterances would be removed.

directly or indirectly to, Customer.

3. ACEIP Tier 2. In addition to ACEIP Tier 1, if Customer wants to help further improve Axon’s services, Customer may choose to participate in Tier 2 of the ACEIP. ACEIP Tier 2 grants Axon certain additional rights to use Customer Content, in addition to those set forth in Tier 1 above, without the guaranteed deployment of a Privacy Preserving Technique to enable product development, improvement, and support that cannot be accomplished with aggregated, transformed, or de-identified data.
☐ Check this box if Customer wants to help further improve Axon’s services by participating in ACEIP Tier 2 in addition to Tier 1. Axon will not enroll Customer into ACEIP Tier 2 until Axon and Customer agree to terms in writing providing for such participation in ACEIP Tier 2.
