STAFF REPORT
T
O: Mayor and Members of the City Council
FROM: Brad Donohue, Director of Public works and Planning Jim Porter, Senior Project Manager
VIA: Dan Barros, City Manager
MEETING DATE: October 22, 2025
SUBJECT: Amendment No. 2 to the Design Services Agreement with Black and Veatch for the Colma Creek Trash Capture Project

RECOMMENDATION
Staff recommends that the City Council by Motion:

APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2 TO THE

AGREEMENT FOR DESIGN SERVICES WITH BLACK AND VEATCH CORPORATION FOR EXTRA

DESIGN WORK FOR THE COLMA CREEK TRASH CAPTURE PROJECT AND APPROVE A PROJECT DESIGN CONTINGENCY IN AN AMOUNT OF $100,000 THAT IS MANAGED BY THE CITY MANAGER, PURSUANT TO CEQA GUIDELINE 15306.

COUNCIL ADOPTED VALUES
T
he recommendation is consistent with the Council value of responsibility because it allows staff to continue and complete the design, environmental clearance, and permitting of a project to mitigate trash impacts in Colma Creek and the San Francisco Bay.

BA

CKGROUND
The San Francisco State Regional Water Quality Control Boards (SWRCB) Municipal Regional Permit 3.0, (MRP) requires that jurisdictions conveying stormwater into the waters of the US capture 100% of trash before the stormwater reaches the receiving water. Permittees must implement trash load reduction control actions in accordance with the following schedule and trash generation area management requirements, including mandatory minimum full trash capture systems, to meet the goal of 100% trash load reduction or no adverse impact to receiving waters from trash by June 30, 2025.

To meet the goal of a 100% trash load reduction and in cooperation with neighboring jurisdictions and CalTrans, the Town assumed the lead agency role for implementing a project AGENDA ITEM #6

Amendment No. 2 to Black and Veatch Contract
City Council Meeting, 10-22-2025 Page 2 of 4
to install full trash capture devices in Colma Creek near McClellan Drive in South San Francisco.

CalTrans has agreed to provide funding for design and construction. The Town was awarded $7.04 million to design and construct the project. The Town is also applying for an additional $5.8 Million due to recent expansion of the project to include treatment of runoff from Old Colma Creek to accommodate a larger portion of Daly City and South San Francisco. Staff submitted this request to the California Transportation Commission (CTC) for approval. The Town and its partners expect to hear back from the CTC in the early part of 2026 on approval of the additional funding request.

The Town approved a design contract with Black and Veatch Corporation (Contractor) to design and permit the Colma Creek Trash Capture Project, (Project) in September of 2024. The scope of work that was agreed upon detailed the scope of work for environmental clearance, permitting and design work.

ANALYSIS
During the current and ongoing design phase of the Project, various permitting agencies requirements became more onerous than originally expected. This in turn required the Contractor to expend additional time and effort in redesigning the project and verifying its functionality through additional hydraulic modeling. The City Manager recently approved Amendment No. 1 to the Agreement under his authority to modify contracts detailed in Colma Municipal Code Section 1.06.080 as the dollar value of the amendment at $26,280 did not exceed 10% of the original contract price of $890,698. The cumulative value of Amendment No. 1 and this new Amendment No. 2 exceeds the City Manager’s authority to modify contracts under Colma Municipal Code Section 1.06..080. Therefore, City Council approval of Amendment No. 2 is required.

The scope of work detailed in Amendment No. 2 is needed to satisfy one of the permitting agencies. The San Mateo Flood and Sea Level Rise Resiliency District (One Shoreline) has requested additional hydraulic modeling to demonstrate that the proposed trash capture device will not impact channel hydraulics adversely if installed. The proposed modeling of how the trash capture device will impact the hydraulics within the creek during various storm events (50, 100-year storm including climate change factors) will provide assurance that the device will not have impacts on adjacent properties. This study will also provide a deeper analysis of the proposed device and the surrounding creek structure and creek capacity.

Lastly, staff is requesting that you appropriate $100,000 in contingency to be managed by the City Manager for future unexpected requests or changes to the design that have come in via outside agencies or others.

Reasons For the Recommended Action
Approving and authorizing the City Manager to execute the Amendment No. 2 to the Black and Veatch Design Contract and approving a $100,000 spending amount to be managed by the Town’s City Manager will enable staff and the Design Consultant to bring this phase of the project to completion. This will also enable the Town and its partners to meet their MRP obligations.

Amendment No. 2 to Black and Veatch Contract
City Council Meeting, 10-22-2025 Page 3 of 4
Sustainability Impact
Completing the design of a full trash capture devices will have a positive impact on water quality by reducing and eliminating trash related impacts in the Colma Creek channel and San Francisco Bay.

FISCAL IMPACT
Black and Veatch original Contract $ 890,698.00
Amendment #01-Supplemental Analysis/additions OPCC $ 26,280.00 Amendment #02- Supplemental Hydraulic Modeling $ 49,990.00 New Contract Amount $ 966,968.00
Caltrans will reimburse the Town on receipt of assigned invoices for project costs incurred and paid to Black & Veatch Corporation

ENVIRONMENTAL
The City Council’s action is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15306 as information collection.

City Council approval will authorize information gathering, environmental review and design for a full trash capture device. Once all the data and information is studied and obtained, and a design is developed, CEQA analysis will be conducted. Any potential installation of the project will only be considered after the CEQA analysis is considered.

ALTERNATIVES
The City Council can choose not to move ahead with approval of Amendment No. 2. This is not recommended. Foregoing the additional studies will delay the project, thus submitting the Town to potential violations with the State Water Board. Currently staff is asking for relief and extending the due date to comply with 100% trash reduction goal by the end of 2025. Not approving the expenditure will compromise our negotiations with the State. Additionally, the Town and its partners could be forced to reimburse Caltrans for expenditures to date related to the design phase, which currently exceeds $687,033.

RECOMMENDATION
Approve and authorize the City Manager to execute Amendment No. 2 with Black and Veatch Corporation for additional design work for the Colma creek trash capture project and approve project design contingency in an amount of $100,00 that is managed by the City Manager, pursuant to CEQA Guideline 15306.

Subject: Colma Creek Trash Capture Improvement Proj ect - Amendment No. 1

Dear Jim:

The Town of Colma and Black & Veatch entered into a Professional Services Agreement for the Colma Creek Trash Capture Improvement Project on Oc tober 15, 2024. Black & Veatch values the relationship we’ve built with the Town on this project, and we believe we are making good progress toward bidding and construction in 2026. Since the project inception additional efforts outside the agreement scope have been required, which impact bo th our budget and our timeline for project completion.

SUMMARY OF CHANGES

Specific areas of additional work are review of existing hydraulic modeling under Task 3 and development of an additional Opinion of Probable Co nstruction Cost under Task 5.

Details for the additional work are as follows:

1) Task 3.5: BV’s scope included review of the existing Colma Creek Hydraulic Model prepared in 2021 for the County of San Mateo by Paradigm. Follo wing review of the model, we determined that the model did not include a split of flows in the old and new channels upstream of their confluence, and that channel flows appeared to be e xtremely low compared to prior flow data provided by the County. An accurate estimate of flows in each channel was critical for us to size the trash capture devices and determine the im pacts of the devices on existing channel hydraulics. Following several discussions with the Town and Paradigm, the Town agreed to retain Paradigm to modify the existing model to show the upstream flows in better detail. This resulted in additional time spent on this task by Black & Veatch, both in discussions with the Town and Paradigm, review of an additional hydrauli c document, and internal discussion to discuss and confirm the new material.

2) Task 5.1: BV’s scope included development of an OPC C during the 60% design phase. The Town requested that an OPCC be developed at the Design A lternate Development stage on April 2, 2025. This was an additional OPCC not included in t he scope of work.

Subject: Colma Creek Trash Capture Improvement Project - Ame ndment No. 2 Task 3.7 - Supplemental Hydraulic Modeling
Dear Jim:

The Town of Colma and Black & Veatch entered into a Professional Services Agreement for the Colma Creek Trash Capture Improvement Project on Oc tober 15, 2024. Black & Veatch values the relationship we’ve built with the Town on this project, and we believe we are making good progress, and are hopeful that some portion of construction can be completed in 2026.

Based on comments received from OneShoreline on the 60% design submittal and subsequent discussion with OneShoreline and other stakeholders on September 12, 2025, the Town has requested that BV perform additional hydraulic modeling to address OneShoreline’s concerns. Our proposal to perform this work is included below.

SUMMARY OF CHANGES

BV will perform the additional work on new Subtask 3.7, Supplemental Hydraulic Modeling:

1)Task 3.7.1: BV will prepare a Computational Fluid Dynamics (CFD) model of the Colma Creek Channels within the project limits. The model will extend sufficiently upstream and downstream so that boundary conditions will not affect flow veloc ity and water surface elevation in the area of interest. Model results will be assessed for potential erosion due to high flows in the channel; flow velocity and shear stress will be evaluated. The model will use flows for the 100-year, 6-hour storm with climate change; specifically, the flows utilized by BV in preparation of the Basis of Design Repo rt.

Other flow conditions may be evaluated based on preliminary results.

2) Task 3.7.2.1: BV will revise the HEC-RAS 2D models (existing and proposed conditions) previously created for Colma Creek and extend the model upstre am into the Old Colma Creek Channel through the upstream limits of the existing topographic survey. The topographic survey extends to the first bridge within the Treasure Island Trailer Park. If needed, additional terrain data for the old Colma Creek Channel will be obtained from USGS to supplem ent the available topographic survey. BV will also revise the proposed condition models to incorp orate a hole for fish passage.

BV will run the HEC-RAS 2D models under three climate scenarios for the existing channel conditions:
• 50-year 6-hour without climate change
• 50-year 6-hour with climate change
• 100-year 6-hour with climate change

BV will run the HEC-RAS 2D model under five climate scenarios for the proposed channel conditions:
• 1-year 1-hour without climate change
o Based on Paradigm’s final report “Colma Creek Hydrologic Model Updates, 12/20/2024, the 1-year 1-hour percentage increase i n rainfall depth is 14%. Our assumption is that the peak flow will be reduced by 14% for existing conditions. The 1-year 1-hour peak flow with climate change is 1105 cfs for New Colma Creek and

Town of Colma Amend 2 | Page 2
226 cfs for Old Colma Creek. As a result, the 1-year 1-hour peak flow without climate change will be set as 969 cfs for New Colma Creek and 198 cfs fo r Old Colma Creek.

• 1-year 1-hour with climate change
• 50-year 6-hour without climate change
• 50-year 6-hour with climate change
• 100-year 6-hour with climate change

3) Task 3.7.2.2: BV will model the existing and proposed channel conditions using effective FEMA flows to determine if the proposed construction impa cts water surface elevations within the Treasure Island Trailer Park. The water surface elevation wil l only be modeled for 100-year 6-hour storm event without climate change and the model will be run under steady state conditions, consistent with FEMA.
