RECOMMENDATION
This item is a study session for informational purposes only. No City Council action is required.
This staff report is being presented to provide information to the City Council regarding fees related to Town services.
COUNCIL ADOPTED VALUES
By reviewing and commenting on the proposed “Draft” User Fee and Charges Study, City Council taking a Responsible approach in amending the Towns Master Fee Schedule in a way that it is fair and equitable to those receiving services.
E
XECUTIVE SUMMARY
The Town last adopted a new Fee Study in 2019 in order to adopt a Master Fee Schedule. The Town recently completed a Cost of Service St udy to identify the cost of providing various user fee related services. The Town’s chief purposes in conducting this new Study were to ensure that existing fees do not exceed the costs of service and to provide an opportunity for the City Council to re-align fee amounts with the adopted cost recovery policies.
A
s part of this new study, a schedule of fees was prepared. The schedule of fees identifies services provided by, or on behalf of, the Town and the costs charged for providing these services. A fee adjustment based on the User Fee Study would allow Planning, Building, Engineering, Police, and Recreation revenues to be more purposefully directed to funding services performed for the community. The study and staff’s recommendations are intended to be considered upon completion of this Study Session. This Study Session provides all interested parties an opportunity AGENDA ITEM #8

to comment or request clarification regarding any of the fees proposed in this cost of service (Fee Study) prior to City Council adoption of new or changed fees.
BACKGROUND
F
ee-related services typically benefit an individual, business, or group. Since these services typically provide a specific benefit, municipalities often seek to recover all, or a greater portion of the costs for providing fee -related services from those benefitting from the service provided. It has been several years since the Town amended its Fee Schedule for the Planning, Building and Engineering Departments. One of the City Council’s priority focus areas is to enhance the Town’s long-term financial stability. Adopting a new fee schedule with an annual review of fees and fee adjustments will assist the Town in its long-term financial stability by recovering a greater portion of costs.
The California constitution (propositions 13, 218 and 26) and various state laws have placed both substantive and procedural limits on cities’ ability to impose fees and charges. Proposition 26 contains a more general articulation of the cost of service principle and includes a requirement that “The local government bears the burden of proving by a preponderance of the evidence that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to cover the reasonable costs of the governmental activity, and that the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor's burdens on, or benefits received from, the governmental activity.”
California law prohibits jurisdictional entities to set user fees or charges based upon subjective justification or based on what neighboring cities charge. The Law is more specific and demanding, entitling jurisdictions to charge a fee that is fair and reasonable, and which does not exceed what it costs the jurisdiction to perform that service. To determine the Town’s actual costs, the Town hired the services of NBS to review the Town’s costs to perform the various services rendered by the Planning, Building, Engineering, Parks and Recreation, and Police Departments. The user fees study included a thorough analysis of the total cost of providing services, including all applicable direct, indirect and overhead costs associated with specific services. This was a coordinated effort among the five above mentioned departments, and included many meetings between NBS and Town Staff to review updates and provide feedback.
ANALYSIS
The following categories of fees were examined in the current study:
• P
lanning services, including the actual costs of providing various types of reviews and adding application types where fees have not been collected in the past; • B
uilding services, establishing a base fee based on the value of the improvement (valuation), including development plan review, zoning compliance review and other planning activities, building plan check and inspection and other building safety activities; Staff Report - Study Session, Fee Study Page 3 of 11
• Public Engineering services, including engineering land development review (such as the review of grading and public improvement plans), encroachment permits, and stormwater (NPDES) permitting;
• P
arks and Recreation services, including fees for program level analysis for a variety of programs such as day camps, youth/teen/adult/senior programs, contract classes and programs, special events and facility rentals;
• P
olice services, including fees for administrative records and processing requests; • A
dministrative Fees handled by the Finance and City Clerk Departments, including application/permit processing; and
• N
ewly added General Plan Fee and Geographical Information Services (GIS) Fee.
T
he fees examined in this study specifically excluded utility rates, development impact fees, and special assessments, all of which fall under distinct analytical and procedural requirements different from the body of user/regulatory fees analyzed in this effort.
Me
thods of Analysis
T
here were three primary phases of analysis used throughout this Comprehensive User Fee Study:
• Co
st of service analysis
• Cost recovery evaluation
• Fee establishment
C
ost of Service Analysis
T
his cost of service analysis is a quantitative effort that compiles the full cost of providing governmental services and activities. There are two primary types of costs considered: direct and indirect costs. Direct costs are those that specifically relate to an activity or service, including the real-time delivery of the service. Indirect costs are those that support delivery of services in general but cannot be directly or easily assigned to a singular activity or service.
Components of the full cost of service include direct labor costs, indirect labor costs, specific direct non- labor costs where applicable, allocated non-labor costs, and allocated Town-wide overhead.
Definitions of these cost components are as follows:
Labor costs – Salary, wages and benefits expenses for Town personnel specifically involved in the provision of services and activities to the public.
I
ndirect labor costs – Personnel expenses supporting the provision of services and activities. This can include line supervision and departmental management, administrative Staff Report - Study Session, Fee Study Page 4 of 11
support within a department, and staff involved in technical activities related to the direct services provided to the public.
S
pecific direct non- labor costs – Discrete expenses incurred by the Town due to a specific service or activity performed, such as contractor costs, third -party charges, and very specific materials used in the service or activity. (In most fee types, this component is not used, as it is very difficult to directly assign most non- labor costs at the activity level.)
Al
located indirect non-labor costs – Expenses other than labor for the departments involved in the provision of services. In most cases, these costs are allocated across all services provided by a department, rather than directly assigned to fee categories.
A
llocated indirect organization -wide overhead – These are expenses, both labor and non-labor, related to agency-wide support services. Support services include general administrative services such as City Manager, Finance, etc. An agency’s support services departments assist the direct providers of public service. The amount of costs attributable to each department or program included in this Study were sourced from a se parate Indirect Cost Calculation, prepared by NBS.
It
should be noted that the development of these time estimates was not a one -step process:
estimates received were carefully reviewed by both NBS and departmental management to assess the reasonableness of such estimates. Based on this review, the Town re considered its time estimates until both parties were comfortable that the fee models reasonably reflected the average service level provided by the Town. Then, time estimates were applied to the appropriate fully burdened labor rate to yield an average total cost of the service or activity.
All cost components in this Study use annual (or annualized) figures, representing a twelve-month cycle of expenses incurred by the Town in the provision of all services and activities agency-wide.
Cost Recovery Evaluation
A
cost recovery rate of 0% means no costs are recovered from fee revenues, and that the cost of the service was borne entirely by the Town, primarily the General Fund. A rate of 100% means that the full cost of service is recovered from the fee. A rate between 0% and 100% indicated partial recovery of the full cost of service through fees, while the remainder was subsidized by the Town.
Determining the targeted level of cost recovery from a new or increased fee is not an analytical exercise. Instead, its targets and recommendations always reflect agency -specific judgements linked to a variety of factors, such as existing Town policies, agency -wide or departmental revenue objectives, economic goals, community values, market conditions, level of demand, and others.
In selecting an appropriate cost recovery target, Staff considered the public and private benefits of the service or activity in question. When a service or activity completely benefits the public at large, it can be argued reasonably that there should be no cost recovery from fees that a truly Staff Report - Study Session, Fee Study Page 5 of 11
public-benefit service is best funded by the general resources of the Town, such as General Fund revenues. Conversely, when a service or activity completely benefits an individual or entity, it can be argued reasonably that 100% of the cost should be recovered from fees collected from the individual or entity.
Questions to be considered in establishing user fees:
• If optimizing revenue potential is an overriding goal, is it feasible to recover the full cost of service?
• Will increasing fees result in non-compliance or public safety problems? • Are there desired behaviors or modifications to behaviors of the service population helped or hindered through the degree of pricing for the activities? • Does current demand for services support a fee increase without adverse impact to the citizenry served or current revenue levels? (In other words, would fee increases have the unintended consequence of driving away the population served?) • Are there broader Town objectives that inform a less than full cost recovery target from fees, such as economic development goals and local social values? • Should the Town adjust user fees and regulatory fees on an annual basis to keep pace with cost inflation?
Because this element of the Study is subjective, NBS provides the cost of service calculation based on 100% full cost recovery as well as the framework for the Town to adjust in accordance with the Town’s goals as pertains to code compliance, cost recovery , economic development, and social values.
Another point to consider would be for future fee schedule adjustments, recommended annually, in keeping up with the cost of inflation is to approve an annual modifier to the fees such as the Consumers Price Index (CPI) or a percentage of labor cost increase. Should the Town adjust user fees and regulatory fees on an annual basis to keep pace with cost inflation? If so, should the Town utilize the CPI with CPI-U measure and bring it to the City Council for approval annually or have the annual adjustment applied administratively?
F
ee Establishment
O
nce the full cost of service was established and cost recovery targets were set, fees were calculated. The fully burdened rate was applied to an average labor time estimate to generate the average full cost of service for the Planning, Building, Engineering, Parks and Recreation, and Police Departments. The attached fee schedules within the draft report reflect a 100% Cost Recovery. An additional column is included where staff is recommending a lower cost of recovery.
For example, the 100% cost recovery rate for the processing of a sign permit could equal or exceed the cost of the sign itself, so a lower fee is recommended.
M
uch of the Town’s fee schedule is composed of flat fees, which are linked to an average cost of service. The average cost method is the predominant approach in establishing the schedule of revised fees. Flat fee structures based on average costs of service is a generally accepted approach and is widely applied among other California municipalities. For the few activities where estimating an average was impossible due to the highly variable or complex nature of the service Staff Report - Study Session, Fee Study Page 6 of 11
in the Planning and Engineering Departments, – use of fully burdened hourly rates coupled with time tracking is the preferred fee collection method, except for smaller projects being charged out to a flat rate charge . In other words, the Town would collect a deposit and charge against the deposit for work on the project based on an established hourly billing rate. This process would require some degree of time estimation or outright time-tracking at the project level to establish an initial project deposit. The Building Department would continue to base their permitting and plan check charges on flat fees based on the valuation of the project.
COMPARATIVE FEE STUDY
The Draft report presents the results of the Comparative Fee Survey for the Town of Colma. Often policy makers request a comparison of their jurisdiction’s fees to surrounding or similar communities. The purpose of a comparison is to provide a sense of the local market pricing for services, and to use that information to gauge the impact of recommendations for fee adjustments.
NBS worked with the Town to choose five comparative agencies: Cities of Daly City, South San Francisco, Brisbane, Pacifica, and San Bruno. Please refer to Appendix B .1 through B.5 of the User Fee Study for this information. The following should be noted about the general approach to, and use of, comparative survey data:
• Comparative surveys do not provide information about the cost recovery policies or procedures inherent in each comparison agency.
• A “market based” decision to price services below the full cost of service calculation, is the same as planning to subsidize that service.
• Comparative agencies may or may not have based their fee amounts on the estimated and reasonable cost of providing services.
• Comparative fee survey efforts are often non -conclusive for many fee categories.
Comparison agencies typically use varied terminology for provision of similar services.
NB
S made reasonable attempts to source each comparison agency’s fee schedule from the Internet and compile a comparison of fee categories and amounts for the most readily comparable fee items that match Colma’s existing fee structure.
D
ATA SOURCES
T
he following data sources were used to support the cost of service analysis and fee establishment phases of this Study:
• The Town of Colma’s Adopted Budget for Fiscal Year 2025-26 • Information on the current and historical utilization of Town contracted professional services related to Planning, Engineering, and Building services • Prevailing fee schedules
• Annual workload data provided by each division studied Staff Report - Study Session, Fee Study Page 7 of 11
The Town’s adopted budget is the most significant source of information affecting cost of service results. This Study has accepted the Town’s budget as a legislatively adopted directive describing the most appropriate and reasonable level of Town spending.
CHANGES TO THE USER FEE STUDY AND FEE SCHEDULE
Several changes have been made in the current User Fee Study since the previous one was presented to the City Council in 2019 and are discussed below.
Added Departments
In order to make the new Fee User Study comprehensive to the overall Town , two additional departments have been provided including: Police, and Parks and Recreation. The discussion of these two departments have been provided in the User Fee Study, Chapters 5 – Police with appendices A.4, and Chapter 6 – Recreation Department with appendix B.5, respectively.
Police Department
The Colma Police Department provides all-inclusive enforcement services for the Town. Most activities and services provided by the Police Department are not recoverable via user or regulatory fees as they are general public safety and the day to day preservation of public order.
Only a small percentage of the total annual costs are eligible for recovery from fee for service activities. The scope of the analysis for the Police Department focused solely on fees for various administrative records and processing requests provided by the Department.
Recreation Department
The Recreation Department offers a range of recreation programs and services, as well as facilities for recreational use and rental. Unlike other fee programs described on this Study, this Department’s results reflect a program level analysis (as opposed to the individual fee level) including a general cost recovery evaluation of the following programs: Day Camps, Youth/Teen/Adult/Senior Programs, Contract Classes and Programs, Special Events (City Sponsored & Private ), and Facility Rentals. The Recreation Department receives its fu nding primarily from the General Fund.
The expenses of administering, operating, and maintaining the Town’s recreational programs and facilities are primarily funded by resources from the General Fund. However, fees collected from class participants and rentals of public spaces can represent a significant sou rce of funding to help cover costs and sustain, if not improve, the level of service provided by the Town.
Burdened Hourly Rate
The cost of providing governmental services increases over time. The last time the fully burdened hourly rates were increased was in 2019 with the adoption of the Master Fee Schedule. The fully burdened hourly rates have changed in the present User Fee Study and are as follows:
Staff Report - Study Session, Fee Study Page 8 of 11
TABLE 1: Existing vs. Proposed Burdened Hourly Rate
Department Existing Hourly Rate
(Previous 2018 User
Fee Study)
Proposed Hourly Rate
(Current User Fee
Study)
Planning $161 $253
Engineering $209 $317
Building $156 $210
These new rates are proposed in the recommended Fee Schedule.
All Department Fees
For the most part, all d epartment fees (Planning, Building, Engineering, Parks and Recreation, and Police) provided in the User Fee Study are recommended for 100% cost recovery with a few exceptions where it would be considered too burdensom e to the applicant or property owner .
The Council may wish to reduce the amount of cost recovery . Please refer to Attachment 1 for the User Fee Study.
Additional New Fees Proposed
General Plan Maintenance Fee
In order to ensure funding is available for the significant costs associated with comprehensive General Plan updates and implementation, the Town estimated a need for approximately $1.2 million in contract costs required to comprehensively update the General Plan over an eight to ten year period, including required annual amendments. The estimated annual costs of a comprehensive general plan update and its associated implementation is approximately $261,750.
A General Plan Maintenance Fee would help offset future operational costs associated with preparation of new, updates, or amendments to a General Plan and its implementation. This would include General Plan Comprehensive Updates, Zoning Ordinance Updates, Housing Element Updates, Zoning Ordinance Annual Amendments, and Housing Element Annual Amendments. It would not pay for the full cost of these, though, would aid in providing some funding set aside for the General Plan.
As indicated in Chapter 7 of the User Fee Study, a certain percentage of a permit would be added as a General Plan Maintenance Fee would be applied for specific Planning, Building and Engineering services. Table 13, General Plan Surcharge Cost Recovery Examples, in the User Fee Study shown below, shows a General Plan Maintenance fee applied at various percentages, .05%,
8.18%, 20.45%, and 81.80% for three different types of permit fees, Major Design Review , Staff Report - Study Session, Fee Study Page 9 of 11
Building Plan Check from $100k-$500k valuation, and Grading Inspection for 501 to 2,000 cubic yards.
Table 13. General Plan Surcharge Cost Recovery Examples
As shown in Table 13 above, an example of how the General Plan Maintenance Fee is applied is the Major Design Review permit which has a permit fee of $15,454 with a General Plan Maintenance fee of .50% or $77, would be added to the fee for a total amount of $15,531.
Table 14, General Plan Surcharge Cost Recovery Outcomes, of the User Fee Study shown below, provides a General Plan Maintenance fee with a recommended cost recovery of .6%, or a total $1,597 would be generated of the $261,750 annual cost recovery surplus.
Table 14. General Plan Surcharge Cost Recovery Outcomes
Additional details regarding the General Plan Maintenance Fee are provided in the attached User Fee Study, Chapter 7. The City Council should discuss whether the Town should apply a General Plan Maintenance Fee to certain permits and, if so, how much.
GIS (Geographical Informational Systems) Fee
Similarly to the General Plan Maintenance Fee, the GIS Fee is a new surcharge that staff is recommending. This fee would help offset future operational costs to maintain GIS as new information would be inputted into its database. An example of this could be as a new development project is submitted and approved , details about the project are added to the database. It is not expected that this fee would pay for the entire GIS maintenance, though , would help offset funds for this purpose. The User Fee Study assumes that for every $1,000.00 of permit value for Planning, Building and Engineering services, .0375% or $3.75, would be added to the permit fee. Additional details regarding the General Plan Maintenance Fee are provided in the attached User Fee Study, Chapter 7. The City Council should discuss whether the Town should apply a GIS Fee to certain permits and, if so, how much.

Annual Adjustment to User Fees and Regulatory Fees
The City Council may wish to consider adjusting the user fees and regulatory fees on an annual basis as the cost to keep pace with cost inflation. For all fees and charges, for example, the Town could use a Consumer Price Index for the San Francisco-Oakland-Hayward area adjustment with the CPI-U measure that is applied to the Town’s new fee schedule on an automatic CPI adjustment or an annual review by the City Council. Conducting a comprehensive user fee study is not an annual requirement and only becomes worthwhile over time as shifts in organization, local practices, legislative values, or legal requirements result in significant change.
ENVIRONMENTAL
The City Council review of the User Fee Study is not a project under the California Environmental Quality Act pursuant to Guideline 15378 as it is more akin to a governmental fiscal activity without any commitment to any specific project.
FISCAL IMPACT
The Town incurred the cost of NBS, Fee Study Consultant and Town staff to conduct the study, analysis and prepare documents for the City Council review. The direction provided by the City Council will have future fiscal impact.
CO
NCLUSION
The Staff Report is for review and discussion regarding the draft user fees and proposed charges.
Staff is requesting that City Council give their opinions and make suggested changes that will lend to fair and equitable cost recovery for services that are rendered to the public for specific services. To focus on the Council’s discussion, staff recommends consideration of the questions listed in the above ‘Cost Recovery Evaluation’ section again provided below and a few additional ones:
• If o
ptimizing revenue potential is an overriding goal, is it feasible to recover the full cost of service?
• If so, should the Town utilize the CPI with CPI- U measure and bring it to the City Staff Report - Study Session, Fee Study Page 11 of 11
Council for approval annually or have the annual adjustment applied administratively? • Should the Town add a General Plan Maintenance Fee? If so, how much? • Should the Town add a GIS Maintenance Fee? If so, how much? • Should the Town subsidize part of the permit costs, (i.e., 5%, 10%, etc.)?

TOWN OF COLMA
User Fees and Charges Study 3
EXECUTIVE SUMMARY
NBS performed a User Fees Study (Study) for the Town of Colma (Town). The purpose of this report is to present the findings and recommendations of the various fee analyses performed as part of the Study and provide the Town with the information needed to update and establish fees for services. The Study’s process ensures that not only are the fees and charges reasonable and equitable, but that they also meet industry standards and uphold the statutory requirements of the State of California.
California cities, counties, and special districts may impose user and regulatory fees for services they provide through provisions set forth in the State Constitution, Article XIII C § 1. Under this legal framework, a fee may not exceed the reasonable cost of providing the service or performing the activity. For a fee to qualify as such, it must relate to a service or activity performed at the request of an individual or entity upon which the fee is imposed, or their actions specifically cause the local government agency to perform additional activities. In this instance, the service or underlying action causing the local agency to perform the service is either discretionary and/or is subject to regulation. As a discretionary service or regulatory activity, the user fees and regulatory fees considered in this Study fall outside of the definition and statutory requirement to impose general taxes, special taxes, and fees as a result of property ownership.
The Town’s main reason for conducting this Study was twofold: (1) first, to ensure that existing fees do not exceed the costs of service, and (2) second, to provide an opportunity for the City Council to re-align fee amounts with localized cost recovery policies.
1.1 Findings
The Study identified an estimated $2.4 million in eligible costs for recovery from fees for service compared to approximately $479,000 the Town is currently collecting each year from fees. The following table provides a summary of the Study’s results :
Table 1. Report Summary
As shown in Table 1, the Town is recovering approximately 20% of the costs associated with providing user and regulatory fee-related services. However, it should be noted that fees for recreational services are typically subsidized for community benefits by other General Fund revenues and the method of setting recreational fees is different than other departments, which is explained in further detail in Section 6.4.
Due to the impact of the Recreation Department on the overall cost recovery picture, the “Subtotal w/o Recreation” illustrates the current cost recovery without Recreation, which is 38% of the costs associated with providing user and regulatory fee-related services. Should Council adopt fees at 100% of the full cost Division

recovery amounts determined by this Study, an additional $460,000 in costs could be recovered, excluding the Recreation Department’s impact.
However, as Section 2.2.3 later explains, there may be other local policy considerations that support adopting fees at less than the calculated full cost recovery amount. Since this element of the Study is subjective, NBS provided the maximum potential of fee amounts at 100% full cost recovery for the Town to consider. As such, Town Staff provided initial recommended fee amounts for Council’s consideration. If Council elects to adopt fee levels at staff’s recommendations, an additional $197,000 in costs could be recovered, for a 64% cost recovery outcome for services provided. Once City Council has reviewed and evaluated the results of the Study, the Town can set fees at appropriate cost recovery levels according to local policy goals and considerations.
1.2 Report Format
This report documents analytical methods and data sources used throughout the Study, presents findings regarding current levels of cost recovery achieved from user and regulatory fees, discusses recommended fee amounts for Council’s consideration, and provides a comparative survey of fees to neighboring agencies for similar services.
The report is organized into the following sections:
Section 2 – General framework, approach and methodology of the Study. Sections 3 through 7 – Discusses the results of the cost of service analysis including: (1) fully burdened hourly rates, (2) calculation of the costs of providing service, (3) cost recovery performance of each fee category, and (4) the staff-recommended fees for providing services. Section 8 – Grand scope conclusion of the analysis provided in the preceding sections. Appendices – Additional analytical details of the analysis performed, and a comparison of fees imposed by selected agencies for similar services.
The Town’s Staff Report will include a Master Fee Schedule document which incorporates recommendations for review and adoption by Council.
TOWN OF COLMA
User Fees and Charges Study 5
INTRODUCTION AND FUNDAMENTALS
2.1 Scope of Study
The Study evaluated user and regulatory fees managed by the following Town departments and divisions:
Planning Division
Engineering Division
Building Division
Police Department
Recreation Department
The fees examined in this Study specifically excluded utility rates, development impact fees, and special assessments, all of which fall under distinct analytical and procedural requirements different from the body of user/regulatory fees analyzed in this effort. Additionally, this Study and the resultant Master Fee Schedule excluded facility and equipment rental rates, and most fines and penalties imposed by the Town for violations of its requirements or codes. 1
2.2 Methods of Analysis
There are three phases of analysis completed for each Town department or program studied:
2.2.1 COST OF SERVICE ANALYSIS
This Cost of Service Analysis is a quantitative effort that compiles the full cost of providing governmental services and activities. There are two primary types of costs considered: direct and indirect costs. Direct costs are those that specifically relate to an activity or service, including the real-time provision of the service. Indirect costs are those that support the provision of services in general but cannot be directly or easily assigned to a singular activity or service.
Direct Costs:
Direct personnel costs – Salary, wages and benefits expenses for personnel specifically involved in the provision of services and activities to the public. 2 Direct non-personnel costs – Discrete expenses attributable to a specific service or activity performed, such as contractor costs, third-party charges, and materials used in the service or activity.
1 According to the California Constitution Article XIII C § 1 (e) (4) and (5), the Town is not limited to the costs of service when charging for entrance to or use of government property, or when imposing fines and penalties. 2 The Town utilizes contracted professionals to provide all Planning, Engineering and Building Division services relevant to this User Fees Study. Therefore, NBS utilized both historical tracked hours and adopted budget expenses as the basis for analysis.
TOWN OF COLMA
User Fees and Charges Study 6
Indirect Costs:
Indirect personnel costs – Personnel expenses supporting the provision of services and activities. This can include line supervision and departmental management, administrative support within a department, and staff involved in technical support activities related to the direct services provided to the public.
Indirect non-personnel costs – Expenses other than labor involved in the provision of services.
In most cases, these costs are allocated across all services provided by a department, rather than directly assigned to individual fee/rate categories. Overhead costs – These are expenses, both labor and non-labor, related to agency-wide support services. Support services include general administrative services such as Town Manager, Finance, Human Resources, etc.
All cost components in this Study use annual (or annualized) figures, representing a twelve-month cycle of expenses incurred by the Town in the provision of all services and activities agency-wide.
Nearly all the fees under review in this Study require specific actions on the part of Town staff to provide the service or conduct the activity. Since labor is the primary underlying factor in these activities, the Study expresses the full cost of service as a fully burdened cost per labor hour. NBS calculated a composite, fully burdened, hourly rate for each department, division, program, or activity, as applicable to the specific organization and needs of each area studied. This rate serves as the basis for further quantifying the average full cost of providing individual services and activities. Determining the fully burdened labor rate for each department, and various functional divisions within a department, requires two data sets: (1) the full costs of service, and (2) the number of staff hours available to perform those services. NBS derived the hours available based on the complete list of all Town employees and/or service hours of its contracted professionals (where applicable).
The Town supplied NBS with the total number of paid labor hours for each employee involved in the delivery of services included in this Study. These available hours represent the amount of productive time available for providing both fee-recoverable and non-fee recoverable services and activities. Available labor hours divided into the annual full costs of service equals the composite, fully burdened labor rate.
Some agencies may also use the resulting rates for other purposes than setting fees, such as calculating the full cost of general services or structuring a cost recovery agreement with another agency or third party.
NBS also assisted the Town in estimating the staff time for the services and activities listed in the Town’s fee schedule. Time tracking records for the fee programs studied as part of this analysis, when available, proved useful in identifying time spent providing general categories of service (e.g., division administration, plan review, inspection, public information assistance, etc.). However, the Town does not systematically track the service time of activities for all departments or all individual fee-level services provided.
Therefore, NBS also relied on interviews and questionnaires to develop the necessary data sets of estimated labor time. In many cases, the Town provided estimates of the average amount of time (in minutes and hours) it took to complete a typical service or activity considered on a per-occurrence basis.
Development of time estimates to inform various fee calculations was not a one-step process but required careful review by both NBS and department or division managers to assess the reasonableness of such estimates. Based on the results of this review, the Town reconsidered its time estimates until all parties were comfortable that the fee models reasonably reflected the average service level provided by the
TOWN OF COLMA
User Fees and Charges Study 7
Town. Finally, the fully burdened labor rate(s) calculated in earlier steps were applied at the individual fee level time estimates, yielding an average total cost of providing each fee for service or activity. The following provides a visual representation of the steps discussed in this section.
2.2.2 FEE ESTABLISHMENT
Much of the Town’s fee schedule is composed of flat or fixed fees, which are linked to an average cost of service. The average cost method is the predominant approach in establishing the schedule of revised fees.
Flat fee structures based on average costs of service is a generally accepted approach and is widely applied among other California municipalities.
The Town also utilizes fee structures that are based on varying project characteristics. These fees are commonly structured around project square footage, construction valuation, occupancy type, or location.
To account for services with varying costs/demands, the Town has structured some fees by size/value to account for the additional staff time and varying costs necessary to provide those services.
For the few activities where estimating an average was impossible – due to the highly variable or complex nature of the service – use of fully burdened hourly rates coupled with time tracking is the preferred fee structure. In other words, the Town would collect a deposit and charge a fee per hour of staff time, requiring some degree of time estimation or outright time-tracking at the case level.
The fee establishment process includes a range of considerations, including the following:
Addition to and deletion of fees – The Study provided each department the opportunity to propose additions and deletions to their fee schedules, as well as rename, reorganize, and clarify fees imposed. Many of these revisions allowed for better adherence to current practices, as well as the improvement in the calculation, application, and collection of the fees owned by an individual. Some additions to the fee schedule were simply the identification of existing services or activities performed by Town staff for which no fee is currently charged. Revision to the structure of fees – In most cases, the focus was to re-align the fee amount to match the costs of service and leave the current structure of fees unchanged. However, in
TOWN OF COLMA
User Fees and Charges Study 8
several cases, fee categories and fee names were simplified or re-structured to increase the likelihood of full cost recovery, or to enhance the fairness of how the fee applied to various types of fee payers.
Documentation of tools to calculate special cost recovery – The Town’s fee schedule should include the list of fully burdened rates developed by the Study. Documenting these rates in the fee schedule provides an opportunity for the City Council to approve rates for cost recovery under a “time and materials” approach. It also provides clear publication of those rates, so that all fee payers can readily reference the basis of any fee amounts. The fee schedule should provide language that supports special forms of cost recovery for activities and services not included in the adopted master fee schedule. In these rare instances, published rates are used to estimate a flat fee or bill on an hourly basis, which is at the department director’s discretion.
2.2.3 COST RECOVERY EVALUATION
The NBS fee model compares the existing fee for each service or activity to the average total cost of service quantified through this analysis. Here are the possible outcomes of the fee analysis:
Cost recovery rate of 0% - This signifies that there is currently no current recovery of costs from fee revenues (or insufficient information available for evaluation). Cost recovery rate of 100% - This means that the fee currently recovers the full cost of service. Cost recovery rate between 0% and 100% - This indicates partial recovery of the full cost of service through fees.
Cost recovery rate greater than 100% - This means that the fee exceeds the full cost of service.
User fees and regulatory fees cannot exceed the full cost of service.
In all cases, the cost recovery rate achieved by a fee cannot be greater than 100%. In most cases, imposing a fee above this threshold could change the definition of the charge from a cost of service based fee to a tax which has other procedural requirements, such as ballot protest or voter approval.
NBS also assists with modeling the “recommended” or “targeted” level of cost recovery for each fee, always established at 100%, or less, than the calculated full cost of service. Targets and recommendations always reflect agency-specific judgments linked to a variety of factors, such as existing Town policies, agency-wide or departmental revenue objectives, economic goals, community values, market conditions, level of demand, and others.
A general means of selecting an appropriate cost recovery target is to consider the public and private benefits of the service or activity in question.
To what degree does the public at large benefit from the service? To what degree does the individual or entity requesting, requiring, or causing the service benefit?
When a service or activity benefits the public at large, there is generally little to no recommended fee amount (i.e., 0% cost recovery), reinforcing the fact that a service which truly benefits the public is best funded by the general resources of the Town, such as General Fund revenues (e.g., taxes). Conversely, when a service or activity wholly benefits an individual or entity, the cost recovery is generally closer to or equal to 100% of cost recovery from fees collected from the individual or entity.
TOWN OF COLMA
User Fees and Charges Study 9
In some cases, a strict public-versus-private benefit judgment may not be sufficient to finalize a cost recovery target. Any of the following other factors and considerations may influence or supplement the public/private benefit perception of a service or activity:
If optimizing revenue potential is an overriding goal, is it feasible to recover the full cost of service?
Will increasing fees result in non-compliance or public safety problems? Are there desired behaviors or modifications to behaviors of the service population helped or hindered through the degree of pricing for the activities? Does current demand for services support a fee increase without adverse impact to the citizenry served or current revenue levels? (In other words, would fee increases have the unintended consequence of driving away the population served?) Is there a good policy basis for differentiating between type of users (e.g., residents and non- residents, residential and commercial, non-profit entities and business entities)? Are there broader Town objectives that inform a less than full cost recovery target from fees, such as economic development goals and local social values? NBS provided the cost of service calculation based on 100% full cost recovery and the framework for the Town’s use to adjust the amount of cost recovery in accordance with the Town’s broader goals as they pertain to code compliance, cost recovery, economic development, and social values. Town staff and management reviewed cost of service analysis outcomes at the individual fee level and collected an initial round of “recommended fee amounts”, which may be equal to or less than the total cost of service per fee item evaluated. Appendix A presents the results of the detailed cost recovery analysis for fee recoverable services, and the Town’s staff report to the Council may be consulted to view initial recommended fee amounts proposed for Council’s consideration.
2.2.4 COMPARATIVE FEE SURVEY
Appendix B presents the results of the Comparative Fee Survey for the Town of Colma. Policy makers often request a comparison of their jurisdictional fees to those of surrounding or similar communities. The purpose of a comparison is to provide a sense of the local market pricing for services, and to use that information to gauge the impact of recommendations for fee adjustments.
In this effort, NBS worked with the Town to choose five comparative agencies: Cities of Brisbane, Daly City, Pacifica, San Bruno, and South San Francisco. It is important to keep the following in mind when interpreting the general approach to, and use of, comparative survey data:
Comparative surveys do not provide information about the cost recovery policies or procedures inherent in each comparison agency.
A “market based” decision to price services below the full cost of service calculation is the same as deciding to subsidize that service.
Comparative agencies may or may not have based their fee amounts on the estimated and reasonable cost of providing services. NBS did not perform the same level of analysis of the comparative agencies’ fees.
The results of comparative fee surveys are often non-conclusive for many fee categories.
Comparison agencies typically use varied terminology for provision of similar services.
TOWN OF COLMA
User Fees and Charges Study 10
NBS made every reasonable attempt to source each comparison agency’s fee schedule from their respective websites and compile a comparison of fee categories and amounts for the most readily comparable fee items that match the Town’s existing fee structure.
2.2.5 DATA SOURCES
The following data sources were used to support the cost of service analysis and fee establishment phases of this Study:
The Town of Colma’s Adopted Budget for Fiscal Year 2025-26 Information on the current and historical utilization of Town contracted professional services related to Planning, Engineering, and Building services Prevailing fee schedules
Annual workload data provided by each division studied The Town’s adopted budget is the most significant source of information affecting cost of service results.
NBS did not audit or validate the Town’s financial management and budget practices, nor was cost information adjusted to reflect different levels of service or any specific, targeted performance benchmarks. This Study accepts the Town’s budget as a legislatively adopted directive describing the most appropriate and reasonable level of Town spending. NBS consultants accept the Council’s deliberative process and ultimate acceptance of the budget plan and further assert that through that legislative process, the Town has yielded a reasonable expenditure plan, valid for use in setting cost-based fees.

PLANNING
The Planning Division is responsible for Advanced (long range) Planning, Current Planning (application processing), Sustainability Services, Economic Development and Neighborhood Services (code enforcement).
The Planning staff, in partnership with other Town staff, residents, and the business community, implements the community vision for the physical development of Colma, as described in the General Plan.
3.1 Cost of Service Analysis
The following table shows the Planning Division’s estimated full cost of providing services on an annual basis and the fully burdened cost per hour developed for cost recovery purposes through fees for services.
Table 2. Fully Burdened Hourly Rate
As summarized above, the Division’s total cost of providing services is approximately $655,000 annually. $256,000 in costs are targeted for recovery from the Town’s fees for services, with the remaining $399,000 as best funded via sources other than fees. All subsequent Planning Division cost of service calculations at the individual fee level assume a fully burdened hourly rate of $253 .
The cost element columns shown in Table 2 were adapted and summarized from Division staff interviews.
To assist the reader in understanding the underlying costs and assumptions used to calculate the fully burdened hourly rate, the following provides summary descriptions of each cost category:
Current Planning – Fee Recoverable – Development review and approval comprise the majority of this Division’s work efforts. 100% of these costs are eligible for recovery from the Division’s fees for service.
Current Planning – Public Information/General Counter – Activities associated with responding to phone calls and general information requests that support the development review process.
Typically, some portion of costs for provision of general public information and assistance do not apply toward recovery from fees and are considered a basic function of governmental services to the public. Planning staff estimated that approximately 50% of these costs support land use application review activities, while the remaining costs should not be considered in the calculation of fees for services.
Advanced Planning Services – Tasks and activities devoted to the advance or long range planning efforts of the Town, including the ongoing maintenance and cyclical update of the Town’s General Plan and local zoning ordinances. These costs are considered non-recoverable from Planning fee Current

but rather as part of a separate “General Plan Surcharge” fee on top of relevant planning, public works and building permits. Therefore, NBS calculated a separate General Plan Maintenance Surcharge Fee for recovery of these costs as part of the Study. Code Enforcement – Activities associated with code enforcement, neighborhood improvement, permit compliance, and weed abatement. These costs are not considered for recovery in Planning’s user/regulatory fees and require an alternate funding source, such as fines and penalties. Sustainability Services – Activities associated with Climate Action Plan implementation, internal staff coordination and outreach, business outreach and education, and residential outreach. These costs are not considered for recovery in Planning fees and require an alternate funding source. Economic Development – Activities associated with ordinance amendments, local hazard mitigation plan implementation, general plan and housing element annual report, and legal mandate implementation. Planning staff estimated that approximately 10% of these costs support land use application review activities, while the remaining costs should not be considered in the calculation of fees for services.
The fully burdened hourly rate involves significant analytical and policy-related decisions regarding the inclusion of categorized activity costs. The decision to either include or exclude certain costs toward recovery in fees for service stems from the basic fee setting parameters set forth by industry standard fee calculation methods and the California State Constitution. State statutes require that any new fee that is levied or any existing fee that is increased cannot exceed the estimated amount required to provide the service for which the charge is levied.
3.2 Fee Establishment
The following is a summary of the overall changes to the Planning fee schedule:
Deletion of fees that are no longer used or not needed, such as:
o Sign Review
o Temporary Banner Permit
o Environmental Document pursuant to a Certified Program (CRP) Reorganization of fee categories or clarification of fee names to create a more user friendly fee structure to fees, such as:
o Reorganized the Sign Permits section to better align with the services provided o Simplified Tree Removal Permits to flat fees
o Combined Parcel Map and Subdivision Maps into one category Addition of new fee categories, noted as “New” in the Current Fee/Deposit column of Appendix A.1:
o SB9 application – a streamlined, ministerial process allowing property owners to split a single-family lot into two or build up to four residential units (duplexes) on a single lot. o Pre-Application Fee
In addition to the Planning Division’s costs, this analysis also includes support costs from other departments who directly review and provide comments on planning applications and user fee services.
Engineering, and City Attorney also participate in the review of Planning’s applications, and their costs have been included with the Planning cost to show the full cost of providing Planning applications and fees. A
TOWN OF COLMA
User Fees and Charges Study 13
detailed cost analysis for Engineering was performed by NBS and is provided in the next report chapter.
Costs for City Attorney services were provided by Town staff as an average hourly rate.
The City also contracts for GIS services. GIS services are used to map, analyze, and manage infrastructure, and services by integrating, visualizing, and querying spatial data. These systems improve efficiency, support strategic planning, enhance transparency, and assist with data-driven decision-making. The Town does not currently charge for these services, however, as part of this Study, the Town is proposing to add a fee of $3.75 per $1,000 of permit value to recover for the services provided.
3.3 Cost Recovery Evaluation
Appendix A.1 presents the results of the detailed cost recovery analysis for the Town’s Planning fees. The “Cost of Service per Activity” column establishes the maximum adoptable fee amount for the corresponding service identified in the “Fee Name” list. This Cost of Service per Activity is reflective of the Planning Division’s costs for review of each entitlement/permit, as well as any supporting department/division’s review as required by the Town’s established development review processes, such as the Engineering Division and Attorney Department.
Currently, the Town’s current Planning fees recover approximately 53% of the total cost of providing services. As shown in the following table, the Town collects approximately $134,000 per year in revenues at current fee amounts. At full cost recovery and the same demand level for these services, the Town would recover approximately $254,000.
Table 3. Cost Recovery Outcomes
NBS provided the full cost of service information and the framework for considering fees, while the Planning Division and Town staff considered appropriate cost recovery levels at or below that full cost.
The “Rec’d Fee Level / Deposit” column in Appendix A.1 displays the Town staff’s initial recommended fee amounts. Staff recommends all fees to recover 100% of the costs of providing services with the exception of the following fee categories:
o Appeals / Reconsideration Fees
o Accessory Dwelling Unit
o Address Assignment
o Sign Permits
o Tree Removal Permits for Major 6+ Trees
o Environmental Impact Reports
o Business Registration Application Processing
These initial recommendations for adjusted fee amounts are projected to recover approximately 99% of the total costs of providing fee related services, assuming current demand for services remains consistent.

ENGINEERING AND BUILDING
The Engineering and Building divisions of the Public Works Department provide the following key services:
Comprehensive land development engineering including processing, plan checking and inspecting of grading, encroachment and public improvement projects, as well as review of certain planning entitlement applications
Building permit processing, plan review, and inspection services
4.1 Cost of Service Analysis
The following table shows the Engineering and Building’s estimated full cost of providing services on an annual basis and the fully burdened cost per hour developed for cost recovery purposes through fees for services.
Table 4. Fully Burdened Hourly Rates
As summarized above, the Division’s total cost of providing services is approximately $1.2 million annually.
Approximately $96,000 in costs are targeted for recovery from the Town’s fees for Engineering services, while approximately $116,000 in costs are targeted for recovery from the Town’s fees for Building services.
All subsequent cost of service calculations at the individual fee level assume a fully burdened hourly rate of $317 for Engineering, and $210 for Building.
The remaining $1.0 million is for services that are not fee recoverable and are best funded via sources other than fees, such as grants or General Fund. Examples of these services include Code Enforcement, capital improvement projects, Town website services, and public facilities, sewer, and street light maintenance.
Significant analytical and policy decisions revolve around inclusion of categorized activity costs in the fully burdened hourly rate. The decision of whether to apply or exclude certain costs toward recovery in fees for service stems from the basic fee setting parameters offered by the California State Constitution and Statutes, which requires that any new fee levied or existing fee increased cannot exceed the estimated amount required to provide the service for which the charge is levied.

4.2 Fee Establishment
The list of fees as shown in appendices A.2 and A.3 to this report reflect minor changes to the Town’s fee schedules and fee amounts for Engineering and Building services. To align fees with the services provided, Engineering simplified the Grading Permit and Plan Check Fees into three tiers and restructured Improvement Plan Check Fees, Improvement Inspection Fees and Encroachment Permits into more simplistic contract value deposit fees. No revisions were made to the Building fee schedule.
4.3 Cost Recovery Evaluation
Appendix A.2 presents the results of the detailed cost recovery analysis for the Town’s Engineering fees; Appendix A.3 presents the results for Building fees. The “Cost of Service per Activity” column establishes the maximum adoptable fee amount for the corresponding service identified in the “Fee Name” list. This Cost of Service per Activity is reflective costs for each Division’s review of each fee category or service, as well as any supporting department/division’s review as required by the Town’s established development review processes.
The Town’s Engineering fees currently recover approximately 71% of the total cost of providing services, while Building fees currently recover approximately 65%. As shown in the following table, the Town collects approximately $61,000 per year in Engineering fee revenues and $72,000 in Building fee revenues at current fee amounts. At full cost recovery, the same demand for these services would recover approximately $85,000 and $110,000, respectively.
Table 5. Cost Recovery Outcomes
NBS provided the full cost of service information and the framework for considering fees, while the Engineering and Building Divisions and Town staff considered appropriate cost recovery levels at or below that full cost.
The “Rec’d Fee Level / Deposit” column in appendices A.2 and A.3 display Town staff’s initial recommended fee amounts. Staff recommends all Engineering and Building fees to recover 100% of the costs of providing services with the exception of the following fee categories:
Engineering: Encroachment Permit, Utility Company Minimum Deposit Amount Building: Permit valuation is below $2,000
Building: Solar/Photovoltaic fees, which are set by state regulations These initial recommendations for adjusted fee amounts are projected to recover approximately 100% of the total costs of providing Engineering fee related services, and approximately 99.5% of the total costs of providing Building fee related services, assuming current demand for services remains consistent.

POLICE
The Colma Police Department provides all-inclusive enforcement services for the Town of Colma. Most activities and services provided by the Police Department are not recoverable via user or regulatory fees.
The scope of analysis for the Police Department focused solely on fees for various administrative records and processing requests provided by the Department.
5.1 Cost of Service Analysis
To support the unique operational aspects of the Police Department, NBS calculated separate fully burdened hourly rates for Sworn versus Non-Sworn personnel, as shown in Table 6 below.
Table 6. Fully Burdened Hourly Rates
Section 2.1, Methods of Analysis, further describes the types of expenditures and allocated costs considered in the development of the rate. The total annual cost for the Police Department is approximately $10.6 million. However, it should be noted that the majority of these annual costs are associated with non-fee related activities, such as general public safety and the day to day preservation of public order. Therefore, only a small percentage of the total annual costs are eligible for recovery from fee for service activities. The calculation of these hourly rates includes all allowable direct and indirect costs associated with providing services included in the fee study. All subsequent fee calculations will assume a rate of $285 for Sworn Personnel and $160 for Non-Sworn Personnel.
When staff are required to work overtime, an overtime rate was calculated by taking 1.5x of the direct salary cost component within the full rate. All other direct and indirect costs stay at their original amounts.
As shown in Table 6, the overtime rate for Sworn Personnel is $329 and $189 for Non-Sworn Personnel.
5.2 Fee Establishment
Town staff reviewed the current fee schedule for Police and determined that the only necessary change to the structure of the current fee schedule was the deletion of Videotape Copy and Dispatch Radio Tapes.
5.3 Cost Recovery Evaluation
Appendix A.4 presents the results of the detailed cost recovery analysis for the Town’s Police fees. In the Appendix, the “Cost of Service per Activity” column establishes the maximum adoptable fee amount for the corresponding service identified in the “Fee Name” list.

RECREATION DEPARTMENT
Recreation programs evaluated in this Study are provided by personnel in the Town’s Recreation Department. The Department offers a range of recreation programs and services, as well as facilities for recreational use and rental. Unlike other fee programs described in this Study, this Department’s results reflect a program level analysis (as opposed to the individual fee level) including a general cost recovery evaluation of the following programs:
Day Camps : These recreational services run by Town staff include seasonal camps during summer, winter and spring breaks as well as an afterschool program at Sterling Park Recreation Center, offering supervised recreational activities such as assistance with homework, arts, crafts and games.
Youth/Teen/Adult/Senior Programs : The Town offers several programs and special trips catered towards the community residents, including Parents’ Night out for youth, Top Golf and movie nights for teens, and Wine & Trolley Tours and special luncheons and potlucks for adults and seniors.
Contract Classes and Programs : The Town offers classes which are facilitated by contract service providers, including arts and crafts, cooking, music and dance, and more. For these services, the Town provides the facility, registration, and promotion for each class offering. Special Events (City Sponsored & Private) : The Town facilitates several special events and special excursions for the community, including Ghost Run, Eggstravaganza and the Town of Colma Community Fair.
Facility Rentals: The public may rent indoor facilities at the Colma Community Center for meetings, parties, community events, private classes, and the like. The public may also rent the Sterling Park Recreation Center or Picnic Site to host smaller parties and events.
The expenses of administering, operating, and maintaining the Town’s recreational programs and facilities are primarily funded by resources from the General Fund. However, fees collected from class participants and rentals of public spaces can represent a significant source of funding to help cover costs and sustain – if not improve – the level of service provided by the Town.
6.1 Unique Parameters for Recreation Program Fees and Facility Rental Fees Article XIIIC of the California Constitution provid es the definition of what types of governmental cha rges constitute a “tax”, and under section 1(e), a “’tax” means any levy, charge, or exaction of any kind imposed by local government”, except for seven stated excep tions to this definition.
Recreation programs, camps and classes fees general ly fall under the first three exceptions listed, wh ich are fees and charges for benefits conferred and pri vileges granted, services and products provided, or regulatory services. Charges qualifying under these exceptions cannot “exceed the reasonable costs to the local government of providing the service or produc t”.
Facility rentals, such as rental of a community cen ters and field usage, fall under exception number 4 , “a charge imposed for entrance to or use of local gove rnment property, or the purchase, rental or lease o f local government property.” Charges qualifying unde r this exception do not include the “reasonable cos t limitation” found in the first three exceptions.

User Fees and Charges Study 19
NBS’ scope of review ensures recreational class and program fee revenues do not exceed the costs of providing services. As described below, the analysi s was completed on an annual basis for each program .
Facility rental and use fees, while not included in the scope of review for this study, were generally evaluated on an annual basis and surveyed to help i nform decision making for any recommended rental rate adjustments from the Department.
6.2 Cost of Service Analysis
NBS calculated the Department’s total annual costs for recreation programs and facility uses. Table 8 summarizes results of that analysis:
Table 8. Total Annual Program Costs
The total estimated cost of all Recreation Department programs is approximately $1.7 million per year.
Section 2.1, Methods of Analysis , provides further definition and discussion of the elements of the total program cost calculation.
To support the unique operational aspects of the Recreation Department’s various services and activities, NBS calculated fully burdened hourly rates for full-time versus part-time staff classification for personnel.
Table 9 provides a summary of the cost of service outcomes:
Table 9. Annual and Hourly Cost of Service Calculation
All subsequent cost of service calculations at the individual fee level assumes a maximum fully burdened hourly rate of $208 for full-time employees and $58 for part-time employees, or a blended rate of $82 on average during normal business hours. After normal business hours, an hourly rate of $243 for full-time employees, $67 for part-time employees, or a blended rate of $96 can be used. These overtime rates were calculated by taking 1.5x of the direct salary cost component within the full rate. All other direct and indirect costs stay at their original amounts.

6.3 Cost Recovery Evaluation
NBS evaluated each program’s estimated annual cost recovery level by matching the most recent fiscal year of revenues collected, to the total program costs established through this Study. Overall, Recreation programs recover approximately 12% of the Town’s costs of providing services. Table 10 summarizes results of that analysis:
Table 10. Program Cost Recovery Evaluation
In the table above, Total Program Cost is shown next to the actual “Annual Estimated Revenues” received from FY 23/24 for each program. The results of this analysis show that current revenue amounts for all recreation programs and facility uses recover less than the total costs of each program calculated by NBS.
6.4 Fee Establishment
The Study performed by NBS primarily provides an annual cost and revenue analysis at the program level.
This provides Town staff and City Council with current cost recovery data and allows the Town to establish, if desired, a cost recovery policy applicable to each program or grouping of programs. In considering cost recovery targets and recommended fees, the Department may consider the current cost recovery evaluation outcomes established by this Study and recommend revised fees and/or program level cost recovery targets for the Council’s review. The City Council may wish to use general fund revenue to subsidize recreational programs as a matter of policy and to ensure access to these programs for a larger portion of the community.
Fees for Individual Recreational Programs and Classes
For existing and ongoing fees charged for recreational programs and class offerings, the Town may wish to use the results of this analysis and general cost recovery policy direction to apply an across the board increase to incrementally improve program cost recovery. This approach is commonly used where the policy directive is to continue to subsidize recreation programs to optimize community access to their benefits, while still seeking to improve funding for these essential programs.
Because of the seasonal and changing nature of recreational services and classes offered by the Department, NBS recommends any new class fees, program fees, and special event fees to be calculated by the Department Director using the analytical methods described below:

TOWN OF COLMA
User Fees and Charges Study 21
Program Cost of Service = [ (A x B) + C + D + E + F ]
A = Estimated time for Town staff to implement and operate the individual program. B = Applicable hourly rates for the staff functions involved in the implementation of the individual program.
C = Actual cost incurred by the Town for any outsid e service provider involved in the individual program.
D = Actual cost incurred by the Town for any specif ic materials acquired for use during the individual program.
E = Prevailing facility rental and/or field use fee s imposed by the Town and reflected in its master fee schedule.
F = Actual costs incurred by the Town to rent and/o r use facilities/fields from other entities.
Using the formula provided above, the calculated cost of service represents the maximum fee that could be imposed by the Town for an individual recreation program or service. The Town may recover between 0% and 100% of the cost of service. Cost recovery targets may vary by individual program, as pertains to the City Council’s adopted cost recovery policy for each program. The Town may also set a differential fee for resident and non-resident participants, as long as the fee amount in any case does not exceed 100% of the cost of service.
Fees for Facility Use or Rental
Fees imposed for the use (entrance or rental) of parks and recreation facilities ensure that some revenues are made available to offset the operation, maintenance, and restoration costs of those facilities, so they may continue to be open to all. As shown in Table 10, the current cost recovery rate for facility rentals is much lower than 100%. The Town can seek to conform to the “market” price for similarly sized facilities available in the community and/or similar comparative public agencies. The documentation presented herein provides a high-level annual cost recovery analysis, and Appendix B.5 to this report provides a survey of other agencies for the Town’s consideration in setting fees going forward. In general, NBS recommends that a survey be conducted by Town staff every three to five years to demonstrate consideration of comparable public and private facility rental options.
6.5 Comparative Fee Survey
Appendix B.5 presents the results of the Comparative Fee Survey for the Department. This comparison was unique to this Department to compare existing facility rentals with surrounding areas. Section 2.1.4, Comparative Fee Survey , provides further definition and discussion of the elements of the comparative survey.

GENERAL PLAN MAINTENANCE SURCHARGE
It is common for jurisdictions in California to employ “surcharges” on top of their fees for service to fund certain types of operational support costs. One common surcharge utilized by California public agencies on top of development permits is for update and maintenance of the general plan. This surcharge is generally assessed as a percentage of fees or some other metric such as project construction value. Surcharge revenues should always be tracked to a separate fund or account and are designated solely for the purpose of the costs they are intended to fund, which typically require large one-time investments on a cyclical or periodic basis.
The Town of Colma updates its General Plan on a routine basis. This Plan helps to guide the growth of the community in a consistent manner. Government Code 66014 (b) allows local agencies to, “…include the costs reasonably necessary to prepare and revise the plans and policies that a local agency is required to adopt before it can make any necessary findings and determinations” . This section of the Government Code supports the assessment of a fee to recover a reasonable share of costs associated with the updated and maintenance of the General Plan.
7.1 Cost of Service Analysis
In order to ensure funding is available for the significant costs associated with comprehensive General Plan updates and implementation, the Town estimated a need for approximately $1.2 million in contract costs required to comprehensively update the General Plan over an eight to ten year period, including required annual amendments. These cost estimates are based on prior contract service costs as well as average annual costs needed to keep up with State regulations. As shown in the table below, the estimated annual costs of a comprehensive general plan update and its associated implementation is approximately $261,750.
Table 11. Annual General Plan Update Costs
The proposed Surcharge should apply only to projects that are commonly subject to review against policies in the General Plan. In addition, it is recommended to pursue a percentage, but not 100% recovery of these costs from fee payers, as there are aspects and elements of the Plan that are more relevant to guiding an agency’s services to existing residents, as well as uses of the Plan for Town initiated improvements and initiatives. Each agency’s policy makers must decide to what degree development, and which types of development, impact the revision and maintenance efforts to their Plan. For jurisdictions with large amounts of undeveloped land available, cost recovery policy typically trends higher than for jurisdictions that are closer to “build-out” of available land resources.

7.2 Fee Establishment
The following table presents four options for fee amounts based on 100%, as well as stages of less than 100% recovery of General Plan costs on top of selected Planning, Building and Engineering fees for service.
The surcharge should apply only to development projects that have a significant impact on the update of the General Plan, or that are subject to more review and approval pertaining to the policies and requirements therein. Therefore, the proposed fee is a percentage charged on top of select recommended fee amounts collected by the Planning and Building/Engineering Divisions for identified relevant fee types.
Table 12. General Plan Surcharge Fee Calculation
To assist the reader in understanding how the cost recovery options presented above would be applied to relevant fee types, the table below demonstrates the additional fee that would be collected on top of the recommended fee amount for these targeted services at various cost recovery levels.
Table 13. General Plan Surcharge Cost Recovery Examples
7.3 Cost Recovery Evaluation
The Town does not currently charge a General Plan Maintenance Fee. The proposed fee would apply to selected types of Planning, Building and Engineering applications as discussed above.
Table 14. General Plan Surcharge Cost Recovery Outcomes
NBS provided a full cost of service evaluation and the framework for considering fees, while the Town determined the appropriate cost recovery levels at or below full cost amounts. Town staff’s initial recommendation is to recover 0.6% of the total costs. At 0.6% cost recovery, the fee would recover approximately $1,600 annually. The Town’s Staff Report provides further discussion on Staff’s decision to recommend a percentage lower than 100% cost recovery.

User Fees and Charges Study 24
CONCLUSION
Based on the outcomes of the Cost of Service Analysis, Fee Establishment, and Cost Recovery Evaluation presented in this Study, the proposed Master Fee Schedule has been prepared by the Town for implementation and included in the Town’s accompanying staff report.
As discussed throughout this report, the intent of the proposed fee schedule is to improve the Town’s recovery of costs incurred to provide individual services, as well as adjust to align with average costs of service calculated in this Study. Predicting the amount to which any adopted fee increases will affect Town revenues is difficult to quantify. For the near-term, the Town should not count on increased revenues to meet any specific expenditure plan. Experience with the revised fee amounts should be gained first before revenue projections are revised. However, unless there is some significant, long-term change in activity levels at the Town, proposed fee amendments should enhance the Town’s cost recovery performance over time, providing it the ability to stretch other resources further for the benefit of the public at large.
The Town’s Master Fee Schedule should become a living document but handled with care:
A fundamental purpose of the fee schedule is to provide clarity and transparency to the public and to staff regarding fees imposed by the Town.
The Town should consider adjusting these user fees and regulatory fees on an annual basis to keep pace with cost inflation. For all fees and charges, for example, the Town could use a Consumer Price Index adjustment that is applied to the new fee schedule. This is in line with the Town’s current process for other fee programs. For more information regarding the specific Consumer Price Index used by the Town, see the Staff Report. Conducting a comprehensive user fee Study is not an annual requirement and only becomes worthwhile over time as shifts in organization, local practices, legislative values, or legal requirements result in significant change.
As a final note, it is worth mentioning the path th at fees, in general, have taken in the State of Cal ifornia. In recent years, there is more public demand for preci se and equitable accounting of the basis for governmental fees and a greater say in when and how they are charged. It is likely that in the future, user and regulatory fees will require an even greater le vel of analysis and supporting data to meet the pub lic’s growing expectations. An agency’s ability to meet t hese new pressures will depend on the level of technology they invest in their current systems. Co ntinuous improvement and refinement of time trackin g abilities will greatly enhance the Town’s ability t o set fees for service and identify unfunded activi ties in years to come.
