STAFF REPORT

DATE: JULY 19, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS AND UTILITY SERVICES

DIRECTOR
SUBJECT: APPROVE FIRST AMENDMENT TO THE MAINTENANCE

SERVICES AGREEMENT FOR TRAFFIC SIGNAL MAINTENANCE
FOR FY2021-22.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

1. Approve First Amendment to the Maintenance Services Agreement with Siemens Mobility, Inc., for FY 2022 to increase the total compensation by $85,827.95 (total annual amount not to exceed $300,961.35) for FY2021-22.

2. Authorize the City Manager to execute the First Amendment.

BACKGROUND

In accordance with Colton Municipal Code (CMC) Section 3.08 of the City’s purchasing ordinance, City staff solicited formal bids for Traffic Signal Maintenance and Emergency Services. The bid for the maintenance contract was advertised on March 13, and March 20, 2020.

During the April 8, 2020, bid opening, the City received tw o bids. Staff evaluated the bids received and, after evaluation, the anticipated annual cost for each bidder to maintain and repair the City traffic signals were as follows:

1. Siemens Mobility, Inc. $206,462.00

2. St. Francis Electric, LLC. $222,315.00

Contract Amendment - Siemen's Mobility Inc.

July 19, 2022

Page 2 ends

On May 5, 2020, City Council awarded a Maintenance Services Agreement to Siemens Mobility, Inc., in the amount of $206,462 for FY 2021 (to maintain fifty -four (54) traffic signals); with the option to renew the contract for two (2) additional one -year terms with an annual CPI increase.

This increase would be based on the yearly CPI Increase per the State of California Department of Labor.

On May 18, 2021, City Council approved the First Amendment to the Maintenance Services Agreement for FY 2021 incr easing compensation by $63,297, (total amount not to exceed $269,759 for FY 2021).

On May 26, 2021, the Agreement was renewed for a second year (FY 2022), and it included a CPI increase of 4.2%. This agenda action if approved would be the First Amendment to the second year.

ISSUES/ANALYSIS

Traffic signals improve efficiency for both pedestrian and vehicular traffic. The City now operates and maintains fifty -eight (58) traffic signals, which are properly maintained to ensure proper operation (through regular monthly maintenance and emergency repairs).

In addition to the cost increase to maintain more traffic signals, there has been a rise in the emergency response call outs. Most of the emergencies are due to accidents (knocked down poles), replacing gr ounded wire, cabinet foundations and traffic signal loops. Also included on the emergency call out list is the repair of Mt. Vernon & M St. traffic signal due to SCE power outage incident. The cost for this repair totaled $44,461.30. In the past eleven (11 ) months (July 1, 2021 through May 31, 2022), the City spent an average of $25,080.11 each month for maintenance and emergency call out services.

FISCAL IMPACTS

Sufficient appropriations for the $85 ,827.95 contract a mendment to cover the remaining FY2021-22 invoices are available in the FY 202 1-22 adopted budget in General Fund Engineering Division Traffic Signal Maintenance Account Number 100 -6150-6151-2460-0000- 000.

STAFF REPORT

TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS AND UTILITY SERVICES

DIRECTOR
SUBJECT: APPROVE EMERGENCY UPDATE & TERMINATION OF
EMERGENCY FOR THE M STREET LINE REPAIR PROJECT.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

1. Terminate the Emergency declaration under Colton Municipal Code Section 3.08.130(A); and

2. Approve the notification of the completion of work to Colton’s Transmission/Distribution system repairing the infrastructure related to the recent system emergency.

BACKGROUND

On January 12 th, 2022, at approx imately 2:10 pm, the Century Substation tripped offline due to the likely cause of either a SCE 115 kV Transmission line arcing , or a tree fire. This closed all circuits connected to the Century Substation, or the entire Southeast wing of the City. The nature of this outage created a major explosion and subsequent fire as well as a p ower line whiplash in the area of the outage. The result of these events caused major damage to Colton’s interconnecting 66 kV line and pole infrastructure. The damage to this line spans across Transmission lines and critical distribution lines. Colton’s l ine crews do not have the capability to make the repairs to these higher voltage lines due to lack of equipment needed and manpower.

This repair work is critical to the safety and grid stability of the Century sub area.

As a result, of this situation, Public Works and Utility Services staff requested Emergency repair work to be enabled through an internal competitive process (not formal or informal) and was approved and contracted with Diversified Utility Services, Inc. 5 Packet Pg. 141
Staff Report to the Mayor and City Council
Emergency Update - M Street Line Repair
July 19, 2022

Page 2 ends

On the late evening of June 10 th, Diversified performed all work in accordance with the contract scope and made full repairs to the infrastructure connected to the 66kV line. This repair does not prevent all outages, but allows for added system stability related to potential outages that m ay occur in the Southwest area of the City during the summer months. Additionally, Line Crews and Substation Crews were present to address any potential issues that may have arisen and to ensure smooth transfer of a return to service in the area.

Public Contract Code section 22050(a) authorizes the City to proceed with awarding a public works contract to perform emergency work without giving notice for bids upon adoption by the City Council by a four -fifths vote of a resolution finding th at the emergency will not permit a delay resulting from a competitive solicitation for bids and that the action is necessary to respond to the emergency. Pursuant to Section 3.08.130 of the City’s Municipal Code and Public Contract Code section 22050(b), the City Council delegated authority to make an emergency determination and award a contract to perform emergency work to the City Manager.

The City Manager determined this work constituted an emergency that did not permit undergoing the formal competitiv e bidding process because this repair work is critical to the safety and grid stability of the Century sub area.

In order to mimic a competitive process, staff sent the request to five qualified contractors and two responded. Diversified Utility Service s, Inc. was selected as the least cost/best fit provider and final contracting has been completed. Diversified has ordered parts and deliveries are pending at this time. The contract required a change order of $10,886.06 (bringing the total contract cost to $102,060.06) as a result of wire supply purchase requirements and City Council approved the change on May 3 rd, 2022. Diversified has ordered all parts and materials ready for installation and repair on June 10th and 11th.

Now, pursuant to Colton Municipal Code Section 3.08.130(A) and Public Contract Code section 22050(b)(3), the City Manager must report to the City Council the reasons justifying why the emergency will not permit a delay resulting from a competitive solicitation for bids and why the action is necessary to respond to the emergency. In turn, pursuant to Public Contract Code section 22050(c)(2), the City Council must review the emergency action by the City Manager and determine, by a four-fifths vote, there is a need the continue the action.

Work was completed in the late evening hours of June 10th and the early morning hours of June 11th and a quality job was well done by all involved. The contractor provided all equipment and services as described in the services agreement.

 K2 Design and Fabrication Inc.

BACKGROUND

SCPPA is a Joint Powers Authority, formed in 1980 under the Joint Exercise of Powers Act of the California Legislature. The City of Colton is one of eleven municipal utilities and one irrigation district that make up the members of SCPPA. Over the years, SCPPA’s role has evolved from gen eration and transmission acquisition, to include legislative advocacy and cooperative efforts to reduce member costs and improve efficiency.

As a SCPPA member, the City of Colton has the benefit of participating in Professional Services Agreements that SC PPA executes at the request of, and on the behalf of, its members. The Electric Department participates in SCPPA’s Public Benefit Committee where activities include the preparation of a State required annual report, which details the use of Public Benefit Funds, and the exchange of information regarding energy efficiency (EE), renewable energy, research, and development programs and low-income services.

ISSUES/ANALYSIS

California Assembly Bill 723 requires municipal electric utilities to collect revenues for the following Public Benefit Programs:

(1) Cost-effective demand -side management services to promote energy efficiency and energy conservation.
(2) New investments in renewable energy resources and technologies consistent with existing statutes and regulations which promote those resources and technologies. (3) Research, development and demonstration programs for the public interest to advance science or technology which is not adequately provided by competitive and regulated markets.
(4) Services provided for low -income electricity customers, including but not limited to, targeted energy efficiency services and rate discounts.

CED EE programs demonstrated positive energy savings in FY 2022. For FY2023 the Energy Efficiency Division would like to renew the SCPPA agre ements with the following companies and pilot K2 Design and Fabrication:

ARCA Recycling Inc. is a program that delivers energy star refrigerators to qualified customers with inefficient refrigerators over 15 years old. This is a cost -share program with the utility. The customer will be billed on their electric account $20 a month for twelve consecutive months totaling $240. ARCA removes the inefficient refrigerators from the homes for recycling.

Set Public Hearing - Street Vacation - Portion of Terrace Avenue and De Berry Street July 19, 2022

Page 2 ends

“The Applicant has submitted a request for the vacation of a portion of Terrace Street (“Street Vacation Request”) to facilitate the construction of improvements that are necessary for the Project. The street v acation request was made pursuant to California Streets & Highways Code, Section 8320 et seq. Such street vacation request requires that certain hearings and procedures be followed, culminating in a hearing before the City Council where such a request is considered. The Street Vacation Request shall be considered prior to the issuance of any grading or building permit for the Project. Should the Colton City Council approve the Street Vacation Request and it is determined that the City of Colton owns an u nderlying fee interest in the land comprising the vacated area, the Applicant shall:

1. Prior to the issuance of any grading or building permit for the Project, negotiate a land sale agreement with the City of Colton to transfer ownership of th e vacated area to the Applicant for their use in complying with the conditions of approval for the Project.

It is understood that should the Street Vacation Request be approved, the Applicant will likely enter into subsequent land sale agreements to furth er transfer ownership of the vacated area to other parties to facilitate their construction of improvements required for the Project.

Alternatively, should the Colton City Council approve the Street Vacation Request and it is determined that the City of C olton does not own the underlying fee interest in the land comprising the vacated area, City shall provide documents necessary to the owners of the vacated area, including quit claim deeds, reflecting the fact that City has vacated and released its interes ts in the vacated area. Nothing contained in this condition shall be construed to require the City Council to approve the Street Vacation Request.”

Generally, the street vacation proceeding leaves the public easement free of public use rights (though private easement rights survive - i.e. water, sewer, electric etc). If the City owns the underlying property, City Council may convey title to a third party free of those public rights. If the City has an easement, then abandoning the easement results in th e owner of the underlying land possessing title free of the easement and ownership of the land reverts to the underlying owners (typically the adjacent property owners).

As required by the condition, staff and the City Attorney reviewed various documents related to the initial development and dedication of the street. The documents showed that the City did not own fee ownership. Thus, vacation of the street easement will mean that the underlying ownership of the street area will revert to the underlying owners. It is our understanding that the Applicant of the Project has already negotiated transfer of the underlying land with the owners.

The procedure to abandon a public street is set forth in Streets and Highways Code 8320 et seq., and the first step is for the City Council to adopt a Resolution of Intention.
