Michael Craine and Sheriff’s Detective Jeremiah McKay. Our Bearcat was used in both an urban and mountain terrain, which proved invaluable for the protection of officers and the saving of civilian lives. In more recent ope rations, the BearCat proved again an indispensable lifesaving piece of equipment as Colton Police Detectives and Officers were serving an early morning search warrant in the City of Colton. Upon making announcements, the suspect opened fire on officers with a high-powered AR-15 rifle striking the Bearcat and saving the lives of the officers.

ISSUES/ANALYSIS

Unfortunately, time has taken its toll on the current armored vehicle and in the last 16 years despite the upkeep and maintenance, it is in nee d of several upgrades, services, repairs, and pieces of equipment. Just recently, on April 13 of 2022, our officers and detectives were serving a search warrant at a residence where the suspect opened fire on officers with a high powered rifle. The offic ers were using the current BearCat for protection and announcements when rounds struck the armored vehicle. Although the BearCat stopped the rounds, it was discovered officers were unable to hear the gunfire directed at them over the older loud idling dies el engine.

The lighting systems, A/C systems, and various electronics are outdated and further hinder the operational effectiveness of the vehicle.

The layout and configuration of our current Bearcat are outdated and the two outward opening doors provide no ballistic coverage when entering or exiting the vehicle on either side. This early model BearCat has very low ground clearance making off -road terrain difficult, as well as maneuvering over common sidewalk curbs. In addition, the current turret provid es little to no coverage on operations and obstructs the officer’s ability to effectively provide safe tactical coverage from an elevated position. The current exterior railings and platforms used to transport officers on the outside of the vehicle are no w considered to narrow and provide an unstable platform for today’s tactical officer and their equipment. The City of Colton and its surrounding cities, have benefitted from our armored vehicle as has the neighboring counties in the numerous life-saving incidents it has participated in.

The new Lenco BearCat G3 is the standard tactical armored vehicle for general law enforcement purposes and special operations units within the US Law Enforcement community. Since the early 2000s, agencies such as LAPD, LA SD SEB, NYPD ESU, Boston PD and hundreds of Federal, State and Local Law Enforcement agencies have made the BearCat part of their standard operating procedure. The new Lenco Bearcat G3 has excellent on -road driving characteristics and maneuverability in ti ght urban settings as well as rural capabilities. The increased ground clearance and robust suspension allows for emergency response in rural regions and natural disaster scenarios where standard armored SWAT vehicles would experience challenges as we have seen. The large floor plan seats 10 – 12 fully equipped officers with a long list of tactical features only found on the Lenco BearCat.

The Lenco BearCat G3 is the standard tactical armored vehicle that was designed to meet the combined requirements of SWAT and tactical EMS teams.

 All Steel Armor Construction
 High Ballistic Protection
 V8 Engine (Gas) and 4WD capabilities
 Commonality of parts with other BearCat variants
 Fully configurable to a wide array of BearCat variants With the purchase of the BearCat G3 and its new capabilities and functions would solve all the current issues we have with our old BearCat. The Colton Police Department would be able to continue using this life saving equipment in the event of an active shooter, mass casualty incident, natural disaster or any other event that requires this level of life saving measures. The BearCat G3 can also be used to assist triage centers and other natural disasters where ambulances or other medical personnel would be limited in their ability to go over rough terrain (such as the Santa Ana River Bed for high water rescues) or damaged roads, as the BearCat G3 is four-wheel drive. The new capabilities of the BearCat G3 in the city as well as surrounding counties will undoubtedly save lives and furthe r protect the community in these turbulent and uncertain times.

Section 3.08.140(C) of the City’s Purchasing Ordinance allows the City to enter into agreements with other agencies for the purchase of supplies, services, and equipment. In such instances, waives the competitive bidding requirement, either formal or informal, for non -public projects when it has been determined that a competitive bid procedure has been conducted by another public agency, and the price to the City is equal to or better than the price to the public agency.

The General Services Admission Federal Supply Service (G.S.A.) awarded Lenco Industries the contract (GS -07F-169DA) on September 15, 2021 and is valid through August of 2026. The Colton Police Department can avail (piggyback ) themselves of this agreement, which allows our department to purchase vehicles from this business under contract pricing. This will save the City of Colton the cost of the bid process, formal or informal, and allow us to take advantage of current pricin g, as well as a volume discount afforded through the Lenco Industries G.S.A. proposal agreement.

This staff report shall serve as proper notification to the City Council for the purchase of authorized “Military Equipment” pursuant to AB 481.

FISCAL IMPACTS

The budget for the City of Colton for the Fiscal Year commencing July 1, 2022 and ending June 30, 2023 was approved and adopted. Sufficient appropriations are available in the FY2022-23 adopted budget in Local Fiscal Recovery Fund Acct Vehicle Account Number #219-2328-1000- 4910-0000-000.

STAFF REPORT

DATE: AUGUST 2, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: TIM MCHARGUE, FIRE CHIEF
SUBJECT: APPROVE PURCHASE OF A FIRE DEPARTMENT ENGINE

THROUGH THE SOURCEWELL COOPERATIVE PURCHASING
PROGRAM.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Waive the formal bidding process in accordance with Colton Municipal Code Section

3.08.140(N) and authorize the City to purchase a 2023 KME Severe Service Pumper through the Sourcewell cooperative purchasing program for an amount not to exceed $850,000.

BACKGROUND

Council approved funding for a new fire engine in the FY2022 -23 budget to replace a 1996 reserve fire engine. This new engine will be pl aced at Fire Station 213 in South Colton and the existing 2005 KME fire engine will be placed into reserve status.

ISSUES/ANALYSIS

Section 3.08.140(N) of the City’s Municipal Code allows for an exception to competitive bidding for non-public projects for “Purchases made through cooperative purchasing programs.”

The Sourcewell cooperative purchasing program uses the buying power of 50,000 government, education, and nonprofit organizations to competitively solicit cooperative contracts ready for use. Sourcewell is a local government unit, public corporation and public agency under the laws of the state of Minnesota.

Sourcewell is authorized to establish competitively awarded cooperative purchasing contracts on behalf of itself and its participating agencies. Sourcewell follows the competitive contracting law process to solicit, evaluate, and award cooperative purchasing contracts for goods and services.

Sourcewell cooperative purchasing contracts are made available through the joint exercise of powers law Minn. Stat. § 471.59 to participating agencies.

Sourcewell uses a rigorous request for proposal (RFP) process to meet the changing needs of members. The desired result is a national, competitively solicited procurement and contract process that is not on ly valued by members but meets or exceeds their requirements —offering exceptional products and services from nationally acclaimed vendors.

Fire recommends using Sourcewell Contract 113021-RVG-3 for this vehicle purchase. Utilizing this contract will sav e the City of Colton the time and cost of the formal bid process and allows us to take advantage of current pricing, and the volume discount afforded through this cooperative purchasing program. Additionally, a prepayment discount of $20,000 has been applied to this purchase.

FISCAL IMPACTS

Sufficient appropriations are available for the vehicle purchase in the FY2022-23 adopted budget in General Fund Fire Department Operations Vehicle Account Number 100 -6090-6091-4910- 0000-000.

STAFF REPORT

DATE: AUGUST 2, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION FOR THE GENERAL

CHILD CARE AND DEVELOPMENT (CCTR) EXPANSION
FUNDING, RESOLUTION NO. R-89-22.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

1. Approve and Adopt Resolution R -89-22 for General Child Care and Development (CCTR) Expansion Funding for the Early Care and Education Division; and,

2. Authorize the addition of one Community Childcare Site Supervisor position.

BACKGROUND

The City of Colton, Early Care and Education Di vision has two main components, the School Age Program (SAP) and the S tate Preschool Program (SPP). The SAP is funded by the California Department of Social Services (CDSS) and the SPP funded by the California Department of Education (CDE) . The SAP is for children in grades K thru 6 th grade, using the CDSS Contract to provide services for before, after, and all -day care on CJUSD closure days.

The SAP operated 246 days a year. The SPP is for younger children, ages 3 to 5 years old. The SPP operates 180 days a year, part -time, with the desired result of preparing you ng children for elementary school, both in the classroom and the playground. As Executive Director of the Program, the City Manager is the designated authority to sign the State contract.

ISSUES/ANALYSIS

CDSS announced the availability of approximately $207 mi llion General Child Care and Development (CCTR) program funds to provide direct services for California children from birth 9 Packet Pg. 234

to age three and for children who are of school age. Funds could be applied for via a Request for Applications (RFA).

City Staff applied and submitted the RFA in January of 2022 , with little expectation. However, in late June staff was notified that CDSS awarded the City of Colton with a CCTR Expansion Contract with additional $456,526 per year . The expanded funding will be utilize d to enhance the services provided by the ECE division in the School Age Program, initial plans include the addition of a Full-Time Community Child Care Site Supervisor, additional part time staff hours, facility improvements and additional contracted professional services support, with the increased service to approximately 50 subsidized children.

CDSS is allotting for a “Three -Year Phase-In”, allowing Contracted Agencies to begin spending the funding immediately, with the understanding it may take time t o reach enrollment/attendance numbers. With the inclusion of this additional funding in the Division, this will be Phase One of “reorganization” of the ECE Division.

The first task at hand is the addition of a full time position of a Community Childcare Site Supervisor, which is a supervisory level position tasked with the responsibility to manage daily operations of an extended childcare or preschool site within the Community Services Department, ECE Division . Currently, there are four active locations, but only three Site or Assistant Site Supervisors, which is inadequate to support additional youth services required through this expanded funding. The existing job description reflects the duties and responsibilities of the position. The salary and benefits for this position has a fully burdened rate of $67,000, however in the first year, the cost will be approximately $47,000 due to time needed for recruitment.

FISCAL IMPACTS

Adoption of Resolution R -89-22 increases adopted FY2022 -232 revenues an d appropriations in the following Community Child Care Fund accounts as follows and amends the FY2022 -23 Authorized Position List to include one (1) additional Full -time Community Childcare Site Supervisor.

Revenue account: 206-577-000 $456,526

Expenditure accounts:
206-7200-7202-1010 Full Time Salaries $47,000

Measure I requires that each local jurisdiction receiving program revenues annually adopt a Five- Year Capital Improvement Plan and an Expenditure Strategy Plan. The Five -Year Capital Improvement and Expenditure Strategy Plan outlines how the local agenc y plans to expend its funds. As part of the County -Wide Measure I Sales Initiative Program, the measure requires an annual adoption and update of the respective plans.

ISSUES/ANALYSIS

Measure I Five-Year Capital Improvement Plan and Expenditure Strategy Plan

Measure I Policy Valley Local Streets (VLS) -11 requires that the Five Year Capital Improvement Plan shall be the basis for the annual audit. Jurisdictions will have flexibility in moving projects around in their Five Year Capital Improvement Plan based on the necessities of the jurisdiction. However, in order for the project to be qualified for expenditure of Local Streets funds, the project must be included in the Five Year Capital Improvement and Expenditure Strategy Plan.

Measure I Local Pass-Through funds estimated revenue for this fiscal year is $1,390,534 and the total anticipated revenue from Fiscal Year 2022/2023 to Fiscal Year 2026/2027 is $7,025,249 (see Exhibit G). Attached as Exhibit A is the Five Year Measure I Capital Improvement Pl an and Exhibit B is the Measure I Expenditure Strategy Plan for Fiscal Year 2022/2023 to Fiscal Year 2026/2027.

The projects that will be funded by Measure I for Fiscal Year 2022/2023 are as follows with corresponding cost:

1. Pavement Rehabilitation: Cooley Drive (I-215 Bridge to Ashley Way) $ 450,442

2. Pavement Rehabilitation: 7th Street (Valley Blvd. to H St.) $ 51,832

3. Pavement Rehabilitation: Rancho Ave. (So. of N St. to Cement Plant Rd.) $ 235,333

4. Pavement Rehabilitation: Citrus St. (Bordwell to La Cadena) $ 124,395

5. Pavement Rehabilitation: Rosedale Ave. - (Litton Ave. to Cordova St.) $ 56,020

6. Pavement Rehabilitation: Litton Ave (La Cadena to Bostick Ave.) $ 95,514

7. O Street Improvement Project (La Cadena to 6th St.) $ 185,415

8. Citywide Sidewalk and ADA Project $ 173,054

9. FY 21/22 Citywide Street and Traffic Improvement $ 18.529 Total = $1,390,534

Inclusion of streets with pavement rehabilitation scope of work was based on the Pavement Management Plan. Below is the corresponding Pavement Condition Index (PCI) and Functional Classification (FC) for these streets:

PCI FC

6. Litton Ave (La Cadena to Bostick Ave.) 27, 69, 72 Local

Pavement Condition Index (PCI) is a numerical index between 0 and 100 being used to indicate the general condition and distress of a pavement. PCI is rated 0 -100, 100 being best and 0 as worst condition. The descriptive range of the PCI rating are: 0 -25 (Very Poor), 26-40 (Poor), 41- 50 (marginal), 51-60 (Fair), 61-70 (Good), 71-85 (Very Good) and 86-100 (Excellent). Pavement distress includes but is not limited to cracking, bumps, sags, potholes, joint reflections and exposed aggregates. The average PCI of the City’s road networ k (total of 141.5 miles) in 2017 is

64. The national average PCI rating is 60 to 65.

“O” Street Improvement Project includes initial funding for the design and construction for replacement of deteriorated concrete street pavement. Citywide Sidewalk and A DA Project includes citywide installation of missing and repair of damaged sidewalk, and installation of missing ADA ramps.

Resolution No. R -97-22 (Exhibit F) will amend FY2022 -2023 Capital Improvement Program (CIP) plan increasing the funding for various FY 2022/2023 Measure I funded projects listed above to compensate for the construction price increase due to inflation. The additional funding is due to revised Measure I projection that increases by $265,599 from the previous projection used by staff in the preparation of FY 2022/2023 Measure I CIP budget of $1,124,935. The updated revenue projection provided by SBCTA staff is $1,390,534.

Staff recommends approval of the attached Resolution No. R -95-22, affirming the Measure I Capital Improvement Plan an d Expenditure Strategy Plan for Fiscal Year 2022/2023 to Fiscal Year 2026/2027.

Measure I Five-Year Capital Project Needs Analysis

In April 1, 2009, SBCTA Board of Directors approved the Strategic Plan, which is the reference manual and policy document f or the administration of Measure I 2010 -2040 programs by SBCTA and its member agencies. The Strategic Plan requires all local jurisdictions applying for revenue from the Measure I -Valley Street and Freeway Interchange Programs to annually adopt and update a Five-Year Capital Project Needs Analysis. Staff requests authorization (Resolution No. R-96-22 – Exhibit E) to submit the updated Capital Project Needs Analysis (CPNA) for FY 2023/2024 to FY 2027/2028, attached as Exhibit C . The current balance (FY 10/11 to FY 22/23) and projected (FY 23/24 to FY 27/28) Measure I Valley Major Street/Arterial Sub -Program allocation for Colton is attached to the CPNA submittal (Exhibit C).

Vernon Avenue Bridge Widening Project, the La Cadena Drive Bridge over Santa Ana River Bridge Replacement Project and Reche Canyon Road Extension to Hunts Lane Project. T he two bridge projects are on -going and currently in right of way phase, and anticipated to be in construction towards the mid of 2023. The Reche Canyon Re -alignment to Hunts Lane Project is in the Preliminary Engineering and Environmental Document Phase, and this phase is estimated to be completed by June 30, 2023.

MEASURE “I” EXPENDITURE STATEGY
PLAN

The City of Colton allocates approximately eighty-five (85%) of FY 2022/2023 Measure I projected revenue for street infrastructure pavement rehabilitation. Delivery of these improvements is focused on streets with low pavement condition index (PCI) rating. Improveme nts includes asphalt paving and restriping. Measure I funds are also being used to provide local match for federal and state grant funded projects; these projects are focused on improving Colton’s infrastructure and /or transportation system for pedestrian/bicycle/vehicular traffic.

The remaining fifteen percent (15%) of the City’s FY 2022/2023 Measure I projected revenue are allocated to Active Transportation components such as sidewalk, handicap ramp installation , and other traffic safety improvements. All identified improvements are consistent with the goals of the city’s General Plan Circulation Element.

DATE: AUGUST 2, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: TIM MCHARGUE, FIRE CHIEF
SUBJECT: APPROVE SOLE SOURCE PURCHASE OF FORCIBLE ENTRY

CONEX BOX TRAINING CENTER TO FORCIBLE ENTRY
EQUIPMENT.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Waive informal bidding and approve the sole source purchase of Forcible Entry Equipment brand forcible entry training prop pursuant to Colton Municipal Code 3.08.140(B).

BACKGROUND

Forcible entry is the defined as the techniques used to get into buildings or other areas of confinement when normal means of entry are locked or blocked. Forcible entry is used frequently in fire and EMS calls where breaching an entry door, roll -up door, window, or other door type quickly changes outc omes of fires and patients. This perishable skill is learned early in a firefighter’s career and must be practiced to maintain proficiency. Presently, Fire uses some rudimentary, homemade props for forcible entry training.

The Forcible Entry Conex Box Training Center is an all -inclusive, plug and play modular training platform outfitted with multiple entry props to meet the needs of fire and law enforcement. This train ing prop can be placed at Fire Station 211 near our current fire training tower.

ISSUES/ANALYSIS

Forcible Entry Equipment is the sole source provider distributor for the Forcible Entry Conex Box Training Center . Section 3.08.140(B) of the City of Colton Municipal Code, states in part, 11 Packet Pg. 270

Page 2 ends

“No Competitive Market. When the City Council determines, in accordance with applicable Law, that a competitive market does not exist and that no competitive advantage will be gained by the public bidding process.”

ISSUES/ANALYSIS

The contract w ith IBEW Electric expired December 31, 2019. The City initially started negotiations on successor agreements in early 2020 when the COVID -19 Pandemic hit in March of 2020. The pandemic derailed contract negotiations which negotiations for a successor agreement were resumed in April 2021.

The association provided needed community services while working cooperatively with the City during Colton’s fiscal challenges for this past decade as well as the recent pande mic the nation suffered. As a result of this fiscal challenges and subsequent limited salary rate adjustments, the compensation rates for the Colton employees has fallen behind regional averages of similar sized full service cities. These contract provisions are intended to increase compensation level s in an attempt to stay regionally competitive and retain quality level of employees for the City of Colton.

Also included in these contracts are one -time monies afforded by the COVID -19 driven American Recovery Plan Act (ARPA) dispensed by the Federal De partment of Treasury. The Plan allows for premium pay to essential workers who work during the pandemic, including government workers providing essential municipal services. The City of Colton workforce returned to work in June 2020 and have continually be en present back in office since that time providing essential services to the city residents. All City employees worked within prescribed health and safety guidelines and this premium pay expresses Council and community gratitude and appreciation for their efforts during this unprecedented pandemic period.

These negotiation results represent direction given to staff during the negotiations process

FISCAL IMPACTS

The total contract amount through the term is estimated at $798,311. The FY2022 -23 cost is estimated at $566,655, $296,060 of which is attributed to the Electric Utility Fund and $270,595 from the ARPA Fund. Approval of Resolution R -92-22 increases FY2022-23 appropriations for contract expenses in the following accounts. The FY2023 -24 impacts w ill be included in the FY2023-24 budget request.

Total Contract, 3 years - $798,311: Electric Fund, 527,715, ARPA Fund $270,595

The value of future savings in the Retiree Medical cap starting in 2023 cannot be cost out at this time without actuarial services, but the capped benefit will assist the City with reducing long- term Other Post Employment Benefit (OPEB) costs. The cost for the minimum 2 hours pay for planned overtime is dependent on departmental usage, which is anticipated to be nominal.
