FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS AND UTILITY SERVICES
DIRECTOR
SUBJECT: PRESENTATION ON IMPLEMENTATION OF A POWER COST
ADJUSTMENT (PCA) FOR THE ELECTRIC UTILITY -
INFORMATIONAL ITEM.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
No Action – Informational Item Only.
BACKGROUND
The City of Colton has to purchase wholesale power su pply through the California Independent System Operator (CAISO) , and natural gas supplies on the open market to supplement its existing power purchase contracts to meet daily demands.
Colton’s cost of wholesale purchased power has increased 209.96% from O ctober through December, 2022, and wholesale Natural Gas prices have increased between 148.33% - 248.75% during the same period.
ISSUES/ANALYSIS
The adopted budget for purchased power in the current fiscal year is $31,114,793. Given the increased power cost expenses reference d above, the projected year-end expenses for such are $52,575,564, resulting in a variance of $21,460,771.
The Department is deferring lower priority Capital Improvement Projects this Fiscal Year, utilizing Reserve Funds , and is pro posing to reduce the General Fund Transfer (GFT) by $2 1 Packet Pg. 7
Staff Report to the Mayor and City Council
Power Cost Adjustment
March 7, 2023
Million. Colton’s electric rates have not changed during the past 10 years – last updated in 2013.
The Electric Utility has maintained a strong financial position during this period of time, with relatively low electric rates for all customer classes. The strong financial position of the Utility has allowed the use of reserves, and the strong financial position of the City has allowed for a significant reduction in the GFT.
Despite these measures, this unforeseen market circumstance also necessitates the implementation of a Power Cost Adjustment (PCA). A PCA is a charge per kWh, which is used (1) to adjust the Electric Department’s electric rates for the actual cost of purchasing and generating electric power and energy to service the City’s customers, and (2) to minimize the fluctuations in rates. The PCA is authorized by the City’s Electric Rules and Regulations; Rule No. 23, which is part of the approved electric rate structure.
By implementing a Power Cost Adjustment (PCA) of $0.085/kWh, this will replenish reserves to maintain Colton’s bond rating, maintain reserve requirements, retain stability for next Fiscal Year budget, and resume necessary Capital Improvements deferred in the current fis cal year.
The PCA will be implemented, effective April 1, 2023 and is anticipated to remain in effect through June 30, 2024.
FISCAL IMPACTS
The implemented PCA will restore revenues to cover the estimated expenditure variance of $21,460,771. With a PCA effective April 1, 2023 through June 30, 2024, revenues a re expected to increase by $4.7M in the remaining Fiscal Year 2022-23, and $29.1M in Fiscal Year 2023-24.

STAFF REPORT
DATE: MARCH 7, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: STACEY DABBS, FINANCE DIRECTOR
SUBJECT: APPROVE AND ADOPT RESOLUTIONS FOR FY2022-23 MID-YEAR BUDGET REVIEW, RESOLUTION NO. R-17-23, CUA-01-23, AND
CHA-01-23.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Adopt Resolution No. R-17-23 authorizing the amendment of the Fiscal Year 2022-23 Budget to include certain necessary adjustments as detailed in this report.
2. It is recommended that the Colton Utility Authority Board adopt Resolution No. CUA- 01-23 authorizing the amendment of the Fiscal Year 2021-23 Budget to include certain necessary adjustments as detailed in this report.
3. It is recommended that the Housing Authority Board adopt Resolution No. CHA-01-23 authorizing the amendment of the Fiscal Year 2021-23 Budget to include certain necessary adjustments as detailed in this report.
BACKGROUND
The City Council adopted the City o f Colton Fiscal Year 2022 -23 Budget at its May 17, 2022 City Council meeting after a series of public workshops. The originally adopted General Fund budget included estimated revenues in the amount of $ 51,560,715 and proposed expenditures totaling $ 52,238,333. Factoring in prior year Purchase Order rolls and authorized prior year budget carryovers, as well as any additional revenue projections and appropriations authorized by the City Council during the course of the current fiscal year, the current Gener al Fund revenue budget is $52,115,788 while the expenditure budget totals $55,328,277.

Staff Report to the Mayor and City Council
FY2022-23 Mid-Year Budget Review
March 7, 2023
It is considered best practice to review the budget on an ongoing basis in order to ensure the fiscal integrity of all City operations. The purpose of this report is to provide current summary information that will assist the City Council in the decision making process. This report includes projections to close the fiscal year for each City fund, as well as all recommended changes to the budget including previously a pproved Council actions through the date of this report as illustrated in the attached Actual and Projected Fund Balances Worksheet.
ISSUES/ANALYSIS
Staff began the mid -year process by first examining the prior fiscal year’s outcomes, then proceeding to evaluate revenue and expenditure performance in the first six months of the current fiscal year, and finally staff has made certain assumptions about performance for the final six months of the fiscal year. Based on this analysis and an analysis of the po tential economic impacts of further pandemic-related emergency orders, staff has conservatively estimated ending balances for fiscal year 2022-23.
GENERAL FUND
As of December 31, 202 2, with 50% of the fiscal year complete, General Fund revenues are
38.2% received while expenditures are 51.3% spent (including encumbrances 55.2% spent).
Certain major General Fund revenues, such as property taxes, are primarily collected in the second, third and fourth quarters of the fiscal year and thus, at mid -year, will generally show less than 50% collected. Property tax in -lieu of VLF, which represents approximately 13% of estimated revenue, is collected in the third and fourth quarters, and thus has a significant lowering effect on the percentage received in the first half of the fiscal year. In addition, sales tax receipts through December reflect only four months collection due to the required accrual method of accounting.
REVENUES
Overall, based on current estimates, revenues are projected to increase through the end of FY2022-23 by $1,391,250 over current budgeted revenues, which represents an increase of 2.7% over the current budget and 3.8% over the original budget projections, as illustrated in the table below.

The revenue increase is attributed to project ed growth in many revenue categories but predominately in the transaction and use taxes, use of money and property, property taxes, and property tax in lieu of VLF categories. The Fiscal Year 202 2-23 budget was adopted before the outcome for the November 2022 election results for Measure S . The additional one -cent transactions and use tax supported by voters becomes operative on April 1, 2023.
Conservatively, the City anticipates to receive $2,000,000 in revenue from Measure S for the last quarter in FY2 022-23. Additionally, as interest rates have dramatically risen since FY2022 -23 budget development, the City’s original assumptions about earned interest in the use of money and property revenue category require revision to better align year -end estimates with expectations based on actuals to-date, anticipated market conditions, and cash flows. The City of Colton realized an 18.65% change over the prior year in median single -family residential sales price, the second highest in San Bernardino County. Ov erall, the City’s net taxable value grew
11.4% over the prior year . Contributing factors to the increase in property tax revenue included several large commercial properties adding to or increasing the tax roll, including improvements at the Mattress Firm on Miguel Bustamonte, the industrial complex on Hanna Street, Montecito Memorial Park, and the industrial complex on La Crosse.
General Fund Transfer
With the adoption of the FY202 2-23 budget, the total GFT amount approved by City Council i n accordance with Measure V was $10,500,000. With the impacts of skyrocketing natural gas prices, the FY2022-23 mid-year budget proposes a $2,000,000 reduction in the GFT . Reducing the GFT will help alleviate some of the pressure the increased operating expenses is placing on the financial performance of the Electric Utility. In accordance with the Flow of Funds Ordinance, the GFT is calculated using the prior years’ audited actual gross revenues less any restricted revenue, which was finalized with the p resentation of the Annual Comprehensive 2 Packet Pg. 29

FY2022-23 Mid-Year Budget Review

Financial Report for the year ending June 30, 202 2. Therefore, the recommended GFT represents a 14.1% transfer.
The GFT Oversight Committee functions in an advisory capacity to the City Council of the City of Colton. It makes recommendations regarding the GFT amount from the Electric Utility Fund to the City’s General Fund. The GFT Committee had a regular meeti ng scheduled on February 28, 2023 to consider its mid -year recommendations to the City Council. The Committee agreed with the staff recommendation to reduce the GFT by $2,000,000, to 14.1%.
EXPENDITURES
With respect to expenditures, a majority of costs are relatively straight-line in nature, i.e., there is a proportionate share spent each month. However , there are some operating costs, as well as capital expenditures, that do not follow this pattern. Because of these timing issues, year -to-date expenditure percentages by Department may vary, while the overall budget to actual percentage is right in line with expectations. Overall, General Fund expenditures are estimated to increase by a net amount of $ 744,098 to close the fiscal year over the current adopted budget. After including the requested mid-year amendments and netting certain one-time items, the FY2021-22 projected General Fund expenditure estimate to close is illustrated as follows.
General Fund expenditures are projected to increase by a net of $ 744,098. The increase factors in the following:
A $518,619 increase in Cost Allocations for general liability insurance claim settlements allocated to General Fund departments
A ($225,553) net salary savings for vacant positions. A $130,000 increase in vehicle operating expenses for increased fuel and vehicle repairs for Police patrol units.
A $ 100,000 increase in telecommunications expenses related to Police criminal investigations.
A $ 100,000 increase in Parks tree trimming and removal services to prevent unsafe conditions in City parks.
An $80,000 increase in Engineering plan check services for substantial new residential and commercial developments tentatively scheduled for Planning Commission. A $25,000 increase in fuel and vehicle repairs for the Fire Department. Additional requests include: Increase in elections expense for the final San Bernardino County ROV expenses for the November election, $14,000; Assessment and creation of a Disaster Preparation work plan, $7,600; Malware software through the Confire contract, $7,000; Increased office supplies and computer for Public Works Intern, $4,000; Operating supplied to combat gopher infestation in City parks, $3,000; Unexpected Fire station generator repairs, $2,500 ; Increased office supplies for Development Services, $2,500; and other nominal increases/decreases to various line items representing a reduction of ($24,568) across all departments.

Staff Report to the Mayor and City Council
FY2022-23 Mid-Year Budget Review
March 7, 2023
ENTERPRISE FUNDS
The City’s major enterprise funds, namely Electric, Water and Wastewater, are all recommended for adjustment at mid -year based on current operations and capital improvement expectations through the end of the fiscal year. It should be noted that each of these operations met or exceeded projected operating results for the prior fiscal year.
Electric
Included in the Electric Utility Fund year-end projections are the increased revenues attributed to residential, commercial, and industria l sales resulting from a $0.085 Power Cost Adjustment (PCA) included in the adopted Electric Rate Rules as a “charge added to the energy charge to reflect unusual conditions in the market that, if not addressed, would result in financial harm to the Electr ic Department.” Additionally, the budget also includes the increased appropriations necessary for significantly rising costs in purchased power costs, specifically for the spiking cost for natural gas. The Electric Department is projecting overall revenue s for fiscal year 2022-23 to increase by $6,946,393 over the current adopted budget. Of the increased revenues, $4,628,170 is attributed to the PCA applied to residential, commercial, and industrial sales Also expected to increase over original projectio ns are interest revenue by $1,090,000, consigned emissions allowances by $803,736, and sale of excess energy by $511,000, which were offset by a $150,000 decrease in penalties and interest . Year-end expenditure projections anticipa te a significant increase of $ 13,607,767 in expenditures over the current budget resulting primarily from a $ 16,071,229 increase in purchased power for natural gas and firm power , which was offset by a $2,000,000 reduction in the General Fund Transfer and $291,559 in one-time salary savings from vacant positions.
Based on current estimates and after factoring out the current net investment in capital assets and required reserve for debt service, the Electric Fund is expected to end the year with an approximate available net posit ion of $ 10,543,546, or 11.5% of the proposed appropriations of $91,434,408.
Water
The Water Fun d revenue projections reflect an in crease of $ 940,000 over the current budget, which is mostly attributed to a $924,000 increase in anticipated interest in come, supplemented by some other minor adjustments. Water Fund expenditures through the end of fiscal year 202 2- 23 are expected to decrease complementarily by $118,058 over the current budget. The decrease in expenditures is mostly attributed to a $ 269,281 salary savings from vacant positions netted against minor operational adjustments based on year-to-date actuals.
Wastewater
The latest revenue projections in the Wastewater Fund reflect a $ 1,175,015 increase over the current budget, attributed to a $742,677 increase in commercial and municipal sewer charges, a $376,188 increase in interest income , and a $ 56,000 increase in miscellaneous revenue for 2 Packet Pg. 33

damage to property . Expenditures are also projected to increase over the current budget by $56,766, wh ich is associated with a $39,071 increase in cost allocations for general liability settlements and nominal other adjustments in utilities operations expenses based on year -to-date actuals.
ALL OTHER FUNDS
All revenue or expenditure adjustments recommend ed for any other funds (not previously mentioned earlier in this report) are considered routine in nature and reflected on the Actual and Projected Fund Balances worksheet attached to this report.
All projections have been updated for balances as reflecte d in the ACFR for the year ended June 30, 2022, as well as any other known items through the date of this report.

The Committee reviewed the proposed General Fund adjustments, personnel requests, General Fund Transfer (GFT) analysis, availa ble fund balance analysis, and an analysis of Electric Utility financial position. SUBJECT: APPROVE AND ADOPT RESOLUTION ACCEPTING 2022 BOARD
OF SUPERVISORS FUNDING AND PURCHASE OF OFF-HIGHWAY
VEHICLES (OHV) AND RELATED EQUIPMENT, RESOLUTION NO.
R-11-23.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve and adopt Resolution No. R -11-23, authorizing the acceptance of the 2022 S an Bernardino County Board of Supervisors (BOS) OHV Funds of $162,334.00;
2. Approve the purchase two Off-Highway Vehicles (OHVs) (one CAN-AM Commander XT-P 1000R and one CAN-AM X3 MAX XRS) and related safety equipment pursuant to Colton Municipal Code 3.08 .140(E) from Bert’s Mega Mall for a cost not exceed $115,000.
BACKGROUND
On November 16, 2021 the San Bernardino County Board of Supervisors approved funds for the creation of a county-wide Off-Highway Vehicle (OHV) Enforcement Fleet. In this contract, the San Bernardino County Board of Supervisors allocated the City of Co lton $162,334.00 to purchase Off-Highway Vehicle s for the purpose of enforcing the growing county/city wide problem of OHV ’s trespassing in the flood control area, canyons, private pro perty, protected habitats, and local city streets.
ISSUES/ANALYSIS

Staff Report to the Mayor and City Council
Grant Purchase & Budget Amendment - County OHV Funding
March 7, 2023
The Colton Police Department serves the City of Colton, California. The City of Colton has a population of approximately 55,000 people and covers a total of 24 square miles. Within th e 24 square miles, a large amount of that land consists of the Santa Ana Riverbed, the La Loma Hills, and Reche Canyon Hills. Within the incorporated city limits are the dunes around the railroad tracks that run east and west as well as north and south. The City of Colton is also known as the Hub City due to both the Santa Fe and Union Pacific railways connect ing within City limits .
These areas are all accessed by dirt roads that are only accessible to 4X4 vehicles, dirt bikes or OHVs. Within the last s everal years the police department has observed an ever -increasing number of off -roaders that come into the city and go off -roading. All these properties are marked as “No Trespassing.” There are times when there are over 500 “Razor” type Off Highway Vehicles along with dirt bikes and quads in the riverbed. Numerous complaints have come in from residents in the surrounding area from all the recklessness that occurs due to off roaders. In order to gain access to the area the off roaders have cut gates, chains, moved K-Rails, and driven over fences to use these protected lands as a recreational area for events and functions. Crime in these off -road areas has also grown to include homicides, stabbings, rapes, drug charges, thefts, pursuits, and fights.
The Colton Police Department does not currently have an off highway/road detail where officers are assigned. The department on a seasonal basis does conduct enforcement by means of overtime assignments. Enforcement is usually conducted when working a multi -agency detail with the help of surrounding agencies to include San Bernardino County Sheriff’s Department, San Bernardino Police Department, Rialto Police Department, and Riverside Sheriff’s Department, along with the California Fish & Game Wardens.
The department had purchased two quads and two Enduro off road motorcycles approximately 15 years ago. However, due to the terrain and age of these vehicles we have had multiple injuries to officers on the Enduros and the quads which has caused the departmen t to no longer use these vehicles for enforcement. The department is requesting the $162,334 allocated for the City of Colton to be used towards the purchase of Off -Highway Vehicles capable of contacting suspects in various terrains with similar type vehic les. With the stability and better safety measures of these new OHV’s, officers will be better equipped to deal with trespassers and their OHVs while maintaining a safe environment.
According to the County's contract, the timeline for all expenditures s hould be spent by September 23, 2023. Because of this compressed timeline and having the OHV Fleet completely up-fitted with emergency lighting, graphics, radios, and safety equipment, staff is requesting the City Council dispense with formal bidding in a ccordance with Colton Municipal Code Section
3.08.140(E), which states “ Purpose of Bidding is Otherwise Accomplished. When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bid ding for Non -Public Projects under this chapter. Prior City Council concurrence with the City Manager's determination shall be required for Non -Public Project purchases over one hundred thousand dollars. ” To comply with the contractual timeline with the County, the Police Department is requesting that City Council accept the informal, three (3) 6 Packet Pg. 145

quote process as sufficient for the purposes of competitive bidding . The police department needs to be fully operational (purchase and up -fitted with decals, radios , lights, and safety equipment) with these vehicles as soon as possible so we can fulfill our contractual obligations to the County should they request assistance from recipient agencies.
With the purchase and implementation of these vehicles and equi pment the Colton Police Department will be able to greatly assist our own officers as well as neighboring jurisdictions with rescue operations in the Santa Ana riverbed, enforcing trespassing violations in the rural areas of our city including the protecte d fly habitats, sand dunes, flood control, Reche Canyon area, and our city streets.
Bert’s Mega Mall base model price for both the Commander and the Maverick was lower than the other two competitors base model price. Also, the quotes from Bert’s had the recommended off-road requested accessories that the other two vendors were unable to build based on specified recommendations. Staff recommends awarding to Bert’s Mega Mall for the purchase of the two OHV’s and related equipment due to the reasons stated above.
FISCAL IMPACTS
The budget for the City of Colton for the Fiscal Year commencing July 1, 2022 and ending June 30, 2023 was approved and adopted. Currently, Staff recommends approving and adopting Resolution R- 11-23 to:
1.) Amend the FY 2022/2023 Bud get to increase revenues in the Miscellaneous Grant Fund Revenue Account GL 225-5890-002 by $162,334.00.
2.) Amend the FY 2022/2023 Budget to increase appropriations in the Miscellaneous Grant Fund Vehicle Expenditure Account GL 225 -6070-6072-4910-0000-002 for $162,334.00 to purchase the OHV vehicles and related emergency/safety equipment related to this OHV purchase.
Staff estimates the total cost to purchase and up -fit both vehicles with emergency lighting, graphics, radios, accessories, and safety equipment will not exceed $162,334.00.

ITEM NO. 7
STAFF REPORT
DATE: MARCH 7, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BILL SMITH, CITY MANAGER
SUBJECT: APPROVE AMENDMENT #2 TO THE JOINT POWERS
AGREEMENT (JPA) WITH THE INLAND VALLEY DEVELOPMENT
AGENCY (IVDA).
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve Amendment #2 to the Joint Powers Agreement (JPA) with the Inland Valley Development Agency (IVDA).
BACKGROUND
Formed in 1990, the Inland Valley Development Agency (IVDA) is a special military base reuse Joint Powers Authority (JPA) created by and through specific State of California Legislation (AB 419) . Its member agencies are the County of San Bernardino, and the Cities of San Bernardino, Loma Linda, and Colton. It is governed by its Board of Directors , which currently includes Mayor Navarro and Councilmember Echevarria.
The Inland Valley Development Agency (IVDA) Joint Exercise of Powers agreement establishes certain officers which are elected by a majority vote of the board on a biennial basis. Presently, the leadership structure incudes two (2) IVDA Co -chairpersons and a Vice -Chairperson. It has been noted that the Co -Chairperson role is somewhat unique in special district orga nizations.
Most special districts operate with a Chair/Vice Chair role or a President/Vice President role.
Over the years, IVDA Board members have inquired about changing the IVDA’s officer structure to a more typical Chair/Vice Chair position. The office r positions are contained in the Joint Exercise of Powers Agreement, and therefore require an amendment to the Agreement to 7 Packet Pg. 173

change the officer positions. The current IVDA Board has decided to make the change in the officer structure.
There is currently a vacancy in the Vice -Chairperson position. Pursuant to the IVDA election procedures, when there is a vacancy of an officer position, the IVDA Board shall at the next regularly scheduled meeting, conduct an election for a successor to such office for the unexpired term. This is scheduled to occur at their March 2023 meeting.
ISSUES/ANALYSIS
Amendment No.2 will make the following changes to the Joint Exercise of Powers Agreement:
1) Update the titles of Board officers from Two (2) Co-Chairpersons and a Vice-Chairperson to a Chairperson, Vice-Chairperson, and a Secretary; and
2) Change the date for the biennial election of officers from the first regular meeting of the Board in the Fiscal Year commencing in an even numbered calendar year (typically July) to the first regular meeting of the Board held in an odd numbered calendar year (typically January).
In order for Amendment No.2 to be effective, it must be approved by all of the IVDA Members consisting of the City of Loma Linda, City of San Bernardino, City of Colton and County of San Bernardino.
FISCAL IMPACTS
There is no fiscal impact as a result of this proposed action.
