ITEM NO. 1

STAFF REPORT

DATE: NOVEMBER 21, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: TIME AND PLACE FIXED TO CONSIDER A PUBLIC HEARING TO

APPROVE AND ADOPT A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF COLTON ESTABLISHING A PRICE LIST FOR

SERVICES PROVIDED AT HERMOSA GARDENS CEMETERY,
RESOLUTION NO. R-92-23.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

1) Approve and Adopt Resolution R-92-23, establishing a Price List for services provided at Hermosa Gardens Cemetery for immediate implementation.

BACKGROUND

The City of Colton owns Hermosa Gardens Cemetery, a municipal cemetery located at 900 North Meridian Avenue and until 1999, operated and managed the cemetery directly. In 2000, the City entered into an agreement with Inland Memorial, Incorporated for the operation of Hermosa Gardens Cemetery (“Cemetery”) through March 2023 when the company was sold.

From March 1 – September 30, 2023, Cemetery Care Providers managed, and operated the Cemetery. Effective October 1, 2023, the City has taken over management and operations at the Cemetery and it is necessary to establish a Price List for services provided at the Cemetery.

ISSUES/ANALYSIS

Cemeteries are essential public services, providing a final resting place for our loved ones.

Managing a cemetery involves various costs, including land maintenance, grave digging, administrative expenses, and other associated services. Establishing a transparent and

competitive price list is vital to meet these financial needs and to provide transparency and clarity for customers. This will ensure that individuals and families have a clear understanding of the costs associated with burial services and related items. Having a well -defined price list helps customers make informed decisions and eliminates any confusion or ambiguity regarding pricing, ultimately contributing to a more efficient and customer-friendly cemetery experience.

To determine appropriate pricing for cemetery services, we conducted a fee survey of the local area, taking into account neighboring cemeteries and relevant data. Staff reviewed the internal costs associated with cemetery operations, including labor, maintenance, equipment, and overhead. See the attached detailed worksheet , Cemetery Fee Survey, which lists fees from Rialto, Redlands, San Bernardino, Claremont and the previous operator. While services and fees vary, it is important for Hermosa Gardens remains competitive within the local market to attract and retain customers, while still considering the community's socio -economic background and the importance of providing affordable options.

The proposed pricing structure adheres to industry standards, complies with all relevant laws and regulations, and provides clear delineation of property options, rights, merchandise, and service choices. Notable differences between the fees established by the previous operator and our proposed list include the introduction of two property tiers and the consistent application of Endowment and related fees. The overall cost framework aligns with neighboring cemeteries, striking a balance between competitive pricing and maintaining quality services.

The introduction of the Historic and Classic sections at differing costs is primarily driven by the varying desirability of these sections. The Historic area, encompassing Blocks 1, 2, 3, and 5, represents the oldest and most established sections with a wealth of trees, upright markers, and prominent features. In contrast, the Classic area includes Blocks 4 and 7, which are newer and lack the same desirable attributes. This distinction also serves as a foundational step for future property development to the east of Hermosa.

Cemetery endowment fees are a common practice in the cemetery industry and serve several important purposes. These fees are typically a one -time payment or an annual contribution required in addition to the purchase of a burial plot or interment space. Cemetery endowment fees are primarily established to ensure the perpetual maintenance and care of the cemetery grounds. These fees contribute to the funding required for landscaping, mowing, tree maintenance, road upkeep, and general upkeep of the cemetery. Without these funds, cemeteries struggle to maintain the peaceful and well-kept appearance that families expect. The Endowment Fee of $995 is applied to each interment to insure the long -term care of Hermosa Gardens Cemetery. These fees are collected and placed in a separate trust where they are held until necessary.

The proposed price list represents a collaborative effort between the City of Colton and OMNI Cemetery Management, the current vendor, which operates in partnership with the City to manage cemetery business. This collaboration is in accordance with the fully executed contract

Price List - Hermosa Gardens Cemetery

Page 3 ends

between the two parties. As outlined in the contract, OMNI is responsible for collecting fees on behalf of the City and remitting appropriate funds to the City on a monthly basis.

It is important to note that OMNI is not permitted to retain revenue from pre -need property, rights, and pre -need or at -need endowment care funds collected. However, they are authorized to retain all income generated from the sale of markers, vases, and other retail items that have been approved by the City. This distinction ensures financial transparency and compliance with the terms of the partnership agreement between the City and OMNI Cemetery Management.

Establishing a fair and transparent pricing structure for cemetery services is essential for maintaining the cemetery's financial health and ensuring that it continues to serve the community effectively. By considering local market trends, cost recovery, and the community's needs, the cemetery can strike a balance between quality service and affordability. City Staff recommends implementing the proposed Hermosa Gardens Cemetery - Price List to achieve this goal.

FISCAL IMPACTS

If all fees are approved as recommended, we anticipate an increase in revenue in correlation to the increase in labor and supply costs.

ALTERNATIVES

Provide alternative direction to staff.

STAFF REPORT

DATE: NOVEMBER 21, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: WAIVE FULL READING, READ BY TITLE ONLY AND PASS FIRST

READING OF AN ORDINANCE OF THE CITY COUNCIL OF THE

CITY OF COLTON AMENDING SECTIONS IN MUNICIPAL CODE,
CHAPTER 2.60 RELATING TO THE COLTON PUBLIC LIBRARY,
ORDINANCE NO. O-12-23.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Waive full reading, read by title only and introduce Ordinance No. O-12-23, amending Section

2.60.030 of the Colton Municipal Code relating to Meetings of the Board of Library Trustees.

BACKGROUND

The City of Colton provides Library services which offer a variety of services and programs for residents, plus a place for families to gather. Libraries are invaluable institutions in communities, serving as centers of knowledge, culture, and community engagement. The values of libraries in communities are multifaceted and extend far beyond their traditional role as repositories of books.

ISSUES/ANALYSIS

Library services have a long history in Colton, Section 2.60 of the Colton Municipal Code relates to the Library was created in 1906 , when the Colton Public Library was initially established .

The Mission of the Colton Public Library is:
“The Colton Public Library is a vital community asset with a threefold purpose:

1.2 Packet Pg. 17
Staff Report to the Mayor and City Council
Ordinance - Library
November 21, 2023

Page 2 ends

1. To lead men, women and children to a knowledge and appreciation of great ideas that are essential to liberty and justice in a democratic society.

2. To improve the quality of community life by assessing and providing the finest popular materials and informational services to meet the educational, recreational, and cultural pursuits of library users.

3. To strive for excellence in library service with professionalism, courtesy, and personal honesty.”

These values underscore the importance of libraries as cornerstones of communities, contributing to education, culture, social well-being, and civic engagement. Libraries continuously adapt and evolve to meet the evolving needs of their communities, making them essential institutions in today's society. As such, the Ordinance regarding Meetings requires update from the last changed/established date in 1906:

2.60.030 - Meetings. (Ord. 218 § 3, 1906)
The Board of Library Trustees Shall meet at least once a Month at such time and places as the said Board of Library Trustees May fix by Resolution. A special meeting May be called at any time by three Trustees by Written Notices served upon each member at least three hours before the time specified for the proposed meeting; a majority of the board Shall constitute a quorum for the transacting of Business. The Board of Library Trustees Shall appoint one of their number president, who Shall serve for one year and until his successor is appointed, and in his presence Shall select a president pro tem.

Section 2.60.030 sets the regular meeting schedule as “at least once a month”. The Library Board of Trustees desires to amend its regular meeting schedule by meeting the fourth Tuesday of the months of January, March, May, July, September and November. Further, the section would be better served by a separation of the second action regarding appointment of the President. Recommendation as follows:

2.60.030 - Meetings.

The Colton Board of Library Trustees shall regularly meet at 12:00 p.m. the fourth Tuesday of the months of January, March, May, July, September, and November, at the Main Library, or at such other location as designated and properly noticed within the City of Colton. The Library Board shall also hold special meetings, pursuant to applicable state law, whenever necessary

2.60.035 - President
The Board of Library Trustees Shall appoint one of their number President, who Shall serve for one year and until his successor is appointed, and in his presence Shall select a President Pro Tempore.

This proposed change was reviewed by the Colton Library Board of Trustees at their August 22, 2023 meeting and after discussion and clarification recommended for approval by City Council.

STAFF REPORT

DATE: NOVEMBER 21, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION ADOPTING THE CA DEPARTMENT OF EDUCATION FY 24-25 CONTINUED FUNDING

APPLICATION FOR THE EARLY CARE AND EDUCATION
DIVISION, RESOLUTION NO. R-99-23.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

· Approve and Adopt Resolution R -99-23, the CA Department of Education FY 24 -25 Continued Funding Application for the Early Care and Education Division.

· Authorize City Manager to act as signatory for all contracts and amendments.

BACKGROUND

The City of Colton, Early Care and Education Di vision has two main components : the School Age Program ( CCTR) and the State Preschool Program ( CSPP). The CCTR is funded by the California Department of Social Services ( CDSS) for children in gr ades K thru 6 th, using the DSS CCTR Contract to provide services for before, after, and all -day care on CJUSD closure days. The CSPP is funded by the California Department of Education (CDE) for younger children, ages 3 to 5 years. The CSPP operates 180 days a year, part-time, with the desired result of preparing you ng children for elementary school, both in the classroom and the playground.

As Executive Director of the Program, the City Manager is the designated authority to sign the State contract.

Each Fiscal year, the City submits the “Continued Funding Application” (CFA) to CDE to renew the aforementioned Contracts. In previous years, Council (Board) Approval and a Resolution 7 Packet Pg. 132

were not required as a part of the CFA Packet. The signatory authority previously granted to the City Manager, who is the Executive Director of the Program, remains the same.

ISSUES/ANALYSIS

In FY 2023-24, the CFA requirements changed, and now Council Approval and a Resolution are required with the CFA submission, which is handled electronically. Additionally, like FY 23-24, CSPP contractors who apply for and are approved for Continued F unding will not need to sign and return a CSPP contract to provide services for FY 202 4–2025. CSPP contractors who apply for and are approved for Continued F unding through the CFA process will be automatically renewed in accordance with all applicable federal and state laws, as well as all CSPP Funding Terms and Conditions and Program Requirements that will be incorporated into the FY 202 4–25 CSPP contract.

FISCAL IMPACTS

This is an administrative compliance action with no direct fiscal or GF impact.

The ECE Program uses Fund 206 -7200-7203 for expenditures and 206 -5776 for revenue for the State Preschool Program. The exact amount of the FY 24 -25 CDE Contract for the CSPP is currently unknown. However, historically, contracts match the Maximum Reimbursable Amount (MRA) from the previous FY. The CDE CSPP Contract for FY 23-24 is $947,092.

STAFF REPORT

DATE: NOVEMBER 21, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS DIRECTOR
SUBJECT: APPROVE A CONTRACT AGREEMENT WITH MCC EQUIPMENT RENTALS. FOR THE CITRUS STREET AND BORDWELL AVENUE
EMERGENCY WATER MAIN REPAIR.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Approve an award of contract to MCC Equipment Rentals, Inc. (MCC) for the Citrus Street and Bordwell Avenue water main repair project in an amount $79,989.36.

BACKGROUND

Maintaining the system that brings water to our homes and businesses is crucial for our community’s well -being. The City’s aging water system has faithfully served us for years, ensuring our health, growth and environment are well taken care of.

On October 12, 2023, an unexpected number of water leaks presented a challenging situation for the Water Utilities Department. A total of six water main breaks were reported on this day. City Staff worked tirelessly throughout the day and into the early hours of the next morning repairing three of the six water main breaks . Due to limited City manpower and recognizing the urgency of the situations at hand, staff promptly sought the assistance of a local contractor , MCC Equipment Rentals, Inc. (MCC), to help manage the situation. Their swift action highlighted the importance of reinforcing our water system and ensuring that we have the necessary resources to handle unforeseen emergencies.

Colton Municipal Code Section 3.08.130 (A), allow s for the City Manager to constitute an emergency for a public project pursuant to section 22035 of the Act and Public Contract Code Section 22050. The City Council hereby delegated to the City Manager the power to declare a public emergency and take any directly related and immediate action required by the emergency, up to a total of one hundred thousand dollars, pursuant to section 22035 of the Act and California Public Contract Code Section 22050.

Under Colton Municipal Code Section 3.08.130(A), “ For Projects of more than fifty thousand dollars, a report on the Emergency and work performed Shall be provided at the next regular meeting of the City Council, and then at every meeting thereafter required by Section 22050. At such meetings, the City Council Shall determine, by a four -fifths vote, that there is a need to continue the action without the benefit of informal or formal competitive bidding in accordance with Section 22035 of the Act and California Public Contract Code Section 22050. The City Council Shall terminate the Emergency action at the earliest possible date that conditions warrant, so that the remainder of the Emergency action May be completed pursuant to a Formal Bidding Procedure.”

For the aforementioned event, s taff evaluated the severity of the leaks on hand and determined the water leak located at the corner of Citrus and Bordwell was a 24-inch water main. Due to the size of the water main and complexity of the leak, staff coordinated with MCC to assist in this repair. Given MCC’s ongoing engagement in a concurrent water main replacement project with the City, MCC was readily accessible, and the City was in possession of all the required insurance and business license requirements ensuring compliance with City policies .

Construction activities began promptly on the evening of October 12 and completed on the morning of October 16, 2023. S taff subsequently requested an emergency procurement be issued to MCC for the water main repair by the City Manager. The City Manager granted staff’s request under Colton Municipal Code Section 3.08.130(A).

FISCAL IMPACTS

Sufficient appropriations are available in the FY 2023-24 adopted budget in Water Utility Fund Mainline Replacement Capital Improvement Account Number 521-8100-8106-3890-0000-000.

STAFF REPORT

DATE: NOVEMBER 21, 2023
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: CHARLES BERRY, DIRECTOR OF UTILITIES
SUBJECT: APPROVE PURCHASE OF ELECTRIC METERS FROM MCAVOY & MARKHAM ENGINEERING & SALES COMPANY.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

It is recommended that the Colton City Council approve the annual purchase of Itron electric meters from McAvoy & Markham Engineering & Sales Company, Inc. in an amount not -to- exceed $965,000, in accordance with Colton Municipal Code 3.08.140(B)(E).

BACKGROUND

The Colton Electric Department (CED) has progressed from using encoder receiver transmitter (ERT) meters and automated meter reading (AMR) for collecting consumption data from its utility customers, to the CENTRON Bridge Meter. The CENTRON Bridge Meter is the bridge between Itron communication architectures that enable advanced metering infrastructure (AMI) and smart grid functionality. This meter was first deployed in 20 12 and is the current standard for CED. The meter’s adaptability allows it to be incorporated alongside existing Itron electric meters with a mobile collection or fixed network systems, delivering advanced metering benefits associated with interval data, remote service switch and demand reset. These revenue quality meters give CED a standardized solution for multiple metering applications, including net - energy metering and two -way communication allowing remote connecting and disconnecting functions. The CENTRON Bridge Meter is consistent with the City Council action on June 1, 1999 for the standardization of the Itron metering reading system.

CED’s ultimate goal is to replace all AMR and non -AMR/AMI meters with AMI technology.

CED currently has approximately 11,100 AMI meters installed for service to its customers.

There are approximately 8,000 AMR meters and 800 non -AMR-AMI meters installed at 9 Packet Pg. 137
Staff Report to the Mayor and City Council

Page 2 ends

customer locations. CED intends to purchase and replace approximately 5,100 AMI meters this fiscal year.

ISSUES/ANALYSIS

McAvoy & Markham Engineering and Sales Company, Inc. is the only distributor authorized to sell Itron electric meters to utilities in Southern California. The vendor has agreed to hold the same pricing (no increase), as negotiated in previous years, for the current fiscal year. The pricing will be firm for the entire fiscal year as follows:

FM 2S, Centron bridge meter, CL200 with disconnect switch, Cat. #C95-0527 $170.11 each FM1S, Centron bridge meter, CL200 with disconnect switch, Cat. #C95-0528 $170.11 each FM12S Centron bridge meter, CL200 with disconnect switch, Cat. #C95-0530 $204.33 each FM2S Centron bridge meter, CL 320, Cat. #C95-0531 $170.11 each FM 2S, Centron, bridge meters 120-480V, CL200, Cat. #C95-0536 $409.19 each FM 45S, Centron poly bridge meters for TOU applications, Cat. #C95-0539 $409.19 each FM 9S, Centron poly bridge meters, for TOU applications Cat. #C95-0537 $409.19 each FM 16S, Centron Poly ERT meters CL200, Cat. #C95-0538 $409.19 each

Colton Municipal Code, Title 3, Chapter 3.08.140, Section ( B) allows for the competitive bidding requirement to be waived for non -public projects when there is no competitive market.

Specifically, Section ( B) allows that the competitive bidding process may be waived, “[w]hen the City Council determines, in accordance with applicable law, that a competitive market does not exist and that no competitive advantage will be gained by the public bidding process.” In addition, Colton Municipal Code 3.08.140 Section ( E) also states the bidding requirements may be waived, “[w]hen the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for non -public projects under this chapter. Prior City Council concurrence with the City Manager’s determination shall be required for non-public project purchases over $100,000.”

Since McAvoy and Markham Engineering & Sales Company is the only authorized distributor of the Itron electric meters for utilities in Southern California, a competitive market does not exist.

If CED were to change to a different meter type, it would also have to change the meter reading software and equipment at significant cost to the Electric department. CED suggests that it is in the City’s best interest to continue with the standardization of equipment and uniformity efforts and requests to continue purchasing Itron meters, as previously approved by City Council on September 7, 2021 (Business Item # 13). McAvoy & Markham Engineering and Sales Co., Inc. is the only vendor authorized to sell Itron meters to the Southern California region, and there is no competitive market or advantages to be gained by public bidding.
