STAFF REPORT
DATE: JANUARY 16, 2024
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION ADOPTING THE CA DEPARTMENT OF SOCIAL SERVICES FY 24-25 CONTINUED
FUNDING APPLICATION FOR THE EARLY CARE AND
EDUCATION DIVISION, RESOLUTION NO. R-01-24.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
· Approve and Adopt Resolution R -01-24, the CA Department of Social Services FY 24 -25 Continued Funding Application for the Early Care and Education Division; and,
· Authorize City Manager to act as signatory for all contracts and amendments.
BACKGROUND
The City of Colton, Early Care and Educa tion Division has two main components : the School Age Program ( CCTR) and the State Preschool Program ( CSPP). The CCTR is funded by the California Department of Social Services ( CDSS) for children in grades K through 6th, using the DSS CCTR Contract to provide services for before, after, and all -day care on CJUSD closure days. The CSPP is funded by the California Department of Education (CDE) for younger children, ages 3 to 5 years. The CSPP operates 180 days a year, part-time, with the desired result of preparing young children for elementary school, both in the classroom and the playground.
As Executive Director of the Program, the City Manager is the designated authority to sign the State contract.
Each Fiscal Year, the City s ubmits the “Continued Fu nding Application” (CFA) to CDSS to renew the aforementioned Contracts . Since FY 2023 -2024, Council (Board) Approval and a 12 Packet Pg. 387

Continued Funding Application - ECE Program
January 16, 2024
Resolution is required as a part of the CFA Packet. The signatory authority previously granted to the City Manager, who is the Executive Director of the Program, remains the same.
ISSUES/ANALYSIS
In FY 2023-24, the CFA requirements changed, and now Council Approval and a Resolution are required with the CFA submission , which is handled electronically. Similarly to FY 2023-2024, CCTR contractors who apply for and are approved for Continued F unding will not need to sign and return a C CTR contract to provide services for FY 202 4–2025. CCTR contractors who apply for and are approved for Continued F unding through the CFA process will be automatically renewed in accordance with all applicable federal and state laws, as well as all CCTR Funding Terms and Conditions and Program Requirements that will be incorporated into the FY 2024–2025 CCTR contract.
FISCAL IMPACTS
This is an administrative compliance action with no direct fiscal or GF impact.
The ECE Program uses Fund 206-7200-7202 for expenditures and 206-5777-000 for revenue for the School Age Program. The exact amount of the FY 2024-2025 CDSS Contract for the CCTR is currentl y unknown. However, historically, contracts match the Maximum Reimbursable Amount (MRA) from the previous fiscal year and the contract for FY 2023-2024 is $778,511.

SUBJECT: APPROVE FIRST AMENDMENT TO CONTRACT FOR NBS FOR WATER AND WASTEWATER RATE AND FEES STUDIES.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve a first amendment to the contract with NBS for Water and Wastewater Rates and Fees Studies to include Capacity Fee Analysis and Implementation in the amount of $12,300, for a total aggregate amount of $100,460.
BACKGROUND
The City of Colton provides service to approximately 10,360 water service connections and 14,996 sewer service connections, of which are residential, commercial, i ndustrial, and municipal accounts. The service area includes 14 square miles in the City of Colton and approximately 0.8 square miles of unincorporated area in San Bernardino County.
In 2018, the Council approved a contract with NBS to perform a Water an d Sewer Capacity fee Study. In light of the current economic landscape and the substantial increase in costs across various sectors, it is essential for the City to consider re -evaluating the water and sewer capacity fee study conducted by NBS in 2018. Th e study, which was diligently completed and presented to the City, led to the decision to defer implementation at that time. However, it is crucial to note that despite the evaluation in 2018, no increases were implemented, and many of the existing fees remain rooted in 1996 figures. Given the dynamic nature of economic conditions and the need to ensure sustainable infrastructure funding, a comprehensive re -evaluation of the capacity fees is now imperative. This process will enable the City to align these f ees with current market values, addressing the rising costs and ensuring a fair and equitable fee structure that adequately meets the evolving needs of our community.

Contract Amendment - NBS Water/Wastewater Rate Study
January 16, 2024
ISSUES/ANALYSIS
On April 5, 2022, the Council approved a contract with NBS for $88,160 for the Water and Wastewater Rate Study. Some of the key components for the rate study include ensuring water rates cover all operating and maintenance costs, ensuring sufficient funding for essential capital improvement projects, and maintaining appropri ate reserve funds. Amending the current water and wastewater study contract scope to incorporate a comprehensive analysis of our Water and Sewer Capacity fee is crucial. Recognizing the distinct nature of these fees as separate components ensures a thorough understanding of our utility financial landscape.
Capacity fees are considered to be a charge on new development or increases in user discharge capacity to help fund and pay for the construction or needed expansion of capital improvements.
This approach aligns with our commitment to reducing the economic burden on our ratepayers by ensuring that fee structures are fair, transparent, and conducive to fostering community growth and development.
FISCAL IMPACTS
The contract amendment for the Water/Was tewater Capacity fees studies is $12,300 of which will be split 50/50 between Water and Wastewater. Sufficient appropriations are available in the adopted FY 2023/24 budget as follows.
Water Fund Professional Services 521-8100-8101-2350-0000-000 $6,150 Wastewater Fund Professional Services 522-8200-8200-2350-0000-000 $6,150

SUBJECT: APPROVE AWARD OF CONTRACT TO TKE ENGINEERING INC.,
FOR ENGINEERING & DESIGN SERVICES FOR THE WALNUT
BOOSTER STATION.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve the award of Professional Services Agreement (PSA) contract to TKE Engineering Inc, for the Engineering an d Design services for the Walnut Booster Station for the amount not-to-exceed $332,937.
2. Authorize the City Manager to execute the agreement.
BACKGROUND
Having an adequate supply of water is an essential part for the health and safety of our community. T he City of Colton is the principal supplier of water service for domestic consumption, fire protection, and irrigation application for consumers within the City of Colton currently serving a population of approximately 53,000 over a 17.5 -square mile servic e area.
Without adequate supply the City could be subjected to building moratoriums issued by the State Health Department.
The City currently has four booster pump stations that deliver water from lower pressure zones to higher -pressure zones. These pump stations typically comprise of multiple active pumping units in addition to a standby pump as well as emergency power supplies set in place in the event of primary power source failure.

Staff Report to the Mayor and City Council
Contract Award - TKE Engineering Inc.
January 16, 2024
The previously existing booster station at the location of Colton’s Walnut Well Site was decommissioned as of September 2014 due to a thunder strike that caused a fire at the site, effectively compromising the functionality of the pump station. Pursuant to the City of Colton Water Facilities Master Plan (2016), for accomm odation of the City’s anticipated water requirements over the next ten to twenty years, construction of this pump station has been proposed to effectively meet the recommended water production capacity of the City.
Specifically, a booster station with the capacity of 1900 gpm is required at the Walnut Well Field to move water from the northern pressure zones to the central and western zones. The construction of this booster station is an essential component of the City’s future developments and residents.
ISSUES/ANALYSIS
On September 22, 2023, City Staff issued a Request for Proposal (RFP) for the preparation of the engineering and design services for the Walnut Booster Station project. The RFP was advertised in The Press-Enterprise newspaper on September 22, 2023 and September 29, 2023. On October 26, 2023, City received proposals from four (4) engineering firms:
No. Name of Consultant Cost
Proposal
Optional Task
& Bidding

Total Cost
1 TKE Engineering Inc. $332,937.00 - $332,937.00
2 Water Works Engineers $462,045.00 - $462,045.00
3 Krieger and Stewart Engineering
Consultants $491,000.00 $228,000.00 $719,000.00
4 Lee & Ro Inc. $574,893.00 $13,865.00 $588,758.00
Staff performed a review of the proposals for accuracy, completeness and ra ted the consultants based on qualifications, performance of similar work, ability to provide services, quality of proposal, work performance for the City and cost. Staff evaluated all of the proposals and determined that the TKE Engineering Inc. proposal m et all of the criteria as outlined in the RFP and scored the highest in the City’s evaluation process, see attached Exhibit A. TKE Engineering Inc. cost proposal for the complete engineering design services is $332,937.00.
FISCAL IMPACTS
The total amoun t for engineering design services for the Walnut Booster Station Project , including a 5% contingency , is $349,583.85. Sufficient appropriations for the project are available in the FY2023-24 adopted budget in Water Fund Booster Station Capital Improvement Account #521-8100-8103-3890-0000-000.

SUBJECT: APPROVE AND ADOPT A RESOLUTION AUTHORIZING REPAIRS TO DAMAGED FIRE ENGINE, RESOLUTION NO. R-03-24.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Dispense with competitive bidding in accordance with Colton Municipal Code Section
3.08.140(B); and
2. Authorize repairs to Medic Engine 213 (ME213) with Fire Apparatus Solutions (FAS) for an amount not to exceed $73,295.69; and
3. Approve Resolution R-03-24.
BACKGROUND
ME213 is a 2005 KME Pumper. On Sunday November 26, 2023 around 11:00 am, ME213 was being driven on City property to facilit ate training for the ne w tractor drawn a erial. While maneuvering ME213, the engine struck a wooden power pole in a parking lot while traveling at around 10 mph (Attachment A) . The engine received significant damage to the body and suspension. The driver sustained a small abrasion to the left hand a nd forearm that did not require medical attention. It is noteworthy that the last accident of this magnitude to a Colton fire engine occurred more than 25 years ago when a ladder truck was struck by a vehicle.

ECE Additional Funding - SB 140
January 16, 2024
California SB 140, sign ed into law on September 13, 2023, addresses child care provisions by establishing transitional one -time payments for family child care providers. It extends its scope to include subsidized child care centers, outside the representation of the Child Care P roviders Union (CCPU), granting them similar one -time payments. The bill's provisions, detailed in WIC Section 10277.1(c) and 10277.2, facilitate financial support, aiming to assist child care providers during this transitional phase. SB 140 stands as a le gislative measure aimed at bolstering the child care sector by offering financial assistance to eligible providers and centers, acknowledging their essential role in the state's childcare landscape.
The City of Colton maintains a contract with the Departm ent of Social Services for General Child Care and Development Programs (CCTR). SB 140 outlines that Contractors, like Colton, will receive an additional allocation equal to five (5) percent of the administrative costs associated with provider payments. Col ton received a one -time payment of $40,128 in accordance with SB 140. SB 140 also extended payments to centers, which are not represented by CCPU.
Background
EffectiveJanuary1, 2020, AB 378 (Chapter385, Statutesof 2019) authorizedfamily childcareproviders, definedin Welfareand InstitutionsCode (WIC) section10421(b) as licensed family child care home operators or license-exempt providers who participate in a state-funded early care and education program, to meet and confer with the state regardingmatterswithinthe scopeof representationas establishedin WICsection 10424.5. Family child care providers chose CCPU to act as their union representative, and CCPU was subsequently certified by the Public Employment Relations Board.
Topics within the scope of representation include, but are not limited to, reimbursement rates, professionaldevelopment, andtrainingfor childcareproviders, and impactson the deliveryof childcareservicesas a resultof changesin regulationsand rules.
On June 30, 2023, the State and CCPU reached a tentative agreement, which would become effective upon the date of ratification and through June 30, 2025. The agreement was subsequently ratified by CCPU members on July 31, 2023, and ratified bythe stateandfully ratifiedvia SB 140, whenGovernorNewsomsignedthe legislation on September 13, 2023. As codified in WIC Section 10277. 1( c), the agreement and SB 140 afford transitional one- time payments to family child care providers. STAFF REPORT
DATE: JANUARY 16, 2024
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS DIRECTOR
SUBJECT: APPROVE IRREVOCABLE LETTER OF CREDIT REDUCTION DUE
TO FAITHFUL PERFORMANCE BOND REPLACEMENT FOR PM
20146.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Authorize a reduction to the Irrevocable Letter of Credit (ILOC) provided by Farmers and Merchants Bank of Long Beach in the amount of $1,624,156.61 since replacement Faithful Performance Bonds and Labor and Material Bonds were submitted in favor of the City for Parcel Map No. 20146.
BACKGROUND
On February 09, 2023, Farmers and Merchants Bank of Long Beach issued an Irrevocabl e Letter of Credit (ILOC) in the amount of Two Million Five Hundred Seventy Four Thousand Nine Hundred Nineteen and 34/100 U.S. Dollars ($2,574,919.34) in favor of the City of Colton for required public improvements fronting the sites at 21661 & 21662 Bart on Road, Colton, CA 92324, as part of Final Parcel Map No. 20146 (PM 20146) as required by the Subdivision Map Act.
Note the address at 21661 Barton Road is for “Building 2” on the south side of Barton Road, east of La Cadena Dr. and the address at 21662 Barton Road is for “Building 1” on the north side of Barton Road, east of Terrace Ave.
On June 21, 2023, Pacific West Management, a California GP, Producer Industrial Partners, LLC and Robert J. Neal and Bernarda A. Neal Revocable Trust transferred owners hip of the parcels comprising the 21661 Barton Road real property (“Building 2”) to CV QOZP Barton Road, LLC. 20 Packet Pg. 454
Staff Report to the Mayor and City Council
Letter of Credit Reduction
January 16, 2024
As part of the requirements under PM 20146, CV QOZP provided the City of Colton with approved comparable Security substitution covering their res pective required public improvement infrastructure fronting their site on the south side of Barton Road for the development of Building 2.
As such, Pacific West Management, a California GP, Producer Industrial Partners, LLC and Robert J. Neal and Bernard a A. Neal Revocable Trust request the City of Colton authorize a reduction to their existing ILOC by $1,624,156.61 to a new amount totaling $950,762.73 for their continued responsibility on Building 1.
The proposed breakdown is further summarized below:
ISSUES/ANALYSIS
Subdivision Map Act (SMA) Section No. 66499.7 (d) states that “if substitute bonds or other security is used as a replacement for the performance security released, the release shall not be effective unless and until the local agency r eceives and approves that form or replacement security.” Therefore, the City Council has to formally accept the replacement security.
Additionally, the SMA further states “a reduction in the performance security, authorized under this section, is not, an d shall not be deemed to be, an acceptance by the local agency of the completed improvements, and the risk of loss or damage to the improvements and the obligation to maintain the improvements shall remain the sole responsibility of the subdivider until al l required public improvements have been accepted by the local agency and all other required improvements have been fully completed in accordance with the plans and specifications for the improvements.” Therefore, any reduction of existing securities due to replacement of portions of those securities do not reduce the obligation to complete public improvements from the developer(s).
FISCAL IMPACTS
There are no fiscal impacts due to the reduction of the ILOC. The City of Colton would still have securities fully covered for all applicable required public improvements under PM 20146 since the proposed ILOC in the final reduced amount of $950,762.73 and the additionally provided Faithful Performance Bonds in the amount of $1,624,156.61 total the fully impro ved amount of $2,574,919.34.

SUBJECT: APPROVE NOTICE OF COMPLETION FOR THE ABANDONMENT OF WELLS 13, 16 & 26 PROJECT.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
It is recommended that the City Council authorize the execution and recordation of a Notice of Completion for the Abandonment of Well 13, 16, 26, Katz and Sullivan Project.
BACKGROUND
Well 13 and Well 16 were constructed in 1934 and 1947 respectively . These are the oldest wells the City owns and have been permanently out of service since 2018. These wells experienc ed pipe failure due to the age of the well as well as declining water table. Moreover, Well 26 and Katz Well only produce approximately 700 gpm. Because of their age, low production and poor efficiency, these wells can no longer be rehabilitated and need to be properly destroyed and removed from the State database.
ISSUES/ANALYSIS
On April 20, 2021, a construction contract was awarded to General Pump Company for the abandonment of the wells in the amount of $269,900. The scope of work is to completely remove the pump equipment, video log , seal and slurry fill the well and process the permit from San Bernardino County and Department of Water Resources.
The Notice to Proceed for the Project was issued on June 28, 2021 and the Project was completed per plans and specification on October 20, 2023. The abandonment of three Sullivan Wells was ultimately removed from the scope. The final cost for the project is $238,113.00. 21 Packet Pg. 473

1. Approve the purchase of 60 APX6000 handheld radios, 20 APX6500 unit radios, as well as miscellaneous accessories such as battery chargers, earpieces, and lapel microphones in the amount of $497,341.57 from Motorola Solutions.
BACKGROUND
The current handheld radios utilized by the Police Department have served us reliably for almost 20 years. However, recent developments in the telecommunications in dustry have led to the discontinuation of our current models by the manufacturer, Motorola Solutions. Consequently, our ability to maintain and replace these radios in case of malfunction or damage has become almost impossible.
ISSUES/ANALYSIS
Effective communication, especially within the Police Department is integral to the seamless operation. The handheld radios serve as a primary means of communication between operational staff and dispatch. Ensuring the communication is clear and reliable is critical for officer safety.
The Police Department purchased our current handheld radios approximately 20 years ago.
Operationally, they have worked extremely well and have very little issues. Unfortunately, 22 Packet Pg. 476
Staff Report to the Mayor and City Council
Purchase - Motorola Solutions, Inc.
January 16, 2024
Motorola Solutions no longer manufactures our current model. Not only do they not manufacture the model, but they no longer are manufacturing replacement parts for the radios.
The Police Department has always piggybacked with the San Bernardino Sheriff’s Department, using their repeater towers to transmit communication over their frequencies and have always purchased similar handheld radios. The Sheriff’s Department has the staff, infrastructure, and permissions with the F.A.A. which allows us the use of both digital and analog frequencies.
Their staff has the knowledge and training to program our radios with the appropriate frequencies not only for Colton but also for all San Bernardino County in case a critical incident or natural disaster occurs. Changing manufacturers would cost the City sign ificantly more than the cost to replace our current radios.
The Sheriff’s Department uses Motorola Solutions for their handheld radios. The Police Department recently tested several different handheld radios over the past several weeks. After careful testing, specifically, in the field operation, staff determined the model APX6000 series from Motorola Solutions would be the best fit for our operations.
Staff would like to purchase 60 of the APX6000 radios, 5 multi -unit charging stations, 30 single unit charging stations, 60 lapel microphones, 60 earpieces, and 20 APX6500 unit radios for a total of $497,341.57.
Due to the fact the Police Department is already utilizing the Sheriff’s Department for communication purposes and for reasons stated above , we respectfully ask to forgo the competitive bidding process using CMC 3.08.140(e) – Exceptions to competitive bidding – Non- Public Projects, which state the “Purpose of Bidding is Otherwise Accomplished. When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for Non -Public Projects under this chapter. Prior City Council concurrence with the City Manager's determination shall be required for Non -Public Project purchases over one hundred thousand dollars.”
FISCAL IMPACTS
The budget for the City of Colton for the fiscal year commencing July 1, 2023 and ending June 30, 2024 was approved and adopted. Sufficient appropriations are available in Local Fiscal Recovery Fund acc ount #219 -2457-1000-2300-000-000 for the purchase of the radios and equipment.

SUBJECT: SET PUBLIC HEARING FOR THE CITY COUNCIL MEETING OF 2/6/24 TO CONSIDER SUBMISSION OF CDBG PROJECTS FOR
FISCAL YEAR 2024-2025 TO THE COUNTY OF SAN
BERNARDINO.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
It is recommended that the City Council set a public hearing date for February 6, 2024 for Fiscal Year 2024 – 2025 Community Development Block Grant funds.
BACKGROUND
Since the Community Development Block Grant (“CDBG”) program’s inception in 1974, it has provided financial assistance to grantees for a variety o f community development purposes. The U.S. Department of Housing and Urban Development (“HUD”) uses a formula to calculate the grant amount for each metropolitan city, urban county, and state. CDBG funds can be used to benefit low and moderate income res idents by: building roads, parks, repairing or rehabilitating housing in target areas, by providing new or increased public services to income -qualifying residents, or by funding initiatives that generate new jobs. The County of San Bernardino’s Community Development and Housing Department (“CDH”) currently provides project oversight for CDBG projects through the Urban County program, in which Colton is a partner and joint recipient.
