SUBJECT: APPROVE NOTICE OF COMPLETION FOR WELL PUMPING
PLANT 31.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Authorize the execution and recordation of a Notice of Completion for the Construction of Well 31 Project.
BACKGROUND
Having an adequate supply of water is an essential part for the Health & Safety of our community. The City of Colton is the principal supplier of water service for domestic consumption, fire protection, and irrigation application for consumers within the City of Colton currently serving a population of approximately 51,000 over a 17.5-square mile service area.
Currently, Well No. 30 is the largest well producer in the City and has the capacity of 3,000 GPM. The water pumped from Well No. 30 is approximately 35% of the total water supply.
Since it was built in 2013 , the pumping plant is always running, and the pump has never been pulled for inspection. Both Well Pumping Plant No. 30 and Well 31 are located in the Central Pressure Zone on Fogg Street/Congress Street.
Water wells require regular maintenance to ensur e adequate water flow and continued drinking water safety. For Well 30 to be inspected, an alternate source of water is necessary to meet the daily water demand. Because of the need to remove Well 30 from service for maintenance, staff recommended equipping Well 31 , since the well was already drilled and was ready for well development. Construction of Well 31 allows for regular maintenance to Well 30 without supply interruption.

SUBJECT: APPROVE AND ADOPT A RESOLUTION TO APPROVE A LIST OF PROJECTS FOR FISCAL YEAR 2024-2025 FUNDED BY SB-1: ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017, RESOLUTION NO.
R-35-24.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve Resolution R-35-24 (Exhibit A) adopting a List of Projects for FY 24-25 funded by SB- 1: Road Repair and Accountability Act of 2017.
BACKGROUND
On April 28, 2017 , the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017 known a s SB-1, to address basic road maintenance, rehabilitation, and critical safety needs on both the state highway and local streets and road systems. The 2016 California Statewide Local Streets and Roads Needs Assessment found that majority of the City’s str eets and roads are in an at -risk/poor condition, and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into a good condition. SB-1 increases per gallon fuel excise taxes, di esel fuel sales taxes and vehicle registration fees. A percentage of the Road Maintenance and Rehabilitation Account (RMRA) funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.
ISSUES/ANALYSIS

Staff Report to the Mayor and City Council
Project List - Road Repair and Accountability Act of 2017 (SB-1) May 7, 2024
Streets and Highways Code (SHC) Section 2032.5(a) articulates the general intent of the legislation that recipients of RMRA fu nding be held accountable for the efficient investment of public funds to maintain local streets and roads and are accountable to the people through performance goals that are tracked and reported.
Pursuant to SHC Section 2030(a), the objective of the Loc al Streets and Roads Program is to address deferred maintenance on the local streets and roads system through the prioritization and delivery of basic road maintenance and rehabilitation projects as well as critical safety projects.
Cities and counties receiving RMRA funds must comply with all relevant federal and state laws, regulations, policies, and procedures. The main requirement for the program is the submittal of the list of projects to the California Transportation Commission (CTC) prior to receiv ing an apportionment of RMRA funds from the Controller in a fiscal year. All projects proposed to receive funding must be included in a city or county budget that is adopted by the applicable City Council or County Board of Supervisors at a regular public meeting. The list of projects is intended to cover, at a minimum, the applicable fiscal year. Project information for future fiscal years can be included and can be updated as needed prior to submittal to the CTC. Any update on the project list requires City Council approval.
Below is the list of proposed streets for funding by SB -1 for Fiscal Year 24 -25. Also shown is the project limit and corresponding Pavement Condition Index (PCI) rating of these streets:
Project Description/Location Budget PCI
1 Pavement Rehabilitation: Pepper Ave. – Randall Ave. to Violet St. including drainage improvement $ 536,540 55, 50

The scope of work for the listed street s includes pavement grinding, rubberized asphalt overlay, pavement striping and installation of traffic loops. Inclusion of these streets was based on the Pavement Management Plan developed by IMS Infrastructure Management Services, Inc. in 2016 for the City of Colton. Recipients of SB -1 fundi ng are required to use a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the 15 Packet Pg. 317

SUBJECT: APPROVE THE PROPERTY DISPOSITION OF THE 1914 JITNEY BUS, CURRENTLY HOUSED IN THE FIRE DEPARTMENT.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve the disposition of the 1914 Ford Jitney Bus to the Big Dog Garage LLC with the intent of restoration and museum display.
BACKGROUND
The City of Colton Fire Department has a 1914 Ford Jitney bus in its fleet, which holds historical significance for our community. LJ Snow Ford donated the Jitney bus to the City of Colton in June 1983. LJ Snow was a Ford Dealer in the heart of Colton for over 50 years. Over the years, the Ford Jitney bus has been a cherished piece of our City’s heritage, s ymbolizing our rich history. The Jitney was stored at Fire Station 212 on Rancho Ave. and then transferred to Station 211 downtown. The vehicle was last fully operational in the late 1990s . Some repairs were attempted in 2018 for $5,000, however the vehicle was operational again for only a short period of time, and remains inoperative at the current time . The Fire department has run out of vehicle storage space and needs to free up space to store a reserve paramedic squad. The space that the Jitney now occupies could be better served to store our reserve apparatus.
ISSUES/ANALYSIS
The Fire Department staff has conducted an exhaustive search over the last ye ar and a half , making multiple phone calls and chasing down several leads to find a suitable home for the Jitney, but with little success. The search included four local Ford dealerships, the local Pioneer Museum, the San Bernardino County Museum, and sev eral other entities , all of which have 16 Packet Pg. 323

declined, stating they have no room to store it. The Colton Area Museum was also considered several years ago but does not have a secure place to store or display the vehicle. Fire reached out to Big Dog Garage LLC Automotive Museum, and after consideration, they have agreed to accept the Jitney. Big Dog Garage is committed to preserving and celebrating automotive history. Additionally, they work with apprentice auto mechanics and plan to assign the Jitney to one of their female apprentices who desires to learn about older vehicles such as this. They have agreed to leave all the labeling and plaques to preserve the connection to the City of Colton.
They plan to restore its functionality and display it in their Sou thern California museum. This transfer would ensure the preservation of this iconic piece of Colton’s history and provide an opportunity for it to be showcased and appreciated by a wider audience.
FISCAL IMPACTS
There is no fiscal impact to the City.
ALTERNATIVES
1. Send the vehicle to auction through the City’s standard procedure for surplus equipment.

SUBJECT: APPROVE THE PURCHASE AND INSTALLATION OF A UTILITY
BED FOR THE ANIMAL SERVICES VEHICLE IN THE POLICE
DEPARTMENT, FROM CALIFORNIA TRUCK EQUIPMENT
COMPANY.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve the purchase and installation of a fabricated utility bed from California Truck Equipment Company for $64,207.00; and,
2. Approve the City Manager or designee to enter into contracts to implement the same that are approved by the City Attorney and contain such provisions as required by Coronavirus State and Local Fiscal Recovery Funds (SLFRF) program established by the American Rescue Plan Act and 2 CFR Part 200.
BACKGROUND
City Council approved designation of $100,000 of the City’s SLFRF funds to t he Police Department's animal services vehicle and utility bed at its September 6, 2022 Council Meeting.
In the approved funding, $50,000 was allocated for one new Ford F350 truck and $50,000 was allocated for the purchase and installation of a fabricated utility bed from California Truck Equipment Company. With the price of metal a nd the inflation of the economy the current price for a new fabricated animal services utility bed is now $64,207. Staff is requesting Council approve the new amount, as the remaining $14,207 will be funded through the police department’s current allocated budget.

Staff Report to the Mayor and City Council
Purchase - California Truck Equipment Company
May 7, 2024
Due to the cost of materials and labor, the original quotes from the three manufactures have risen since the original staff report that was written and adopted on September 6, 2022. Additionally, staff has added a power lift g ate to these quotes as a precautionary safety measure for animal services personnel to use instead of having to lift heavy , large breed animals. This power lift gate will prevent future back injuries to all personnel that work animal services duties, and in fact, will limit the amount of personnel needed to arrive on scene to help lift large breed animals.
Currently, when the Animal Services Officer needs help, he/she will call a police officer to their location to assist in the lift. This takes a Police Officer off the streets and not subject to calls during this process. The power lift gate will allow the Animal Services Officer to put large breed animals in the back of the truck by themselves without the need to utilize other police department staff.
Additionally, staff recommend the purchase of an appropriate utility bed that promotes rust prevention and is safe for the transportation of animals. Staff solicited and received three updated quotes for the construction of the animal services body.
1. Diamond Truck Body Manufacturing (Stockton, CA) $ 49,862.05
2. Pacific Truck Equipment Body (Whittier, CA) $103,622.04
3. California Truck Equipment Co. (Downey CA) $ 64,207.00
Staff has determined that the quote of California Truck Equipment Co. is mo st advantageous to the City because the cost of transporting the vehicle to and from Diamond Truck Body Manufacturing would exceed the price difference and would likely render any warranty work cost prohibitive. In addition, staff have purchased from Cali fornia Truck Equipment Co. in the past and know it’s a quality product. The quote from Diamond Truck Body did not include a power lift gate , which staff estimates to be approximately $6,500. California Truck Equipment Company is the closest in proximity to the City, allowing for easier delivery, warranty repair work, and chassis installation. Should staff get the direction to proceed with Diamond Truck Body, driving back and forth for installation requires a 780-mile round trip. This trip may be needed for any defects, recalls, and other future necessary warranty work for which the City would incur the cost of fuel, payroll, and time , which overall is estimated to exceed the cost of California Truck Equipment Company’s quote.
Staff believes it is in th e best interest of the City to dispense with public bidding and use California Truck Equipment Company for fabrication and installation as stated under City of Colton Purchasing Ordinance section 3.08.080(E). CMC 3.08.140(E) -Purpose of Bidding is Otherwise Accomplished When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for Non -Public Projects under this chapter. Prior City Council concurrence with the City Manager's determination shall be required for Non -Public Project purchases over one hundred thousand dollars. Staff recommends award of the purchase to California Truck Equipment Company in the total amount of $64,207.

SUBJECT: APPROVE PURCHASE OF 7 VEHICLES FOR THE POLICE
DEPARTMENT FROM TOYOTA OF REDLANDS.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve the purchase of 7 Toyota vehicles for Code Compliance, Administrative, and Detective fleet from Toyota of Redlands for $289,688.68 in accordance with Colton Municipal Code Section 3.08.140(E); and,
2. Approve the purchase and installation costs of the related emergency vehicle equipment from West Coast Lights & Siren, Inc. in the amount of $60,000.00.
BACKGROUND
The Police Department has researc hed the ability to order unmarked vehicles for our various divisions from state and federal vendors (Sourcewell & CMAS) however, the availability is scarce, and the timelines are extensive. The Police Department has missed the window to price out the new 2025 vehicles via the State CMAS contract. Staff ha s reached out to Toyota of Redlands and obtained quotes that are very competitive with the state and federal contracts. In addition, Toyota of Redlands has agreed to hold the vehicles that are currently in-transit, as well as the vehicles being manufactured.
ISSUES/ANALYSIS
The Police Department has several older unmarked vehicles with over 100,000 miles on them that are still in service. These older vehicles are unreliable, unsuitable for travel, and generally need to be rotated out of service. With the recent allocation of new positions within the 18 Packet Pg. 341

department (2 code compliance officers, 2 community service officers, 1 Police Sergeant, and various professional staff), this has created a shortage of available vehicles.
During the fiscal year 2023–2024, the window to purchase certain vehicles from state and federal contracts is limited and hard to find available dealerships to order and hold vehicles with any realistic timeline. Staff obtained qu otes for all 7 vehicles from different vendors (Freeway Toyota, Toyota of Riverside), however; Toyota of Redlands was the only dealership who could obtain all the needed vehicles quickly and hold them while the police department seeks City Council approval. In addition, Toyota of Redlands was overall within +/ -1% of the state and federal contract pricing.
Using Toyota of Redlands will keep the taxpayer money in San Bernardino County as opposed to using dealerships outside our county. Staff is recomme nding Toyota of Redlands for this purchase based on the availability, flexibility to hold the vehicles, and their competitive pricing schedule. Toyota of Redlands is a local dealership so there will be no cost of shipping or having personnel travel around the state to pick up these vehicles. Purchasing these vehicles will help solve the lack of Code Compliance, Detective, and Administrative. Toyota of Redlands is our only viable option at this point to purchase these limited vehicles during this fiscal budget.
Due to the limited timeframe, staff is asking City to forgo the formal bidding process and award Toyota of Redlands this purchase under CMC 3.08.140(E) – Exceptions to competitive bidding – Non-Public Projects, which state the “Purpose of Bidding is Otherwise Accomplished. When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for Non -Public Projects under this chapter. Prior City Council concurrence with the C ity Manager's determination shall be required for Non -Public Project purchases over one hundred thousand dollars.”
Staff is requesting that West Coast Lights and Sirens (601 Colombia Ave, Riverside, CA) be designated as a single source vendor, up fitting of emergency lighting, sirens, and related equipment on department vehicles, pursuant to City of Colton Purchasing Ordinance section
3.08.140(E). West Coast is located approximately 6 miles from the police station. The close proximity to the City saves staff time, a further cost saving to the City. Prior to the P.D. exclusively using West Coast Lights and Sirens, we used several different vendors. We found the installation was inconsistent and the quality of work was at times poor. This can cause costly repairs, again taking vehicles out of service for extended periods of time and void vehicle and equipment warranties. During past reviews, West Coast was consistently found to have superior quality and workmanship with prices lower or competitive wit h other emergency vehicle up fitters.
Because West Coast has been our primary vendor for over ten years, all vehicles are outfitted in the same manner for consistency increasing officer safety. While these vehicles will be used for the Detective Bureau, Code Compliance, and the Administrative Division the upfitting from West Coast will be minimal as they are not patrol vehicles. The estimated cost for upfitting the 18 Packet Pg. 342
Staff Report to the Mayor and City Council

Code Compliance vehicles is $5,000. The estimated cost to upfit a Detective/Administrativ e vehicle is at the most $10,000, bringing the total upfitting cost for all 7 vehicles to $60,000.
Staff has attached the most recent cost to upfit a detective/administrative vehicle (2023 Jeep) from West Coast Lights and Siren as a cost reference. Staff anticipates that there could be a minor cost adjustment with the upfitting of different vehicles.
FISCAL IMPACTS
The budget for the City of Colton for the Fiscal Year commencing July 1, 2023 and ending June 30, 2024 was approved and adopted. Currently , sufficient appropriations are available in the FY2023-24 adopted budget in General Fund Police Administration Vehicles Account #100 - 6070-6071-4910-0000-000.

TM 20296 Bond Release
May 7, 2024
ISSUES/ANALYSIS
Bond submittal as means to guarantee construction of public improvements prior to the start of construction is a standard condition of approval of all subdivisions in accordance with City policies and the Subdivision Map Act. For this Tract, such public improvements included street, sewer, and drainage improvements. The developer submitted Faithful Performance and Labor and Materials (Payment) Bonds ( Exhibit A) for Tract Map No. 20296 and are summarized as follows:
Faithful Performance Bond $ 461,021.00
Labor & Materials (Payment) Bond $ 230,511.00
Maintenance and Warranty Bonds $ 46,129.10
In addition to the required bonds, the developer was required to submit a cash deposit for Guaranteeing Performance (staking) in the amount of $5,000 for Tract Map No . 20296 (Exhibit B). Since public improvements are now completed, the developer is requesting bond release, including any riders, and cash deposit Guaranteeing Performance (Staking) reimbursement.
Government Code Section 66499(b) authorizes the City Coun cil to release the bonds if the improvements are completed and reimburse the cash deposit once verification of the installation of the monuments is completed. The Maintenance and Warranty Bonds are required to remain in place for a period of one (1) full year to warranty the constructed public improvements.
Approval of this action will authorize staff to release the Maintenance and Warranty Bonds when appropriate. The Cash Deposit for Staking Guarantee can be reimbursed immediately after City Council approval and confirmation of installation.
FISCAL IMPACTS
There are no fiscal impacts due to the release of the Faithful Performance, Labor and Materials (Payment) Bonds, including any riders, and reimbursement of the Cash Deposit for Staking Guarantee. Af ter Maintenance and Warranty bonds are release d, funding for public improvements constructed through this project will be maintained by the streets maintenance budget.
