(“CFD 2021 -2” and together with CFD 2021 -1, the “Districts”) for the purposes of providing funding for the following public services:

CFD 2021-1 was formed for the purpose of financing certain types of services, including but not limited to the following:
• Police protection services; and
• Fire protection services.

CFD 2021-2 was formed for the purpose of financing certain ty pes of services, including but not limited to the following:
• maintenance and lighting of parks, parkways, streets, roads, and open space; • flood and storm protection services;
• graffiti abatement;
• the operation and maintenance of storm drainage systems; • maintenance and operation of any real property or other tangible property with an estimated useful life of five or more years that is owned by the City; • and/or any other services authorized under the Act.

DISCUSSION

An ordinance was adopted fo r each of the Districts authorizing the City Council, by annual resolution, to annually determine the special tax to be levied within each District for the then current tax year and future tax years provided that the special taxes to be levied shall not ex ceed the maximum special taxes authorized in the rate and method of apportionment of special tax (the “RMA”) approved for each District.

Staff requests the City Council to adopt the attached Resolutions and direct the Director of Finance to remit the cert ified Resolutions to the County of San Bernardino Auditor Tax Collector, requesting the special taxes be collected on the property tax bills for the parcels of each District, along with ordinary ad valorem property taxes to be levied on and collected from the owners of such parcels.

A special tax will be levied on all taxable parcels within the Districts as set forth in the Exhibit A of each Resolution. CFD 2021 -1 special tax rates for fiscal year 2024/2025 shall be $366.96 per single family residential property and $257.47 per multi -family residential property for a total of $6,238.15 special taxes. CFD 2021 -2 special tax rates for fiscal year 2024/2025 shall be $70.99 per single family residential property and $49.33 per multi -family residential property for a total of $1,206.66 special taxes. Such special taxes to be levied do not exceed the maximum special taxes authorized in the RMAs for each District.

These actions are not subject to the requirements of the California Environmenta l Quality Act (“CEQA”). The approval of the resolutions is not a “project” within the meaning of 14 CCR Section 15378 (“State CEQA Guidelines”) because it has no potential for resulting in direct or indirect physical change in the environment. The specia l taxes are exempt from CEQA pursuant to California Public Resources Code section 21080(b)(8) and State CEQA Guidelines section 15273(a) because such special taxes are necessary and reasonable to fund the administration, operation, and maintenance of the public services to be provided.

FISCAL IMPACT

The special tax revenues proposed to be levied in CFD 2021 -1 and CFD 2021 -2 will offset the cost of providing the respective City services. Failure to approve these Resolutions will result in a budget shortfall, rendering the Districts incapable of providing funding for the needed services.

ITEM NO. 15

STAFF REPORT

DATE: AUGUST 6, 2024
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BRIAN DICKINSON, PUBLIC WORKS DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION TO APPROVE MEASURE

I FIVE YEAR CAPITAL IMPROVEMENT PLAN AND CAPITAL
PROJECT NEEDS ANALYSIS FOR FY 2024/2025, RESOLUTION NO.

R-86-24 & R-87-24.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

1. Approve Resolution No. R -87-24 (Exhibit D) reaffirming and adopting Fiscal Year 2024/2025 Measure I Five -Year Capital Improvement Plan (Exhibit A) and Expenditure Strategy Plan (Exhibit B).

2. Approve Resolution No. R -86-24 (Exhibit E) approving submittal of the Fiscal Year 2024/2025 to FY 2028/2029 Five-Year Capital Projects Needs Analysis (CPNA – Exhibit C) to the San Bernardino County Transportation Authority (SBCTA), as required by the Measure I Strategic Plan.

BACKGROUND

In 1989, the San Bernardino County voters approved the passage of Measure I, authorizing San Bernardino County Transportation Authority (SBCTA), to impose a one -half of one -percent sales tax through 2010. This tax revenue is designated for transportation and traffic management programs. In 2004, voters approved an extension of this sales tax through 2040.

Measure I require that each local jurisdiction receiving program revenues annually adopt a Five - Year Capital Improvement Plan and an Expenditure Strategy Plan. The Five -Year Capital Improvement and Expenditure Strategy Plan outlines how th e local agency plans to expend its 15 Packet Pg. 335

funds. As part of the County -Wide Measure I Sales Initiative Program, the measure requires an annual adoption and update of the respective plans.

ISSUES/ANALYSIS

Measure I Five-Year Capital Improvement Plan and Expenditure Strategy Plan

Measure I Policy Valley Local Streets (VLS) -11 requires that the Five Year Capital Improvement Plan shall be the basis for the annual audit. Jurisdictions will have flexibility in moving projects around in their Five-Year Capital Improvement Plan based on the necessities of the jurisdiction. However, in order for the project to be qualified for expenditure of Local Streets funds, the project must be included in the Five-Year Capital Improvement and Expenditure Strategy Plan.

Measure I Local Pass-Through funds estimated revenue for this fiscal year is $1,387,290 and the total anticipated revenue from Fiscal Year 2024/2025 to Fiscal Year 2028/2029 is $7,311,776 (see Exhibit F). Attached as Exhibit A is the Five -Year Measure I Capital Improvement Plan and Exhibit B is the Measure I Expenditure Strategy Plan for Fiscal Year 2024/2025 to FY 2028/2029.

The projects that will be funded by Measure I for Fiscal Year 202 4/2025 are as follows with corresponding cost:

1. Pavement Rehabilitation: Cooley Drive (West end to Ashley Way) $ 403,608

2. Pavement Rehabilitation: Olive Ave. (La Cadena Dr. to Bordwell Ave) $ 101,160

3. Pavement Rehabilitation: Bordwell Ave. (East End of Olive to Olive Ave) $ 33,325

4. Pavement Rehabilitation: 11th St. (M St. to O St.) $ 70,360

5. Pavement Rehabilitation: Randall Ave (Pepper Ave. to West City Limit) $ 147,753

6. Pavement Rehabilitation: Berkely Ct. (Rosedale Ave.- West End) $ 44,505

7. FY 24-25 Citywide Alley Paving Project $ 63,700

8. Citywide Sidewalk and ADA Improvement Project $ 257,806

9. FY 24/25 Citywide Slurry Seal Project $ 200,000

10. FY 24/25 Citywide Street and Traffic Improvement $ 65,073 Total = $1,387,290

Inclusion of streets with pavement rehabilitation sc ope of work was based on the Pavement Management Plan. Below is the corresponding Pavement Condition Index (PCI) for these streets:

PCI

1. Cooley Drive (West end to Ashley Way) 50, 51, 57

2. Olive Ave. (La Cadena Dr. to Bordwell Ave) 52, 54, 62

3. Bordwell Ave. (East End of Olive to Olive Ave) 69

5. Randall Ave (Pepper Ave. to West City Limit) 46

6. Berkely Ct. (Rosedale Ave.- West End) 52

Pavement Condition Index (PCI) is a numerical index between 0 and 100 being used to indicate the general condition and distress of a pavement. PCI is rated 0 -100, 100 being best and 0 as worst condition. The descriptive range of the PCI rating are: 0-25 (Very Poor), 26-40 (Poor), 41- 50 (marginal), 51-60 (Fair), 61-70 (Good), 71-85 (Very Good) and 86-100 (Excellent). Pavement distress includes but is not limited to cracking, bumps, sags, potholes, joint reflections and exposed aggregates. The average PCI of the City’s road network (total of 141.5 miles) in 2017 is

64. The national average PCI rating is 60 to 65.

Alley paving includes alleys between Olive and Palm Ave (Larch St. to Mt. Vernon Ave.), M St and N St. (La Cadena to West) and South of Valley Blvd (4th St. to Pennsylvania).

Staff recommends a pproval of the attached Resolution No. R -87-24, affirming the Measure I Capital Improvement Plan and Expenditure Strategy Plan for Fiscal Year 2024/2025 to Fiscal Year 2028/2029.

Measure I Five-Year Capital Project Needs Analysis

On April 1, 2009, SBCTA Board of Directors approved the Strategic Plan, which is the reference manual and policy document for the administration of Measure I 2010 -2040 programs by SBCTA and its member agencies. The Strategic Plan requires all local jurisdictions applying for revenue from the Measure I -Valley Street and Freeway Interchange Programs to annually adopt and update a Five-Year Capital Project Needs Analysis. Staff requests authorization (Resolution No. R -86-24 – Exhibit E) to submit the updated Capital Project Needs A nalysis for FY 2025/2026 to FY 2029/2030, attached as Exhibit C.

Local jurisdictions apply for funds from the Valley Street and Freeway Interchange Programs to finance improvements along City arterial roadways and interchanges. The projects identified fo r allocations are arterial improvements to the La Cadena Drive over Santa Ana River Bridge Replacement Project, Mount Vernon Avenue over UPRR Bridge Widening Project, and Reche Canyon Road Re -alignment to Hunts Lane Project. These projects are all identif ied in our current Capital Improvement Program.

The prior and current year Measure I Arterial Funding, with the required Development Impact Fee (DIF) match, is being used as a match for the federally funded projects such as the Mt.

Vernon Avenue Bridge Widening Project, the La Cadena Drive Bridge over Santa Ana River Bridge Replacement Project and Reche Canyon Road Extension to Hunts Lane Project. The bridge projects are on -going and currently in right of way phase and anticipated to be in construction towards the beginning or mid of 2025. STAFF REPORT

DATE: AUGUST 6, 2024
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: ANTHONY VEGA, POLICE CHIEF
SUBJECT: APPROVE THE PURCHASE OF EVENTIDE TELEPHONE SERVER FOR THE POLICE DEPARTMENT.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Dispense with Competitive Bidding under Colton Municipal Code Section 3.08.140(e) and approve the purchase of one Eventide NexLog DX Server with 24 teams, 8 IP and 16 a nalog channels with a four-year software subscription and installation for $102,787.78.

BACKGROUND

Several years ago, the City began transitioning from analog telephones to Microsoft Teams Phone Services, marking a significant shift in how the City manag es communication. This modernization reduces the need for traditional telephone hardware and provides advanced features such as voicemail transcription, call forwarding, and integration with other Microsoft 365 applications. However, outdated server tech nology at the Police Department has impeded the completion of this transition. The current telephone system at the Police Department relies on an analog server that cannot host Microsoft Teams Phone Services. To fully transition to Microsoft Teams, the Police Department needs to update its server to a digital system.

ISSUES/ANALYSIS

Currently, the Police Department’s telephone services rely on an old, outdated analog system.

This system, despite its age, has the capability to record almost all of the t elephone lines within the department, a feature that is actively utilized. During the City’s transition to Microsoft 17 Packet Pg. 351

Teams Phone Services, it was determined that the new system would not support recorded telephone lines with the existing analog server.

To continue the transition to Microsoft Teams Phone Services, the Police Department must upgrade its current analog server to a modern, digital server. The Department’s IT team has identified that the Eventide NexLog DX Server would facilitate this upgrade . This solution will allow the Police Department to transition to Microsoft Teams Phone Services without losing any vital recording capabilities. Moreover, it provides additional resources to expand the department’s telephone services, enabling the addit ion of more recorded telephone lines as needed.

Staff is seeking to purchase the server through AT&T Public Safety Solutions. The Police Department has purchased equipment from them before and we currently use AT&T for our 9 -1- 1 operating systems, we w ould like to respectfully forego the competitive bidding process pursuant to CMC 3.08.140(e) – Exceptions to competitive bidding – Non-Public Projects, which states, “Purpose of Bidding is Otherwise Accomplished. When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for Non-Public Projects under this chapter. Prior City Council concurrence with the City Manager's determination shall be required for Non -Public Project purchases over one hundred thousand dollars.”

FISCAL IMPACTS

Sufficient appropriations for the purchase of the server are available in the FY2024-25 adopted budget in account number 100-6070-6071-4930-0000-000.

FROM: BILL SMITH, CITY MANAGER
PREPARED BY: RAY BRUNO, FIRE CHIEF
SUBJECT: AUTHORIZE THE PURCHASE OF A 2025 RAM 1500 CREW CAB 4 X 4 FOR THE FIRE DEPARTMENT.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

It is recommended that Council approve the purchase of a 2025 RAM 1500 Crew Cab for a replacement Fire Chief vehicle from Los Angeles Chrysler Dodge Jeep Ram for $54,59 4.01 in accordance with Colton Municipal Code Section 3.08.140(E).

BACKGROUND

The Fire Department has researched the ability to order a new Fire Chief vehicle from various vendors including National Auto Fleet Group , however the availability is scarce, a nd the timelines to receive said vehicle are extensive with a one hundred day build time. Staff has reached out to Los Angeles Chrysler Dodge Jeep Ram and obtained a quote that is lower than other quotes and has the vehicle immediately available. The dea ler has agreed to hold the vehicle on-site for a period of thirty (30) days beginning on July 5, 2024, while the bid is under review.

ISSUES/ANALYSIS

The Fire Department maintains a fleet of seven staff vehicles. This requested vehicle will be used to r eplace a 2017 Ram 1500 that has 113,561 miles on it and is currently used as the Fire Chief vehicle. Additionally, lights, siren, mobile data computer, lettering, and other equipment will be installed upon receipt.

QUITCLAIM OF TWO (2) EXCESS PARCELS OF LAND TOTALING
APPROXIMATELY 15,608 SQUARE FEET OF REAL PROPERTY

ALONG PEPPER AVENUE, SOUTH OF VALLEY BOULEVARD, TO

VALLEY-ORANGE ENTERPRISES, LLC, A CALIFORNIA LIMITED
LIABILITY COMPANY, RESOLUTION NO. R-76-24.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Quitclaim approximately 15,608 square feet of real property along the south side of Valley Boulevard, west of Pepper Avenue to Valley -Orange Enterprises, LLC, a California limited liability company by adopting Resolution No. R-76-24.

BACKGROUND

On August 04, 2015, the City Council adopted Resolution No. R -95-15, approving a Purchase & Sale Agreement with the County of San Bernardino and adopted Resolution No. R -96-15, approving a Disposition and D evelopment Agreement with Valley Orange Enterprises, LLC for the redevelopment of the southwest corner intersection of Pepper Ave. and Old Valley Blvd.

On March 14, 2017, the City’s Planning Commission approved Resolution No. R -7-17, approving Master Plan Review and Architectural and Site Plan Review and Sign Program to allow construction of a new 3,000 square foot convenience store, 1,600 square foot adjoining deli and adjoining express car wash within the Hub City Centre Specific Plan and sign program on a site located in Planning Area 20 within the R (Retail) Zone of the Colton Hub City Centre Specific Plan on Property Measuring approximately 1.82 acres located at 1600 W. ISSUES/ANALYSIS

As part of the Con ditions of Approval for the entitlement of the development of the southwest corner intersection of Pepper Ave. and Old Valley Blvd. project, known as DAP -001-362, it was conditioned to submit a final map for review, approval, and recordation to account for the various lots/parcels, including the realignment of Old Valley Blvd. into Valley Boulevard.

After the project was completed and the final map recorded, it was discovered two (2) parcels of land as described and shown in Exhibits A/B attached, were n ot accounted for on a technical level but included in the sale, transactions, land exchanges, etc. aforementioned.

These two parcels were meant to be included as part of the original quitclaims of the real property from the beginning of the process. It is important to note, Caltrans does not claim these parcels of land nor does the County of San Bernardino. These parcels of land essentially became excess (remnant) pieces of island parcels of land that no one claims for liability or maintenance purposes. Therefore, Staff recommends these two parcels of land be quitclaimed to Valley Orange Enterprises, LLC to clean up the final map in accordance with the Subdivision Map Act.

FISCAL IMPACTS

No fiscal impacts are associated with this action , as this is a matter of administrative correction.

Improvements constructed on these parcels of land are to be maintained by Valley Orange Enterprises, LLC as required by municipal code section 8.4 – Property Maintenance.

ITEM NO. 20

STAFF REPORT

DATE: AUGUST 6, 2024
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: RAY BRUNO, FIRE CHIEF
SUBJECT: APPROVE AND ADOPT A RESOLUTION APPROVING CHANGES

TO THE WEED ABATEMENT PROGRAM TO ACCOUNT FOR
YEAR-ROUND WEED ABATEMENT, RESOLUTION NO. R-84-24.

RECOMMENDED ACTION

Staff recommends that the City Council take the following action:

Adopt Resolution R-84-24 approving year-round weed abatement.

BACKGROUND

Under the current weed abatement program, property owners are sent courtesy notices reminding them of abatement twice a year, in March and again in October. Properties are then inspected twice a year, in June and November. In the case of owner non-compliance, the City’s contractor abates the properties, and the Fire Department bill s the owners directly. All fees not paid are then sent to the San Bernardino County Assessor’s office for inclusion on the property tax rolls for collection.

Currently we open weed abatement in March, with a due date for abatement of June 1st. The City’s contractor completes non -compliant properties by July 3rd. With approval of year -round weed abatement, we anticipate closing 23/24 weed abatement at the City C ouncil meeting on August 20, and commencing the year round weed abatement at that same meeting. With year- round weed abatement, if nuisance properties are identified, we can provide the owner with a 30 - day notice to comply. If the property owner does not comply, the City’s weed abatement contractor will abate the property.

Page 2 ends

There are benefits to year -round weed abatement and some consequences that we have identified.

Benefits to year-round weed abatement can include but not limited to:
 Continuous weed control preventing weeds from spreading and establishing deep roots.  Reduced fire hazard keeping vegetation at manageable levels, reducing the risk of fire spread.
 Cost efficiency with regular maintenance being more cost-effective than sporadic or emergency abatement.
 Aesthetic improvement by maintaining a weed-free environment enhancing the visual appeal of landscapes.
 Health benefits by reducing the pollen or allergen of the weeds.  Improved customer service by enhancing our ability to respond to citizen complaints about properties needing weed abatement.

Consequences to year-round weed abatement can include:

 Increased staff hours to inspect properties, provide compliance notices, and invoice.  Dissatisfaction from property owners when abatement is required more than once annually
 Up to 18 months to recover fees from property owners for weed abatement if placed on the County tax rolls.

FISCAL IMPACTS

The approved FY24/25 budget increased funding for weed abatement by $20,000 to accommodate bringing forward year weed abatement.

ALTERNATIVES

1. Continue to administer the program as it currently exists.

2. Provide alternative direction to staff.
