Report on Compliance and Other Matters
As part of obtaining reasonable assurance about whether City of Colton’s financial statements are free from material misstatement, we performed tests of its compliance with certain provisions of laws, regulations, contracts, and grant agreements, noncompliance with which could have a direct and material effect on the financial statements. However, providing an opinion on compliance with those provisions was not an objective of our audit, and accordingly, we do not express such an opinion. The results of our tests disclosed no instances of noncompliance or other matters that are required to be reported under Government Auditing Standards.
Purpose of This Report
The purpose of this report is solely to describe the scope of our testing of internal control and compliance and the results of that testing, and not to provide an opinion on the effectiveness of the entity’s internal control or on compliance. This report is an integral part of an audit performed in accordance with Government Auditing Standards in considering the entity’s internal control and compliance. Accordingly, this communication is not suitable for any other purpose.

The Honorable City Council
of the City of Colton
Colton, California
We have audited the financial statements of the governmental activities, the business-type activities, each major fund, and the aggregate remaining fund informat ion of City of Colton as of and for the year ended June 30, 2024, and have issued our report thereon dated December 16, 2024. We have previously communicated to you information about our responsibilities under auditing standards generally accepted in the United States of America and Government Auditing Standards , as well as certain information related to the planned scope and timing of our audit in our engagement agreement dated May 15, 2024. Professional standards also require that we communicate to you the following information related to our audit.
Significant audit findings
Qualitative aspects of accounting practices
Accounting policies
Management is responsible for the selection and use of appropriate accounting policies. The significant accounting policies used by City of Colton are described in Note 1 to the financial statements.
As described in Note 1D, the City changed accounting policies by adopting Statement of Governmental Accounting Standards (GASB Statement) No. 100, Accounting Changes and Error Corrections , effective July 1, 2023. The implementation of this standard resulted in the City showing a restatement for a change to or within the financial reporting entity due to the change in presentation of the Capital Improvements Capital Projects Fund from nonmajor to major.
We noted no transactions entered into by the entity during the year for which there is a lack of authoritative guidance or consensus. All significant transactions have been recognized in the financial statements in the proper period.
Accounting estimates
Accounting estimates are an integral part of t he financial statements prepared by management and are based on management’s knowledge and experience about past and current events and assumptions about future events. Certain accounting estimates are particularly sensitive because of their significance to the financial statements and because of the possibility that future events affecting them may differ significantly from those expected. The most sensitive estimates affecting the financial statements were:
The annual required contributions, pension expense, net pension liability and corr esponding
deferred out
flows of resources and deferred inflows of resources for the City’s public def ined benefit plan
s with CalPERS are based on actuarial valuations provided by CalPERS.
The Other Postemployment Benefit (OPEB) expense, Total OPEB liability, and corr esponding deferred out
flows of resources and deferred inflows of resources for the City’s OPEB plans ar e based on ce
rtain actuarial assumptions and methods prepared by an outside consultant.

Management’s estimate of the claims payable liabilities related to general liability a nd worker’s compensati
on claims are based on estimates by the claim’s administrators.
We evaluated the key factors and assumptions used to develop the allowance in determining that it is reasonable i
n relation to the financial statements taken as a whole.
Financial statement disclosures
Certain financial statement disclosures are particularly sensitive because of their significance to financial statement users. The most sensitive disclosures affecting the financial statements were:
The disclosure of the retirement commitments reported in Note 9 to the financial stat ements.
The disclosure of the OPEB commitments reported in Note 10 to the financial statements.
The financia
l statement disclosures are neutral, consistent, and clear.
Difficulties encountered in performing the audit
We encountered no significant difficulties in dealing with management in performing and completing our audit.
Uncorrected misstatements
Professional standards require us to accumulate all misstatements identified during the audit, other than those that are clearly trivial, and communicat e them to the appropriate level of management. The attached schedule summarizes uncorrected misstatem ents of the financial statements. Management has determined that their effects are immaterial, both individually and in the aggregate, to the financial statements taken as a whole.
Uncorrected misstatements or the matters underlying uncorrected misstatements could potentially cause future-period financial statements to be materially misstated, even if management has concluded that the uncorrected misstatements are immaterial to the financial statements under audit.
Corrected misstatements
None of the misstatements detected as a result of audit procedures and corrected by management were material, either individually or in the aggregate, to the financial statements taken as a whole.
Disagreements with management
For purposes of this letter, a disagreement with management is a financial accounting, reporting, or auditing matter, whether or not resolved to our satisfaction, that could be significant to the financial statements or the auditors’ report. No such disagreements arose during our audit.
Management representations
We have requested certain representations from management that are included in the management representation letter dated December 16, 2024.

Management consultations with other independent accountants In some cases, management may decide to consult with other accountants about auditing and accounting matters, similar to obtaining a “second opinion” on certain situations. If a consultation involves application of an accounting principle to the entity’s financial statements or a determination of the type of auditors’ opinion that may be expressed on those statements, our professional standards require the consulting accountant to check with us to determine that the consultant has all the relevant facts. To our knowledge, there were no such consultations with other accountants.
Other audit findings or issues
We have provided a separate communication to you dated December 16, 2024, communicating internal control related matters identified during the audit.
Required supplementary information
With respect to the required supplementary information (RSI) accompanying the financial statements, we made certain inquiries of management about the methods of preparing the RSI, including whether the RSI has been measured and presented in accordance with prescribed guidelines, whether the methods of measurement and preparation have been changed from the prior period and the reasons for any such changes, and whether there were any significant assumptions or interpretations underlying the measurement or presentation of the RSI. We co mpared the RSI for consistency with management’s responses to the foregoing inquiries, the bas ic financial statements, and other knowledge obtained during the audit of the basic financial statements. Because these limited procedures do not provide sufficient evidence, we did not express an opinion or provide any assurance on the RSI.
Supplementary information in relation to the financial statements as a whole With respect to the combining and individual nonmajor fund financial statements and schedules (collectively, the supplementary information) accompanying the financial statements, on which we were engaged to report in relation to the financial statements as a whole, we made certain inquiries of management and evaluated the form, content, and methods of preparing the information to determine that the information complies with accounting principles generally accepted in the United States of America, the method of preparing it has not changed from the prior period or the reasons for such changes, and the information is appropriate and complete in relation to our audit of the financial statements. We compared and reconciled the supplementary information to the underlying accounting records used to prepare the financial statements or to the financial statements themselves. We have issued our report thereon dated December 16, 2024.
Other information included in annual reports
Other information (financial or nonfinancial information other than the financial statements and our auditors’ report thereon) is being included in your annual report and is comprised of introductory and statistical sections. Our responsibility for other information included in your annual report does not extend beyond the financial information identified in our opinion on the financial statements. We have no responsibility for determining whether such other information is properly stated and do not have an obligation to perform any procedures to corroborate other information contained in your annual report.
We are required by professional standards to read the other information included in your annual report and consider whether a material inconsistency exists between the other information and the financial statements because the credibility of the financial st atements and our auditors’ report thereon may be undermined by material inconsistencies between the audited financial statements and other information. If, based on the work performed, we conclude that an uncorrected material misstatement of the other information exists, we are required to describe it in our report.

INDEPENDENT ACCOUNTANTS’ REPORT
ON APPLYING AGREED-UPON PROCEDURES
Honorable Mayor and Members
of the City Council
City of Colton
Colton, California
We have performed the procedures enumerated below on the accompanying Appropriations Limit Worksheet No. 6 of the City of Colton, California, (the City) for the year ended June 30, 2024. The City’s management is responsible for the Appropriations Limit Worksheet No. 6.
The City and the League of California Cities (as presented in the League publication entitled Article XIII- B Appropriations Limit Uniform Guidelines) have agreed to and acknowledged that the procedures performed are appropriate to meet the intended purpose of meeting the requirements of Section 1.5 of Article XIII-B of the California Constitution. This report may not be suitable for any other purpose. The procedures performed may not address all the items of interest to a user of this report and may not meet the needs of all users of this report and, as such, users are responsible for determining whether the procedures performed are appropriate for their purposes.
The procedures performed and our findings were as follows:
1. We obtained the completed Appropriations Limit Worksheet No. 6 for the year ended June 30, 2024, and compared the limit and annual adjustment factors included in that worksheet to the limit and annual adjustment factors that were adopted by resolution of the City Council. We also compared the population and inflation options included in the aforementioned worksheet to those that were selected by a recorded vote of the City Council.
No exceptions were noted as a result of this procedure.
2. For the accompanying Appropriations Limit Worksheet No. 6, we added last year’s limit to the total adjustments and compared the resulting amount to this year’s limit. We also recalculated the adjustment factor and the adjustment for inflation and population and compared the results to the amounts on Appropriations Limit Worksheet No. 6.
No exceptions were noted as a result of our performing this procedure.

3. We compared the prior-year appropriations limit presented in the accompanying Appropriations Limit W
orksheet No. 6 to the prior-year appropriations limit adopted by the City Council for the pr ior year
.
No exceptions were noted as a result of our performing this procedure.
We were engaged by the City to perform this agreed-upon procedures engagement and conducted our engagement in accordan
ce with attestation standards established by the American Institute of Certified Public Accountants. We were not engaged to and did not conduct an examination or review engagement, the objective of which would be the expression of an opinion or conclusion, respectively, on the accompanying Appropriations Limit Worksheet No. 6. Accordingly, we do not express such an opinion or conclusion. Had we performed additional procedures, other matters might have come to our attention that would have been reported to you.
We are required to be independent of the City and to meet our other ethical responsibilities, in accordance with the relevant ethical requirements related to our agreed-upon procedures engagement.
This report is intended solely for the information and use of the City Council and management of the City and is not intended to be, and should not be, used by anyone other than these specified parties.

NOTE 1 PURPOSE OF AGREED UPON PROCEDURE REVIEW
Under Article XIIIB of the California Constitution (the Gann Spending Limitation Initiative), California governmental agencies are restricted as to the amount of annual appropriations from proceeds of taxes. Effective for years beginning on or after July 1, 1990, under Section 1.5 of Article XIIIB, the annual calculation of the appropriations limit is subject to agreed-upon procedures review in connection with the annual audit.
NOTE 2 METHOD OF CALCULATION
Under Section 10.5 of Article XIIIB, for fiscal years beginning on or after July 1, 1990, the appropriations limit is required to be calculated based on the limit for the fiscal year 1986-87, adjusted for the inflation and population factors discussed at Notes 3 and 4 below.
NOTE 3 INFLATION FACTORS
A California governmental agency may adjust it s appropriations limit by either the percentage change in California per capita personal income from the preceding year (which is supplied by the State Department of Finance), or the percentage change in the local assessment roll from the preceding year due to the change of local nonresidential construction. The factor adopted by the City of Colton (the City) for fiscal year 2023-24 represents the annual percentage change in the per capita personal income from the preceding year.
NOTE 4 POPULATION FACTORS
A California governmental agency may adjust its appropriations limit by either the annual percentage change of the jurisdiction’s own population or the annual percentage change in population in the county where the jurisdiction is located. The factor adopted by the City for fiscal year 2023-24 represents the annual percentage change in population for the county.
NOTE 5 OTHER ADJUSTMENTS
A California government agency may be required to adjust its appropriations limit when certain events occur, such as the transfer of responsibility for municipal services to, or from, another government agency or private entity. T he City had no such adjustments for the year ended June 30, 2024.

STAFF REPORT
DATE: JANUARY 21, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: ROBERT DELOACH, INTERIM PUBLIC WORKS DIRECTOR SUBJECT: APPROVE AND ADOPT A RESOLUTION FOR CHANGE ORDER NO. 2 WITH CAT TRACKING, INC. AND PACIFIC PRODUCTS &
SERVICES FOR THE FY 24/25 TERMED PURCHASE ORDER FOR
THE SUPPLY OF STREET SIGNS, RESOLUTION R-03-25.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve Change Order No. 2 for Cat Tracking, Inc. term Purchase Order increasing the amount to $95,000 for the purchase of additional street sweeping signs.
2. Approve Change Order No. 2 for Pacific Products and Services term Purchase Order increasing the amount to $80,000 for the purchase of additional street signpost and mounting hardware.
3. Approve Resolution R -03-25 appropriating additional fund s from reserve balance to purchase the additional street signs materials.
BACKGROUND
As part of City’s maintenance responsibility, Public Works/Street Division’s crews maintain City street signs for the safety of pedestrian and motoring public. The C ity’s maintenance responsibility for street signs includes replacing faded and damaged signs, and installation of new signs.
On April 16, 2 024, the City Council approve d Change Order No. 1 to the street sweeping contract that stipulated an alternate day/alternate side sweeping schedule along City streets. The action to change the street sweeping schedule necessitates installation of thousand s of street 6 Packet Pg. 430

sweeping signs indicat ing the day and hours of sweeping operations. Installation of additional street sweeping signs is necessary for parking restriction information and enforcement.
ISSUES/ANALYSIS
Cat Tracking, Inc. is the City’s supplier for street and other traffic signs needed for traffic safety and street signage. Street signs annual term purchase order (P.O.) is $20,000 per year, but due to the increase in sign procurement brought by the needed street sweeping signs, the Cat Tracking purchase order was increased under the City Manager’s authority to $50,000 (attached as Exhibit A) for FY2024-25 on December 16, 2024. This initial P.O. increase is still not sufficient . The street sweeping signs needed to complete the comprehensive stre et sweeping signs installation is about 1,700 pieces , which equates to approximately $76,500. Due to the increase in expenditures for the purchase of street signs, City staff recommends increasing the Cat Tracking, Inc. term purchase order for FY2024-25 to $95,000 (Change Order No. 2).
Pacific Products and Services is the City’s supplier for street sign materials such as steel post s, bolts, and other mounting hardware. Pacific Products and Services LLC annual term purchase order (P.O.) is $20,000 per ye ar but , due to the increase in sign procurement brought by the needed street sweeping sign, the P.O. was increased to $35,000 (attached as Exhibit B) per year on December 16, 2024. This initial purchase order increase is still not sufficient to complete t he installation of the additional street sweeping signs. To fully fund the purchase of the street signpost and hardware needed , staff recommends increasing the term PO for Pacific Products and Services to $80,000 (Change Order No. 2).
The increase for both P.O.s will also cover the purchase of street signs and hardware that will be used for repair and replacement for the rest of FY2024-25.
FISCAL IMPACTS
An additional appropriation from General Fund reserve is necessary to increase the contracts to purchase the signs and necessary hardware. STAFF REPORT
DATE: JANUARY 21, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE FIRST CONTRACT AMENDMENT FOR
ENVIRONMENTAL SERVICES WITH ECORP CONSULTING INC.,
FOR PRE-CONSTRUCTION DEVELOPMENT OF COLTON ECO-
FRIENDLY PARK WITH COMMUNITY SPORTS FIELDS.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Authorize the City Manager to execute the attached f irst amendment to Professional Services Agreement (PSA) with ECORP Consulting, Inc., increasing the contracted amount by $50,000 to $400,000 to provide pre-construction development analyses for the Colton Habitat Conservation Park with Eco -Friendly Communi ty Sports Fields , as per the terms of the PSA, including exhibits attached thereto.
BACKGROUND
In April 2024, the City of Colton awarded a two -year contract to ECORP Consulting, Inc. for environmental consultation services essential to the development of the Colton Eco -Friendly Habitat Park, covering Phases I and II of the project, with a total compensation not -to-exceed $350,000. Progress on the Park project has been steady; however, as highlighted in previous presentations, its unparalleled complexity due to environmental considerations and coordination with regulatory agencies has presented unique challenges. Consequently, tasks originally planned for future phases must be advanced in the timeline to maintain project momentum.
ISSUES/ANALYSIS
The Pr oject Team has determined that tasks initially planned for future phases need to be incorporated into Phase I to address requirements from the Local Enforcement Agency (LEA). 9 Packet Pg. 448
Staff Report to the Mayor and City Council
Contract Amendment - ECORP Consulting
January 21, 2025
The LEA has mandated that the complete Environmental Assessment, Field Investigat ion Plan, Health and Safety Plan, and Waste Management Plan for the Guyaux Landfill mitigation be submitted concurrently. Under the original plan, the Environmental Assessment and Field Investigation Plan were included in the Phase I scope, while the Heal th and Safety Plan and Waste Management Plan were allocated to future phases. This sequencing must now be adjusted to meet LEA’s concurrent submission requirement.
ECORP Consulting, Inc. has provided a detailed technical approach and cost estimate for th e additional work required in Phase I. The additional tasks bring the total cost for the revised scope to $109,325 for landfill -related work. These adjustments ensure compliance with LEA requirements and maintain progress on this highly complex project. The following summarizes the tasks and associated costs:
o Site Worker Health and Safety Plan (including Community Health and Safety Plan and Waste Management Plan): $21,500
o Post-Closure Project Management and LEA Coordination Meetings: $11,150
Staff recom mends approval of Change Order #1 to the Professional Services Agreement, increasing the contract amount by $50,000 for a total not -to-exceed limit of $400,000. This adjustment will allow critical tasks to be advanced as needed to maintain project momentu m and accommodate potential future task adjustments. All changes will require prior approval from the designated staff representative. However, as long as the changes remain within the revised contract amount, additional City Council approval will not be required, ensuring the project stays on track without unnecessary delays.
FISCAL IMPACTS
City Council approved Resolution R-31-23 on April 18, 2023, appropriated funding for the State Grant in expenditure account group 225 -6200-6238. Adequate appropria tions are available in the FY202 4-25 budget in Miscellaneous Grants Fund Capital Improvement Account number 225-6200-6238-3890-000-023.

ubject: Change Order Proposal to Move Phase II Tasks to Phase I for Completing the California Environmental Quality Act (CEQA) Impacts Analyses and Regulatory Approvals for the Colton Habitat Conservation Park with Eco-Friendly Community Sports Fields Project
Dear Ms. Farrar:
ECORP Consulting, Inc. (ECORP) is pleased to provide our change order request to provide support to PBLA Engineering Services and the City of Colton to complete the impact analyses, regulatory approvals, and amended/updated Initial Study/Mitigated Negative Declaration (IS/MND).
A need to move tasks we had planned to do in the second-phase contract up to the first-phase was identified by the Project Team as we found out the Local Enforcement Agency (LEA) requires us to submit the complete environmental assessment, field investigation plan, health and safety plan, and management plan for the Guyaux Landfill mitigation concurrently. The initial plan was to do the environmental assessment and field investigation plan in the phase-one contract and then the health and safety plan, and management plan, in the phase-two contract, but all plan documents related to the landfill must be submitted at the same time to LEA. The Scope of Work and Cost Estimate below provide the technical approach and costs proposed by ECORP for these studies. All tasks and subtasks follow the numbering and lettering designation from ECORP’s original proposal.
SCOPE OF WORK
Task 3 – Guyaux Landfill Tasks (Ninyo & Moore)
Subtask 3A – Site Worker Health and Safety Plan, Community Health and Safety Plan and Waste Management Plan
This task includes preparing a worker Site Health and Safety Plan (SHSP) that also includes as an appendix a Community Health and Safety Plan (CHSP). Both of these plans will be included in the Waste Management Plan (WMP) as appendices. The Proposed Project cannot begin until the LEA (and possibly other regulatory agencies/parties) reviews and approves the WMP.

Site Worker Health and Safety Plan (SHSP) Any time subsurface activities are conducted by subcontractors and other field staff working at the landfill for this Project or subsequent to completing the Project, they will be required to be trained and current in accordance with the standards provided by Hazardous Waste Operations and Emergency Response (HAZWOPER) (40- hour initial training with annual updates). Appropriate management personnel will also have 8-hour supervisor training. All personnel, including subcontractors, working in or near the subsurface activities are required to have current HAZWOPER certification.
The worker SHSP will be prepared in general accordance with the Federal Occupational Safety and Health Administration Hazardous Waste Operations and Emergency Response Standard (29 Code of Federal Regulations 1910.120) and California Code of Regulations, Title 8 Section 5192. The Ninyo & Moore Certified Industrial Hygienist (CIH) will assist and oversee preparation of the plan.
The SHSP will be required to be implemented during any subsurface activities conducted at the site.
The SHSP will be included as an appendix to the WMP and will be required to be implemented during any subsurface activities conducted at the site.
Community Health and Safety Plan (CHSP) Due to the location of the site (adjacent to residential properties), a CHSP will be prepared for the purpose of providing controls and oversight necessary to limit the community’s exposure to chemicals of concern, dust, noise, and safety hazards associated with planned site Proposed Project activities. The CHSP will provide information related to potential
public exposures to hazards including recommended methods to prevent exposure; identify the chemicals/constituents of concern; describe the environmental monitoring requirements and site control methods; and provide a plan to address potential exposures to hazardous materials/substances that could be encountered. The CHSP will be included as an appendix to the SHSP and will be required to be implemented during any subsurface activities conducted at the site.
Waste Management Plan (WMP) This task includes preparing a WMP that provides policies, information, requirements, and guidelines regarding procedures to be followed by subcontractor(s) and other field personnel participating in any subsurface activities conducted at the site, including but not limited to (e.g., grading; excavating/backfilling; monitoring; temporary stockpiling and management of excavated wastes, soils, etc.; sampling and testing; and assistance with possible onsite reuse of excavated materials [with regulatory agency approval] related to the Project). This WMP needs to be implemented during the current and future construction Project activities.
The general contents of the plan will include an introduction; plan objective; site location/descriptions; site characterization information (environmental background, geology, hydrology, waste types, etc.); definitions of wastes, materials, contaminated substance, hazardous substance, hazardous waste, regulated wastes, etc.; definition of competent person(s); requirements related to contractors/subcontractors working at the site; information related to environmental consultant; notifications; permits; excavation, segregation and stockpiling; offsite disposal and/or onsite reconsolidation; stockpile sampling program; stockpile sampling analytical testing program;

waste transport and offsite disposal; waste management inspection and documentation program; and information/requirements for updating the WMP. The plan is intended to be a master document that can be used, and as necessary, updated for the current Project as well as future work that involves disturbing the subsurface materials at the site. The WMP will be submitted to the LEA for their review and approval prior to beginning the Proposed Project.
Task 3A Deliverables:
♦ Draft and Final versions of the SHSP, CHSP, and WMP submitted electronically.
Task 7 – Meetings and Project Coordination
Subtask 7B – Guyaux Landfill Project Management/Coordination, Meetings, and Site Visit
This task is anticipated to include Project management, meetings/teleconferences, coordination with regulatory agency staff and other parties directly related to the Guyaux Landfill activities. It is recommended that there is an initial Project “kick off” meeting with regulatory agency and other Project staff (ECORP, City of Colton, etc.) to confirm that the proposed scope of work as indicated in this proposal is consistent with the environmental requirements for the construction of the planned soccer park, particularly because this scope of work differs from the Mitigation Measures indicated in the IS/MND (Psomas 2019). A site visit with applicable staff is recommended, likely at the time of the “kick off” meeting. The level of effort related to agency interaction for the Project is not known at this time and therefore a certain amount of time was assumed for the purposes of this scope of work.
Time for ECORP’s Project Manager is included in this task to attend any meetings related to the Guyaux Landfill activities.
Task 7 Deliverables:
♦ None.

Contract Amendment - GK & Associates
January 21, 2025
ISSUES/ANALYSIS
On June 9, 2024, the City of Colton entered into a Professional Services Agreement (Agreement) for the third year with GK & Associates for the Provision of Engineering Support for Design, Project Management and Inspection Services in the amount not -to-exceed $305,878. The original contract with GK and Associates was awarded on June 21, 2022, with option to renew for additional two consecutive years Fiscal Year 2023 -24 and 2025 -26. The RFP for this contract was advertised on May 5, 2022.
The prevailing rates of GK & Associates are 30% lower compared to other consultants. In addition, they have provided excellent quality service. Since GK and Associates have already started some of the projects listed , above and the work necessary is within GK and Associates scope of work, staff recommends increasing GK and Associates contract by $130,000 for the additional staff for the completion of the listed projects.
FISCAL IMPACTS
Sufficient appropriations are available in the adopted FY2024 -25 budget for the contract amendment. The costs of professional engineering services are included in the programmed Capital Improvement Projects. Below is the list of accounts that will be used for GK & Associates contract amendment.

FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE CONTRACT AMENDMENT TO PBLA FOR PROJECT
MANAGEMENT NECESSARY IN THE PRE CONSTRUCTION
DEVELOPMENT OF COLTON ECO FRIENDLY PARK WITH
COMMUNITY SPORTS FIELDS.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Authorize the City Manager to execute the attached first amendment t o Professional Services Agreement (PSA) with PBLA Engineering, Inc., increasing the contracted amount to $350,000 to continue to provide project management for the Colton Habitat Conservation Park with Eco - Friendly Community Sports Fields, as per the terms of the PSA, including exhibits attached thereto.
BACKGROUND
The City of Colton has initiated its first major park development project in over 25 years: the Colton Habitat Conservation Park with Eco -Friendly Community Sports Fields, funded by the State of California. This landmark project aims to provide sustainable recreational opportunities while addressing critical habitat conservation needs.
The site presents considerable challenges due to its location near the Santa Ana River, which is a sensitive e nvironmental zone, and its historical association with the Guyaux landfill, creating additional complexities for development. Regulatory compliance is a significant hurdle, requiring approval from eleven agencies, each with specific environmental and habit at-related mandates.
ISSUES/ANALYSIS

Staff Report to the Mayor and City Council
Contract Amendment - PBLA Engineering, Inc.
January 21, 2025
In March 2024, the City awarded a two -year professional services contract to PBLA Engineering, Inc. to serve as the lead consultant for this ambitious project. Known for their proven expertise, PBLA Engineering is tas ked with ensuring the development complies with the Mitigated Negative Declaration (MND), while adhering to the conditions outlined in the State funding agreement. Their responsibilities include revising the master plan, overseeing regulatory compliance, a nd managing environmental mitigation to secure agency approvals and proceed with construction.
The contract for Phases I and II was established with a not -to-exceed limit of $150,000, covering preliminary surveying, planning, and early project development tasks. While steady progress has been made, the unique complexities of the project —including stringent environmental considerations and the need to coordinate with multiple regulatory agencies —have necessitated ongoing adjustments to the timeline and sequencing of tasks.
Key adjustments include:
Step II - Planning Phase: Some tasks initially scheduled for this phase were deferred to a later stage to accommodate pending regulatory approvals. Step IV - Engineering and Documents Phase: Select tasks from this phase were advanced to facilitate the completion of preliminary grading plan options required by regulatory agencies.
Progress Summary (Phase I/II - $150,000 Contract)
The first two phases of the Colton Habitat Conservation Park project reflect dedicatio n to navigating complex challenges while maintaining steady progress. Despite the site’s environmental sensitivities and regulatory intricacies, significant milestones have been achieved within the initial contract parameters:
Step I - Preliminary Surveyi ng and Encumbrance Map: All nine tasks have been successfully completed, laying the groundwork for the project by delivering essential data and mapping critical to guiding subsequent phases.
Step II - Planning Phase: Five of seven tasks (Steps 1, 2, 4, 5, and 7) were completed.
Tasks 3 and 6 were strategically postponed, pending approval of the preliminary grading plan, ensuring alignment with agency requirements.
Step IV - Engineering and Documents Phase: In a proactive adjustment to maintain momentum, three tasks (1, 2, and 7) from this later phase were advanced and completed ahead of schedule, supporting the development of grading plan options critical for regulatory review.
These accomplishments underscore the City’s strategic planning efforts and PBLA Engineering’s ability to adapt to evolving project demands. By prioritizing critical deliverables and dynamically adjusting the project’s approach, the groundwork has been firmly established for continued success in future phases.

Staff Report to the Mayor and City Council
Contract Amendment - PBLA Engineering, Inc.
January 21, 2025
RECOMMENDATION
Staff recommends approval of Change Order #1 to the existing Professional Services Agreement, increasing the contract amount by $200,000 for a revised total not -to-exceed limit of $350,000.
This change will allow PBLA Engineering to advance critical tasks and main tain project momentum while accommodating further adjustments based on regulatory feedback. The proposed change order includes provisions for staff oversight to ensure accountability. All task adjustments must receive prior approval from the designated sta ff representative, and as long as these changes remain within the revised contract amount, additional City Council approval will not be required. This streamlined approach ensures the project continues progressing without unnecessary delays, allowing the City to address the complexities of this environmentally sensitive development while meeting State funding requirements.
FISCAL IMPACTS
City Council approved Resolution R-31-23 on April 18, 2023, appropriated funding for the State Grant in expenditure ac count group 225 -6200-6238. Adequate appropriations are available in the FY202 4-25 budget in Miscellaneous Grants Fund Capital Improvement Account number 225-6200-6238-3890-000-023 to facilitate both contracts.

Dear Ms. Farrar,
PBLA has completed the tasks for the First Phase of our contract with the city, which included Steps I and II, for the final design and approval process for the Colton 45-Acre Habitat Conservation Park with Eco-Friendly Sports Fields (See attached Contract showing completed items).
As we previously discussed we had to move some tasks in Step II to later in the project schedule and move up some tasks in Step IV up to the Phase I contract to accommodate the design process and regulatory agency requirements (these are delineated in the attached contract with the city).
To summarize, we have done the following in our first phase $150,000 contract:
• Completed all tasks (1-9) in “STEP I - PRELIMINARY SURVEYING AND ENCUMBRANCE MAP” • Completed Steps 1,2,4,5,& 7 in “STEP II - PLANNING PHASE” • Held off on tasks 3 & 6 in “STEP II - PLANNING PHASE” (which will be completed later when we receive regulatory approval of the preliminary grading plan) • Completed tasks 1,2,& 7 in “STEP IV – ENGINEERING AND DOCUMENTS PHASE” (which were necessary to move up in the process to develop the preliminary grading plan options) We are now ready to proceed with our phase II $150,000 contract and are requesting the city issue a compensation amendment for the following:
Compensation is agreed at Not-To-Exceed One Hundred and Fifty Thousand and Thirty Dollars ($150,030) for our Phase II city contract, which will be for the contract period February 2025 through February 2026) and shall include the following:

SUBJECT: APPROVE PURCHASE WITH MERIDIAN RAPID DEFENSE GROUP
FOR BARRICADES AND TRAILER IN THE AMOUNT OF
$125,932.41.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve the purchase of one Meridian 8 -Barrier Drop Deck Trailer, Nine (9) Archer 1200 Barricades and related supplies for $125,932.41, from Meridian Rapid Defense Group through the GSA MSA purchasing program in accordance with Colton Municipal Code Section
3.08.140(C).
BACKGROUND
The City of Colton hosts numerous special events where ensuring the safety of attendees is a top priority. Securing streets to safeguard against errant motorists, potential threats, and other hazards is critical. In recent years, there has been a notable increase in vehicular incidents at special events and markets both locally and globally.
Currently, the City relies on bollards, k-rails or City vehicles to block off streets, which offer a basic level of protection but falls short of meeting optimal safety standards. To enhance security while avoiding the significant costs associated with conc rete K -rails, the City plans to deploy Archer 1200 Anti -Vehicle Barriers provided by Meridian Rapid Defense Group LLC. This innovative solution has been thoroughly reviewed and approved by City staff from Community Services, Public Works, Police, Fire, an d Risk Management, ensuring its suitability for safeguarding public events.
ISSUES/ANALYSIS

Staff Report to the Mayor and City Council
Purchase – Meridian Barricades
January 21, 2025
The recommended product for purchase, the Archer 1200 Anti -Vehicle Barrier, is manufactured by Meridian Rapid Defense Group, a Pasadena -based company. The Archer 1200 is a unique solution with the capability to stop a 15,000 -pound truck traveling at 38 mph. It is portable, allowing a single person to move it between locations, reusable even after vehicle impact, and designed to minimize injury to drivers and redu ce shrapnel spray upon impact. These barriers, constructed from high-strength, ballistic-rated steel, are non -lethal and easy to install or relocate as needed. Additionally, the Archer 1200 has been awarded the official designation of Qualified Anti-Terrorism Technology (QATT) by the U.S. Department of Homeland Security under The SAFETY Act.
Section 3.08.140(C) of the City's Purchasing Ordinance allows staff to dispense with competitive bidding when it is determined “that a competitive bid procedure has been conducted by another public agency and the price to the City is equal to or better than the price to that public agency .” The General Services Administration Federal Acquisition Service maintains a Multiple Award Schedule (GSA MAS) with contracts available to governmental entities.
In July 2024, the GSA awarded contract #47QSWA19DO001F to Meridian Rapid Defense Group for Physical Access Control Systems. Meridian provided the City a quote for $ 125,932.41 for the purchase of one T1000 Barrier Drop Dec k Trailer, 9 Archer 1200 Mobile Barriers, and related accessories.
Purchasing the Archer 1200 barriers will enable City staff to efficiently close streets to vehicle traffic, provide crowd protection, and prevent vehicle encroachment. As additional fundi ng becomes available, the City will have the option to procure more barriers to further enhance public safety at events.
FISCAL IMPACTS
Sufficient appropriations for the purchase are available in the FY2024 -25 budget in Local Fiscal Recovery Fund Capital Account Numbers:

MERIDIANS's current customers include local, state and federal agencies, military installations and facilities, major police departments, commercial and industrial businesses, and a broad range of entertainment, cultural, civic, educational and sporting events. MRDG's barriers are thoroughly tested, certified, and proven. Indeed, the Archer 1200 Barrier is the only portable barrier solution to hold certifications in both the U.S. and Europe with both the U.S. Department of Defense and European PAS 68 crash test standards for deployment of unanchored barriers on hard surfaces.
The Meridian Archer 1200 is the center point barrier of the anti-terrorism vehicle mitigation and prevention solution to vehicle-ramming attacks and all other improper vehicle intrusion situations. The Archer 1200 Barrier is easily and rapidly deployed through the use of the Archer Field Tow Bar and/or Archer Hauler. The Archer 1200 barriers may be configured in varying numbers and patterns and connected with Arrestor Cables.
The absolutely best-in-industry exemplary features of the Meridian products and technology for crowd safety include:
--rapid deployment of portable barriers with unmatched stopping capabilities for all vehicles; --delivery and flexible positioning requiring no heavy equipment/cranes and by one person with no team needed;
--modular design so that one or more barriers can be placed, and then easily moved into different configurations in response to changing needs and conditions while denying terrorists the advantages of pre-attack tactical planning;
--the Archer 1200 is 100% reusable with a lifetime guarantee. The barriers can be reused immediately after any impact;
--unlike fixed bollards, the Archer 1200 barriers are non-lethal to the driver and minimize shrapnel spray.
The barriers thus preserve the opportunity for authorities to capture the instigator and protect evidence, as well as protect a driver in an accidental scenario;

--the configuration of the barriers enable ease of authorized pedestrian traffic and appropriate vehicles access. One person can deploy the barriers to block a street, roadway or pathway from vehicle access but permit unobstructed pedestrian access. One person can then separate the barriers as needed to provide access by an authorized vehicle and then immediately return the barriers to the appropriate positions to again block all unauthorized vehicles but allow pedestrians to walk though unobstructed.
--the MRDG barriers avoid the problems of fixed concrete bollards and the inefficient, dangerous, vulnerable and uninsured use of police and other vehicles as blockades;
--the MRDG solution does not require electricity to operate, or heavy equipment or hydraulics.

AACN4F022 4’ Arrestor Cable
2.0 The reflective MERIDIAN Arrestor Cables use technology from aircraft carriers to absorb the kinetic energy of a moving vehicle and pull the barriers into play for vehicle mitigation without loss of life. They are attached to barriers in 4-foot segments and can be up to three-ply across strung between two barriers. The reflective cables were designed specifically keeping safety in mind without compromising the mechanical properties of a sling rope. The arrestor cable is manufactured using only the highest grade extra improved plowed steel and vinyl coated in neon yellow that aids in visibility as well as abrasion protection and flexibility. The vinyl coating not only protects the users’ hands and makes the wire easier to handle, but it also seals in any lubrication on the wire rope, increasing it useful life. Each wire rope cable is attached to the barriers by two G-100 Swivel self-locking hooks. The self- locking hooks each have a working load limit of 5,700 pounds and are able to swivel during load, a feature which allows the barriers to roll upon impact, ensuring the safety of the work area.

Hauler 2.0
The newest and most advanced MERIDIAN® Hauler has all the hallmarks of MERIDIAN’s products’ maintenance free and one [1] person ease of use. The Hauler is a rugged barrier dolly that can traverse a variety of surfaces from asphalt to gravel to unimproved dirt roads. The Hauler features a 3,000 lb. rated jack and is manufactured using high strength and corrosion resistant aluminum T6 6061. Using aluminum has allowed us to decrease the weight of the Hauler by 35% while still providing a lifetime warranty on any component of the hauler. The new Hauler was upgraded with an aluminum core solid thread wheel that will guarantee the hauler will last as long as the life of the barrier.
The new hauler brakes are also now adjustable so as the tires slowly wear over time one can simply readjust the brakes, so they are making contact with the tires. The new upgraded leverage action is simple in that it only requires the placement of the extension rod into the barrier receiver and locking the pin in place. Once the leverage Hauler is secured, then a simple swing- action moves the barrier into position. Safety is the key so when lifting the barrier, the leverage action is fast up and slow down with the all-purpose brake being deployed.
