PROPOSED SCHEDULE
Table 1 outlines the proposed project schedule and deliverables. This schedule below includes an approximate 6 to 6.5 months (25.5 weeks) timeframe from authorization to proceed to public hearings. For purposes of this schedule, we have provided only two review cycles, but the schedule can be adjusted if the City needs an additional review cycle. 3. TERMS.
3.1 Incorporation of Recitals. The Parties agree that the Recitals constitute the factual basis upon which the City and the Applicant have entered into this Agreement. The City and the Applicant each acknowledge the accuracy of the Recitals and agree that the Recitals are incorporated into this Agreement as though fully set forth at length.
3.2 City Selection of Consultants. As a necessary and indispensable part of its fact finding process relating to the review of the Applicant's proposed Project and uses of the Property, the City shall retain the services of Consultants to provide advice as the City may deem necessary in its reasonable and sole discretion. The City has thus far retained or is prepared to retain (either directly or as subconsultants) those Consultants listed in Exhibit “D” attached hereto and incorporated herein by referenc e, but shall have the right to retain any additional consultants or sub-consultants pursuant to this Agreement. The contemplated general scope of work of the Consultants for the Project is also described in Exhibit "D" attached hereto, but the City reserves the right, in its reasonable and sole discretion, to amend the scope of work as it deems necessary and appropriate to the City's proper review and consideration of the Applicant's Project.
The Applicant agrees that, notwithstanding the Applicant's reimbursement obligations under this Agreement, Consultants shall be the contractors exclusively of the City and not of the Applicant. Except for those disclosures required by law, including, without limitation, the Public Records Act, all conversations, notes, memoranda, correspondence and other forms of communication by and between the City and its Consultants shall be, to the extent permissible by law, privileged and confidential and not subject to disclosure to the Applicant. The Applicant agrees that it shall have no claim to, nor shall it assert any right in any reports, correspondence, plans, maps, drawings, news releases or any and all other documents or work product produced by the Consultants.
3.3 Applicant to Cooperate with Consultants. The Applicant agrees to cooperate in good faith with the Consultants The Applicant agrees that it will instruct its agents, employees, consultants, contractors and attorneys to reasonably cooperate with the Consultants and to provide all necessary documents or information reasonably requested of them by the City and/or the Consultants; provided, however, that the foregoing shall not require the disclosure of any documents or information of the Applicant which b y law is privileged, proprietary, confidential, and exempt from disclosure under the Public Records Act.
3.4 Applicant's Reimbursement of Costs and Expenditures . The Applicant shall reimburse the City for one hundred percent (100%) of the actual fees, costs and other expenditures incurred by the City relative to the Consultant costs, as well as staff services associated with the Project, other out-of-pocket expenses incurred by the City ("Costs"). The City has preliminarily reviewed the scope(s) of work required and has estimated the aggregate Costs for all Consultants sixty-four thousand two hundred and sixty dollars ($64,260), ("Estimated Costs"). Within ten (10) calendar days of the execution of this Agreement, the Applicant shall submit deposit in the amount of $64,260, which amount the City shall separately account for in a Project deposit account ("Deposit Account").
3 (BB&K: 12-11)
23152.08600\7640413.1
As the Consultants invoice the City for fees, costs, and expenditures associated with the Project, staff charge their time for services associated with the Project, and City Attorney charges for legal services associated with the Project, the City may draw upon the Deposit Account to make the required payments. At any time that the Deposit Account drops below ($3,000), the City may make demand on Applicant to replenish the Deposit Account to reach the minimum Five Thousand Dollars ($5,000), or alternative minimum amount upon City entering contract(s) with environmental consultant(s) for Project, and Applicant shall submit the required amount of funds to City within ten (10) calendar days. In the event Applicant fails to make any required deposit, City shall have the right to consider Applicant's Project applications as withdrawn and cease processing such applications.
City shall not exceed the Estimated Costs without consulting with Applicant regarding the need for additional services which cause the Costs to exceed the Estimated Costs ("Excess Costs").
The City shall use reasonable good faith efforts to consult with the Applicant prior to amending any scope of services to be provided by the Consultants and incurring Excess Costs. The Applicant's obligation to reimburse the City for Excess Costs shall be contingent upon the City providing Applicant with written notice of the amendment of the scope of services to be performed by any Consultant and the estimated cost thereof prior to the commencement of work. Once the City provides such notice, Applicant shall be obligated to pay the Excess Costs in the same manner as the Estimated Costs provided above, including, but not limited to, replenishing the Deposit Account.
For purposes of this Section, the City shall be deemed to have consulted with the Applicant when the City has provided written notice to the Applicant that the City reasonably anticipates that it will incur, or has incurred, Excess Costs. If, after consultation, the Applicant disagrees with the City's incurring of Excess Costs, then the Applicant's sole and exclusive remedy will be to terminate this Agreement pursuant to Section 3.6 of this Agreement, subject to the Applicant's obligation to reimburse the City for all Costs incurred by the City prior to the date of termination, whether or not yet paid by the City to any Consultants.
The City shall maintain accurate records of invoices received from, and payments made to, the Consultants resulting from the Project, and will provide a payment summary to Applicant within a reasonable time upon request. In the event that excess funds rem ain in the Deposit Account upon conclusion of the Project and after all final payments to the Consultants have been made, the City agrees to refund that excess amount, if any, to Applicant within fifteen (15) days of final payment to the Consultants. Alte rnatively, if the Costs of the services of the Consultants exceed the Estimated Costs and Excess Costs, if any, then Applicant shall remain obligated to pay for all such Costs. Applicant shall pay any such amount within ten (10) calendar days of demand for payment by City.
3.5 Term. The term of this Agreement shall commence on the date that this Agreement is approved by the City Council and fully executed by the Parties, and shall terminate when all services required for the project by Consultants have been completed to the City's reasonable satisfaction and the Applicant has satisfied all of its obligations under this Agreement . For purposes of this section, Applicant's obligations shall include, but shall not be limited to, its obligation to reimburse the City for Estimated Costs and Excess Costs, whether or not paid by the

City to Consultants prior to the date of termination. The Applicant's obligation to reimburse the City as provided in this Agreement shall survive the natural expiration of this Agreement pursuant to this section, as well as the termination of this Agreement pursuant to Section 3.6.
3.6 Early Termination.
3.6.1 By City. The City may, in its reasonable and sole discretion, terminate this Agreement prior to the term set forth in Section 3.5 above, without cost or liability to the City, upon thirty (30) days prior written notice to the Applicant in the event that Applicant e ither: (1) fails to satisfy any obligation of this Agreement; or (2) fails to reasonably prosecute its application(s) for the Project.
3.6.2 By Applicant. The Applicant may, in its reasonable and sole discretion, terminate this Agreement prior to the end of the term set forth in Section 3. 5 above, upon thirty (30) days' prior written notice to the City; provided, however, that Applicant's right to so terminate this Agreement is expressly contingent upon Applicant satisfying both of the following: (1) Applicant shall give City written notice withdrawing its application(s) for the Project; and (2) Applicant shall satisfy all of its obligations under this Agreement up through the proposed effective date of termination. For purposes of this section, Applicant's obligations shall include, but shall not be limited to, its obligation to reimburse the City for Estimated Costs and Excess Costs, whether or not paid by the City to Consultants prior to the date of termination.
3.6.3 Notice to Consultants . Within two (2) working days following either the City's decision to terminate this Agreement or the City's receipt of written notice indicating the Applicant's decision to terminate this Agreement, the City shall notify all Consultants and instruct them to cease work on the Project. Consultants shall also be instructed to bill the City for any services completed prior to the date of termination.
3.7 Assignability. This Agreement may not be assigned by either Party without the prior and express written consent of the other Party, which consent shall not be unreasonably withheld. In determining whether to approve a request by the Applicant to assign this Agreement, the City may consider, among other things, the proposed assignee's financial status and commitment to the Project. Any attempted assignment of this Agreement not in compliance with the terms of this Agreement shall be null and void and shall confer no rights or benefits upon the assignee.
3.8 No Oral Modifications. This Agreement represents the entire understanding of the City and the Applicant and supersedes all other prior or contemporaneous written or oral agreements pertaining to the subject matter of this Agreement. This Agreement may be modified, only by a writing signed by both the authorized representatives of both the City and the Applicant.
All modifications to this Agreement must be approved by the City Council.
3.9 Binding Upon Successors. This Agreement and each of its terms shall be binding upon the City, the Applicant and their respective officers, elected officials, employees, agents, contractors, and permitted successors and assigns.

23152.08600\7640413.1
3.10 Legal Challenges. Nothing herein shall be construed to require City to defend any third party claims and suits challenging any action taken by the City with regard to any procedural or substantive aspect of the City ’s approval of development of the Property, the environmental process, or the proposed Project. The Applicant may, however, in its sole and absolute discretion appear as real party in interest in any such third party action or proceeding, and in such event, it and the City shall defend su ch action or proceeding and the Applicant shall be responsible and reimburse the City for whatever legal fees and expert or other costs, in their entirety, including actual attorneys' fees, which may be incurred by the City in defense of such action or proceeding.
This City shall have the absolute right to retain such legal counsel as the City deems necessary and appropriate and the Applicant shall reimburse the City for any and all attorneys' fees and expert or other costs incurred by the City as a result of such third party action or proceeding . Applicant may, at any time, notify City in writing of its decision to terminate such reimbursement obligation and, thereafter, the City may choose, in its sole discretion, to defend or not defend such third party action or proceeding. In the event that the City decides not to continue the defense of such third party action or proceeding, Applicant shall be obligated to reimburse City for any and all costs, fees, penalties or damages associated with dismissing the action or proceeding. In the event that the City decides to continue the defense of such third party action or proceeding, Applicant shall have no further obligation to reimburse City for its attorney fees and expert or other costs.
3.11 Attorneys' Fees. In the event that any action or proceeding, including arbitration, is commenced by either the City or the Applicant against the other to establish the validity of this Agreement or to enforce any one or more of its terms, the prevailing Party in any such action or proceeding shall be entitled to recover from the other, in addition to all other legal and equitable remedies avail able to it, its actual attorneys' fees and costs of litigation, including, without limitation, filing fees, service f ees, deposi tion costs, arbitration costs and expert witness fees, including actual costs and attorneys' fees on appeal.

The invalid term or provision may be severed from the Agreement and the remainder of the Agreement may be enforced in its entirety.

Item: 10.
Staff Report
Meeting Date: January 20, 2026
To: City Council
From: Bill Smith, City Manager
Prepared By: Anthony Vega, Chief of Police
Item Name: Funding Acceptance - County of San Bernardino - Approve Resolution to Accept Award from the County of San Bernardino and Purchase (3) Police Motorcycles, Resolution No. R-02-25.
Recommended Action:
It is recommended that the City Council:
1. Adopt Resolution # R-02-26 to accept an award from the County of San Bernardino for $83,772.00 for the purchase of three (3) police motorcycles;
2. Approve the purchase of three (3) police motorcycles in the amount of $122,196.30 from BMW Motorcycles of Riverside in accordance with CMC 3.08.140(E);
Background:
The City of Colton utilizes police motorcycles to support traffic enforcement, special events, and public safety operations. In addition, the Department is in the process of expanding its Traffic Division to better address traffic safety, enforcement, and collision reduction efforts citywide.
The current motorcycle fleet consists of units that are approximately ten (10) years old and have reached the recommended service life. This also allows for the Department to increase the number of motor officers deployed throughout the city.
The City’s need for reliable police motorcycles has been recognized by the County of San Bernardino, which awarded the City $83,772.00 to assist with the purchase of three (3) new police motorcycles. This funding covers $83,772 of the total purchase cost of $122,196.30, with the City responsible for funding the remaining $38,424.30.
Issues/Analysis:
Police motorcycles are high-use specialty vehicles that operate under demanding conditions, including prolonged idle times, high mileage, and exposure to varied environmental elements.
As motorcycles age, maintenance costs rise, parts availability becomes limited, and downtime as it relates to riding the motorcycle increases. Continued reliance on aging motorcycles creates operational risks, reduces enforcement effectiveness, and may compromise officer safety.
Replacing three motorcycles will support the expansion of the Traffic Division while ensuring continuity of the traffic enforcement and public safety operations.
The estimated total cost for three (3) new police motorcycles is $122,196.30 San Bernardino County will cover $83,772, leaving the City’s contribution at approximately $38,424.30.
We respectfully request to waive the competitive bidding process under CMC 3.08.140 – Exceptions to Competitive Bidding – Non-Public Projects. Specifically, we refer to subsection (E), which states:
"Purpose of Bidding is Otherwise Accomplished. When the City Manager determines that it is in the best interest of the City and its administrative operations to dispense with public bidding for Non-Public Projects under this chapter. Prior City Council concurrence with the City Manager's determination Shall be required for Non-Public Project purchases over one hundred thousand dollars.."
The Police Department would like to use this exception for several reasons. BMW of Riverside is approximately 10 miles from the Colton Police Department and has served the Inland Empire for more than 15 years, as it relates to police motorcycles. The Police Department has purchased police motorcycles from them in the past and, still utilizes BMW of Riverside's services for maintenance and repairs on our current motorcycle fleet. This long-standing relationship has resulted in consistent motorcycle configurations, reliable performance , and dependable service support. BMW of Riverside has demonstrated an ongoing commitment to meeting the operational needs of our department by providing specialized expertise, responsive service, and high-quality equipment.
Additionally, the dealership's proximity allows for rapid access to maintenance, warranty support, and emergency repairs. Alternative BMW dealerships are located significantly further away, with Temecula and Long Beach approximately 45 and 50 miles from the department, respectively, resulting in increased travel time, higher costs, and reduced availability of motorcycles.
The following local agencies also utilize BMW of Riverside for the purchase and servicing of their police motorcycles:
- Riverside County Sheriff's Department
- Corona Police Department
- Upland Police Department
- San Bernardino Police Department
- Fontana Police Department
- Chino Police Department
- Riverside Police Department
- Rialto Police Department.
Fiscal Impacts:
The total cost of the three (3) police motorcycles is $122,196.30, of which $83,772 was granted by the San Bernardino County Board of Supervisors, and the City’s match of $38,424.30 is currently appropriated in the adopted FY2025-26 budget in General Fund Police Department Administration Capital Outlay Account Number 100-6070-6071-4930-0000-026.
Adoption of Resolution # R-02-26 will accept the grant award from the County of San Bernardino and appropriate the funds necessary for the purchase as follows:
• Increase revenues by $83,772 in Miscellaneous Grant Fund Account # 225-5890-026 for acceptance of the County of San Bernardino’s grant award. • Appropriate $83,772 in Miscellaneous Grant Fund Capital Outlay Account # 225-6070- 7084-4930-0000-026 to expend the County award.

Staff Report
Meeting Date: January 20, 2026
To: City Council
From: Bill Smith, City Manager
Prepared By: Stacey Dabbs, Finance Director
Item Name: Investment Policy - Annual Delegation of Investment Authority and Investment Policy Review, Resolution No. R-03-26.
Recommended Action:
Staff recommends that the City Council approve and adopt Resolution R-03-26, delegating investment authority to invest and reinvest funds for the City and to sell or exchange securities.
Background:
California Government Code sections 53600 et seq. establish the statutory framework governing the investment of public funds by local agencies. Specifically, Government Code section 53646(a)(1) requires the legislative body of a local agency to review the agency’s investment policy at least annually.
The City of Colton’s Investment Policy was most recently reviewed and approved by the City Council and remains in effect. The policy establishes prudent standards for the investment of City funds, emphasizing safety of principal, liquidity, and yield, in that order, and ensures compliance with all applicable provisions of the California Government Code.
In addition, pursuant to Government Code section 53607, the City Council has delegated authority for the investment and reinvestment of City funds to the Finance Director through a separately adopted resolution. That delegation remains in effect and is not proposed to be modified as part of this annual review.
This item is a routine, annual compliance action to satisfy statutory requirements. No amendments to the Investment Policy are being proposed at this time.
Issues/Analysis:
Staff has completed its annual review of the City’s Investment Policy and finds that the policy:
• Continues to comply with California Government Code sections 53600–53609 and related statutes governing allowable investments and prudent investor standards; • Clearly defines investment objectives, authorized investments, maturity limitations, diversification standards, internal controls, safekeeping, and reporting requirements; • Remains aligned with current City cash flow needs, risk tolerance, and operational practices; and
• Provides adequate guidance for the Finance Director in administering the City’s investment program in a conservative and compliant manner.
There have been no material changes in state law requiring modification of the City’s existing Investment Policy since its most recent adoption. As such, staff does not recommend any revisions at this time. The policy will remain in effect unless and until amended by future City Council action.
Fiscal Impacts:
There is no fiscal impact associated with the recommended action.
Alternatives:
1. Provide alternative direction to staff.

Investment Policy
I. POLICY STATEMENT
It is the policy of the City to invest public funds based on compliance with state law and prudent investment practices. The primary goal of the City’s investment Policy is to invest in a manner that will provide the maximum security of the principal invested with a secondary emphasis on providing adequate liquidity and finally to achieve a rate of return within the parameters of prudent risk management while conforming to all state statutes and local regulations governing investment of public funds.
II. SCOPE
This investment policy applies to all financial assets of the City. These funds are accounted for in the City’s Annual Comprehensive Financial Report.
From time to time, the City Council may authorize the issuance of debt in accordance with State and Federal laws. Given the special requirements of such debt/repayment schedules, arbitrage rebate requirements, the City Council may choose to place the investment of these funds with the City’s fiscal agent. In such instances, the policy, objectives and investment restrictions shall be established by the City Council by separate action and investment of such funds shall be governed by the indenture of trust.
No investment will be made in any security with a remaining maturity in excess of five years (60 months) at the time of purchase or a below market rate of return, unless the City Council has granted express authority to make such investment. Interfund transfers are not covered by this policy.
III. INVESTMENT PHILOSOPHY
The City’s investment philosophy is to invest conservatively to minimize risk.
Investments shall be made in a manner consistent with the Prudent Investor Standard for trustees of local government monies, as described in Government Code Section 53600.3, which states as follows:
When investing, reinvesting, purchasing, acquiring, exchanging, selling or managing public funds, a trustee shall act with care, skill, prudence, and diligence under the circumstances then prevailing, including, but not limited to, the general economic conditions and the anticipated needs of the agency, that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity of the agency.
IV. OBJECTIVE
The authority governing investments for municipal governments is set forth in Government Code sections 53600 et seq. The primary objectives of investment activities, in order of priority, are:
a. SAFETY
Safety of principal is the foremost objective of the investment program. The investment of City funds shall be undertaken to seek to ensure the preservation of capital in the overall portfolio.
b. LIQUIDITY
The investment portfolio will remain sufficiently liquid to enable the City to meet the operating requirements that are reasonably anticipated.
c. YIELD
The City’s investment portfolio shall be designed with the objective of attaining a benchmark rate of return throughout budgetary and economic cycles, commensurate with the City’s investment risk constraints and the cash flow characteristics of the portfolio.
V. INVESTMENT AUTHORITY
The authority to manage the City’s investment program is derived from Government Code, Section 53600 et seq. The City Council has delegated the management responsibility for the investment program to the Finance Director through adoption of the Delegation of Investment Authority Resolution (R-119-24).
Only those titles specifically referenced in the Delegation of Investment Authority Resolution may engage in an investment transaction except as provided under this Investment Policy and the procedures established by the City Council.
VI. ETHICS AND CONFLICT OF INTEREST
All participants in the investment process shall act as fiduciaries of the public trust.
Those delegated authority through the Delegation of Investment Authority shall refrain from personal business activity that could conflict with proper execution of the investment program, or which could impair their ability to make impartial investment decisions. Officers and employees involved in the investment process shall disclose any material financial in financial institutions that conduct business with the City and they shall further disclose any personal financial/investment positions that could be affected by the performance of the City’s operations and functions or by the management of the City’s investment program.
VII. AUTHORIZED FINANCIAL DEALERS AND INSTITUTIONS
All broker/dealers and financial institutions authorized to provide investment services to the City of Colton must qualify under Securities & Exchange Commission Rule 15C3-1 (uniform net capital rule).
VIII. AUTHORIZED AND SUITABLE INVESTMENTS
Investment alternatives are governed by California statute and are further limited by the provisions of this Investment Policy. Schedule I outlines the investment types which are authorized and may be selected for investment given the liquidity needs and economic circumstances of the City, at the discretion of the City’s Finance Director. Investment in any other security, other than those authorized, is prohibited.
IX. REVIEW OF INVESTMENT PORTFOLIO
The securities shall be purchased in conformity with Section V, “Investment Authority” and must comply with Section VIII “Authorized and Suitable Investments” at the time of purchase. If at a later date, a security is no longer in compliance with Section VIII, the Finance Director shall report the non-compliant security to the City Council and the City Manager.
X. UNAUTHORIZED INVESTMENTS
Certain investments are prohibited by Government Code section 53601.6, including inverse floaters, range notes, mortgage-derived interest-only STRIPS and securities that result in zero interest accrual if held to maturity unless the agency holds the security to maturity (except for money market funds). Besides investments prohibited by statute, this policy disallows investment in the following due to a higher perceived risk:
a. Asset-backed securities (ABS) are supported by pools of installment loans or leases or by pools of revolving lines of credit;
b. Investment Agreements are contracts regarding funds deposited by an investor often separated into those offered by banks and those offered by insurance companies commonly known as GICs;

Staff Report
Meeting Date: January 20, 2026
To: City Council
From: Bill Smith, City Manager
Prepared By: Charles Berry, Electric Utility Director
Item Name: Purchase - Altec Industries, Inc. - Approve Purchase of Three (3) Service Trucks for the Electric Utility Department.
Recommended Action:
Approve the purchase of three (3) fully equipped Altec service body trucks for the Electric Utility Department through Sourcewell Contract No. 110421-ALT, in an amount not to exceed $360,779, which includes a contingency of up to 10% to address supply-chain cost variability and additional upfitting necessary to support electric power line construction and maintenance activities, and authorize the City Manager or designee to execute all necessary purchasing documents.
Background:
Service body trucks are mission-critical assets for the Electric Utility Department and are used daily for overhead and underground line construction, system maintenance, equipment transport, and outage response.
The vehicles proposed for replacement were placed into service in 2014 and have now exceeded their anticipated useful service life. As these vehicles have aged, they have experienced increased maintenance needs, reduced availability, and limitations in meeting current operational and safety standards. Continued reliance on these units presents increasing operational risk, higher lifecycle costs, and reduced reliability during routine work and emergency response.
Replacement of these vehicles is consistent with the City’s fleet replacement strategy, asset management planning, and the Electric Utility’s obligation to maintain a safe, reliable, and resilient electric distribution system.
Issues/Analysis:
The proposed purchase will be made using Sourcewell Contract No. 110421-ALT, which was competitively solicited at the national level and satisfies California public procurement requirements. Use of the Sourcewell contract:
• Ensures competitively established pricing.
• Reduces procurement lead time.
• Minimizes administrative burden.
• Allows flexibility to address market volatility and availability constraints.
The replacement service body trucks will be delivered as turnkey units consisting of Ford F-350 4x4 diesel chassis with integrated steel service bodies. In addition to standard service body features, final configuration may require additional upfitting to fully support electric power line construction and maintenance activities, which may include but is not limited to:
• Specialized tool and material storage modifications.
• Enhanced towing, pintle, or hitch configurations.
• Additional safety, warning, or work lighting.
• Jobsite power, auxiliary electrical, or inverter systems. • Utility-specific mounting or fabrication.
The requested contingency allows these upgrades to be completed as operational requirements are finalized and as equipment availability and pricing are confirmed. Approval of the purchase of three (3) Altec service body trucks, including a reasonable contingency allowance, represents a prudent and necessary investment in the Electric Utility Department’s fleet replacement program. Replacing vehicles that have been in service since 2014 will reduce operational risk, improve reliability, and ensure that utility crews are equipped to safely and effectively perform power line construction and maintenance work.
Fiscal Impacts:
Sufficient appropriations are available in the adopted FY2025-26 budget in Electric Utility Fund Transmission/Distribution Division Vehicle Account Number 520-8000-8004-4910-01010-000.

Staff Report
Meeting Date: January 20, 2026
To: City Council
From: Bill Smith, City Manager
Prepared By: Charles Berry, Electric Utility Director
Item Name: Purchase - Altec Industries, Inc. - Approve Purchase of Three (3) Flat Rack Trucks for the Electric Utility Department.
Recommended Action:
Adopt a Resolution authorizing the City Manager, or designee, to execute all documents necessary to purchase three (3) flatbed utility work trucks from Altec Industries, Inc. through Sourcewell Contract No. 110421-ALT, in an amount not to exceed $393,500, inclusive of a 10% contingency, to address supply-chain volatility and required upfitting necessary to support electric line construction operations.
Background:
The Electric Utility currently operates three flatbed utility work trucks, originally placed into service in model year 2001, 2016 and 2017, respectively and these vehicles, which are heavily utilized, have exceeded their expected useful life. These vehicles are specially upfitted units used to support electric utility construction and maintenance activities, including the transportation of heavy materials such as distribution transformers, electrical cable reels, conduit, poles, and related equipment.
Due to the specialized nature of these vehicles and the demanding service conditions under which they operate, these units have experienced increasing maintenance requirements, reduced reliability, and higher lifecycle costs. Continued reliance on this aging equipment presents operational inefficiencies and elevated risk during both routine field work and emergency restoration activities.
Issues/Analysis:
The requested purchase includes a not-to-exceed contingency of up to ten percent (10%) of the
base vehicle cost. This contingency is necessary due to ongoing chassis availability constraints, manufacturer price adjustments, and supply-chain volatility affecting heavy-duty utility vehicles, as well as the specialized upfitting required to purpose these units for electric utility operations.
These flatbed work trucks are not standard fleet vehicles; they are custom-configured and upfitted to safely transport heavy materials such as distribution transformers, cable reels, conduit, poles, and related equipment. Final vehicle pricing may fluctuate based on OEM chassis pricing, production-year changes, regulatory requirements, and availability of specialized components, including safety lighting, hydraulic accessories, and load-securement systems.
The contingency provides limited financial flexibility to address minor cost variances, required configuration adjustments, or manufacturer-driven price changes without necessitating additional Council action for incremental modifications. Any use of contingency funds will be strictly limited to costs directly associated with vehicle procurement, upfitting, and delivery and will not exceed the authorized not-to-exceed amount.
Fiscal Impacts:
Sufficient appropriations are available in the adopted FY2025-26 budget in Electric Utility Fund Transmission/Distribution Division Auto Equipment Account Number 520-8000-8004-4910- 0101-000.

Staff Report
Meeting Date: January 20, 2026
To: City Council
From: Bill Smith, City Manager
Prepared By: Dawn Miller, Assistant to the City Manager Item Name: Set Public Hearing - Set Public Hearing for the City Council Meeting of February 3, 2026 to Consider Submission of Community Development Block Grant Projects for Fiscal Year 2026-2027 to the County of San Bernardino.
Recommended Action:
It is recommended that the City Council set a public hearing date for February 3, 2026 for Program Year 2026 – 2027 Community Development Block Grant funds.
Background:
Since its establishment in 1974, the Community Development Block Grant (CDBG) Program has provided financial assistance to eligible jurisdictions to support a broad range of community development activities. The U.S. Department of Housing and Urban Development (HUD) allocates CDBG funds to metropolitan cities, urban counties, and states based on a statutory formula. These funds are utilized to principally benefit low- and moderate-income residents through activities such as the construction and improvement of public infrastructure (e.g., roads and parks), the repair and rehabilitation of housing within designated target areas, the provision of new or expanded public services to income-qualifying residents, and the implementation of initiatives designed to create or retain jobs. The County of San Bernardino’s Community Development and Housing Department (CDH) administers and provides oversight for CDBG projects through the Urban County Program, in which the City of Colton participates as a partner and joint recipient.
Issues/Analysis:
In the fall of 2025, staff was advised by CDH that the submittal deadline for all CDBG proposals for fiscal year 2026-2027 funds was November 14, 2025. Those proposals are to be analyzed by CDH for eligibility. Eligible project proposals serving Colton residents were forwarded back to the City on January 12, 2026, for further processing. In late January 2026, the CDBG Ad Hoc Committee will meet to finalize project recommendations to be presented to the City Council on
February 3, 2026. Final funding recommendations are due back to the County by February 12, 2026.
Staff requests Council set a public hearing date for February 3, 2026, to consider and establish their fiscal year 2026-2027 final funding recommendations. Eligible applications recommended for funding will be available for public review beginning January 20, 2026, in the City Clerk’s office at City Hall, 650 N. La Cadena Drive, in Colton.
The County of San Bernardino will then publish all projects countywide, all prioritized and approved projects from its participating cities as required by HUD, prior to adoption of the Consolidated Plan.
Fiscal Impacts:
CDBG Funded projects completed by the City are 100% reimbursable, up to the approved project limit. Funded capital improvement projects will be included in the 2026-2027 Capital Improvement Program and will be included in the City’s budget.
