RESOLUTION OF THE CITY COUNCIL APPROVING THE UPDATED TRAFFIC IMPROVEMENTS AT THE INTERSECTION OF GERHART AVENUE AND UNION PACIFIC AVENUE AND AUTHORIZING TRANSFER OF APPROVED RELATED MEASURE AA FUNDS TO FY 2018-19 ANNUAL PAVEMENT REHABILITATION PROGRAM ACCOUNT FOR INSTALLATION OF THE PROPOSED TRAFFIC IMPROVEMENTS WHEREAS, staff has completed a traffic review due to safety concerns at the intersection of Gerhart Avenue and Union Pacific Avenue; and WHEREAS, on the November 16, 2021, City Council meeting the City Council made a motion to approve the traffic improvements at the intersection of Gerhart Avenue and Union Pacific Avenue. However, an additional field survey was conducted as part of the construction planning process which identified additional traffic improvements; and, WHEREAS, based on the Traffic Study and final field observation various traffic devices are recommended to improve the overall safety of the intersection at Gerhart Avenue and Union Pacific Avenue including, but not limited to the relocation of the crosswalk to the south leg of the intersection and the reconstruction of the curb ramp on the northwest (NW) corner so that it is ADA compliant; and, WHEREAS, the estimated cost for the proposed traffic improvements at the intersection of Gerhart Avenue and Union Pacific Avenue is $62,664; and WHERAS, on July 6, 2021, funds in the amount of $50,000 for the proposed traffic improvements were approved by City Council; and, WHEREAS, on August 20, 2019, the City approved a construction contract with SHAWNAN in the amount of $3,545,666 with $390,023 in contingency for the FY 2018-19 Annual Pavement Rehabilitation Program which has a remaining contingency balance of $33,946.28; and, WHEREAS, staff is recommending that the approved Measure AA funds of $50,000 in account number 41-5170-57010.10446 be transferred to the FY 2018-19 Annual Pavement Rehabilitation Program account, number 41-5170-57010.14614 to cover the shortfall of $12,664; and, WHEREAS, the proposed improvements will be done by SHAWNAN as a Change Order to their contract.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
Section 1. City Council approves updated traffic improvements at the intersection of Gerhart Avenue and Union Pacific Avenue which includes the removal of the existing north leg crosswalk and relocating it to the south leg of the intersection.
Section 2. City Council authorizes the Director of Finance to transfer the approved $50,000 Measure AA funds to the FY 2018-19 Annual Pavement Rehabilitation Program account to cover shortfall of $12,664 for installation of traffic improvements at the intersection of Gerhart Avenue and Union Pacific Avenue to be done by SHAWNAN as a Change Order to their contract.
Section 3. Authorize the Mayor to execute the Resolution for and on behalf of the City of Commerce.
Section 4. This Resolution shall take full force and effect immediately upon adoption by the City Council.
