CITY OF COMMERCEAGENDA REPORT

CITY OF COMMERCE

AGENDA REPORT
Item No.

Item No.

TO: Honorable City Council
FROM: City Manager
SUBJECT: Award of Agreement between Geosyntec Consultants and the City of Commerce for MS4 Inspections and Training Meeting Date: January 25, 2022
RECOMMENDATION:

The City Council will consider adopting a Resolution approving an Agreement with Geosyntec Consultants for the City’s MS4 stormwater site inspections, business compliance assistance, enforcement activities, and annual employee training.

BACKGROUND/ANALYSIS:

The MS4 Permit requires the City of Commerce (City) to inspect and assess business operations and maintenance practices who qualify under the State Water Board’s critical sources criteria. Namely, business types such as auto dealers, auto repairs, parking lot businesses, gas stations, chemical/allied products, metal products, motor freight, hazardous waste facilities, and restaurants to name a few that the State considers more likely to produce harmful pollutants that may reach our waterways in the event of a spill. There are approximately 600 businesses in the City that may qualify for such an inspection.

The purpose of the inspections is to review Best Management Practices (BMPs) and employee training and document compliance with MS4 Permit requirements. The new MS4 Permit effective September 11, 2021 requires the City to conduct inspections every two years during the five-year permit cycle. Some businesses may require a follow-up visit. The City is required to document that all inspections were completed in its annual report to the Regional Water Quality Control Board.

Staff solicited proposals from consultants on the Gateway Water Management Authority’s On-call list on November 1, 2021. Two proposals were received from Geosyntec Consultants ($483,640) and CWE ($489,999). The City has worked with both firms and both are highly qualified. In reviewing the proposal details and rate sheets, staff recommends awarding an agreement to Geosyntec Consultants for a 5-year period to coincide with the 5-year stormwater permit cycle and timeframe in which the City must conduct at least two rounds of inspections and follow-up visits as needed.

FISCAL IMPACT:

There is no fiscal impact to the City’s General Fund as the costs are eligible for funding from the Safe Clean Water Program, the Countywide Stormwater Fee that generates approximately $1 million per year for the City of Commerce for designated MS4 stormwater compliance activities.
