CITY OF COMMERCE

AGENDA REPORT
TO: Honorable City Council
FROM: City Manager
SUBJECT: Resolution to Enter into an Agreement with Moore Iocofano Goltsman Inc. (MIG) for On-Going Professional Consulting Services for Management Services to Assist with the Preparation of the City’s Sixth Cycle Housing Element, as well as Implementation of a Vehicle Miles Traveled (VMT) Analysis and Environmental Review Meeting Date: April 12, 2022
RECOMMENDATION:

Adopt a Resolution authorizing Moore Iacofano Goltsman, Inc. (“MIG”) to continue with the preparation of a comprehensive update to the General Plan and Zoning Ordinance, while providing additional enhancements to allow for the preparation of a Housing Element as well as Vehicle Miles Traveled analysis (“VMT”) in compliance with State Law.

BACKGROUND:

In 2018, through Resolution 18-72, the Council awarded the preparation of a Comprehensive Update to the General Plan and Zoning Ordinance, and associated environmental documents to MIG. A three-year agreement was executed shortly thereafter. The contract was amended on April 23, 2020 to reflect additional enhancements that were not considered as part of the original April 2018 scope of work. The contract for the General Plan Update (“GPU”), Zoning Code Amendment (“ZCA”), and Environmental Impact Report (“EIR”) expired.

During the past year, staff was required to address emergent issues resulting from policy measures that have been implemented by the State. These measures include having to address housing as well as how to measure traffic patterns within a community. Staff has been diligently working with MIG to ask for their continued assistance to ensure these state-mandates will be addressed in conjunction with the General Plan. The current Resolution will provide for a new agreement in order to cover these changes, along with the completion of the General Plan.

DESCRIPTION
MIG is the City’s chosen consultant that was tasked to assist with the preparation of the City’s General Plan. Work on the General Plan is on-going, but over the last year, two emergent issues have required staff to adjust and augment the budget to cover, the State’s Housing and Community Development Department (“HCD”) requirements to obtain an expeditious approval of the City’s Sixth-Cycle Housing Element. In addition, SB743 went into effect on July of 2021 which requires local municipalities to adjust the way traffic patterns are measured. Previously, traffic was measured using a Levels of Services (“LOS”) analysis. Through LOS, traffic was measured on a grade system. Since July 2021 that is no longer the case as the State now requires the use of the Vehicle Miles Traveled (“VMT”) model, which analyzes traffic from a start-to-end point.

The General Plan, Zoning Code, Housing Element and traffic analysis as set forth in SB743 should be covered by the revised contract adjustment request within two and a half years (staff from the date of execution to allow for the extended State of California Housing and Community Development review that has been applied to the 6th Cycle Housing Elements, the reinitiated land use analysis and its possible vetting with the community.

FISCAL IMPACT:

The request to augment the budget to cover the completion of the General Plan, expediting the preparation and review of the City’s Sixth-Cycle Housing Element, as well as implementing the VMT model for traffic analyses will be up to $218,111. Of this amount, the Director of Economic Development and Planning was able to successfully secure $65,000 from the State’s HCD to cover a portion of the cost for the Housing Element. In addition, a Measure AA request for $90,000 was made and granted to help cover the cost towards the General Plan. The remaining balance of $63,111, if necessary, will be requested through the upcoming 2022/23 budgetary process.
