AGENDA REPORT

CITY OF COMMERCE

AGENDA REPORT
TO: Honorable City Council
FROM: City Manager
SUBJECT: Letter of Support for the State General Fund Request for $180 million for SB 1383 Local Assistance Grants Meeting Date: May 10, 2022
RECOMMENDATION:

The City Council will consider for adoption a Resolution authorizing staff to send a support letter signed by the Mayor to the State of California requesting a one-time $180 million budget increase for FY22-23 for SB 1383 Local Assistance Grants.

BACKGROUND:

SB 1383 establishes methane emission reduction goals to reduce the landfill disposal of organic waste 50% by 2020 and 75% by 2025 from 2014 levels; and recover at least 20% of currently disposed of surplus food by 2025. CalRecycle was given authority to adopt regulations that would achieve these organic waste reduction requirements. The regulations are comprehensive, placing various added responsibilities on local jurisdictions, including: providing organic collection services, an edible food recovery program, education and outreach to the community, procurement requirements of organic material, providing access to edible food and composting facilities, and monitoring and enforcement by the local jurisdictions.

This year, local governments, including the City of Commerce, have started to implement many of the requirements, which Cal Recycle has estimated will cost $20 to $40 billion over the next decade, including the addition of 50 to 100 new organic waste recycling facilities. In FY 2021-22, the League of Cal Cities (Cal Cities) and a coalition of advocates successfully secured $60 million state budget allocation for local assistance grants to implement SB 1383. However, Cal Recycle received 470 applications for this funding, which is insufficient to support local government projects seeking resources to develop a new comprehensive collection plan.

Cal Cities is requesting a letter of support to be sent to our state legislator supporting a one-time $180 million state general fund budget request increase for the FY22-23 to support local assistance for organics waste and recycling development and implementation. The Governor and Legislature will begin discussing budget issues in the next two months with a final adoption on June 15th.

In light of the added State mandate requirements and burdens placed on local government, staff recommends approval of the Resolution authorizing staff to send the requested support letter.

ALTERNATIVES:

1. Approve as to form as outlined by staff herein.

2. Provide alternative direction.

3. Not approve the motion to approve the grant agreement.

FISCAL IMPACT:

Preparation of the Support Letter can be carried out with no fiscal impact on the City of Commerce.
