RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, REQUESTING THAT THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES RENDER SPECIFIED SERVICES RELATING TO A SPECIAL MUNICIPAL ELECTION OF THE CITY OF COMMERCE TO BE HELD ON TUESDAY, MARCH 7, 2023 WHEREAS, the City Council of the City of Commerce, California, has called a Special Municipal Election to be held on Tuesday, March 7, 2023, for the submission to the qualified voters of the City one (1) measure amending Commerce Municipal Code, Title 5 “Business regulations”, Chapter 5.48 “Card Clubs” relating to a City Ordinance No. ___; and WHEREAS, in the course of conduct of the election it is necessary for the City to request services of the County of Los Angeles; and WHEREAS, in the course of conduct of said election, it is necessary that the City request services of the County, with all necessary expenses incurred in performing those services to be reimbursed by the City of Commerce.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the requirements of Section 10002 of the Elections Code of the State of California, this City Council requests the Board of Supervisors of the County to permit the County Elections Department to prepare and furnish the following for the use in the conduct ing the election:
A listing of county precincts with number of registered voters in each, so city may consolidate election precincts into city voting precincts, and maps of the voting precincts; A list of polling places (vote centers) and poll workers the county uses for their elections; The voter record of the names and address of all eligible registered voters in the City in order that the City’s consultant may:
a. Produce labels for vote-by-mail voters and do the mailing; b. Produce labels for voter information guides and do the mailing; c. Print Rosters of Voters and Street Indexes;
d. Voter signature verification services;
4. Furnish equipment and assistance as needed according to state law for election day, counts and other related matters.
SECTION 2. That the County Elections Department is authorized to canvass the returns of the Special Municipal Election and to certify the same to the City Council of the City of Commerce at the time and in the manner provided by law. Pursuant to Elections Code 10418 the election shall be regulated and performed in accordance with the provisions of law regulating the special election.
SECTION 3. That the City shall reimburse the County for services performed when the work is completed and upon presentation to the City of a properly approved bill.
SECTION 4. That the City Clerk is hereby authorized and directed to file a certified copy of this Resolution with the Board of Supervisors and the County Elections Department of the County of Los Angeles.
SECTION 5. Notice of the election is hereby given. Additionally, the City Clerk is authorized, instructed and directed to procure and furnish any and all official notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election.
SECTION 6. That this Resolution shall take effect immediately upon its adoption.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
