WHEREAS, the project is Categorically Exempt pursuant to section 15301 Class 1 of CEQA. Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. This exemption applies to projects involving existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities. Here, the project is Categorically Exempt pursuant to section 15301 Class 1 of CEQA due to modification to existing pavement marking and striping within existing streets.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:

Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.

Section 2. Award a construction contract to J&S Striping Company, Inc., the lowest responsible bidder, for the Mixmaster Striping and Pavement Marking Improvements Project, in the amount of $192,607.06 and authorize the Mayor to execute the contract in a form approved by City Attorney.

Section 3. Authorize construction contingencies in the amount of $28,891.06 (15%) for unforeseen conditions.

Section 4. Authorize Transtech Engineers, Inc. to proceed with Construction Management and Inspection Services, in the amount of $22,149.81 (10% of total construction cost and contingencies), pursuant to their existing On-Call Professional Service Agreement.

Section 5. Approve an additional $500,000 appropriation from Measure AA to cover the cost of Phase I and II improvements as recommended by the Measure AA Advisory Committee on January 17, 2023.

Section 6. All procedures of the California Environmental Quality Act (“CEQA”), California Public Resources Code §21000 et seq., and the CEQA guidelines, title 14 of the California Code of Regulations, chapter 3, §15000 et seq. have been satisfied and the City Council has found that the proposed Project is Categorically Exempt from California Environmental Quality Act (CEQA) requirements under provisions of CEQA Guidelines Section 15301 – Existing Facilities. This exemption applies to projects characterized as alterations to existing facilities meeting the conditions described in Section 15301. This exemption applies to projects involving existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities.

Pursuant to CEQA, the City Council finds and determines there is no substantial evidence that the Project could have a significant effect on the environment. The City Council in its independent judgment finds that there is no possible significant effect directly related to the Project because the Project consists modifications to existing pavement markings and striping within existing streets where there is negligible or no expansion of the use. The City Council finds that the Project will not cause any physical change in the environment, that the Project is categorically exempt from CEQA under Administrative Code, Title 14, Chapter 3, § 15301, Class 1, Existing Facilities, and therefore no further action is required under CEQA.

Section 7. Authorize the Mayor to execute the Resolution for and on behalf of the City of Commerce.

Section 8. This Resolution shall take full force and effect immediately upon adoption by the City Council.

PASSED, APPROVED and ADOPTED this 24th day of January 2023.
