TO: Honorable City Council
FROM: City Manager
SUBJECT: Rejection of Bids for the Class II Bicycle Facility Improvements on Eastern Avenue, Commerce Way, and Harbor Street MEETING DATE: February 21, 2023
RECOMMENDATION:

It is recommended that the City Council reject all bids received for the Class II Bicycle Facility Improvements on Eastern Avenue, Commerce Way, and Harbor Street and authorize staff to re-advertise the project as part of the 2022-2023 Annual Pavement Rehabilitation Project.

BACKGROUND:

On December 1, 2020, City Council received and accepted $3.2 million in Sustainable Transportation Equity Project (STEP) Grant from California Air Resources Board (CARB). On May 11, 2021, City Council authorized execution of the STEP Grant Agreement with CARB. The grant provides for the following:

Class II bike lanes to connect residents to several key destinations; 400 plantings of shade trees near pedestrian, bike, and transit corridors (facilitated by Tree People); Two zero-emission fixed route buses and two zero-emission Dial-A-Ride shuttles to kick-start the City's commitment to a zero-emission fleet; and The Transit-Oriented Development (TOD) and Displacement Avoidance Plan to prepare for the build out of LA Metro's future Citadel rail station.

The STEP grant includes $274,032.00 for the design and construction of Class II Bicycle Lanes with a required resource contribution (local match) of $43,312.50. The proposed project will involve Class II dedicated bicycle lanes along Commerce Way, Eastern Avenue south of Sheila Street to Commerce Way, and Harbor Street, procurement and installation of 12-16 associated detection cameras at the signalized intersections within the project area.

ANALYSIS:

The Project was advertised for bids on November 30, 2022, with a bid due date of December 21, 2022. However, no bids were received, and the project was re-advertised for bids on December 21, 2022. The following three (3) bids were received by the City at the Bid Opening held on January 24, 2023, at 2:00pm:

Bidder
Base Bid Amount
Additive Bid Amount

TOTAL BID AMOUNT
J & S STRIPING CO, INC.
$374,966.45
$47,252.60
$422,219.05
Superior Pavement Markings, Inc.
$409,509.70
$50,000.00
$459,509.70
PTM General Engineering Services, Inc.
$576,076.00
$80,000.00
$656,076.00
The bids received are much higher than the Engineer’s estimate of $280,000 and more importantly much higher than the $251,196.00 STEP Grant and $34,875.00 allocated City’s share for the construction phase. Considering high bids, cost of construction management and inspection services as well as contingencies, to obtain favorable bids staff recommends including this project in the 2022/2023 Annual Pavement Rehabilitation Project scheduled to be advertised within the next two months. It is staff’s opinion that since the Pavement Rehabilitation Project includes striping and pavement marking components, the City is expected to receive favorable bids.

Pursuant to section 3.16.100 of the City Municipal Code, the City Council may reject any and all bids presented and re-advertise for bids or to exclude any item from the award of bid or waive any informality on a bid. Therefore, staff is recommending that City Council reject the bids and authorize staff to re-advertise the project as part of the 2022-2023 Annual Pavement Rehabilitation Project ALTERNATIVES:

Approve staff recommendation
Disapprove staff recommendation
Provide further direction to staff
FISCAL IMPACT:

Bid rejections have no impact to the City’s General Fund.

RELATIONSHIP TO STRATEGIC GOALS:

The issue before the Council is applicable to the following Council’s strategic goal: “Improve and maintain infrastructure and beautify our community” as identified in the 2012 Strategic Plan.
