NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.
Section 2. Approve Plans and Specifications for the Basketball/Volleyball Courts Resurfacing at Various City Parks Project.
Section 3. Award a construction contract to Trueline Construction & Surfacing, Inc., the lowest responsible bidder, for the Basketball/Volleyball Courts Resurfacing at Various City Parks Project, in the amount of $243,686.40 and authorize the Mayor to execute the contract in a form approved by City Attorney.

Section 6. Approve a supplemental appropriation of $104,608 from Measure AA funds to cover the total project cost as recommended by the Measure AA Advisory Committee on January 17, 2023.
Section 7. All procedures of the California Environmental Quality Act (“CEQA”), California Public Resources Code §21000 et seq., and the CEQA guidelines, title 14 of the California Code of Regulations, chapter 3, §15000 et seq. have been satisfied and the City Council has found that the proposed Project is Categorically Exempt from California Environmental Quality Act (CEQA) requirements under provisions of CEQA Guidelines Section 15301 – Existing Facilities. This exemption applies to projects characterized as repairs to existing facilities meeting the conditions described in Section 15301.
Pursuant to CEQA, the City Council finds and determines there is no substantial evidence that the Project could have a significant effect on the environment. The City Council in its independent judgment finds that there is no possible significant effect directly related to the Project because the Project consists of the repair and resurfacing of existing public facilities; basketball and volleyball courts where there is negligible or no expansion of the use. The City Council finds that the Project will not cause any physical change in the environment, that the Project is categorically exempt from CEQA under Administrative Code, Title 14, Chapter 3, § 15301, Class 1, Existing Facilities, and therefore no further action is required under CEQA.
Section 8. Authorize the Mayor to execute the Resolution for and on behalf of the City of Commerce.
Section 9. This Resolution shall take full force and effect immediately upon adoption by the City Council.
PASSED, APPROVED and ADOPTED this 21st day of February 2023.
