SUBJECT: Approval of Joint Agency Agreement for Bridge Maintenance at Telegraph Road over Rio Hondo River Meeting Date: April 11, 2023
RECOMMENDATION:
Staff recommends City Council consider adopting a Resolution approving a Joint Agency Agreement for Bridge Maintenance at Telegraph Road over Rio Hondo River Channel between the Cities of Commerce, Downey and Pico Rivera.
BACKGROUND AND ANALYSIS:
Telegraph Road is a 4-lane wide bridge with asphalt concrete pavement deck cover that spans across Rio Hondo River. This bridge is jurisdictionally shared between the Cities of Commerce, Downey, and Pico Rivera. Although the Los Angeles County Department of Public Works, through service requests by one or more affected cities, has provided maintenance services to the bridge on behalf of said cities on an as needed basis, there is no written agreed upon procedure for initiating bridge maintenance and/or repairs.
The proposed Bridge Maintenance Agreement between the cities of Commerce, Downey and Pico Rivera establishes among other provisions roles and responsibilities of each city for any types of maintenance including but not limited to preventive maintenance, repair for damages, and improvements recommended by Los Angeles County bridge inspectors and /or a third party as part of Los Angeles County’s biannual bridge inspection program which is financed by California Transportation and administered by County of Los Angeles. Additionally, the proposed agreement establishes each jurisdiction’s cost sharing responsibility based on the percentage of bridge deck area located within each respective jurisdiction as established by Los Angeles County in their bi-annual inspection report as follows: City of Commerce (23%), City of Downey (27%) and City of Pico Rivera (50%).

According to the proposed Agreement, the City of Pico Rivera will serve as the lead agency and be solely responsible for completing necessary repairs per applicable Federal and State standards as well as the affected city’s specifications and/or contractors and initiate and complete the necessary repairs through LA County and/or a Licensed Contractor through communication and coordination with Downey and Commerce within a reasonable timeframe. Furthermore, the City of Pico Rivera will cover the cost of the repairs and invoice Downey and Commerce for its share of the cost. Upon notification, the City of Pico Rivera will initiate the repair work within sixty (60) calendar days and notify Downey and Commerce accordingly. In case of an emergency where motoring public are impacted and the bridge must be fully open to vehicular traffic, the City of Pico Rivera will notify Downey and Commerce and immediately initiate the repairs, pay for repairs without obtaining other cities concurrence and invoice the other two cities for their cost share. Should Pico Rivera fail to proceed with the repairs within 5 working days, the City of Downey who has the second highest ownership of the bridge will assume the lead agency role and initiate the repairs.
Staff recommends that City Council adopt the attached Resolution approving the a joint Agency Agreement for Bridge Maintenance at Telegraph Road over Rio Hondo River between Cities of Commerce, Downey and Pico Rivera.
