TO: Honorable City Council
FROM: City Manager
SUBJECT: First Amendment to the Commercial Refuse and Recycling Hauler Semi-exclusive Agreement Meeting Date: May 30, 2023
RECOMMENDATION:
The City Council will consider adopting a Resolution approving a First Amendment with commercial refuse and recycling haulers operating under a semi-exclusive agreement with the City of Commerce to extend the term to October 31, 2025.
BACKGROUND:
On November 1, 2018, the City Council authorized semi-exclusive Agreements for a period of five (5) years and are due to expire on October 31, 2023. The Agreements allow for an extension of the original term by two additional two-year terms. Listed below are the current commercial haulers under an agreement and the number of commercial customers they service in the City of Commerce.
Athens/Calmet* (307)
AAA Rubbish (204)
Waste Management (172)
Haul Away Rubbish (162)
NASA Services (96)
Republic Services (90)
Universal Waste Systems (45)
*On January 11, 2022, City Council authorized the assignment of Calmet’s Agreement to Athens Services.
Refuse haulers continue to work with the City by predominantly reporting their recycling tonnages to the City on a monthly basis as well as remaining current with payment of their 15% gross receipts hauler fees. Service continues uninterrupted and without complaint.
On February 21, 2023, the City Council received a waste hauler update report in which Council was provided with three options for consideration as follows:
Option #1 – Extend term of all current semi-exclusive agreements or Option #2 – Release a new RFP and reduce the number of waste haulers with a semi-exclusive agreement effective November 1, 2023 or Option #3 – Enter into an exclusive franchise agreement with one waste hauler Council approved Option #1 and directed staff to prepare an amendment for each of the seven commercial haulers. Staff therefore recommends City Council adopt a Resolution approving a First Amendment to the Agreement with each of the commercial refuse and recycling haulers.
