Here, the project is Categorically Exempt pursuant to section 15301 Class 1 of CEQA because the project consists of the installation of new signs within existing public right of ways where there will be negligible or no expansion of the existing use.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:

Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.

Section 2. A construction contract to Square Signs LLC DBA Front Signs, as the lowest responsive and responsible bidder, for the Citywide Wayfinding Vehicular Directional Signs Project in the amount of $139,680.26 is hereby awarded and the Mayor is authorized to execute the contract in a form approved by City Attorney.

Section 3. Construction contingencies of up to $27,936.05 (20% of construction contract) for unforeseen conditions is hereby authorized.

Section 4. Authorize Construction Management and Inspection Services for up to $16,761.63 (10% of the total Construction Contract and Contingencies).

Section 5. Authorize Transtech Engineers, Inc. to proceed with Construction Management and Inspection pursuant to their existing on-call agreement for consultant services.

Section 6. Allocate $184,377.94 in Measure AA funds to cover the total project cost.

Section 7. All procedures of the California Environmental Quality Act (“CEQA”), California Public Resources Code §21000 et seq., and the CEQA guidelines, title 14 of the California Code of Regulations, chapter 3, §15000 et seq. have been satisfied and the City Council has found that the proposed project is Categorically Exempt from California Environmental Quality Act (CEQA) requirements under provisions of CEQA Guidelines Section 15301 – Existing Facilities. This exemption applies to projects characterized as alterations to existing facilities meeting the conditions described in Section 15301.

Pursuant to CEQA, the City Council finds and determines there is no substantial evidence that the project could have a significant effect on the environment. The City Council in its independent judgment finds that there is no possible significant effect directly related to the project because the Project consists of 1 because the Project consists of the installation of new signs within existing public right of ways where there will be negligible or no expansion of the existing use. The City Council finds that the project will not cause any physical change in the environment, that the project is categorically exempt from CEQA under Administrative Code, Title 14, Chapter 3, § 15301, Class 1, Existing Facilities, and therefore no further action is required under CEQA. Pursuant to said findings, the City Council directs staff to prepare and file corresponding Notice of Exemption.

Section 8. Authorize the Mayor to execute this Resolution for and on behalf of the City of Commerce.

Section 9. This Resolution shall take full force and effect immediately upon adoption by the City Council.
