SUBJECT: Award Construction Contract to Green Giant Landscape, Inc. for the Civic Center Landscape Renovation and Demonstration Garden Project Meeting Date: June 27, 2023
RECOMMENDATION
The City Council will consider adopting a Resolution to:
Approve the Plans and Specifications for the Civic Center Landscape Renovation and Demonstration Garden Project; and Award a Construction Contract to Green Giant Landscape, Inc. for the Civic Center Landscape Renovation and Demonstration Garden Project in the amount of $428,381.95; and Authorize Construction Management and Inspection Services by Transtech Engineers, Inc. and Lost West pursuant to their On-Call Professional Consulting Services Agreements; and Authorize up to 15% of the construction contract for construction contingency for unforeseen conditions; and Authorize up to 10% of the total construction contract and contingencies for Construction Management and Inspection Services; and Make a finding and determination that the Civic Center Landscape Renovation and Demonstration Garden Project is exempt from further CEQA review pursuant to Administrative Code, Title 14, Chapter 3, Section 15301, Class 1, categorical exemption (Existing Facilities). The project results in minor alterations to existing public facilities involving no significant expansion of the existing use. The project is not anticipated to have any significant impacts with regard to traffic, noise, air quality or water quality. There are adequate utilities and public services to serve the project and pursuant to said findings, direct staff to prepare and file corresponding Notice of Exemption because the Project consists of maintenance of existing landscaping; and Allocate $105,381.96 in Measure W Safe Clean Water Program Funds.
BACKGROUND
On September 13, 2022, the City Council approved a Turf Replacement at Parks Program as part of the Fiscal Year 22/23 Capital Improvement Program (CIP) to further reduce the City’s water usage and maintenance at its parks. City Council approved $400,000 in Measure AA funds for this program. On February 21, 2023, the City Council approved the City’s participation in the Central Basin Municipal Water District’s Member Agency Disadvantage Communities Project for a water-conserving demonstration garden and allocated $50,000 in Measure AA funds based on reimbursement to cover the cost of the award amount.
As part of the Turf Replacement at Parks Program and Central Basin Municipal Water District’s Member Agency Disadvantage Communities Project, the City worked with Lost West to design the grassy areas around the Civic Center including the areas surrounding the Senior Center and the areas on both sides of the Central Library entrance for a demonstration drought tolerant educational garden with walking pathways and signage.

As required by the California Public Contract Code, staff specified in the Bid Specifications that the award of contract will be to the lowest responsive and responsible bidder as determined solely by the City. As shown in the above bid tabulation, Green Giant Landscape, Inc. submitted the lowest base bid, which is based on the Total Base Bid Schedule “A” Amount plus the Total Base Bid Schedule “B” Amount. Staff conducted a bid analysis for the Green Giant Landscape, Inc., and verified their California contractor’s licensing, Department of Industrial Relations (DIR) registration, state and federal debarment files, and references. Based on the bid analysis, Green Giant Landscape, Inc. was found to be the lowest responsive and responsible bidder. The bid analysis completed by staff is attached for reference.
On May 22, 2023, the City received a letter from the second lowest bidder, Kormex Construction, Inc., (“Kormex”) requesting to withdraw their bid due to a clerical error made on their unit prices of two bid items. However, the withdrawal request was submitted after all bid amounts from all bidders were made public. Considering that there was no discrepancy found in the unit price versus the total cost for the two bid items specified by Kormex, their request will be denied.
The project will be funded by Measure AA funds, Central Basin’s Grant, and the City’s share of LA County Measure W Safe Clean Water Program Funds which provides local, dedicated funding to increase water supply, improve water quality, and provide community enhancements throughout LA County related to stormwater requirements.
Staff recommends that City Council adopt the attached Resolution which in summary does the following:
