CITY OF COMMERCE

AGENDA REPORT
TO: Honorable City Council
FROM: City Manager
SUBJECT: Eastern Avenue Transit Hub Project Acceptance
MEETING DATE: June 27, 2023
RECOMMENDATION:

The City Council will consider adoption of a Resolution accepting the Eastern Avenue Transit Hub Project as complete, authorizing staff to file the Notice of Completion with the County Recorder’s Office and authorizing release of 5% retention per contract provisions.

BACKGROUND:

On January 12, 2021, the City Council approved the Commerce in Motion Comprehensive Operational Analysis (COA) service plan recommendations. The COA recommendations address the community's unmet transportation needs, such as more frequent service, expanded weekend service, and route extensions. The result is a more efficient, reliable, and expanded transportation network that will improve transportation services throughout the City of Commerce and surrounding communities. One of the COA recommendations was designing and building a transit hub.

On April 20, 2021, the City Council approved the concept design on Eastern Avenue and Harbor Street. The transit hub's key elements focus on lowering on-bus travel times and reduce the need for buses to pass through the seven-pronged intersection where Atlantic Boulevard crosses the Santa Ana Freeway referred to as the "Mixmaster.” The Mixmaster intersection has long cycle times and can also be congested adding to on-bus travel times.

On June 1, 2021, the City Council approved the plans and specifications for the Eastern Avenue Transit Hub Project and authorized staff to advertise the project for bids. The public bid opening occurred on July 20, 2021 and CEM Construction Corporation (“CEM”) was determined to be the lowest responsible bidder. On August 17, 2021, City Council awarded the construction contract to CEM for $701,550.00 and authorized a 16.5% contingency in the amount of $127,331.33 for construction contingencies and Construction Management and Inspection services of which $115,755.75 is for construction contingency for a total construction budget of $817,305.75.

On July 13, 2022, the City Council approved $396,638 in Measure AA Funds to be transferred to the Eastern Avenue Transit Hub Project account for Street Lighting Improvements on Eastern Avenue from Steven’s Steakhouse to Jillson Street, which included $344,902.88 as a Change Order to CEM’s contract and $51,735.12 for contingencies and inspections. Additional Change Orders in the amount of $134,132.17 were also approved throughout the project. This brought the total construction budget to $1,213,943.75.

ANALYSIS
The work under the contract has been completed satisfactorily and project is ready for acceptance.

The work included but not limited to the installation of bus shelters, information Kiosk and Display System, installation of electrical service lines and service cabinet from Southern California Edison feed point to Information Kiosk with display, relocation of existing electronic speed reader/display sign to new location, installation of concrete bus pad and cold mill existing pavement, asphalt pavement removal and construction, restoration of traffic signal loops, replacement of existing curb and gutter with new curb and gutter, installation of ADA curb ramps, installation of traffic markings, striping, arrow markings, and traffic legends, restoration of traffic loop detectors, furnishing and installation of prefabricated restroom facility, furnishing and installation of water and sewer lateral connections to prefabricated restroom facility.

Therefore, staff recommends that the City Council adopt the attached resolution accepting the Project as complete, authorizing staff to file the “Notice of Completion” with the County Recorder’s Office for the project and authorizing release of Contractor’s 5% retention per contract provisions.

Staff understands that further adjustments may be approved by the City Council at a later date however the project should be accepted as it was completed according to the scope approved by City Council.

FISCAL IMPACT:

The total cost of the construction work including contract change orders completed by CEM is $1,138,390.17 which was covered from the $1,213,943.75 approved construction budget consisting of $817,305.75 in approved reimbursable Federal Grant Funds (5307 Funds) and $396,638.00 in approved Measure AA funds.
