TO: Honorable City Council
FROM: City Manager
SUBJECT: Harbor Toxics Total Maximum Daily Load (TMDL) Stormwater Compliance Agreement Meeting Date: August 22, 2023
RECOMMENDATION:

Staff recommends the City Council approve a Resolution authorizing an Agreement between the Gateway Water Management Authority (GWMA) and the City of Commerce for cost sharing of maintaining water quality monitoring equipment and for monitoring services in compliance with the Harbor Toxics Total Maximum Daily Load (TMDL) for stormwater compliance.

ANALYSIS:

As a member of the GWMA, the City of Commerce (City) is able to participate in joint ventures with other member agencies regulated under the MS4 Permit for stormwater and non-stormwater discharges for administration and cost sharing. On June 5, 2018, the City executed a five (5) year Agreement to participate in a joint cost-saving collaboration as a good faith effort to comply with the Harbor Toxics TMDL for pollutants affecting water quality. This effort includes maintenance of monitoring stations in various regulated rivers that the member agencies discharge into including one station in the Los Angeles River at Wardlow Road in the City of Long Beach. Since the City discharges storm water into a portion of the Los Angeles River, the City will benefit from this joint cost-sharing arrangement.

On July 26, 2023, GWMA requested the City enter into a new Agreement for a period of three (3) years. The current Agreement expired on June 30, 2023. The new Agreement term will expire on June 30, 2026.

FISCAL IMPACT:

Commerce’s share is based on a 50% equal share and 50% by area in addition to a 5% administrative GWMA member fee to administer the Agreement. Non-members pay a 5-10% administrative fee. The City’s cost is $768.93 ($732.31 + 5% administration fee) for Fiscal Year 2023/24. There is sufficient funding in the Safe Clean Water Program Account number 34-9100-52001 for this MS4 Permit implementation activity.

RELATIONSHIP TO STRATEGIC GOALS:

This item is related to the 2016 Strategic Goal Guiding Principle 5:
to create and pursue opportunities for collaboration and regional partnerships to maximize resources and address regional issues.
