SUBJECT: Commerce Way Pavement Construction Project Acceptance MEETING DATE: August 22, 2023
RECOMMENDATION:
The City Council will consider adoption of a Resolution accepting the Commerce Way Pavement Construction Project as complete, authorizing Staff to file the Notice of Completion with the County Recorder’s Office and authorizing release of 5% retention per contract provisions.
BACKGROUND:
On April 26, 2022, the City Council approved the plans and specifications for the Commerce Way Pavement Construction Project (Project) from Sheila Street to Washington Boulevard, and authorized staff to proceed with the bid solicitation.
On July 15, 2022, staff advertised the bid package for the Project. On September 27, 2022, City Council awarded the construction contract to Toro Enterprises, Inc. for $784,540.00 and furthermore authorized a 15% contingency in the amount of $117,681.00 for a total construction budget of $902,221.00.
ANALYSIS
The work under the contract has been completed satisfactorily in staff’s view and the project is ready for acceptance.
The project work included but was not limited to the construction of a new raised landscaped median, trees and uplighting, street lighting, sidewalk, street pavement, electrical receptacles for holiday lighting and reconstruction of the Commerce Way and Sheila Street intersection to a more conventional four-way stop to allow for better traffic flow and increased safety for pedestrians and vehicles.
Therefore, staff recommends that the City Council adopt the attached resolution accepting the Project as complete, authorizing staff to file the “Notice of Completion” with the County Recorder’s Office for the project and authorize release of Contractor’s 5% retention per contract provisions.
FISCAL IMPACT:
The total cost of the construction work including contract change orders completed by Toro Enterprises, Inc. is $823,244.17 of which $490,000.00 was covered through Federal Funds and the remaining $333,244.17 funded through the approved Measure AA budget.
