Importance:

Dear Andy Singh,
This email is to inform you of your application process with the Commerce Commercial Cannabis Permit Program has been inactive for over three years. Pursuant to Commerce Municipal Code Section 5.61.090(3), the City reserves the right to reject an incomplete application. Additionally, in accordance with Section 5.61.290, the City Manager authorized the establishment of an additional policy effective October 10, 2022, requiring that persons or entities without an active application for over one year submit a complete Development Agreement application within 30 days of the effective date of the administrative policy.

Attached is an official letter from the City requesting your immediate attention to submit a complete Development Agreement to the City's CCP staff by March 08.2023, 30 days from the date of this notice. Furthermore, to avoid rejection of your application you must commit to a business location and provide the City sufficient evidence of the legal right to occupy and use the proposed location to operate a commercial cannabis business.

If you have any questions, please contact our CCP staff via email at [email protected].

Sincerely,
CCP Staff

Dear RS Innovations,
In October 2018 the City Council adopted Ordinance No. 700, establishing Commercial Cannabis regulations for the City. At that time the Commerce Commercial Cannabis Permit Program (CCP) initiated an open application period where your application for RS Innovations was reviewed and deemed appropriate to move forward in the process.

It has been nearly four years since the application process began, and your application has been at a standstill for over three years with no good-faith effort on your part to move forward. As you know, the City has been very accommodating and has exercised significant patience as you determine what course you plan to take with your commercial cannabis business. While the City understands unforeseen circumstances like the pandemic adversely affected many businesses, considerable time has also been provided to allow you to keep moving forward in the process, as most applicants have done.

Failure to do so may subject the applicant to immediate disqualification. As such, please be informed of the City's intent to reject your application if you are unable to comply with the abovementioned policy by March 08, 2023, 30 days from the date of this notice.

In order to avoid rejection of your application, you must commit to a business location and provide the City sufficient evidence of the legal right to occupy and use the proposed location to operate a commercial cannabis business. Once you commit to a business location, please submit a complete Commercial Cannabis Development Agreement Application to the City's CCP staff for review. If CCP staff deems your application appropriate to move forward in the process, your project will be considered by the City's Planning Commission and City Council.

As mentioned, failure to submit a complete Development Agreement Application (with a business location) by no later than that will result in the commencement of rejection proceedings.

If you have any questions, please contact our CCP staff via email at [email protected].

Sincerely,
CCP Staff
