CITY OF COMMERCE AGENDA REPORT
TO: Honorable City Council
FROM: Acting City Manager
SUBJECT: Consideration of Purchase and Installation of Outdoor Fitness Equipment at Rosewood Park through Sourcewell Cooperative Agreement with BCI Burke Company Meeting Date: March 12, 2024
RECOMMENDATION:

Staff recommends that City Council consider:

Adopting a Resolution approving Outdoor Fitness Equipment at Rosewood Park Project, awarding a contract for purchase and installation of Burke Outdoor Fitness Equipment at Rosewood Park to Innovative Playgrounds Company through Sourcewell Cooperative Contract No 010521-BUR with BCI Burke Company; and exempting the project from the bidding process in compliance with City Municipal Code Section 3-16.030.

BACKGROUND AND ANALYSIS:

In January 2024, staff received a cost proposal for the project from Innovative Playgrounds Company for procurement and installation of Burke outdoor fitness equipment at Rosewood Park for $180,924.05. The work on this project includes the demolition of existing fitness areas, excavation and grading of the grass area, construction of the 1600 square feet of concrete slab for fitness equipment, procurement, and installation of Burke fitness equipment for 13 plus age group with instructional signage, two 6 feet PVC traditional benches with backs, PVC litter container and 48x30 feet high style canopy.

The procurement and installation of Burke outdoor fitness equipment at Rosewood Park will be awarded through a competitive bid contract (Master Contract #010521-BUR) by Sourcewell (formerly the National Joint Powers Alliance). Sourcewell is a public agency service cooperative that serves over 50,000 members. Through national solicitations, they provide the opportunity for members to purchase through nationally leveraged, competitive bid contracts. Innovative Play Equipment is a sole source provider of playground and fitness equipment of BCI Burke Company, for the counties of San Bernardino, Los Angeles, Orange, Riverside, San Diego and Imperial in the State of California. They are also authorized to offer installation products and services for this playground equipment (see attached copy). BCI Burke was awarded a Cooperative Contract No 010521-BUR by Sourcewell on February 15, 2021(Copy attached).

State law allows for the use of cooperative contracts as an alternative to a competitive bidding process, provided the applicable requirements in Chapter 5 Joint Exercise of Powers are satisfied. Sourcewell is a State of Minnesota local government agency and service cooperative created under the laws of the State of Minnesota (Minnesota Statutes Section 123A.21) that offers cooperative procurement solutions to government entities. Participation is open to federal, state/province, and municipal governmental entities, higher education, K-12 education, nonprofit, tribal government, and other public entities located in the United States. Sourcewell issued a public solicitation for Playground and Water Play Equipment with Related Accessories and Services from which Burke was awarded a contract in Feb 2021 (copy is attached). Agencies including City of La Puente, Azusa, Ontario, Fontana, Garden Grove and Laguna Beach recently followed a similar process and awarded a contract to Innovative Playgrounds Company through Cooperative Contract No 010521-BUR with BCI Burke Company. The City of Commerce is a member of Sourcewell. Exception to the bidding process is authorized per the City’s Municipal Code Section 3-16.030 subject to City Council authorization.

The project is exempt from the requirement of CEQA pursuant to Section 15301 (Class 1) and 15303 (Class 3).

Staff is recommending that City Council adopt the attached Resolution approving Outdoor Fitness Equipment at Rosewood Park Project, awarding a contract for purchase and installation of Burke Outdoor Fitness Equipment at Rosewood Park to Innovative Playgrounds Company through Sourcewell Cooperative Contract No 010521-BUR with BCI Burke Company; and exempting the project from bidding process in compliance with City Municipal Code Section 3-16.030.
