RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, APPROVING AN AGREEMENT WITH ST. NICK’S CHRISTMAS LIGHTING & DÉCOR COMPANY FOR THE HOLIDAY DÉCOR PROGRAM WHEREAS, the City’s Holiday Décor Program has been provided by St. Nick’s Christmas Lighting & Décor Company (St. Nick’s) since July 18, 2017; and WHEREAS, the City Council approved a First Amendment to the Agreement on April 7, 2020 and a Second Amendment on November 16, 2021, which is due to expire on July 18, 2024; and WHEREAS, St. Nick’s has provided good customer service and was very flexible during the CoVID pandemic with reducing costs and programming as requested; and WHEREAS, the City Council restored its Holiday Décor Program last year and directed staff to release a Request for Proposals (RFP) for leasing of décor, installation, removal, and minor refurbishment and storage throughout the year which was released on June 28, 2023 and the City received six proposals; and WHEREAS, staff met with the City Council Holiday Décor Sub-Committee members to review each proposal, receive feedback on prior holiday programs and suggestions for the new program and after careful review of each proposal for their ability to meet the City’s expectations, experience, quality of décor, themes offered, customer service, and flexibility with modifications to the program, the Sub-committee selected St. Nick’s theme #2 with gold, green and blue décor colors and requested some modifications for the new Holiday Décor Program as shown in their revised proposal; and WHEREAS, the City Council Holiday Décor Sub-Committee Recommendation is to award an agreement to St. Nick’s for an initial three-year term with the option to extend the term by two years and approve their modified proposal.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.
Section 2. Approve an Agreement with St. Nick’s Christmas Lighting & Décor Company for the City‘s Holiday Décor Program services for an initial three-year term with the option to extend the term by mutual written consent of the Parties for two years. The cost for the services shall not exceed $188,400 per year.
Section 3. Authorize the Mayor to execute this Resolution and the Agreement.
Section 4. This Resolution shall take full force and effect immediately upon adoption by the City Council.
