AGENDA REPORT

CITY OF COMMERCE

AGENDA REPORT
TO: Honorable City Council
FROM: Acting City Manager
SUBJECT: National Purchasing Cooperative Interlocal Agreement Meeting Date: March 26, 2024

RECOMMENDATION
The City Council will consider Adopting a Resolution authorizing the execution of the BuyBoard National Purchasing Cooperative Interlocal Agreement.

BACKGROUND:

California law allows for the use of cooperative contracts as an alternative to a competitive bidding process provided the applicable requirements in Chapter 5 Joint Exercise of Powers are satisfied. Exception to competitive bidding is allowed if competitive bidding has already been conducted by another public agency including, but not limited to, another local agency, the State through the California Multiple Award Schedule (CMAS), the Federal government through the General Services Administration (GSA), the U.S. Communities Government Purchasing Alliance, or the Western States Contracting Alliance (WSCA).

The BuyBoard National Purchasing Cooperative is a public agency created in accordance with Maryland state statues, MD. Code Ann., State Fin. & Proc. §13-110 (West 2009). Its purpose is to obtain the benefits and efficiencies that can accrue to members of a cooperative, to comply with state bidding requirements, and to identify qualified vendors of commodities, goods and services. See attached Buy Board Fact Sheet.

DISCUSSION:

In order for the City of Commerce to join the BuyBoard National Purchasing Cooperative, the proposed Agreement is required to be executed. There is no cost to join or use any of the contracts and is open to all types of local government agencies as well as non-profits. Revenue to operate the BuyBoard comes from a small service fee payable by participating contracted vendors and is generated only when a member makes a purchase. Several local agencies including but not limited the cities of Downey, Maywood, Lakewood, Lynwood, Bell Gardens, Cerritos, Whittier, Culver City, and Cypress are current members of the BuyBoard National Purchasing Cooperative, see attached for complete list of Public Agencies.

Staff recommends City Council adopt a Resolution authorizing the execution of the BuyBoard National Purchasing Cooperative Interlocal Agreement.

FISCAL IMPACT
There is no cost to join the BuyBoard National Purchasing Cooperative.
