A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA APPROVING THE SECOND AMENDMENT TO THE AGREEMENT WITH GSI ENVIRONMENTAL INCORPORATED FOR ENVIRONMENTAL ASSESSMENT AND REMEDIATION SERVICES WHEREAS, the City Council awarded GSI Environmental Inc. an Agreement effective June 1, 2018 for on-call services for environmental site assessment, remediation, remedial construction, and regulatory and community interaction; and WHEREAS, the City Council also authorized GSI Environmental to conduct an environmental assessment and remediation of the former Specific Plating Site located at 1350 South Eastern Avenue under Department of Toxic Substances Control (DTSC) oversight and a Voluntary Cleanup Agreement between DTSC and the Successor Agency; and WHEREAS, GSI Environmental’s original scope of work was completed at the end of calendar year 2021, DTSC has since required additional work related to determining groundwater impacts and potential groundwater remediation; and WHEREAS, the project’s work is funded by the California Department of Finance as the Successor Agency to former Commerce Redevelopment Agency and the City bares no fiscal impact; and WHEREAS, Council approved the First Amendment to the Agreement, as allowed per Section 7.2 of the Agreement, with GSI Environmental to extend the term by three (3) years until June 1, 2024 to continue with the Assessment and Remediation Project; and WHEREAS, staff recommends Council approve the Second Amendment to the Agreement with GSI Environmental to extend the term by three (3) years until June 1, 2027 to complete the former Specific Plating Assessment and Remediation Project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
SECTION 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.
SECTION 2. The Second Amendment to the Agreement by and between GSI Environmental Inc. and the City of Commerce is hereby approved.
SECTION 3. The Mayor is hereby authorized to sign the Second Amendment and this Resolution for and on behalf of the City.
SECTION 4. This Resolution shall take full force and effect immediately upon adoption by the City Council.
