CITY OF COMMERCE
AGENDA REPORT
TO: Honorable City Council
FROM: Acting City Manager
SUBJECT: Resolution of the City Council of the City of Commerce Approving a First Amendment to the Agreement with Moore Iacofano Goltsman Inc. (MIG) for On-Going Professional Consulting Services Meeting Date: April 23, 2024
RECOMMENDATION:
Adopt a Resolution authorizing a First Amendment to the Agreement with Moore Iacofano Goltsman, Inc. (“MIG”) to continue with the on-going professional consulting services, while authorizing an increase to their contract in the amount of $35,200, to assist with preparing the appropriate environmental analysis associated with the City’s Sixth-Cycle Housing Element.
BACKGROUND:
In 2018, through Resolution 18-72, the Council awarded the preparation of a Comprehensive Update to the General Plan and Zoning Ordinance and related environmental documents to MIG. A three-year agreement was executed shortly thereafter. The contract was amended on April 23, 2020 to reflect additional enhancements that were not considered as part of the original April 2018 scope of work. The contract for the General Plan Update (“GPU”), Zoning Code Amendment (“ZCA”), and Environmental Impact Report (“EIR”) expired.
In April 2022, an agreement was approved authorizing MIG to continue with the preparation of a comprehensive update to the General Plan and Zoning Ordinance, while providing additional enhancements to allow for the preparation of a Housing Element as well as Vehicle Miles Traveled analysis (“VMT”) in compliance with State Law.
ANALYSIS:
Since 1969, California has required that all local governments (cities and counties) adequately plan to meet the housing needs of everyone in the community. California’s local governments meet this requirement by adopting housing plans as part of their “general plan” (also required by the state). General plans serve as the local government’s "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing.
California’s housing-element law acknowledges that, in order for the private market to adequately address the housing needs and demand of Californians, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests largely on the effective implementation of local general plans and, in particular, local housing elements.
Over the past several years, the City has been working closely with MIG to complete the City’s General Plan as well as the Sixth-Cycle Housing Element. As part of the Housing Element process, it was determined that an environmental analysis would be appropriate to support the Housing Element for State’s Housing and Community Development Department (“HCD”) approval and the City’s upcoming adoption of the document. As such, staff authorized MIG to prepare and complete an environmental analysis, allowing the City to obtain a more expeditious approval from HCD.
A First Amendment to MIG’s agreement is being proposed to increase the budget of the existing contract in the amount of $35,200, to reflect the additional environmental analysis that was not considered as part of the original scope of services.
ALTERNATIVES:
Approve staff recommendation
Disapprove staff recommendation
Provide further direction to staff
FISCAL IMPACT:
The amendment request to augment MIG’s budget to prepare and complete the environmental analysis associated with the City’s Sixth-Cycle Housing Element will be up to $35,200. If the City Council approves the aforementioned recommendation, staff will facilitate an appropriation in the amount of $35,200 from the City’s Measure AA Fund.
RELATIONSHIP TO STRATEGIC GOALS:
The City of Commerce Strategic Action Plan, Economic Growth Guiding Principle No. 3, encourages and supports a long-range planning vision through the City’s General Plan, zoning ordinance, and related land use planning documents that incorporate community and stakeholder input and provides a compass for strategic economic growth, infrastructure investments and city. Additional time to allow for a thoughtful Housing Element Update is in line with this guiding principle.
