A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, APPROVING THE CITY OF COMMERCE’S 2024 ENGINEERING AND TRAFFIC SURVEY (SPEED SURVEY) FOR SEVEN (7) STREET SEGMENTS WHEREAS, pursuant to the California Vehicle Code Section, the City completed an Engineering and Traffic Survey (ETS) for seven 7 street segments citywide attached herein as Attachment A; and WHEREAS, the purpose of the ETS is to establish updated speed limits that can be legally enforced using radar at pre-determined locations; and WHEREAS, the adoption of the City of Commerce’s 2024 ETS attached herein as (Attachment A) will allow the posted speed limit to be upheld by the courts and does not constitute a "Speed Trap" as defined by CVC Section 40802; and WHEREAS, state and local agencies should conduct ETS at least once every 5, 7, or 14 years, in compliance with the California Vehicle Code (CVC Section 40802) to reevaluate non-statutory speed limits on segments of their roadways.

WHEREAS, ETS can be an enforceable document for a maximum of 14 years as long as there have not been any significant changes in the roadway; and WHEREAS, approval of the City’s ETS is required to establish citywide speed limits to be upheld by the courts; and WHEREAS, the recommended speed limits are consistent with the prevailing behavior as demonstrated by the radar speed measurements; and WHEREAS, based on the results of the ETS, the speed limit for 6 segments is recommended to remain unchanged. However, speed limit for Ferguson Dr from Gerhart Ave to East City Limit is recommended to be lowered by 5 Mile per hour(mph) from 30 mph to 25 mph due to existing conditions, land use and collision rates; and WHEREAS, the recommendation contained in the ETS were intended to establish prima facie speed limits.
