TO: Honorable City Council
FROM: City Manager
SUBJECT: A Resolution of the City Council of the City of Commerce, California, Approving the Equal Employment Opportunity Program Pursuant to Title VII of the Civil Rights Act of 1964 and the Federal Transit Administration’s Circular 4704.1A MEETING DATE: December 10, 2024
RECOMMENDATION:

The City Council will consider approving the Equal Employment Opportunity Program Pursuant to Title VII of the Civil Rights Act of 1964 and the Federal Transit Administration’s Circular 4704.1A BACKGROUND:

The City of Commerce Transit (CCT) has established the Equal Employment Opportunity Program pursuant to Title VII of the Civil Rights Act of 1964, Title 49, Chapter 53, Section 5332 of the United States Code, and the Federal Transit Administration’s Circular 4704.1A “Equal Employment Opportunity (EEO) Requirements and Guidelines for Federal Transit Administration (FTA) Recipients.” ANALYSIS:

CCT is required to issue a signed and dated policy statement that demonstrates its commitment to the Equal Employment Opportunity (EEO) Program. This statement should clearly outline the program's objectives and define the responsibilities for its implementation. As a recipient of federal funds, CCT must submit an updated EEO plan to the Federal Transit Administration (FTA) for review and approval every four years. This document details the City of Commerce's policies and procedures to ensure that CCT complies with various federal statutes and regulations prohibiting employment discrimination.

As an FTA recipient employing 50-99 transit-related employees, CCT must prepare and maintain an abbreviated EEO Program as provided in the FTA Circular 4704.1a. The abbreviated EEO Program must include the following elements:

Policy Statement
Dissemination Plan
Designation of Personnel Responsibility
Assessment of Employment Practices
Monitoring and Reporting Plan
Required City Policy Attachments
ALTERNATIVES:

Approve staff recommendation
Reject staff recommendation
Provide staff with further direction
FISCAL IMPACT:

This EEO Program will not impact the City’s operating budget. However, it is required for all transit agencies that receive federal funding.

RELATIONSHIP TO 2016 STRATEGIC GOALS:

This agenda item pertains to the strategic planning goal of "reviewing and updating services and activities to enhance efficiency." The recommendation outlined in this report is necessary for the City of Commerce Transit to remain eligible for federal funding.
