TO: Honorable City Council
FROM: City Manager
SUBJECT: A Resolution Approving Second Amendment to the Agreement with Data Ticket, Inc.

MEETING DATE: February 25, 2025
RECOMMENDATION:

That the City Council approve a Resolution approving the Second Amendment to the Agreement with Data Ticket, Inc., to incorporate provisions specific to security and permissible uses.

BACKGROUND:

The City has maintained an agreement with Data Ticket, Inc. since September 25, 2017 to process parking citations. This includes the handheld citation machines, processing citations, taking payment, and processing appeals. This agreement was for a five-year period and is renewed automatically for one-year periods. The streamlined process of using Data Ticket, Inc. for citation processing has reduced administrative staff time.

At the June 25, 2024 Council meeting, staff presented the first amendment request – to provide the additional services associated with processing administrative citations issued by the City. As stated, these citations are non-criminal and outlined as an enforcement remedy in Commerce Municipal Code Chapter 1.13 – Administrative Fines and Citations. Violations that may receive administrative citations include code enforcement, animal control, street takeover spectators, and fireworks. Data Ticket Inc., will process the citations, collect payment, coordinate appeals, and hold hearings.
