RESOLUTION NO. 25-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COMMERCE, CALIFORNIA, ACCEPTING THE BRENDA VILLA AQUATIC CENTER MOVING SECTIONAL GLASS WINDOWS AND HEAVY-DUTY FANS INSTALLATION PROJECT (DESIGN-BUILD) AS COMPLETE, AUTHORIZING STAFF TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER’S OFFICE, AND AUTHORIZING RELEASE OF 5% RETENTION PER CONTRACT PROVISIONS WHEREAS, the Brenda Villa Aquatic Center Moving Sectional Glass Windows and Heavy-Duty Fans Installation Project (Design-Build), “Project”, commenced on February 22, 2024, and was completed satisfactorily in July 2025, and project is ready for acceptance; and WHEREAS, the total cost of the construction work completed by CABD Construction Inc. including two approved change orders, is $1,051,497.04 of which was covered from approved Measure AA funds.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COMMERCE DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution.
Section 2. The City Council accepts the Brenda Villa Aquatic Center Moving Sectional Glass Windows and Heavy-Duty Fans Installation Project (Design-Build) performed by CABD Construction Inc. as complete.
Section 3. Staff is authorized to file the “Notice of Completion” with the County Recorder’s Office for this project and furthermore authorized to release the 5% contract retention per contract provisions. The $125k in unspent appropriations will return to Measure AA’s fund balance.
Section 4. The Mayor is hereby authorized to execute this Resolution for and on behalf of the City of Commerce.
Section 5. The City Clerk shall certify to the adoption of this Resolution.
Section 6. This Resolution shall take full force and effect immediately upon adoption by the City Council.
