RESOLUTION APPROVING A LEASE AGREEMENT RELATED TO PROPERTY LOCATED AT 2313 SOUTH ATLANTIC BOULEVARD (APN: 5244-024-001), BETWEEN THE CITY OF COMMERCE AND AWP PROPERTIES LLC. FOR PARKING STALLS FOR PATRONS OF THE BANDINI LIBRARY WHEREAS, the City of Commerce is requesting to temporarily lease 10 (ten) parking stalls on the privately-owned parking lot located on 2313 S. Atlantic Boulevard, Commerce, CA 90040, identified as A.P.N. 5244-024-001 for patrons of the Bandini Library; and WHEREAS, the City is proposing to occupy the ten (10) parking stalls on a month-to-month basis for parking purposes; and WHEREAS, the lease agreement is set to commence upon completion of the flood repair work, and continue temporarily on a month-to-month basis. The City will pay $3,600.00 monthly, subject to cancellation by either party at any time; and WHEREAS, the fee will be paid on or before the first business day of each and every month of the lease term; NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE, DECLARE AND DETERMINE AS FOLLOWS:
Section 1. The City Council of the City of Commerce hereby finds and declares that the foregoing recitals are true and correct and incorporates them herein as findings and as a substantive part of this Resolution.
Section 2. Approve the lease agreement, in a form approved by the City Attorney, and any exhibits incorporated therein, for the leasing of portions of the properties located at A.P.N. 5244-024-001 on 2313 S. Atlantic Boulevard, Commerce, CA 90040, as designated in Exhibit A, between AWP Properties LLC and the City of Commerce, for the amount of $3,600.00 for a month-to-month lease starting upon the date of execution of the lease agreement.
Section 3. Authorize the Mayor to sign the lease agreement and this Resolution for and on behalf of the City of Commerce.
Section 4. The City Clerk shall certify to the adoption of this Resolution.
Section 5. This Resolution shall take full force and effect immediately upon adoption by the City Council.
